02-08-93 PC Minutes MINUTES OF THE GOLDEN VALLEY PLANNING COMMISSION February 8, 1993 A regular meeting of the Planning Commission was held at the Golden Valley City .Hall, Council Chamber, 7800 Golden Valley Road, Golden Valley, Minnesota. The meeting was called to order by Chair McAleese at 7:05 PM. Those present were Commissioners Groger, Johnson, Kapsner, Lewis, McAleese, and Prazak; absent was Pentel. Also present were Mark Grimes, Director of Planning and Development; Beth Knoblauch, City Planner and Mary Dold, Secretary. I. Approval of Minutes - January 11, 1993 MOVED by Prazak, seconded by Johnson and motion carried unanimously to approve the January 11, 1993 minutes as submitted. II. Informal Public Hearin - Amendment to Zonin Code, Deletin Sec. 11.41 Rai road Zoning District in its Entirety Beth Knoblauch, City Planner, gave a brief summary of her memo, dated February 2nd, to the Planning Commission commenting that most of the rail road property in the City has never been placed under the Railroad Zoning designation. Railroads are basic rights-of-way like roads and highways. Because they are not publicly owned, however, the City has to considered them as Open Development. She also commented that the "Official Zoning Map" lumps Radio and Railroad under one pat- . tern on the map. Staff sees no rami-fications by deleting the railroad district from the zoning chapter of the City Code. Commissioner Groger asked if existing railroads would then have other zoning. Ms. Knoblauch commented that the railroads are like streets and highways; they are right-of-ways and will be considered open development. If the owner of a of railroad property sold off this property, the new owner would then have to come to the City and have this parcel rezoned. Chair McAleese opened the informal public hearing; hearing and seeing no one he closed the informal public hearing. MOVED by Kapsner, seconded by Groger and motion carried unanimously to recommend to the City Council approval of the amendment to the Zoning Code, deleting Sec. 11.41 "Railroad Zoning District" in its entirety. III. Informal Public Hearing - Amendments to Sec. 11.11 of Citv Code to Adoot a New Official Zoning Map Beth Knoblauch, City Planner, gave a summary of her memo, dated February 2nd, to the Planning Commission. She stated there were no changes to .the text of the Zoning Code and to get the current date on the zoning map Sec. 11.11, Subd. 1 should be deleted from the Zoning Code and then re-adopted. Ms. Knoblauch presented to the Commission a large, color-coded zoning map show- ing the zoning changes that staff is requesting. She reviewed the different properties involved, ie. City-owned, churches, schools and businesses. The Minutes of the Golden Valley Planning Commission February 8, 1993 Page Two reason for updating the map is to correct discrepancies. Three forms of discre- pancies have been identified by staff: areas where the zoning as shown on the existing map does not correspond with the record of zoning ordinances; areas where the zoning designation is generally correct but does not correspond with current property lines; and areas where the zoning designation is in conformance with the record of zoning ordinances but conflicts with existing development. There was some discussion regarding P.U.D.'s. All P.U.D.'s would now be zoned as a P.U.D. and would have a single underlying zoning district designation con- sistent with their use. The zoning map shows both the P.U.D. and actual type of development which is confusing when there is more than one development. This will not hurt the accuracy of the zoning map because the P.U.D. takes precedence over the zoning. All permanent, institutional property will be given the appropriate institu- tional zoning designation. Most of these properties are. City-owned. This change should make it easier for people looking for vacant lots to find them. Miscellaneous zoning changes will be made to correct discrepancies which are stated above. An example of such a change would be the NE corner of the Honey- well property where the zoning map. shows this .corner of land being commercial. At one time a gas station was located on this site but today the area is green space and shows no outline of being commercial. Staff finds it appropriate to change the commercial zoning to industrial as exists with the rest of the property. Commissioner Lewis and Chair McAleese were very concerned that notices were not sent to property owners where a change in zoning would affect their property. Staff felt that this updating of the Zoning Map. would benefit those owners by bringing their property into conformance and an individual notice would not be needed. A legal notice will be sent to the City newspaper as required for a Public Hearing.. Lewis and McAleese continued to show support for an individual notice being sent to property owners for the upcoming City Council meeting. Mark Grimes, Director of Planning and Development, said that he would call those people whose property changed significantly. Lewis and McAleese accepted this suggestion. Chair McAleese opened the informal public hearing; seeing and hearing no one he closed the informal public hearing. MOVED by Lewis, seconded by Groger and motion carried unanimously to recommend to the City Council approval of the Amendments to Sec. 11.11. of the City Code to Adopt a new Official Zoning Map with the condition that staff would notify several of the property owners whose land would be involved in this zoning change. IV. Reports on Meetings of the Housing and Redevelopment Authority, City Council and Board of Zoning Appeals No reports were given. Other Business Secretary Mary Dold asked Chair McAlee se if he would like to review the normally scheduled review of attendance at the 2nd meeting of February to the 1st meeting of March due to the lack of an agenda. Chair McAleese agreed to have the review of attendance at the March 8th meeting of the Planning Commission. VI.
