09-23-74 PC Minutes i�: MINUTES OF THE GOLDEN VALIEY PLANNING COMMISSION September 23, 1974 A regular meeting of the Golden Valley Planning Cornmission was held at 7:30 P.M. on Nbnday, September 23, 1974 at the Civic Center, 7800 Golden Valley Road, Golden �altey, Minnesota. Chairman Ron Edstrom presided and the fotlowing members were present: Comnissioners Christiansen, Hakala, Nerje, Hughes, Lundsgaard, and Sehtin, Also present were Carl Dale, Planner, and Jon Westiake, staff inember. Members absent: Commissioner Leonard. i . APPROVAL OF MINUTES: MOVED by Christiansen, seconded by Sehlin, carried unanimously, to approve the minutes of the August 26, 197�+ Planning Comnission meeting as maited. 2. WAIVER OF THE PLATTING ORDINANCE (a) Richard C. Ernst (McOonald's Corporation) Commercial 9315 Medicine Lake Road The request is to divide a parcel of land into two parcets—the larger of which wautd be 2�'7 feet by 197•6 feet (54,5b9 square feet). The smatler parcei is pie shaped with a depth of 194 feet by 197 feet (33,600 square feet). The larger parcel which fronts on Medicine Lake Road is the site on which McDonatd Corporation is planning ta construct a restaurant. McDonald's site plan indicates taro aceesses onto Medicine Lake Road and one access onto Millsboro Avenue, with 76 on site parking spaces. The City is requesti�g an easement or dedication of seven feet for sidewalk along Medicine Lake Road. Also, the City Attorney feels this use may not need a Special Use Permit. The Planning Comnission then asked the staff questions about the waiver as requested and the parking of the McDonald� s Restaurant on Winnetka Avenue, which has 67 on site parking spaces and 37 spaces on the overflow tot. Mr. Richard C. Ernst, property owner, was present and indicated that the site that McOonaid' s is interested in meets the requirements of the Zoning Code. The remaining parcel is for sate and it could be used for such uses as a professionat office, pet clinic, or a small retail sales building. Richard Engstrom and Chuck Ad�ns were also present for McOonald's Corporation. Mr. Engstrom stated that this restaurant would act as a relief for the existing Mdlonald's Restaurant on Winnetka Avenue. Also, he reviewed the landscape plan and parking plan. The Planning Cortmission in discussing the request corr�ared the traffic problem at the present McDonald' s Restaurant and related it to the new site. The Comnission discussed the two entrances on Medicine lake Road and expressed concern about the �unt of traffic that would be generated at the new site— including the proposed lot to the South, although the use is not known at this time. The Planning Commission was also concerned about tMe smailer size of the remaining parcel and its large frontage on the curve of Hillsboro Avenue. The Planning Commission in denying the request noted that this part of the City has been under intense d�velopment pressure during the tast year. Projects have been approved in this area which will increase traffic. If aliowed the waiver woutd increase the intensity of the land use. The Planning Commission then further detaiied their concerr�s as follows: 1 . Deny the request because of the rapid pace at which this area of the City is developing-which wi11 lead to a congested area. 2. Too many driveways to the site with short distances between. 3. Because of the Corm�ercial zoning, this should be one parcel of land. By dividing the parcel it will aTlow rrare congestion. 4. No need for a fast food restaurant in this area which wautd add ta the traffic, litter, and noise. (b) P. B. Olson (Residential ) 3700 Galden ValTey Road The request is to divide a parcel and add to another parcel of tand to make twoo lots. These two lots would be land locked and tocated in the southern ec�d of a very large parcel of ground. Mr. Olson was the mriginal owner of this large parcel and has since sold the majority of the land to Skyline Buitders, Inc. Also, south of these two lots is a lot with a home on it. The staff feels that a waiver of the Platting Ordinance will not resolve any problems but oniy add to th�n by adding a lot. Because of all the problems involved in this request it was moved by Herje, seconded by Sehlin to defer action on this request to the October 28, 197� Planning Commission meeting aTtowing the staff to contact Skyline Builders, Inc. regarding a preliminary ptat for the area, and if Skyline Buiiders, Inc. aad Mr. Olson are unable to c«ne up with a plan, the staff should develop one. (According to Mr. Dale, the staff can design a plan and use the official map to make it a permanent record.) 3. GENERAL (a) Guide for Institutional Uses in Ptanned Unit Development Carl Dale reviewed the foltowing guidetines to be applied when the Planning Commission is considering a planned unit development with respect to institutional uses: "INSTITUTIONAL GUI�ELINES 1 . Definitions. "Institutional Uses". These shalt include the following - Church, religious institutuin, club or lodge (non-profit), specialized housing (for students, mentaily itl , infirm, elderly, physicatly or mentally retarded, and similar �� Planning Commission September 23� 1974 page 3 group housing), medical uses (those uses involving the diagnosis, treatment, and care of human beings including hospitals, dental services, medical services or clinic, nursing or convalescent home, orphans home, rest home, sanitarium, chemical dependency center, and similar uses), day nursery, veterinary clinic, schoots (public and private providing instruction to three or more students on the premises at any given time), philanthropic or eleemosynary organization, fraternity, sorority, welfare, or similar use. 2. Standards and Criteria Guidelines (4) Institutional Uses and Area Standards. The purpose of this s.ection is to establish standards and guidelines for the granting of a PUD Permit to erect institutional use project in relation to an overall design and an integrated physical plan, and in accordance with the provisions and procedures provided for in this Ordinance. The owner or owners of any tract of land may submit a plan for the developrr�nt and use of such tract by making an application for a PUD Permit authorizing corrq�letion of the devetopment in accordance with the following guidelines: (a) The tract of land for which such a development is proposed and permit requested shall contain not less than taro acres of land in a single tot or be corr�osed of two or more platted lots. (b) The tract of tand for whieh such a developm�nt is proposed and a permit requested shall not have less than one hundred fifty (150) feet of frontage on a public street as measured at the required buitding setback line. (c) 7he proposed development shall be served by the pubtic water and sewer system, and fire hydrants shall be installed according to a plan approved by the Fire Chief as to type and location. (d) No principat building sha11 be nearer than its height to the rear or side property line when such line abwts on a residential area. (e) Private roadways within the project shalT have an improved surface and width and shail be so designated and constructed as to permit fire trucks to provide proper protection to each building. (f) The number of dwelling units, bed units, or other special living quarte�s may be flexible but not greater than that which would be detrimental to the pablic heaith, safety, and generai welfare. (g) Provisions for solid waste storage and disposal shall be provided according to a plan approved t�y the Gity Council . (h) Landscaping shall be provided according to a design ptan approved by the City Council and shall include a detailed ptanting list with -sizes indicated. (i) The surface drainage system shall be constructed according to a plan approved by the City Engineer. (j) The entire site shalT be utilized for some approved purpose. (k) The off—street parking spaces shall be painted on the surfaced area accordi�g to a plan which has received approval of the City �Council . (1) Provisions shall be designed for off—street loading to service the use and such space shaTi have easy access and not be designated for any other use." Comnissioner Christiansen then withdrew his motion. It was then moved by Herje, seconded by Hughes to defer action on the guide— lines allowing the Planning Commission to farther review the guidelines for Institutionat uses and atso ask the City Attorney if he would see a�y problems regarding the guidelines. The Planning Corrmission wiil continue discussion on this matter at the October 28, 197� Planning Cc�rtimissior� meeting. (b) Meeting Date Change Because of the Columbas Day Holiday on October 12, 1974 there wiil be no regularly schedwled Ptanning Cortmission meeting on that date. (c) King� s Valley P.U.D. #13) The Ptanning Commission had questions regarding the consumer summary sheet on perma lease and the purchase of laad with respect to the King�s Valley development. It was moved by Herje, seconded by Hakala, carried unanimously, to send a letter to Centurion Company asking if they would consider sending a representative of their organization to answer questions the Planning Comnission has regarding the aforesaid and also if an individuat has to be in a certain income bracket to purchase the lower priced units.
