PARK BOARD
VILLAGE OF GOLDEN VALLEY
July 14, 1948
The Parr: Board of the Village of Golden Valley met in regular meeting ROLL CALL
at the Villase Hall at 9:00 P.M. on July 14, 1943. In attendance
were: Mrs. Seeman, Moes, and Mrs. Arms.
The minutes of the last meeting were approved as read.
MINUTES
The Secretary read correspondence from the `tillage Clerk enclosing CORRESPONDENCE
a copy of the 'rilla,;e Council's resolution creating, this Park Board. FROM VILLAGE
The resolution is attached to and Trade a part of these minutes. The CLERK
correspondence quoted the Council's resolution appointing current
Park Commissioners and stated that $ 500 had been voted for their use.
Correspondence from Morell and Nichols, Consulting Engineers for the PARK LANDS
Villabe of Golden Valley, described park lands in the Village and
included the enclosure of Village maps showing those lands.
Correspondence from Stanley Kane, Village Attorney, indicated that POWERS AND
the powers and duties of the Park Board are not established by the DUTIES
Council, but are set .forth in the statute under which the Board was
created. A copy of that statute was enclosed and is attached�to and
made a part of these minutes.
Discussion of the a?)ove correspondence emphasized that the Board
lacked concrete information pertaining to its powers to assess for
park improvements and the question of whether property title for
park lands rests with the Council or this Board.
Correspondence from the Chester Bird American Legion Post 523 set
forth the conditions under which they would be able to financially
support the proposed park on Belmont Avenue. The Secretary was
directed to reply and to point out that this Board finds itself
unable to legally comply with these conditions.
Discussion of Belmont Park area indicated the advisability for
early development. The Vice President was requested to obtain the
following information:
1. The availability of free use of Villa;e equipment
and the 'Tillage Engineer to grade the Belmont area.
The Board agreed that it was willing to pay for the
time of the equipment operators during such work.
2. Determine by interview with the Villabe Attorney
whether this Board has the authority to assess
properties for improvements.
3. Arrange with the Park Board of Minneapolis for one
of their park planners to accompany this Board on a
tour of the Belmont area for the purpose of obtaining
their recommendations for its development.

The Secretary was directed to correspond with the Commissioner HIGHIRAY DEPARTMENT
of Highways inquiring about their plans for future use of PROPERTY
gravel pit property located on the west side of Lilac Drive
and North of Medicine Lake Road.
The President recommended that action be taken to empower BOULEVARD TREES
this Board to regulate the planting of trees on future
boulevard property between streets and their sidewalks in the
Village. The matter was tabled for future discussion.
The Vice President was directed to request the Minneapolis PLAYGROUNDS
Park Board to develop the park properties just east of South
Tyrol Hills and Valley View Park as playground areas. He was
further requested to determine the method by which the Minne-
apolis Park Board assesses properties for park development.

BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE, VILLAGE
OF GOLDEN VALLEY: That the Village of Golden Valley
expressly accept the provisions of Sections 448.43 to
448.48 Minreeota Statutes Ann--t--ted and the acts amendatory
thereof creating w park board in and for swid Village as
provided in said sections.
The eaid board shall consist of three members !.ppointed
by the president of the Villa -e Council and confirmed by
the Village Council. .`.hen tho board is first appointed
one member shall be appointed for one year, his term to
expire December 31, 1943, one for two years, hie term to
expire December 31., 1949, ane one for three years, his
term to expire December 31, 1950; thereafter all Eppointments
shall be for three -y-: ar terms.
RESOLVED, further, That the board Aen created here-
under shall be known as the Park Board of the Village of
Golden Valley and shall have all the pc.:rere over the
management, control and operetion of all real esta,t now
o.onad or her -,after acquired for park or boulevard purposes
as authorized under the statutes aforeeFid.

The park board shall- consist of three members and shall be appointed by the mayor
of the city or president of the village co.mcil and confirmed by the coimcll of
the city or village; and when first created one shall be appointed .for the term
of one year, one for the term of tyro years, and one for the term of three years,
and these members shall hold their off!ces for the term of three gears and. -:ntil
their successors are appointed and qualified; and each member so appointed shall
� qualify with "-n ten days after notification of hiis appointment by subscribing an
oath that he will faithfully and impartially perform the duties of his o ^f:i ce, and
shall file his oath in the office of the village recorder or the clerk, as the case
may be. There shall be appointed each year thereafter by the council one member
of the board whose tern of office shall be three years, and each member (f the board
shall be president thereof duxinm the last year of the tens for which he is appointed.

The park board shall have full, absolute, and exclusive control of, and poimr over,
all real estate now or hereafter acquired by the municipality and set apart for
park or boulevard purposes therein or in adjoining territory, and all public property
used therein or therefor. The board shall have power and awithority to maintain
the same, and to beautify and improve any and all such lands and the approaches
thereto for the benefit of the general public; to erect and construct therein such
roadways, paths, buildings, fountains, toilet rooms, and other imnrovenents necess—
ary to meet the requirements of the visiting public; to bu all necessa7 material
and fuel required to carry out the proVLsions of sections K48.!.43 to 448.48, to
make reasonable rules and remlations for the government of the same as are necess—
ary and proper; to employ such help in and about the conduct of the parks and boule—
vards as may be necessary; to provide musical and other free entertainment .for the
Ueneral public; to employ a secretary, at a salary not exceeding x"500 per annum,
whose duty it shall be to keep a full and cormiete record of all transactions of
the board, attend its meetings, and do and perform any other duties as may from
time to time be required of him by the board; to ermloy an attorney if found necess—
ary to assist the board at a salary* of not exceeding 1; 00 per annum; to fix the
compensation of any and all persons employed by the board; to audit and allotr all
just claims for labor, services, or material furnished by order of the board, and
endorse its approval of such claims thereon when allowed, which claims when so audited
and allowed and endorsed shall be presented to the council of the municipality for
payment and paid by the municipality as other claims are paid; provided, the board
shall not have the right to sell, rent, lease, or in any other way dispose of or
encumber, or suffer, or permit the property, or any part thereof, to come under
the control of any other person or. corporation whatever. 'Where the park shall contain
a pond or lake or other body of grater which can be used for the purpose of taking
therefrom ice, the park board shall ha?re the rower to lease the pond or lake or other
body of water which the park may contain for the purpose of takinT therefrom ice.
The board shall also have power and authority to receive on behalf of the municipality
any proper donations of statutory, shrubbery, trees, material, or other personal
property for use in and about the parks and boulevards. The board shall make detailed
report of all its doings and proceedings to the council at least once in three months.

448,47 COMPENSATION OF MEIME&S
The members of the board shall serve without compensation except as may be provided
by the council of the municipality, which shall in no case fix any greater compensation
for service of each member than $100 per annum, which salary, if any be allowed,
shall be paid by the municipality as other claims are paid by it; and nothing in
sections 448.43 to 448.48 shall be construed so as to prevent any person from holding
membership in the board, and also in the light, water, and power corrrdss=_on.
148,48 PROVISIONS, HCYff AVAILF) OF
Any city or village which may wish to avail itself of the provisions of sections
448.43 to 448.47, shall do so by resolution of its council expressly accepting
the provisions thereof, which resolution shall be adopted by a majority of all the
members of the council and approved by its presiding officer, and those sections
shall not apply to any city or village until the adoption of that resolution, and
shall not be construed as in any manner superseding, repealing, amending, or
qualifying the provisions of any home rule charter heretofore adopted by any city
or village under the laws of this state, and shall not in any manner apply thereto.
