Sprint Lease Agreement Sprint is terminating its lease agreement as of September 30, 2012, and wants to leave its equipment on the New Hope tower. Verizon Wireless is proposing to install an antenna on the Golden Valley water tower and build a storage building near the tower. Golden Valley staff is currently reviewing the site plan. 2. Lead Detection Survey Project. Water Conservation Service (WCS), project contractor, has completed its survey in Crystal and has surveyed about half of New Hope. The contractor is intending to provide a preliminary report for the August meeting. WCS will eventually want to discuss the survey with each city. 3. Clancy reported that a conference call is scheduled on FrlSd ,July 13, 2012, with Scott Harder to discuss the Minneapolis-JWC metering jet epancy. Below is an excerpt of the discussion from the June 6 meeting minutes: Leak Detection Contract The contract was sent to Water Conservation Service, Inc. (WCS) for signature. The anticipated project start-up is June 18. Mathisen added that leaks will most likely be found; however, the TAC has not discussed how leakages will be addressed. Once all the leaks have been identified, the TAC will be able to do a cost estimate analysis. WCS will be surveying the entire system and the cost will be per hydrant. Tracy will confirm that WSC will provide a hydrant overlay for the JWC when the survey is completed. Based upon the record above, public works staff requested that the agreement be signed. However, since formal action was not taken, it is suggested that the agreement be placed on the August 1, 2012 meeting to be ratified. The joint water system leak detection survey was discussed during previous Joint Water Recommendation Ratify the contract with Water Conservation Service, Inc. for a JWC leak detection survey in the Cities of Crystal, New Hope, and Golden Valley in the amount of $13,836. Attachments Contract for Joint Water Commission 2012 Watermain Leak Detection Survey GABert Tracy\JWC Documents\Memos\Leak Detection 2012.docx CONTRACT FOR JOINT WATER COMMISSION 2012 WATERMAIN LEAK DETECTION SURVEY THIS AGREEMENT, entered into the 14-�daY of �u °� , 2012 between the Joint Water Commission; Cities of Crystal, Golden Valley and New Hope, a joint powers organization, pursuant to Minnesota Statute 471.57, hereinafter referred to as the JWC, party of the First Part, and Water Conservation Services, Inc., a corporation under the laws of the State of Minnesota, hereinafter called the Contractor, party of the Second Part. ARTICLE 1. The Contractor, for and in consideration of one dollar and other good and valuable consideration received including the payment, or payments herein specified, and by the JWC to be made, hereby covenants and agrees to furnish all materials, all necessary tools and equipment, and to do and perform all the work and labor necessary for the 2012 Watermain Leak Detection Survey project according to the Contractor's Proposal included as Exhibit A. The Proposal of the Contractor, together with this Contract, shall together constitute the Contract Documents, and herein are referred to as the Contract Documents. ARTICLE 2. The Contractor agrees to commence said work and conclude the same in accordance with the Proposal heretofore filed with the JWC and in accordance with the time schedule for commencement and completion of the work set forth in the Contract Documents, time being of the essence of this agreement, and to complete said work in every respect to the satisfaction and approval of the JWC by August 31, 2012. ARTICLE 3. In consideration of the covenants and agreements stated above, the JWC agrees to pay the Contractor the sum stated in the Proposal of said Contractor. Upon completion of the scope of work, the Contractor shall submit invoice to the JWC for the work performed. Invoice shall be submitted to Bert Tracy, Public Works Department, City of Golden Valley, 7800 Golden Valley Road, Golden Valley, MN 55427. ARTICLE 4. The Contractor agrees to hold harmless, indemnify and defend the JWC, their elected officials, officers, agents, and employees against any and all claims, losses, or damages, including attorneys' fees, arising from, allegedly arising from, or related to, the provision of services under this agreement by the Contractor, its employees, agents or officers. ARTICLE 5. All policies and certificates shall provide that the policies shall remain in force and effect throughout the term of the Contract, or in lieu thereof, the Contractor shall keep such policies in full force and effect throughout the term of the Contract. ARTICLE 6. It is understood and agreed by the Contractor that the JWC, through its authorized agents shall be the sole and final judge of the fitness of the work and its acceptability, and no payment shall be made to the Contractor hereunder until the work shall have been found acceptable by the JWC through its authorized agents. It is understood and agreed by the Contractor that, with respect to all work, the Contractor will keep as complete, exact and accurate an account of the labor and materials used as is possible, and in submitting the final statement will itemize and allocate the costs of said work. ARTICLE 8. All payments to the Contractor shall be made payable to the order of Water Conservation Service, Inc. and the JWC does not assume and shall not have any responsibility for the allocation of payments or obligations of the Contractor to third parties. ARTICLE 9. The JWC reserves the right to cancel the award of any contract at any time before the execution of the contract by all parties without any liability against the JWC. ARTICLE 10. The JWC may by written notice terminate the Contract or any portion thereof when it is deemed in the JWC's best interest to do so or the JWC is unable to adequately fund payment for the Contract because of changes in state fiscal policy, regulations or law; or after finding that for reasons beyond the Contractor's control the Contractor is prevented from proceeding with or completing the Contract work within a reasonable period of time. In the event that any work is terminated under the provisions hereof, all completed items or units of work will be paid in accordance with the procedure on attached Exhibit A and as otherwise mutually agreed to. Termination of the Contract or any portion thereof shall not relieve the Contractor of responsibility for the completed work, nor shall it relieve the Contractor's Sureties of their obligations for and concerning any just claims arising out of the work performed. Below are the terms and conditions for the project. At the cities discretion, they can elect to do all or a portion of each proposed section. Section I This section details the work to be performed by Water Conservation Services (WCS) as well as the Joint Water Commissions responsibilities' for the project. Detailed and accurate maps showing all of the *hydrant locations, of the chosen project areas, will be provided to Water Conservation Services (WCS) before any work is to be performed by WCS. It is the sole responsibility of the Joint Water Commission to provide accurate maps and to specify what areas and hydrants are to be included in this project. *ANY HYDRANT THAT IS FOUND IN THE PROJECT AREA AND NOT SHOWN ON THE PROVIDED MAPS WILL BE SOUNDED FOR LEAKAGE AND AN ADDITIONAL CHARGE OF $10 WILL BE ADDED TO THE AGREED UPON CONTRACT PRICE FOR EACH ADDITIONAL HYDRANT. The Water System Survey will include: I. Listening to each hydrant in the area that is specified by the city, be it a Full, Half or Quarter System Survey. 2. Doing preliminary correlating in each area that is identified as having sounds of leakage. 3. A "Preliminary Water System Leak Report" will be sent to the city identifying the areas that have the possibility of leakage. WCS will need to have more specific information of curb stops, valves, and main line locations researched by the city for more accurate correlations to be performed at a later date. Curb stops and valves must be exposed and accessible. 4. After the city has gathered all of the pertinent information the city will set a date to meet with WCS to do the final correlations to pinpoint the areas of leakage. 5. A "Final Water System Leak Report" will then be sent to the city identifying all of the locations of leakage that are currently on the system and need to be addressed for corrections. Section II This section details the cost of having a water system survey performed. All prices are based on the total number of hydrants stated by the city. The Joint Water Commission has stated that they have a total of 3,027 *Hydrants and 0 "Valves/Curb Stops to be included in the water system survey. All of the numbers in this section will be reflected using the number of hydrants & valves stated by the city. Total cost of the water system survey is subject to change based on the city's accuracy in regards to the total number of hydrants to be surveyed during this project. Total cost: 0 Full System Survey of all 3 cities = $14,565 — 5% (discount) = $13.836 * Hydrants that are found in the project area and not shown on the provided maps, will be sounded for leakage and an additional charge of $10 will be added to the agreed upon contract price for each additional hydrant. **Valves/Curb Stops will only be sounded when there are plastic main lines included in the project area. The new total cost of this project following completion of the final design is as follows: Design Cost $49,698 Special Inspection Cost $3,000 Construction/Demolition Cost $664,825 Total Estimated Project Cost $717,523 Reasons for the increase in cost include: 1. Increased lengths of straight length pipe added between the meters to improve metering accuracy. This increased the overall vault size as well. 2. Improvements to the metering system to add piping/valve redundancy to the metering vault to prevent future maintenance from taking the vault out of service. 3. The addition of a 24 -inch stub outside of the vault structure for future connection to an emergency well system (if installed). 4. Cost needed to demolish the existing metering vault and discharge meter pit (approximately $80,000). 5. Additional improvements made to the entire system to ensure longevity and workability within the system to provide extended project life. Golden Valley staff has been involved in discussions with the City of Minneapolis to see if they are still on board with financing this project at 50% as originally committed. The City of Minneapolis G:\PROJECTS\JWC Water Meter Improvements (12-30)\Memos\Cost Overruns.docx has verbally committed to financing this project at 50% following final design as long as the JWC picks up the demolition costs at 100%. The JWC's share of this project will be $400,000. An estimate of the engineer's probable construction cost is attached for your review. Requested Action: Approve the project under its current scope and revise the budget to meet $400,000 so that the project can go out for bid.
