08-09-82 PC Minutes t15 Minutes of the Golden Valley Planning Comnission August 9, 1982 A regular meeting of the Planning Comnission was held in the Council Chambers of the Civic Center, 7800 Golden Valley Road, Golden Valley, MN. C hairman Thompson called the meeting to order at 7:00 P.M. Those present were Commissioners Forster, Polachek, Prazak, Singer and Thompson. Co mnissions Leppik and Tubman were absent. Also present were Mike Miller, Planning and Redevelopment Coordinator, and Alda Peikert, Assistant Planner. I . Approval of Mi nutes - July 26, 1982: It was moved by Corranissioner Forster, seconded by Comnissioner Singer and c arried unanimously to approve the minutes of the July 26, 1982 Planning Comni ssion meeti ng as recorded. I I. Set date f or i nformal publ i c h eari ng - Condi ti onal Use Permi t, 810 Rhode Island Avenue: APPLICANT: Calvary Lutheran Church of Golden Valley L OCATION: 810 Rhode Island Avenue North REQUEST: Approval of Conditional Use Permit to operate a child care facility within an Institutional (I-1 ) Zoni ng Di strict. C hairman Thompson introduced this agenda item and reviewed the staff report f rom Planning and Redevelopment Coordinator Mike Miller indicating that in his opinion the conditional use permit application is incorr�lete and the applicants have not supplied sufficient information for proper analysis of the request. Ch airman Thompson stated that he asked Mr. Miller what infor- m ation was lacking and that Mr. Miller listed the following items as missing: 1 . Th e site plan delineates no parking areas, no drop off or pick up loca- tions, and no access from Rhode Island Avenue. Only the house, garage and dri veway from vacated former Rhode Island Avenue are shown. 2 . Th'e application states that the purpose of the proposal is to provide day care for up to 35 children but gives no information on licensing of the operation. Mr. Miller received a contradictory notification f rom the State indicating application f or a license to serve only 20 c hildren. 3. The description of the operation lacks information on staff, including the number of staff persons and their qualifications. ��.� Planning Comnission Minutes - August 9, 1982 Page 2 4. The City Building Inspector prepared a list of building improvements which would be required for the proposed use, but the application i ncl udes no statement of i ntent to make those i rr�rovement. F urthermore, the Buil di ng Inspector states that 20 chi 1 dren can be accommodated on the first floor of the house which is the only portion of the building the proponents intend to use. It is unclear where the p roponents pl an to house an addi ti onal 15 ch i 1 dren. C hai rman Thomp son stated h i s recommendati on that the Pl anni ng Comni ssi on take no action to set an informal public hearing date until sufficient information to complete the application is delivered. Chairman Thompson stated that he would not want the Planning Comnission to make a recomnen- dation to the City Council with insufficient information because it would n ot be fai r to the proponents. Mr. Gary Johnson requested permission to speak as representative of the p roponent, Calvary Lutheran Church. A1 so present were Ms. Deanna Hanson, Mr. Jim Ryman, and Mr. Stephen M. Carnes of Calvary Lutheran Church. Mr. J ohnson stated that the proponents are wi 11 i ng to provi de whatever i nfor- mati on i s reasonabl e and needed. Mr. Johnson i ndi cated that the i nfor- mation could be provided within a couple of days and requested that the Planning Corrannission set an informal public hearing date based on that a ssurance. C hai rman Thomp son rei tereated hi s recorranendati on that no heari ng date be set until information required to complete the application is submitted to the Planning and Redevelopment Coordinator. It was the consensus of the Planning Comnission that no action should be taken to set a hearing date. III. Informal public hearing - P.U.D. #36, 23rd and Winnetka: APPLICANT: Donna Zitur et al L OCATION: 7831 - 7833 23rd Ave. N. 7851 - 7853 23rd Ave. N. 2 200 - 2202 Winnetka Ave. N. 2140 - 2142 Winnetka Ave. N. REQUEST: Approval of Preliminary Design Plan for P.U.D. #36 including 8 Townhouse units. C hairman Thompson introduced this agenda item and asked whether Comni ssioners had any questions of staff. Comnissioner Polachek asked why this development is proposed as a PUD at this time and was not submitted as a PUD earlier at the time of construc- tion. Planning and Redevelopment Cordinator Mike Miller replied that the 11? Planning Commission Minutes - August 9, 1982 Page 3 p roponents could have requested a PUD at the time of construction, but it apparently did not occur to either the proponents or staff that it would be a dvisable or advantageous to use the PUD procedu re. Mr. Miller suggested that marketing factors have changed since the development was completed a nd that the proponents naw wish to sell the dwelling units within each double bungalow individually. C hairman Thompson recognized Ms. Donna Zitur and Ms. Mary Weinzierl, who w ere present to represent the proponents. Planning Comnissioners had no q uestions of the proponents. C hairman Thompson opened the informal public hearing for public input. There was no one present who wished to speak on this agenda item, and C hairman Thompson closed the public hearing. C hairman Thompson reviewed the recommended conditions of approval in the s taff recommendation. Concerning the first condition, Mr. Miller ref erred the proponents to Mr. Robert Close, Landscape Architect on retainer with the Ci ty, for advi ce on preparation of a detai led landscape plan for sub- mission with the General Plan of Development and review by the Building Board of Review. Concerning the second condition, the proponents indicated that their attorney is preparing the necessary Homeowners Association docu- m ents and easements. It was moved by Com�nissioner Prazak, seconded by Comnissioner Forster and c arried unanimously to recommend City Council approval of the Preliminary D esign Plan for PUD #36, 23rd and Winnetka, which proposes conversion of four double bungalows to eight individually awned single family d�velling u nits, subject to the following conditions: 1 . Submission of a detailed landscape plan for complete quality landscape t reatment including a planting schedule with the General Plan of Development and approval of the landscape plan by the Building Board of Review and provision of a landscape bond in an amount stipulated by the B uilding Board of Review prior to City Council authorization of signa- ture of the PUD Permi t and Fi nal Plat for PUD #36. 2 . Submission of Homeawners Association Agreements and Bylaws, Driveway Easements, and any appropriate deed restrictions or covenants with the G eneral Plan of Development and approval of these doucments by the City A ttorney prior to City Council approval of the General Plan of Development for PUD #36.
