01-28-80 PC Minutes �,�� MINUTES OF THE GOLDEN VALLEY ` PLANNING COMMISSION January 28, 1980 A regular meeting of the Planning Commission was held at 7:30 p.m. on January 28, 1980, at the Civic Center, 7$00 Golden Valley Road, Golden Va11ey, Minnesota. Chairperson Eastes called the meeting to order at 7:30 p.m. Those present were Commissioners De Sautels, Eastes, Forster, Hughes , Levy, Polachek, Sehlin, Spector, Swanson and Thompson. A1so present were Mike Miller, Planning and Red�velopment Coordinator and Martin Farrell , Assistant City Planner. Commissioner Edstrom arrived at 7:40 p.m. I . APPROVAL OF MiNUTES It was moved by Sehlin, seconded by Thompson and carried unanimously to approve the minutes of the January 14, 1980 Ptanning Commission meeting. II DtSCUSSION OF T.H. 12 MORATORIUM ORDINANCE At the request of the Planning Commission Chairperson, Assistant City Attorney P,llan Barnard addressed the Planning Commission. Mr. Barnard authored the T.H. 12 Moratorium Ordinance and briefly �escribed the punpose of the ordinance. 111 . INFORMAL PUB�IC HEARING - REZONING APPLICANT: The New Life Atano Society LOCATION: 8401 Medicine Lake Road REQUEST: Change Zoning from Residential to Institutional Mike Miller briefly gave some background material about the Alano Society, the property proposed to be rezoneci and the reason for the rezoning request. The Alano Society is proposing to purchase an older, single family dwelling for the purpose of using the property as a meeting place for their activities. The property is presently zoned Residential and the proponent is requesting a rezoning to Institutional to allow this type of land use. Donald Hughes expressed concern and requested that it be noted that the Planning Commission should not confuse the purpose of a rezoning with this particular use. The proponent, represented by Robert Schum, addressed the Commission. Mr. Schum stated that ths structure would be used for evening meetings, between the peak hours of 6:00 p.m. and 10:00 p.m. -An average of 20 to 30 peopl;e 'would attend these meetings, with the maximum number of occupants reaching 70 members at any one given time. A neighborhood group, represented by Mary Nicholson, 243o Zealand Avenue N. , presented a preliminary petition, signed by 40 of the local neighbors and also a final petition_ signed by 50 of the local neighbors, opposing the rezoning., Paul Moquist, 2435 Xylon Avenue North, addressed the Commission and expressed concern about the setback requirements. Edward Zapple, 246o Zealand Avenue North, stated that he opposed the rezoning because of the potential parking nuisance. �7e� Minutes of the Golden Vatley Planning Commission January 28, 1980 Page 2 Don Schaffer inquired about lighting the parking area and was informed i# the lot were lit, the lights could not shine onto a neighbor's property. Tom Boyce, 2465 Xylon Avenue North brought up the issue of traffic safety and the idea of preserving the character of the neighborhood. Dave Gelperin, 2425 Zealand Avenue North, expressed concern about future zoning and the possible other uses that could occupy the property, George Dodnick, a member of Alcoholics Anonymous described the function of the group and urged the commission to grant the rezoning request. After hearing from all the concerned citizens, Chairperson Eastes calted for further discussion from the Commission. Dave Thompson stated decisions by the Planning Commission should be made on the basis of good planning. He did not feel this type of rezoning was good planning and wanted to keep the neighborhood residential . E,dstrom stated that institufiional uses have traditionatTy.been located in residential neighborhoods. Swanson concurred with Edstrom. Hughes fhen stated the rezoning went against the Comprehensive Plan for the residential area. A�fter further dis�ussion it was moved by Thompson, seconded by Sehlin, to deny the request. Roll call was taken. Commissioners Thompson, SehTin, Forster and Hughes were for the motion. Commissioners Swanson, Edstrom, Specktor, Levy, DeSautels, Eastes and Potachek voted nay. The motion was not carried. It was then moved by Swanson, seconded by Edstrom, to recommend approval of the rezoning from Residential to Institutional and requested that the project be reviewed by the Ptanning Commission in 6 months and again in 12 months from this time and it was recommended that proponent landscape the property as recommended by the City Ptanner. Roll call was taken. Commissioners Specktor, Swanson, Levy, DeSautels, Eastes, Edstrom and Polachek voted in favor of the motion. Commissioners Sehlin, Forster, Hughes and Thompson voted nay. The motion to approve the rezoning was carried. Commissioner Hughes requested it be noted in the minutes that Staff stated stipulations coutd be placed on the rezoning recommendations by the Planning Commission. The Commission recessed for 10 minutes. IV. SET DATE FOR INFORMAL PUBLIC HEARING - REZONING APPLIGANT: St. Regis Paper Company LOCATION: 4232 - 4240 O1son MemoriaT Highway - REQUEST: Change Zoning from Light Industrial to lndustrial Mike Miller recommended February 11 , 1980 for the informal public hearing date. �' '�� Minutes of the Planning Commission January 28, 1980 Page 2 After some brief discussion, it was moved by Swanson, seconded by Forster, and carried unanimously, to set February 11 , 1980 for the Public Hearing for the rezoning #rom Light Industrial to Industrial . V. REQUEST FOR BUILDING PERMIT - 7.N. 12 MORATORIUM AREA APPLICANT: Edwin J. Turnquist LOCATION: 6300 Wayzata Blvd. REQUEST: Approval to develop a 151 unit "Thrifty Scot" Motel Mike Milter briefty explained the request and the concerns involving the service road that would be serving the property. Ed Turnquist, the proponent, addressed the Planning Commission and entertained questions regarding the development. It was then moved by Polachek, seconded by Thompson, and carried unanimously to recommend the granting of a building permit for construction of the 151 unit "Thrifty Scot'.' Motel , based on the three recommendations in the staff report where were as follows : 1 . further detailed study of this development proposal is unnecessary to determine the appropriate location for such a proposed use; 2. it does not appear likely that the proposed land use at this particular location within the T.H. 12 Area will be prohibited by provisions of any proposed Zoning Ordinance or amended Comprehensive Plan for the T.H. 12 area; and 3. while the proposed tand use will require the development of a new service road, provision of the necessary right-of-way �ill not adversely a�fect the upgrading of T.H. 12 nor will the provision of utilities to the site adversely affect the upgrading of T.H. 12. VI . BACKGROUND REPOR7 ON MIDDLE SCHOOL Chairperson Eastes stated that the City Cowncil would like the Planning Commission to develop criteria for evaluating future land uses for the Middte School Property. Commissioners Polachek and Levy were appointed the Subcommittee and requested to have prepared a recammendation by February 11 , 1980. VII . PROPOSED ZONING ORDINANCE AMENDMENT. Terminal Warehouse Zone District Mike Miller gave a Staff review of the need for this zoning ordinance amendment and briefly explained the new Terminal Warehouse Zoning District. It was then moved by Edstrom, seconded by Levy and carried unanimously to review the ordinance and discuss it further at the next Ptanning Commission Meeting, February 11 , 1980. � "�."�1 Minutes of the Planning Commission January 28, 198Q Page 3 VIII . WORK SESSION - PUBLIC FACILITIES COMPONENT OF COMPRfHENSIVE PLAN Transportation Edstrom represented the Transportation Subcommittee and discussed the revisions made in the Transportation section. Al1 corrections and additions were noted and will be written into the final draft. It was moved by Specktor, seconded by Hughes and unanimously carried to accept fihe Transportation Plan subject to the proposed additions and corrections . The following chenges in the Transportation Seetion. of the Comprehensive. Plan were presented to an-d accepted by the Planning Commission. 111 . Data Summary, under,-lntermedi;ate Arterials ; - "lndiana Avenue" was deleted from Westbound T.N. 55 ar�d Eastbound :T.H. 55. "Ardmore and Meadow Lane" were added to Westbound T.H: 55• "Meadow Lane and Lilac Drive North" were added to Eastbound T.H. 55. "Douglas Avenue" was deleted from Northbound T.H. 100 and Southbound T.H. T00. 111 . Data Summary, under Collectors : "in �rder for a street to be designated a Collector, it must also meet the requirerr�nts established by the Minnesota Department of Transportation for Municipal State Aid streets. The following are examples of Collector streets in Go)den Valley:" has been deleted. lll . Data Summary, the Functional CTassification Map fior streets was altered to reflect the mentioned changes. Map X - Transit Lines - Asterick was added next to MAJOR ACTJVITY CENTER in the legend. The fare zone on the east end o�f the map was deleted. In the Findings � Recommendations Section, under Finding #2 in the last paragraph, last sentence, an "e" was added to "sever" in order to correct the spelting. In the Findings � Recommendations Section, under Finding #7, Need 1 : "MTC" was replaced by "Metropolitan Transit Commission" and "MLB�C" was replaced by "Medicine Lake Bus Company, Inc." lt was decided that Thompson and Polachek will represent the Planning Commission at the City Council Meeting scheduled for Monday, February 4, 1980.
