MINUTES OF THE GOLOEN VALLEY
PLANNING COMMISSION
March 14, 1977
A regular meeting of the Gotden Valley Planning Commission was held at 7:30 P.M.
on Monday, March 14, 1977 at the Civic Center, 7800 Golden Valley Road.
Golden Valley, Minnesota.
Chairman Ron Edstrom presided and the following members were present:
Commissioners Forster, Herje, Hughes, Mindess, Sehlin, Specktor, and Wagman.
Atso present was Jon Westlake, staff inember.
Members absent: Commissioner Polachek:
1 . APPROVAL OF MINUTES: MOVED by Sehlin, seconded by Herje, carried unanimously,
to approve the minutes of the February 28, 1977 Planning Commission meeting as
amended as follows: Page 1 , Item 2, add to sentence: The tetter points out that
if there is a quorum present to conduct business and a member of the Commission
disqualifies himself resulting in less than a quorum to vote on the issue, then
the Chairman should refuse to entertain the motion.
2. REQUEST FILL PERMIT
Appticant: Reuben T. Leines
Location: East of Highway 100 and North of Legion Club
Request: Fill Property with Two Feet of Clay—Black Dirt Mixture
The property owner has applied for a Fill Permit to fill the area located North
of the Legion Club and East of Highway 100. The Environmental Commission dis—
cussed the req�aest at their February 14, 1977 meeting and deferred action on the
request to their March 14, 1977 meeting to allow site inspection by Commission
members. During the last few years the City has not issued Fill Permits, unless
it has been in relation to some form of construction. The City is not aware of
any construction that may take place on this site.
If the Planning Commission feels a permit should be issued, the following shoui�d
be completed by the property owner:
a) The northern portion of the site is in the Flood Plain, and no filling
can take place in the �lood Plain without Bassetts Creek Flood Control
Commission and Oepartment of Natural Resources review. The flood
elevation contour should be delineated on the survey. Also, it
should be clearly marked in the field.
b) Finished grade� plan that will not adversely affect adjacent property
(should include a top dressing over soil ).
c) Type of fill (application indicated clay—black dirt mixture)
d) Maintenance of f211 area during the fill period
e� Provisions for control of drainage
f) Provisions for control of materials dispersed from the site by wind
and water
g) Provisions for leveling the site during the fitl operatior�
h) Provisions for closing off access to fill area
i ) Starting date and termination of fill operation (app1ication indicates
termination Juty 1 , 1977)

Mr. Leines, property owner, was present to answer questions regarding his
request. He indicated that the filling and leveling of the site would make
the property more saleable.
The Ptanning Commission in discussing the request noted the survey contains spot
elevations but no contour; therefore, the following is not known: 1 ) how the
fill will tie in with the property to the East, and 2� what portion of the
northern area of the site is in the F1ood Plain. The Planning Commission
pointed out that if the site is filled as described by Mr. Leines, it would
improve the property but there may be dust or runoff problems during the fill
operation and before a ground cover can take hold in the fill area.
It was moved by Herje, seconded by Forster to recommend to the City Council that
a fill permit be issued, subject to the following conditions:
1 . Items b) through i ) in the planning report
2. Add the following conditions
j) No filling in the Flood Plain, and that the flood elevation
contour should be delineated on the survey and also it
should be marked in the field
k} Limits of fill operation to be clearty marked in the field
1 ) Require a performance bond
m) City Council to give consideration to the Environmentat
Commission comments on this item
The motion carried with Commissioner Sehlin voting nay.
3• WAIVER OF THE PLATTING ORDINANCE
Appticant: New Hope Nursing Home
Location: 2531 Douglas Drive
Request: Divide Parcel for Two Double Lots
Zoning: Residential
The request is to divide a parcei into three lots located in the Southwest �orner
of Douglas Drive and Medicine Lake Road. Parcel 1 contains a home. The garage
further North on the site would be moved onto this parcel . The parcel would
contain 130 feet of frontage with a depth of 322 feet and 38,900 square feet.
Lot 2 (corner lot) would have a frontage of 150 feet and a depth of 121 feet
with 18,150 square feet in the lot. Lot 3 woutd have a frontage of 121 feet by
150 feet of depth with 18,150 square feet. Lots 2 and 3 would be double
bungalow 1ots.
Previous requests in this area have been proposed for combining and dividing
parcets located to the Southwest of this area for the platting of single family
lots; however, nothing has been finalized.
Presently there is a new double bungalow located to the East of this parcel at
2520 Douglas Drive. The Comprehensive Ptan indicates a heavier density for
this area, such as four plexes. The total tand area in this parcel is
75,200 Square feet, which would allow four double tots (8 units) using
18,750 square feet as a guide, but because of street access, only three
parcels could be divided off. If the two double lots are approved, the
next step woutd be a variance by the Board of Zoning Appeals.

Because no representative was present for the request it was moved by Hughes,
seconded by Specktor, carried unanimously to defer action on this item.
4. REQUEST FILL PERMIT - FLOOD PLAIN
Appticant: Patrick Darcy, Sr.
Location: 1919 Kyle Place
Request: Fill Area where Proposed House is to be located
Zoning: Residential
The request is to fill an area of the Flood Plain where the single family dwelling
would be located on Lot 1 Block 2 Zimmerman Terrace. The Bassetts Creek Flood
Control Commission and the Department of Natural Res�urces have been notified of
the request, and the Bassetts Creek Flood Control Commission has responded by
indicating that the Commission recommends that compensating flood storage volume
be provided in accordance with the Management Plan for the area filled below the
833-foot elevation. The problem is that from the 833-foot elevation south to
Sweeney Lake there is no elevation higher than 833� to provide equal storage.
One way to reduce the impact on the Flood Plain would be a front yard variance which
could be granted by the Board of Zoning Appeals.
Mr. Darcy, property owner, discussed the request with the Planning Commission
stating he had purchased the lot approximately one year ago and intends to construct
his home in the area shown as the fill area on the survey. The Planning Commission
in discussing the request noted there is no way to provide equal storage on the
lot because of the grade and that granting fill permits for fill without equal corn-
pensation will have an effect on the flood plain.
After further discussion it was moved by Mindess, seconded by Wagman that in view
of the fact that the proponent has purchased the lot in good faith and intends to
construct a home, and in view of the fact the Planning Corrmission does not want to
create an unnecessary hardship, it was moved that the Planning Commission recommend
approval of a Fill Permit, subject to the following conditions:
1 . No filt allowed more than 85' South from the North property line.
2. The Planning Commission recommends to the Board of Zoning Appeals that
any variance in the front yard setback allowed by the Board of Zoning
Appeals compensate by reducing the 85-foot line as measured from the
North property line (Example: variance of 10� . Fitl area could be
no closer than 75' from the North property line).
The motio�n carried with Commissioner Hughes abstaining, noting he is a member of
the Board of Zoning Appeals.

5• PLANNEO UNIT DEVELOPMENT - SET INFORMAL HEARING
P.U.D. #19 Concept Approval
Proponent: John Paulson
Location: 1370 Douglas Drive
Request: Construct a Six-story Apartment Building - first three stories
to contain parking.

The proponent has applied for concept approval under the Planned Unit Development
Ordinance. The proposed apartment building will be six stories in height, three
of which wilt be garage area. Because of the elevation of the lot, the height
of the structure will be approximately the same as the present apartment
buildings to the North. The structure will contain 37 units. The Comprehensive
Plan indicates Residential High Density for this area.
Mr. Paulson briefly explained his proposal . The Planning Commission indicated
to Mr. Paulson that along with other requirements they will be considering the
following at the concept hearing: density, height, land use, and traffic. The
Commission asked that they receive copies of the elevations for study prior to the
informal hearing. The housing policy was discussed and the Planning Commission
asked the staff to provide figures on rental units.
It was moved by Specktor, seconded by Wagman, carried unanimously, that the
Planning Commission set April 11 , 1977 for concept hearing for P.U.D. #19, and
that prior to this time the proponent meet with the residents in the area in
reference to this project.
6. GENERAL
(a) Appoint Nominating Committee for 1977 Ptanning Commission
Officers and �hree Alternates to the Board of Zoning Appeals
Chairman Edstrom pointed out that if the Planning Commission so chooses to
appoint a nominating corr�nittee, the committee would have to discuss the
nominations at an announced meeting but could contact the Commission members
as to their feelings about serving as Chairman, Vice Chairman, or Secretary
of the Planning Commission.
It was moved by Specktor, seconded by Wagman, carried unanimously, that the
Chairman appoint a nominating committee and that the nominating comnittee
contact each member of the Planning Commission to determine if they are
interested in becoming an officer of the Planning Commission for 1977. The
nominating committee then would meet at 7:00 P.M. on April ll , 1977 prior to the
regularly scheduled Comnission meeting to develop the committee' s recommendations
for the Planning Commission officers.
Chairman Edstrom appointed Commissioners Herje, Specktor, and Wagman as the
nominating committee with Commissioner Specktor to act as chairperson of the
committee.
(b) Letter of Appreciation
It was moved by Hughes, seconded by Specktor, carried unanimously, that the
Chairman of the Planning Commission send a letter of apprec�ation representing
the Ptanning Commission to former Commission member Warren Lundsgaard.
(c) Planning Corrxnission Information
At the beginning of the Planning Commission meeting the Chairman distributed
copies of the Code of Ethics Ordinance and the Guidelines for Corr�nissions to
the Planning Corrrr�ission members. The Commission members were also reminded that

on March 30, 1977 the City Council will sponsor a Board and Comnission dinner
and training session at Brookview at 6:00 P.M. and all members are invited.
There being no further business to come before the meeting, it was on motion,
duly seconded, adjourned at 10:00 P.M.
