MINUTES OF THE GOLDEN VALLEY
PLANNING COMMISSION
April 25, 1988
A regular meeting of the Planning Commission was held in the Council Chambers of
the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The meeting
was called to order by Vice Chair McAleese at 7:08 P.M.
Those .present were Commissioners Lewis, McAleese, McCracken-Hunt and Russell.
Commissioners Kapsner, Leppik and Prazak were absent. Also present were Mark
Grimes, Director of Planning and Development, Alda Wilkinson, City Planner, and
Gloria Anderson, Planning Secretary.
I. APPROVAL OF MINUTES - APRIL 11, 1988
It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Lewis, and
carried unanimously to approve the minutes of the April 11, 1988 Planning
Commission meeting.
II. SET DATE FOR INFORMAL PUBLIC HEARING - REZONING
APPLICANT: Teacher Federations Credit Union
LOCATION: Vacant Lot East of and Adjacent to 6500 Olson
Memorial Highway
REQUEST: Rezoning from Open to the Business .and Professional
Offices Zoning District
This agenda item was introduced. by Vice Chair McAleese and reviewed by Director
of Planning and Development Mark Grimes.
It was moved by Commissioner Russell, seconded by Commissioner McCracken-Hunt
and carried unanimously to set an informal hearing date of May 9, 1988 to
consider the request for rezoning of the above described property by the Teacher
Federations Credit Union.
III. INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT
APPLICANT: Mui Li Wan, Inc.
LOCATION: 2300 Nevada Avenue North
REQUEST: Conditional Use Permit to Allow Food Processing
That Involves "cooking, heating, smoking, soaking
or marinating" in an Industrial Zoning District
Vice Chair McAleese introduced the above item and asked fora review of the
staff report. City Planner Alda Wilkinson reviewed the staff report noting that
the site now has a number of non-conformities and the proposed use of the
property would offer an opportunity to improve the property. She stated that
some of the City Staff had visited their present site and that it did not have
any negative effect on the surrounding properties. Ms. Wilkinson stated that
the site plans meet the requirements of the Zoning Code except along the front
of the property and the applicant would be going to the BZA for a variance on

this frontyard setback. Staff recommended approval of this use as it is an
improvement and would make use of a now vacant building.
Commissioner Russell asked how many persons would be employed. Staff stated
approximately 20 to 25 persons would be employed there.
Commissioner Lewis had questions regarding loading docks on two sides of the
building, inside storage of wastes and signage for the property.
City Planner W ilkinson stated that the proponent could later answer the question
on loading docks. She said that all wastes would have to be stored inside the
building until removed from premises and that the existing signage, though
non-conforming, could remain if only the name was changed on the sign. If there
were any alterations or a complete new sign, it would have to meet the City's
sign regulations.
Commissioner Russell asked who was responsible for overseeing removal. of the
underground fuel tanks. City Planner Wilkinson stated it was regulated by the
State and PCA and would be overseen by the City Fire Marshal.
Vice Chair McAleese asked if there was a reason that staff suggested the tanks
be removed no later. than September 30, 1988. City Planner Wilkinson stated that
the tanks should be removed immediately as they had been abandoned for more than
the allowable .period of time.
The proponents, Mr. Ducharme, and Marian Ducharme, President of Mui Li Wan,
Inc a, were present. Mr. Ducharme stated that reading the staff report was the
first he was aware that the underground tanks would have to be removed by a
certain date. Mr. Ducharme also noted that the reason for the two locations for
loading docks is that one was where trucks could be loaded directly from the
freezers.
Vice Chair McAleese stated for the record that he was not surprised that the
underground tanks had to be removed but that such a long .time period was given
for this removal.
Vice Chair McAleese opened the Informal Public Hearing.
Mr. Ivar Sorenson, President of Jacobson Machine Works, 2445 Nevada Avenue,
stated his only concern was with cooking odors but that his questions had been
answered.
Mr. Jeff Bartlett, representing R. L. Johnson Company, 7125 Sandburg Road, had
a question on parking which was answered.
The Informal Public Hearing was closed.
Vice Chair McAleese reviewed with the Planning Commission and for the audience
the ten specific points to be considered when reviewing an application for a
Conditional Use Permit. He noted that staff had prepared a response to each of
these items and found that there would be no ill effects on surrounding properties.

It was moved by Commissioner Russell, seconded by Commissioner McCracken-Hunt
and motion carried unanimously to recommend City Council approval of the
Conditional Use Permit requested by Mui Li Wan, Inc., 2300 Nevada Avenue North,
subject to the following conditions:
1. The site shall conform to the Site Plan, Sheet L1, prepared by Damon Farber
Associates, dated April 7, 1988, and revised April 8, 1988 and April 18, 1988.
2. All green areas adjacent to parking and drive shall be protected by concrete
.curb as required by the City Zoning Code.
3. Landscaped front yard along Nevada Avenue North shall meet the 35 foot
landscaped setback required by the City Zoning Code unless a variance is
granted by the City Board of Zoning Appeals (BZA).
4. Abandoned underground fuel storage tanks shall be removed in accordance with
Uniform Fire Code Section 79.133 and in accordance with direction from the
City Fire Marshal.
5. Site improvements indicated on the approved Site Plan, Sheet L1, prepared by
Damon Farber Associates, dated April 7, 1988, and revised April 8 and April
18, 1988, shall be completed no later than November 1, 1989.
6. One or more financial guarantees in amounts or a total amount approved by
the City Engineer and City Building Official shall be provided to guarantee
removal of the underground fuel storage tanks and installation of all site
improvements, including asphalt paving, concrete curb and landscaping. A
financial guarantee in an amount to cover the landscaping shall run for two
(2) full growing seasons after installation of landscaping materials and
until released by the Golden Valley Inspection Department. The financial
guarantee(s) shall be delivered to the City of Golden Valley Inspection
Department prior to issuance of any permits.
7. All waste generated by the occupancy shall be store internally until removed
from the premises.
8. The site shall meet all requirements and recommendations of the City Fire
Marshal, City Engineer, City Sanitarian, and City Building Official.
9. Any failure to comply with one or more of the conditions of approval shall
be grounds for revocation of the conditional use permit.
IV. INFORMAL PUBLIC HEARING - PLAT OF VALLEY SQUARE THIRD ADDITION
APPLICANT: City of Golden Valley
LOCATION: Golden Valley Road Between Winnetka Avenue North
and Wisconsin Avenue North
REQUEST: Approval of the Preliminary Plat of Valley Square

The above item was introduced by Vice Chair McAleese and reviewed by Director
Grimes. He explained that the City had purchased property for the new Golden
Valley Road and also made some exchanges with the Super Valu and Bank. The
results were a number of small parcels which have now been replatted to make a
simple legal description.
Vice Chair McAleese opened in the Informal Public Hearing. Hearing and. seeing
now one, the Informal Public Hearing was closed.
It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Russell,
and carried unanimously to recommend City Council approval of the Preliminary
Plat of Valley Square 3rd Addition.
V. INFORMAL PUBLIC HEARING - PLAT OF GOLDEN VALLEY CIVIC CENTER.
APPLICANT: City of Golden Valley
LOCATION: 7800 Golden Valley Road
REQUEST: Approval of the Preliminary Plat of Golden Valley
Civic Center
The above item was introduced by Vice Chair McAleese and reviewed by Director
Grimes. Director Grimes stated that the purpose of this plat was to combine the
City owned property in the Civic Center block area into one parcel to simplify
the legal description.
Vice Chair McAleese opened in the Informal Public Hearing. Hearing and seeing
now one, the Informal Public Hearing was closed.
It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Russell,
and. carried unanimously to recommend City Council approval of the Preliminary
Plat of Golden Valley Civic Center.
VI. REPORT ON HRA, BZA AND CITY COUNCIL MEETINGS
Vice Chair McAleese provided a report on the April. 12, 1988. meeting of the Board
of Zoning Appeals. Commissioner McCracken-Hunt stated she did not attend the
April 12, 1988 HRA meeting. Commissioner Kapsner represented the Planning
Commission at the April l9, 1988 City Council meeting but was .not present to
provide a report.
