03-12-79 PC Minutes d:��� s�: MINUTES Of THE GOLDEN VALLEY PLANNING COMMISSION March 12, 197g A regular meeting of the Golden Valley Planning Commission was held at 7:30 P.M. on Monday March 12, 1979 at the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. Chair Sehlin presided and the following members were present: Cammissioners Eastes, Forster, �erje, Hughes, Mindess, Polachek and Specktor. Also present was Jon Westlake, staff inember. Member absent: Commissioner Edstrom. i . APPROVAL OF MINUTESs It was moved by Mindess, seconded by Hughes carried unanimously to approve the minutes of the February 26, 1979 Planning Commission meeting as amended as follows: Add prior to the first paragraph of ttem �2, Commissioner Mindess dismissed himself from the table because of a conflict of interest. Page 3, add to first paragraph of second sentence the word permanent between a permanent private easement. 2. CONFLICT OF INTEREST: It was moved by Specktor seconded by Mindess that any Commissioner indicating a conflict of interest, that it be so noted in the minutes. The motion carried unanimously. 3• PRELIMINARY PLAT - GOLDEN VALLEY DEVELOPMENT Applicant: Gittleman Corporation Location: South of 6001 Glenwood Ave. Request: Divide Parcel into 18 Single Family Lots Zoning: Residential The request is to subdivide approximateTy Ten Acres (gross area) into Eighteen Single Family detached building lots. The proposed development lies North of Laurel Ave. , South of Glenwood Ave. , East of Glenway Slopes Addition and West of the Neslund property, which is where King Creek was proposed. PRELIMINARY PLAT All lots meet or exceed the 12,500 sq. ft. requirement. Two of the eighteen lots have a frontage of 90 feet, however the twa lots have square footage of 17, t0� and 18,900 square feet. The reason for the large square footage of the lots located in the central area of the plat is the drainage ditch which runs from Southwest to Northeast � through the property. OUTLOT A Outlot A is proposed to be added to the Hamman property and a portian of the Hamman property will beeome part of the proposed street to the South of Glenwood Ave. The plat indicates a concepfi of how the Hamman property can be further subdivided with a future cul de sac. � 93 Planning Commission March l2, 197g page 2 QUTLOT B Outlot B is shown as a concept fcar four (4) future lots. The property currently has a single �Family hc�use on it. STREET PATTERN The plat is designed with a 60ft. Right of Way and a radius of 50 ft. for the cul de sac (Ordinance requires 60 ft.) . The plat shows a dedi- cation of 40 feet of Right of Way for Laurel Ave. The Plx�t Plan also indicates how the street pattern could loop through the Neslund property (east of plat) back to Glenwood Ave. GREEN BELT The plat indicates a dedic�tian of a 60 ft. strip called putlot C on the plat, which has an area of 28,600 sq. ft, The size e�f the p�rcel is approximately 10 acres. The land dedieatican policy of the Council is l0i or in this proposal 1 acre (43,560 sq, ft.) . DRAINAGE DITCH The open drainage ditch lying between Block 2 and B1QCk 3 i� designed with a 3: 1 slope. The width of the ditch �t the bottQm is 5 �eet and g0 feet at the tap. The bottom af the ditch will be ]5 feet e�r more lower than the rear yard at the house sites. COMPREHENSIVE PLAN The Comprehensive Plan indicates a Planned Unit Develc�pment for the property with a low density for approximately 80i of the site and a mid-density for approximately 20i of the site in the Southeast ccarner. The property is zoned Residential . TRAFFIC CIRCULATION PATTERN The proposed development would be accessible by way vf Glenwoad Avenue. The current P1ot Plan shows a local residential street (proposed) running South of Glenwood Avenue through the proposed development, then East looping back to Glenwood Ave. on the Neslund property. The proposed street pattern is U-shape and similar to that street pattern serving the residential area West of the proposed development (Dakota Ave. to Brunswick Ave. So.) . In addition a cul de sac is planned for the site. SURROUNDING LAND USES North: Glenwood Avenue (Collector) ; North of Glenwood Avenue lies single family dwelling units. South: Laurel Avenue; South of Laure] Ave. lies the Merchant lndustrial Park. East: Vacant Property - previous proposal was King Creek. West: Residential - detached single family dwelling units. Southeast corner - City of Golden Valley-vacant land. Planning Commission March 12, 197g page 3 TOPOGRAPNY (Soil and Sl.ope) The Northern area of the property is described as prairie, having rolling terrain possessing ` irregular shaped hills and knolls. The Southern area is described as Low Land. CONSIDERATION l . The Planning Commission and City Staff have stated all along on these two sites, that when there has been a proposal on one of the properties, that the owner or developers of each site should work together because of the uniqueness of the site in relation to terrain, flood plain, drainage ditch, utilities and it would help reduce the isolation of the neighborhood. 2. If the Planning Commission recommends approval on the preliminary plat, the following items need further attention prior to the final plat being approved: (a) The drainage ditch requires further review in relation to elevation, (b) If the configuration of 0utlot B is not worked out prior to Council review of the plat, the Council then should consider assessments for Outlot B, (c) Cash in lieu of or land dedication, (d) Location survey of the Hamman residence and Turner residence to indicate the future plat shown for these properties is functional , (e) brainage plan� to show erosion control for construction period. The Planning Commission asked if the proponent was aware of their policy on open land passed by the Planning Commission August 13, 1973, which in essence states that when it is believed that coordination of planning is needed when the pro- posal may have an affect on adjacent land, than these areas should be cons+dered in relation to the current proposal . Mr. Melvin Gittleman, property owner and developer, stated he has owned the praperty for approximately 15 months and feels after several meetings with the City he has answered the problem regarding the interior street pattern, drainage, flood plain and how this property would function with the Neslund prpperty. Mr. Gittleman indicated he and Mr. Pdeslund hav� tried to agree on the development of the property but nothing could be worked out. The following comments were noted by individuals present: Mr. Ron Bastier, representing the Neslund property, requested that the Planning Commission defer the request to the April 9, 1979 meeting in order that the firm he works for can evaluate the project with respect to engineering as it relates to the Neslund property. Mr. Lowell Swanson of 245 Brunswick Ave. So. , was concerned about the drainage on the West side of the plat so water i� not pocketed in the rear yards of the homes to the East of Brunswick Ave. GTen Iden indicated he was pleased to see a traditional plat proposed for this property. Mr. Iden referred to drainage easements in Glenway Slopes and how the proposed plat should maintain these easements. The Planning Commission in discussing the request referred to the Hamman property and how the property is to be transferred with the Gittleman property. The ��::° Planning Commission March 12, 1979 page 4 transfer wi }1 make the West lot line parallel with the proposed street. The Commission in reviewing Outlot 6, noted there are at least three different ways the 45 foot by 400 foot L-shaped parcel could became viable, such as; a) Turner could join in the plat, b) the property could be eombined with the Turner parcei as a large lot, c) Gittleman could add three additional building lots to the current plat by working with Turner. If the property is left as an L-shape Outlot, the Council will have to decide on the policy of assessments for Outlot B, beeause as designed the parcel is not a buildable lot. In reviewing the interior street pattern ,the Planning Commission pointed out it was important that the Neslund parcel and Gittleman parcel develop a street pattern between the two properties, if not each property ends up with an extremely long cul de sac. The Commissio� asked if the 60 foot green belt North of Laurel Ave. could be en- larged, noting the Comprehensive Plan indicates a meandering 100 foot green belt. It was moved by Mindess seconded by Herje carried unanimously to table the request to the Apri1 9, 1979 Planning Commission meeting as requested by Mr. Bastier, representing the Neslund property, to study the Gittleman Plat as to how the street pattern, flood plain, utilities and drainage can be incorporated in developing the Neslund Parcel . 4. WAIVER OF PLATTING Applicant: The Samurai Japanese Steak House Location: 850 Louisiana Ave. So. Request: Add Additional Footage to Present Lot Zoning: Industrial Commissioner Mindess dismissed himself from the table because of a conflict of interest. The request is to add 110 feet to the North of Lot Z, Biock i , Baker's Industrial Park, making a parcel 80,g14 square feet. The request is to develop a site to house a restaurant (The Samurai Japanese Steak House) , which is classified as a Class l Restaurant by fihe Zoning Code. The remaining parcel is of sufficient size for development which would contain 56,538 sq, ft. or approximately l 1/4 acres. Mr. Jack Offenback, president of The Samurai Japanese Steak House, presented his request to the Commission. The Commission noted the proposal meets the parking ordinance for a Class I restaurant and landscaped area except off Market Street where the proponent is asking for a variance from the Board of Zoning Appeals, because of running a service drive thro:ugh the green area but providing additional landscaping in front of the structure. The remaining lot, although it is smaller because of the proposal , will still contain approximatel 1 1/4 acres of land. v" It was moved by Hughes seconded by Specktor carried unanimously to recammend approval of the Waiver of the Platting Ordinance as requested as per survey, by Lot Surveys Company, dated March 13, 1979. �� Planning Commission March 12, 1979 page 5 5. PLANNED UNIT DEVELOPMENT - SET INFORMATIONAL HEARING P.U.D. #18-A General Plan Proponent: Sachs, Friedell , Latz � Goldman Location: 5610 Laurel Avenue Request: Set General Plan Hearing It was moved by herje secanded by Forster carried unanimously to set April 9, lg7g for the General Plan Informational Hearing to consider a 3-story, 65 unit apartment building. The Commission requested a site plan and that the developer meet with the property owner prior to the meeting. 6. ORDINANCE CREATING THE 'PLANNING COMMISSION Chair Sehlin stated she attended the March 5, 1979 Council Meeting where a first reading was given to the ordinance creating a Planning Commission of not less than 9 members or more than 13 members. Chair Sehlin stated that the Council was informed of the difficulty of having more than nine members. There being no further business to come before the meeting, it was on motion, duly seconded, adjourned at 9:00 P.M.
