11-24-75 PC Minutes � � �� MINUTES OF TNE GOLDEN VALLEY PLANNING COMMISSI0�1 November 24, 1975 A regular meeting of the Golden Valley Planning Commission was held at 7:30 P.M. an Monday, November 24, 1975 at the Civic Center, 7$00 Golden Valley Road, Golden Valley, Minnesota. Chairman Ron Edstrom presided and the following members were present: Commissioners Christiansen, Herje, Hughes, Sehlin, and Specktor. Also present was Jon Westlake, staff inember. Members absent; Commissioner Lundsgaard. 1 . F1.400 PLAIN (a) Proponent: Nick M. Loscheider Request Variance — 1315 Louisiana Avenue North Request Fill Permit — 1345 Louisiana Avenue North � 1316 Marytand Avenue The Ftood Plain Envelope for this area of the City is 877' and the first floor elevation of a structure is required by the Flood Plain Ordinance to be at least one foot higher — which would be a minimum of 878' . If you will recall from the last Planning Corrmission meeting, the propon�nt has applied for an elevation variance regarding the proposed structure at 1315 louisiana from the Board of Zoning Appeats. The Board heard the request� after the last Ptanning Cc>mmission meeting and deferred action on the request to their December rr�eting. In reviewing the request further there was a total of five lots. Lots 1 and 2 Block 1 , Prospect Neights Second Addition were cleared by the Bassetts Creek Flood Control Comnission in a letter dated October 29a 1975 which indicated the two lots are above the 877' elevation of the Management Envetope. Therefore, the Planning Cornmission is now dealing with three lots — two of which should follow the fill pracedure of the Ordinance (1325 louisiana and 131b Maryland). This can be done because the difference in curb grade elevation and the finished structure elevation is not that significant. If the Planning Carmission agrees with this, a letter should be sent to the Bassetts Creek Flood Control Commission for a permit to fill these lots in the area of the structure to remove that portion of the lot from the Flood Plain. The Bassefits Creek Flood Control Commission in reviewing the request will review such items as the fill in relation to the flood storage area and whether equat storage areas should be provided. Because of the elevation of the curb in relation to the Flood Plain and the requirement that the structure be one foot higher than the Flood Plain, the proposed structure at 1315 Louisiana would be difficult to build. In order $ _ �i,� Planning Commission November 24, 1975 page 2 to meet the etevation of 878' the structure would�approximately five feet higher than the curb and also due to fill , it v�uld affect the property to the North and South of the site; therefore, the proponent is asking the Board of Zoning Appeals for consideration of a variance regarding the elevation. Prior to the proponent appearing before the Board of Zoning Appeals a requirement is that the Ptanning Commission along with other agencies consider the proposal for input if any to the Board of Zoning Appeals. The Planning Commission in reviewing the request referred to several sections of the Flood Plain Ordinance and discussed at length such items as: Where can equal areas of storage be provided: What effect will these lots , if filled or built on, have in the immediate area or up or down stre�n: Where is the balance point of how much construction or fil ] should be allowed in the Flood Plain? The Planning Comnission then talked about the procedures as to this particutar request as well as other requests the Commission may have in the future and a previous request regarding a fill permit. The Commission also discussed the different agencies that would be involved depending upon the type of request and where the jurisdiction of the agency lies. It was moved by Herje, seconded by Sehlin that the Planning Commission has no recomnendatiorr to the Board of Zoning Appeals regarding Lot 1 Block 1 Peterson' s Valley View Addition. Upon vote being taken by roll call the following voted in favor of the motion: Sehlin and Herje; and the following voted against the same: Christiansen, Specktor, and Hughes. The motion did not carry. It was then moved by Christiansen, seconded by Hughes to recommend to the Board of Zoning Appeals that the praponent be allowed to fill the lot to an elevation of 875' on �ot 1 Btock 1 Peterson' s Valley View Addition with the stipulation that the developer submit to the City Engineering Department for approval a ' grading plan using the 875� elevation with proper distribution of grade because of the adjoining properties. Upon vote being taken by roll catl the following voted in favor of the motion: Ch�istiansen, Hughes, and fdstrom; and the following voted against the same: Sehlin and Herje. Commissioner Specktor abstained. The motion carried. (Because of the newness of this Ordinance the Planning Commission asked that the City Attorney state whether the Board of Zoning Appeals can carry out the Planning Corrmission' s recommendations.) It was moved by Christiansen, seconded by Hughes, carried unanimously, that the propanent be allowed to fill Lot 3 Block 1 Prospect Heights Second Addition and Lot 4 Block 1 Peterson's Vatley View Addition to an elevation of 877' which would allow the strueture to be constructed out of the Flood Plain with the stipulation that the proponent submit to the City Engineering Department for approvat a grading plan taking into consideration the adjoining tots. (b) Discussion — Flood Plain Ordinance Because of the above request and the discussion regarding the Ordinance, including the procedure it should follow, ��it was rraved by Christiansen, seconded by Herje, carried unanimousty that the Planning Commission ask the City Council for a clari— fication of the Ordinance--such as a procedural flow chart for steps of the various points of the Ordinance and the jurisdiction of the various agencies involved. -��Cornmissioner Sehlin left the meeting to attend Valley Square Task Force �eting. �,.�e� Planning Commission November 24, 1975 page 3 3.
