MINUTES OF THE GOLDEN VALLEY
PLANNING COMMTSSION
June 27, 1988
A regular meeting of the Planning Commission was held in the Council Chambers of
the Civic Center, 7800 Golden Valley Road, Golden Valley, Minnesota. The. meeting
was called to order by Chair Prazak at 7:05 P.M.
Those present were Commissioners Kapsner, Leppik, Lewis, McAleese, McCracken-Hunt,
Prazak and Russell. Also present were Mark Grimes, Director of Planning and
Development, and Gloria Anderson, Planning Secretary.
I. APPROVAL OF MINUTES - JUNE 13, 1988
It was moved by Commissioner Kapsner, seconded by Commissioner Leppik, and carried
unanimously to approve the minutes of the June 13, 1988 Planning Commission
meeting.
II. SET-DATE FOR INFORMAL PUBLIC HEARING - PLAT PETITION
APPLICANT: City of Golden Valley
LOCATION: Between Sunset Ridge and Ravine Trail
REQUEST: Approval of the Preliminary Plat of North
Tyrol Park
This item was introduced by Chair Prazak and reviewed by Director Grimes. The
Planning Commission seta date of July 11, 1988 for an Informal Public Hearing
to consider the preliminary plat of North Tyrol Park.
III. SET :DATE FOR INFORMAL PUBLIC HEARING - PLAT PETITION
APPLICANT: Dean Franssell
LOCATION: 1510 Kelly Drive
REQUEST: Approval of the Preliminary Plat of Franssell
Addition Which Divides the Property at 1510 Kelly
Drive Into. Two Single-Family Residential Lots
Director Grimes added this request fora preliminary plat approval which
proposes to divide the property at 1510 .Kelly Drive into two single-family
residential lots. The Planning Commission seta date of July 11, 1988 for an
Informal Public Hearing to consider the preliminary plat of Franssell Addition.

IV. SET DATE FOR INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT
APPLICANT: Avis Rent A Car System, Inc.
LOCATION: 9010 Olson Memorial Highway
REQUEST: Approval of a Conditional Use Permit to Allow for
the Operation of an Outdoor Used Car Sales Lot in a
Commercial Zoning District
Director Grimes also added this item to the Agenda and briefly reviewed the
request by Avis Rent A Car System, Inc. to operate an outdoor used car sales lot
in a Commercial Zoning District. The Planning Commission set an informal. public
hearing date of July 11, 1988 for consideration of this conditional use permit
request by Avis Rent A Car System, Inc.
V. INFORMAL PUBLIC HEARING - CONDITIONAL USE PERMIT
APPLICANT: Valley Community Presbyterian Church
LOCATION: 3100 North Lilac Drive
REQUEST: Conditional Use Permit to Allow Day Care in an
Institutional Zoning District

Chair Prazak introduced the .above item. Director Grimes reviewed the staff
report on the request by the Valley Community Presbyterian Church for a
Conditional. Use Permit to allow day care in their church building in an
Institutional Zoning District. Director Grimes noted they would be licensed by
the State to care .for 60 children, infants to preschool age. The hours of
operation would be 6:30 a.m. to 6:30 p.m. five-days a week. He noted there
would be an increase in traffic during the peak drop off hours in the morning.
and again when the children are picked up in the evening but`that it would not
have a negative effect on the area. Director Grimes indicated that the city
encourages additional day care as there is a need. for it in Golden Valley.
Mr. Norman Baer was present to represent the proponent. He stated he was the
Chair of the Board set up by the church to organize and operate the day care.
Also present was Ann Johnson, hired as Director of the day care center.
Commissioners asked if there was an outdoor play area. Mr. Baer said there
would be a fenced in play area at the southeast corner of the church building.
Commissioner Leppik asked if the day care would be open to the public or church
only and if it would be self-supporting.

Mr. Baer said the day care center was open to the general public. He also
stated that hopefully the day care center would be self-supporting in time but
presently it is being subsidized by the church.
Chair Prazak-opened the informal public hearing.
Jeanne Lies, 5320 Triton Drive, stated she was glad to see a day care center but
had concerns about the maintenance of the grounds, traffic and noise from
children playing outside.
Mr. Baer explained that the majority of the children would be infants and
toddlers and. would not be outside. He stated he would take her concerns
regarding maintenance of the grounds back to the proper persons at the church.
The informal public hearing was closed.
Chair Prazak said the proposal seemed reasonable to him.
Commissioner Lewis said she felt there certainly is a need for additional day
care in Golden Valley.
Commissioner Kapsner stated he felt church buildings were generally under
utilized and that day care would be a good use.
It was moved by Commissioner Russell, second ed by Commissioner McCracken-Hunt
and motion carried unanimously to recommend City Council approval of the request
by Valley Community Presbyterian Church for a con ditional use permit to operate
a day care center in their building at 3100 North Lilac Drive subject to the
following conditions:
1. The site and building plans submitted with the application be made a
part of the conditional use permit.
2. The operation receives all other necessary permits from the State and
Golden Valley before operation begins.
3. The day care center shall be limited to 60 children.
4. Any failure to comply with one or more of the conditions of approval
shall be grounds for revocation of the conditional use permit.
VI. AMENDMENT TO THE ZONING CODE
Director Grimes introduced a request by Greg Malik for an amendment to the
Zoning Code which would allow marine engine repair as a conditional use in a
Commercial Zoning District.

After discussion, the consensus of the Commissioners was that marine engine
repair should be included as a conditional use in the Commercial Zoning
District. Commissioner McAleese stated he felt the City should not change the
code as the City has more discretion denying this zoning change than it would
denying a conditional use permit. More importantly, he saw no compelling basis
for changing the Zoning Code, especially since only one party has ever expressed
an interest in commercial marine engine repair operations, and that party.-
-despite notice - did not attend the informal public hearing to express his
views.
Other Commissioners felt that any conditional use would still have to meet the
criteria of a conditional use permit and all setbacks and other City
regulations.
It was moved by Commissioner McCracken-Hunt, seconded by Commissioner Russell
and motion carried on a vote of 6 - 1 to recommend City Council approval of an
amendment to the Zoning Code to allow for marine engine repair as a conditional
use in the Commercial Zoning District.
VII. REPORT ON HRA, BZA AND CITY COUNCIL MEETINGS
Commissioners provided reports on HRA, BZA and City Council meetings which they
had attended over the past month.
