07-12-82 PC Minutes �� � Minutes of the Golden Valley Planning Commission July 12, 1982 A regular meeting of the PTanning Commission was held in the Council C hambers of the Civic Center, 7800 Golden Valley road, Golden Valley, MN. C hairman Thompson called the meeting to order at 7:00 p.m. Those present were Commissioners Forster, Polachek, Prazak, Singer, Thompson and Tubman. Commissioner Leppik was not present at the beginning of the meeting. Also present were Mike Miller, Planning and Redevelopment Coordinator, and , Alda Peikert, Assistant Planner. I . Call Informal Public Hearing = Amendment to P.U.D. #1-B, Colonial Acres Covenant Manor�— APPLICANT: Colonial Acres Healthcare center L OCATION: 5825 St. Croix Avenue REQUEST: Approval of Preliminary Design Plan for Ame ndment of P.U.D. #1-B Chairman Thompson introduced this agenda item and noted the staff recomnen- dation of a July 26, 1982 informal public hearing date. Mr. James Van Vugt w as present to represent the proponent. Commissioner Leppik arrived at the meeting. I t was moved by Corr�ni ssi oner Si nger, seconded by Commi si oner Tubman and carried unanimously to set an informal public hearing date of July 26, 1982 f or consideration of the Preliminary Design Plan for a proposed amendment to PUD #1-B, Colonial Acres. III. Informal public hearing - P.U.D. #37, Brandon Terrace Townhouses: APPLICANT: Brad J. Jones L OCATION: 528 Indiana Avenue North REQUEST: Approval of Preliminary Design Plan for P.U.D. #37 � �' �� � � �-: P1 anni ng Corr�ni ssi on Mi nutes - July 12, 1982 Page 2 Chairman Thompson introduced this agenda item and noted the staff report indicating that the proponent requested continuation of the public hearing u ntil July 26, 1982 to allow time for plan changes. The proponent, Mr. B rad Jones, was present. It was moved by Commissioner Forster, seconded by Commissioner Polachek and c arried unanimously to reset the informal public hearing for consideration of the Preliminary Design Plan for PUD #37, Brandon Terrace Townhouses, for J uly 26, 1982. IV. Recommendation on the Management Plan f or the rental portion of P.U.D. 0-B , Medl ey Park Townhouses;� Chairman Thompson introduced this agenda item and recognized Mr. Gene Syl vestre, consul tant to the Numan Ri ghts Corirr►i ssi on, who was ,pres.ent to represent the Human Rights Commission. Chairman Thompson asked Mr. Sylvestre to explain the question and answer format used in the Management Plan. Assistant Planner Alda Peikert informed the Planning Cormnission that the M anagement Plan was received f rom the project developer, Bor-Son Investment P roperties Corporation, in the question and answer format. Ms. Peikert i ntroduced Mr. Gerry Kimmer of Realty Management Services, the firm which will manage the project and which is responsible for the Management Plan, and suggested that he would be able to explain the format. Mr. Kirrmer stated that the format of the Medley Park Management Plan is a standard f ormat which Realty Management Services has used for other project M anagement Plans and which covers standard questions stipulated by the Minnesota Housing Finance Agency (MHFA) and HUD Area Office. M r. Commissioner Leppik asked Mr. Kimmer a series of questions regarding the Medley Park Management Plan. Cor�nnissioner Leppik's first question con- cerned a statement on pp. 8-9 of the Management Plan that prospective ren- ters would not be shown t�h�e actual apartment to be rented until the time the lease is to be signed. Mr. Kimmer explained that the discussion per- tains to rental units under construction and not available for showing to p rospective renters. Mr. Kimmer provided assurance that if the actual unit should not measure up to expections, the prospective renter would have the right of refusal of a specific unit and would be under no obligation to sign the lease. Correuni ssioner Leppik' s second question referred to payment of late fees charged on delinquent rent payments covered on p.15 of the Medley Park ��� Planning Commission Minutes - July 12, 1982 Page 3 M anagement Plan. Co mnissioner Lepik questioned whether such fees would not b e a hardship for low and moderate income persons in subsidized units. Mr. Kimmer stated that the management would give consideration to the cir- c umstances in each individual case and make adju stments if warranted. Corrrmnissioner Leppik referred to the item on parking availability in the April 15, 1982 memorandum recording a meeting of the Human Rights Cornrnission Housing Comnittee with representatives of Bor-Son and Realty M anagement Se rvices and suggested need for a greater number of heater plug i ns. Corr�ni ssioner Forster, former member of the Board of Zoning Apeals (BZA) , informed the Commission that garage and heater plug in requirements w ere established by the BZA. Commissioner Leppik pointed out several corrections to Addendum #1 of the M edley Park Management Plan, including correct reference to the Golden Valley Human Rights Co mnission and correction of the Golden Valley Civic Center address in two instances. Mr. Kimmer stated' that these corrections woul d be made to Addendum #1. Commissioner Leppik noted that a number of the questions raised in the Medley Park Management Plan are simply answered in the affirmative and directed attention specifically to such a question on p. 20 asking whether the lease would be fair and nonpunitive. Co mnissioner Leppik asked who determines whether the lease is fair and nonpunitive. Mr. Kimner replied that the lease to be used is one approved by HUD for Section 8 use. C hairman Thompson stated that he would p refer to refer to the City Council a Management Plan presented in a more concise format. Chairman Thompson , asked staff to bring from the file a copy of the approved Calvary Project M anagement Plan for comparison. W hi 1 e the P1 anni ng Comni ssi on was wai ti ng f or a copy of the Cal vary Project M anagement Plan, Planning and Redevelopment Coordinator Mike Miller took the opportunity to notify Mr. Kimmer that the April 15, 1982 memorandum on the meeting of the Human Rights Cor�nnission Housing Committee with Mr. Kimmer and Betty Kaelke of Bor-Son contains an erroneous statement con- cerning provisions for washers and dry ers. The memorandum states that there will be hook ups for washers and dry ers in each rental unit but that these apliances will not be provided with the units. Mr. Miller notified Mr. Kimmer and stated that he would separately notify Bor-Son that the Pt1D Permit for the project, scheduled for referral to the City Council on July 20, 1982, will not go to the City Council until such time as Bor-Son assures the City that they intend to go along with their original agreement to provide washers and dry ers for every unit within the Section 8 portion of the Medley Park Townhouses Project. Planning Commissioners compared the format of the Calvary Project M anagement Plan with that of the Medley Park Management Plan and found that � �� Planning Commission Minutes - July 12, 1982 Page 4 the two plans cover the same topics in the same order, but that the Calvary Plan is in outline format rather than the question and answer format used in the Medley Park Management Plan. Mr. Sylvestre stated that the Human Rights Commission concerned itself with content rather than format. Commissioner Prazak stated that he has no problem with the format and feels that the content is what is important. I t was moved by Commi ssioner Si nger, seconded by Comni ssioner Prazak and c arried unanimously to recommend that the HRA approve the Managernent Plan f or the subsidized rental portion of PUD #30-B , Medley Park Townhouses, with the i nclu si on of Addendum #1 as approved by the Human Ri ghts Commission Housing Committee. Valley Square Comnission Update: Chairman Thompson provided the Planning Comnission with a report on the status of the Valley Square C,amni-ssion recommendation to the HRA.
