October 11, 1971
A regGl.ar meeting of the C,�lden Va11ey Planning Commission was held at 7:30 P.M.
on Monday, Qetober 11, 1971 at the Civic Center, 7$00 Golden Valley Road,
Golden Valley, Minnesota.
Chairman Lundsgaard presided and the follo�ring members were present: Vice
Chair�an Franzen, Cammissioners Anderson, Christiansen, Fdstrom, Moran, Sampson,
and Van Horn. Al.sfl present was Consultant Otto 5chtnid and Recording 5ecretary

carra.ed �nanimously� to approve the minutes of the September 27, 1971 meeting
as amended.
The Chairman, Warren Lundsgaard, introduced newly-appointed C.ommissioner
John Sampson to the Planning Commission.
2. REZOAtINGs Torah Aeademy (ALnanac Realty Co�pany)
lt40� Golden Valley Road
(Institutional I-1 to Business and Professional Offices)
This application requests s change in rezoning from Institutional (I-1) to
Business and Professional Offices the parcel located North of Golden Valley
Road and West of Mary Hills �frive.
The applicant, Mr. Robert Alm of Almanac Realty Company, explained the reasons
why he is requesting the rezoning of this parcel of grc�und. The Planning
Commission in discussing this parcel. noted the land is surrounded on three
sides by single family residential dwellings.
Mr. Otto Schmid, Village Consultant, reviewed with the Commission his rgport
which is as follows:
"This property has been for sale for sometime. There exists a problem in any
area when religious orientated properties decide tc� mov e. The problem is
obvivusly that the seller is faced with a minimum of potential bt�yers. This
problem is compounded by the fact that religious orientated facilities are
generally located in residential aress.
In 1q63 the (�.urch of the Latter �3ay Sanints, original occupiers of the
property, decided �o move. An attampt was made at that time to rezone to
Business and Professional Offices. The requsst was denied by both Planning
Commi.ssion and Council. The Planning Coramission reasoned that: 1.) this
would constitute spot zoning, 2.) Business and Pr€�fessianal Offices �aould allow
other uses than this specific elinic use proposed� and 3.) approval of the
request would set a precedent in similar situations.

The property, although located along a busy thnrflughfare, is in a residential
neighborhood. We concur with the 1963 Planning Commission report even though
it might be pointed out that Glenwood Hills Hospital and the Clinic of Neurology
and Phsycolo�y are located across the street. In addition, the MiSCCA treatment
center is under construction. However, the Villa�e in the past has noted that
these related medical uses should be limited to the south side of Golden Valley Rd.
A rezoning is �aore or less a chatige in the land use plan for future development.
To spot zone a commercially related use in this area would seemingly indieate that
the Village is in favor of such action along all major thoroughfares. This is
hardly the case.
The sketch plan indicates that this particular parcel be earmarked for Instittitional
related uses such as church, d�y sehool, nursery, nursing home, and the like."
After further diseussion, it was raoved by Christiansen� seconded by Van Horn�
carried unanimously, to recommend denial of this requested rezoning for Business
and Professiona7. Offices, noting the Con�ultant�s report.

Discussion on Planned Unit 1�evelopment Notice Requirements
Warren Lunds�aard read to the Planning Coinmission a letter from the Golden Val.ley
Chamber of Commeree with respect to the present 250-foot requirement ( in the
Planned Unit Development Ordinance) for certified mail. Mr. George Brambilla
was present representing the C�amber of Co�erce and informed the Commission they
would like to see written notices mailed out within 1,000 feet for a Planned Unit
Development notification rather than the present 2$4-foot requirement.
The Planning Commission informed Mr. Brambilla that presently State law requires
' that certified mail be mailed within 250 feet for a Planned Unit Development� but
beyond this the Planning Department mails wri�ten notices farther than the 250 feet.
Also, a legal notice of said planned unit development is published in the news-
paper. The Planning Commission is presently in the process of reviewing the
Zoni.ng Code; and when the Planned Unit �ev�elopment Ordinanee is reviewed, the
particular section that deals with notification will be studied carefully.
It was moved by Franzen, seconded by Van Horn, carried, to consider the request
by the Chamber of Commerce in further detail at the time the Planning Commission
revie�ws the Planned Unit Development Ordinance.
!�. A1&IINISTRATIVE
(a) Memorandum from Mi.dwest Planning and ftesearch, Inc. on extension
of contract completion
The Planning Commi.ssion reviewed the memorandum from Midwest Planning and Research,
Inc. (distributed at the September 27, 1971 meeting) for an extension of the contract
on the comprehensive pl$nr►ing program� because of several factors, to March of 1972
wi.th no additional expense to the Village of Gc�lden Valley.

It was moved by Edstrom,, seconded by Franzen, carried unanimously, to recammend
an extension of the comprehensive planning program to March of 1972.
(b) General
1. Tndependent School District No. 275 (RE: Dietrich Company PUD #!t)
The Chairman of the Planning Commission read a letter from Dona3.d E. Wiese,
Chairman of the School Board District of Independent School District No. 275
with respect to a special mesting held by the School Board on September 1.lt, 1971
about testimonies from a group of residents who are concerned about traffic
problems believed to be imminent if a major structure (office building) receives
final approval from the Planning Commission and Village Council. The letter
al.so contained a resolution in reference to said office building.
2. Planning CommiSSion Meeting Date Change - October 25 to October 26
It was moved by F'ranzen� seconded by Moran, carried unanimously� to meet on
Tuesday, October 26, 1971 because of the 25th of the raonth being Veterans �ay.
3. Transit Meeting - League of Women Voters
Commissioner Mary Anderson reminded th� Planning Commi.ssion of a transit meeting
sponsored by Golden Valley and St. Louis Park Leagues of Women Voters to be held
at Prudential on November 10, 1971 at 7:00 P.M.
There being no further business to come before the meeting, it was on motion,
duly seconded, adjourned at 9:00 P.�I.
