12-28-81 PC Minutes 30 Minutes of the Golden Valley Planning Commission December 28, 1981 A regular meeting of the Planning Commission was held in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, MN. Chairman Thompson called the meeting to order at 7:00 p.m. Those present were Commissioners: Eastes, Polachek, Singer and Thompson. Commissioners Forster, Leppik and Moede were not present. � Also present were Mike Miller, Director of Planning and Redevelopment, and Alda Peikert, Assistant Planner. I . Approval of Minutes - December 14, 1981 : . It was moved by Commissioner Polachek, seconded by Commissioner Singer and carried unanimously to approve the minutes of the December ]4, 1981 Planning Commission meeting as recorded. II . Informal Public Hearing - Conditional Use Permit: APPLICANT: Reinertson & Associates , �nc. LOCATION: 5740 & 5800 Duluth Street REQUEST: Approval of a Conditional Use Permit allowing a 5-story office building plus 23 feet additional height for mechanical apparatus in a 6 � P 0 Zone District. Chairman Thompson recalled for the Commission that the proponent, Mr. Mark Reinertson, requested a change in his application at the time the Planning Com- mission set a hearing date at the previous meeting. Chairman Thompson informed the Commission that Mr. Reinertson had not provided the City PTanning and Re- development Department with a complete revised application and the Planning Commission could neither hold a hearing nor set a new hearing date on this item. Therefore, the Chairman was obliged to pass over this agenda item. III . Informal Public Hearing - Conditional Use Permit: APPLICANT: Executive Leasing Corporation LOCATION: 698Q Wayzata Boulevard REQUEST: Approval of a Conditional Use Permit to operate a gasoline service station in an Industrial Zone Di stri ct. 31 Planning Commission Minutes of December 28, 1981 Chairman Thompson introduced this agenda item and asked whether there were any questions of staff. The Commissioners had no questions for staff. The Chairman recognized Mr. Leo Martin, Executive Leasing Corporation, who was present to represent the proponent. Chairman Thompson opened the informal public hearing. There was no one present who wished to speak on this agenda item, and the public hearing was closed. In response to an invitation from the Chai-rman, Mr. Martin stated thafi he had nothing to add. Chairman Thompson reviewed the staff report including items specified by Ordinance for consideration and the staff recommendation for conditional approval . It was moved by Commissioner Singer, seconded by Commissioner Eastes and carried unanimously to recommend City Council approvai of the Conditional Use Permit requested by Executive Leasing Corporation to allow operation of a gasoline service station at 6980 Wayzata Boulevard in the Industrial Zoning District subject to the following conditions: 1 . The car wash facility shall not be open to the general public. VioTation of this condition shall be grounds for revocation of the Conditional Use Permit. 2. Vehicle parking on-site shall be restricted to those areas designated for parking on the site plan only. Violation of this condition shall be grounds for revocation of the Conditional Use Permit. IV. Informal Public Hearing - Conditional Use Permit: APPLICANT: Executive Leasing Corporation LOCATION: 6980 Wayzata Boulevard REQUEST: Approval of a Conditional Use Permit to operate a "U-Haul" truck and trailer rental service within an lndustrial Zone District. Chairman Thompson introduced this agenda item and asked whether there were any questions of staff. Planning Commissioners had no questions for staff at that time. Chairman Thompson opened th�-informal public hearing. There was no one present who wished to speak on this agenda item, and the public hearing was closed. The proponent, Mr. Leo Martin of Executive Leasing Corporation, stated that he had nothing to add, and Planning Commissioners had no questions for the proponent. At this point, Commissioner Eastes directed a question to staff concerning enforce- ment of the condition of approval recommended in the staff report stating that rental trucks and trailers should not be parked in the off street parking area re- quired by City Ordinance. Planning and Redevelopment Director Mike Miller explained that both he and City Inspection Department staff have occasion to drive by and check the subject site often enough to notice should a parking problem develop and that stipulation of this condition in the conditional use permit would afford the City added leverage to correct any parking problem which might develop at this site in the future. 32 Planning Commission Minutes of December 28, 1981 Commissioner Eastes further questioned whether the off street parking require- ment stipulated by the City Zoning Ordinance could not be enforced based on the Ordinance without addition of a condition in the conditional use permit approval . Mr. Miller replied that the condition is not technically necessary for enforce- ment_of the off street parking requirement, but that further stipulation as a condition of the permit approval serves to inform the proponent and to reinforce the requirement in ordinance form, as City Couneil action on conditional use permits is passed as ordinance. It was moved by Commissioner Eastes, seconded by Commissioner Polachek and carried unanimously to recommend City Council approval of the request by Executive Leasing Corporation for a conditional use permit to rent "U-Haul" trucks and trailers at 6980 Wayzata Boulevard in the Industrial Zoning District subject to the following conditions: 1 . The operators of said business understand and agree not to park any rental trucks and/or trailers within any parking area needed for required off street parking as noted by the City Zoning Ordinance in accordance with the approved site plan. 2. All vehicles and equipment used for rental purposes must be stored elsewhere on the site and �roperly screened from view. V. Informal Public Hearing - Conditional Use Permit: APPLICANT: Jim Lupient Oldsmobile Company LOCATION: 7000 Wayzata Boulevard REQUEST: Approval of a Conditional Use Permit to operate a car rental business within an lndustrial Zone District. Chairman Thompson introduced this agenda item and noted revisions to the recom- mendation in the staff report, including clarification of the first and sixth recom- mended conditions of approval and addition of a seventh condition of approval . Chairman Thompson recognized Mr. Kyle Johnson, Albitz Design, who was present to represent the proponent. Chairman Thompson opened the informal public hearing. There was no one present who wished to speak on this agenda item, and the public hearing was closed. It was moved by Commissioner Eastes , seconded by Commissioner Polachek and carried unanimously to recommend approval of the conditional use permit requested by Jim Lupient Oldsmobile Company for a car rentaT business and for an automobile servicing and repair operation accessory to Jim Lupient Oldsmobile Company sales and rental located at 7000 Wayzata Boulevard subject to the following conditions: �� Planning Commission Minutes of December 28, 1981 1 . Restriction of automobile servicing and repair, including diesel pump repair, to the Jim Lupient Oldsmobi1e Company sales, service and rental business. 2. Board of Zoning Appeals (BZA) approval of a waiver of the 20 foot west side yard building setback requirement and of the )0 foot landscaped west side yard parking setback requirement. 3. Landscaping to the specifications of the Building Board of Review of the 35 foot front yard area on the three sides of the site facing streets. 4. Removal of gasoline pumps and underground fuel storage tanks in accordance with City Tank Removal Guidelines promulgated by the City Fire Marshall and City Bui1ding Inspector, except for one pump island which may be retained 'for Jim Lupient sales and rental car use. 5. Use of permanent exterior building materials on the two sides of the building addition facing public streets unless use of inetal exterior is approved by the Building Board of Review. 6. Limitation of the number of cars parked to the south and east of the building to li as indicated on the site plan and limitation of the number of cars parked to the north of the building to the number reasonably spaced outside of the 35 foot minimum setbacks from the streets on the east and north, to be delineated on plans submitted for approval of the Building Board of Review prior to issuance of a building permit for the proposed addition. 7. Violation of any of the above conditions shall be grounds for revocation of the conditional use permit. VI . Report on HRA Meeting - December 15, 1981 : Prior to presenting his repart on the December 15, 1981 HRA meeting, Commissioner Singer requested a change in the proposed schedule for Planning Commissioner representation to City Council meetings in 1982. Commissioner Po1achek agreed to attend the March 16, T982 City Council meeting, and Commissioner Singer will attend the February 16, 1982 meeting. Commissioner Singer provided Planning Commissioners with a report on the December 15, 1981 HRA meeting, covering extension of the closing date on Calvary Community Services property, a request from the HRA Chair for a timetable for the Valley Square Redevelopment Project, a report on the informational meeting with the South Wirth Neighborhood Committee, and settlement of the Ewald property purchase. VIf . Report on City Council Meeting - December 15, 1981 : Commissione`r Forster was absent, and it was necessary to postpone his report on the December 15, 1981 City Council meeting until the .next Planning Commission Meeting. �� Planning Commission Minutes of December 28, 1981 However, in conjunction with the report on the Council meeting, Chairman Thompson asked Planning and Redevelopment Director Mike Miller to explain the reasons for an upcoming PUD application for the North Wirth Redevelopment Project . Mr. Miller explained that an application for PUD General Plan of Development approval , without the Concept approval step, would be coming before the Planning Commission and that the North Wirth Parkway Redevelopment Project should have been presented to the Planning Commission as a PUD from the beginning. VIII . Schedule of Planning Commission Representatives to City Council and HRA Meetings: Chairman Thompson called attention to the proposed schedules of Planning Commission representatives to City Council and HRA meetings for the months of Janua ry through March 1982 and asked whether there were any problems with the schedules in addition to the change requested earlier by Commissioner Singer. Planning Commissioners had no other problems with the proposed schedules. Planning and Redevelopment Director Mike MiJler informed the Commissioners that schedules for the remainder of 1982 would be prepared following City Council reappointment and/ or appointment of Planning Commissioners scheduled for the end of March 1982.
