First Consideration - Ordinance #490 - Establishing A 2013 Master Fee Schedule Prepared By Sue Virnig, Finance Director Summary Staff reviewed the upcoming master fee schedule with Council at the Council/Manager meeting on November 13. The schedule shows the approved rates for 2012 and the proposed rates change for 2013. The utility Rates will be effective for any billing after April 1, 2013. ORDINANCE NO. 490, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Establishing A 2013 Master Fee Schedule The City Council for the City of Golden Valley hereby ordains: Section 1. The City Code requires that certain fees for City services and licenses be established from time to time by the City Council. Section 2. The Master Fee Schedule attached hereto as Exhibit A is hereby adopted as the city's fee schedule effective January 1, 2013, unless otherwise noted and shall be added to Chapter 25 of the City Code. Section 3. City Code Chapter 1 entitled "General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violation" is hereby adopted in its entirety, by reference, as though repeated verbatim herein. Mandatory State Surcharge: per permit is a minimum of .50 and when a permit fee is over $1,000 in value the state surcharge is .0005 times the permit value. Surcharge is remitted to MN State Treasurer. Permit Cancellation Policy: 80% of the permit fee will be returned upon written notice of cancellation. If job has been started no refund will be made. No surcharge or plan review fees will be returned (includes the fees for stormwater management, right-of-way (ROW) and tree preservation permits). Authorization to Sign Amended PUD Permit - Meadowbrook School PUD No. 90 - Amendment No. 2 Prepared By Joe Hogeboom, City Planner Summary Hopkins Independent School District 270 has requested a Minor PUD Amendment to allow for an expansion to its parking lot and an enhancement to its student drop-off and pick-up area. PUD No. 90 was adopted by the City Council on December 19, 2000. The PUD was established to allow the City and the School District to build the Davis Community Center following the relocation of Turner's Crossroad and Xenia Avenue. The first amendment to the PUD was approved in May, 2012 to allow a small addition to the building. Because Meadowbrook School is guided by a PUD, all development within the property must be consistent with the PUD permit and the plans attached to the PUD permit. The current PUD plans do not reflect the proposed parking lot addition, so they must be amended. Staff has determined that the proposed amendment may be considered as a minor amendment to the PUD. In order to qualify as a minor amendment, the minor amendment has to meet an eight point test. The proposed amendment meets the test. The proposed minor amendment shall not: 1. Eliminate, diminish or be disruptive to the preservation and protection of sensitive site features. 2. Eliminate, diminish or compromise the high quality of site planning, design, landscaping or building materials. 3. Alter significantly the location of buildings, parking areas or roads. 4. Increase or decrease the number of residential dwelling units by more than five percent. 5. Increase the gross floor area of non-residential buildings by more than three percent or increase the gross floor area of any individual building by more than five percent. 6. Increase the number of stories of any building. 7. Decrease the amount of open space by more than three percent or alter it in such a way as to change its original design or intended function or use. 8. Create non-compliance with any special condition attached to the approval of the Final PUD Plan. The City Council has the right to approve the amendment by a simple majority vote without a public hearing or to refer the matter to the Planning Commission for their input and recommendation. Because of the minor impact of this proposal, staff does not think it necessary to have Planning Commission or public input. The plans propose modification of the existing west parking lot and pedestrian system which serve the elementary school and community center. The comments contained in this review are based on the plans submitted to the City on October 22, 2012. Site Plan and Access The proposed modifications to the west parking lot include widening the south driveway access onto Xenia Avenue North and expanding the student drop-off area on the west side of the parking lot. The south driveway access is proposed to be widened and striped to accommodate three lanes of traffic; one for ingress and two for egress (left turn and right turn). The widening of the south driveway access is mostly internal to the site and will not impact Xenia Avenue or the City's existing sidewalk. The west side of the parking lot is proposed to be expanded and striped to create two lanes of one-way traffic through the student drop-off area. Although staff has concerns about safety and driver behavior with the two-lane configuration, it finds the plans to be acceptable as proposed. A new sidewalk will be installed around the expanded drop-off area and will connect to the west building entrance, the playground area, and the City's existing sidewalk along Xenia Avenue. The City recommends that the connection to the City's sidewalk on Xenia be moved south to follow the "cow path" created by existing foot traffic. All new pedestrian facilities must meet Americans GADevelopments - Private\Meadowbrook School PUD Anne ndment\Meadowbrook - Minor PUD review_11-14.docx with Disabilities Act (ADA) accessibility standards. In addition, all new sidewalks constructed as part of this project will be owned and maintained by Hopkins Schools. Installation of the new sidewalk will require the construction of a modular block retaining wall approximately 50 feet long in the City's right-of-way, immediately adjacent to the City's sidewalk on Xenia Avenue. It is not anticipated that the block wall will impact the City's sidewalk maintenance efforts. A Right -of -Way Management permit is required for the construction of the wall and, as a condition of the permit, the wall will be permanently owned and maintained by Hopkins Schools, Sanitary Sewer Inflow and Infiltration Reduction The City has an Inflow and Infiltration (1/1) Ordinance that requires the sanitary sewer service to be brought into compliance when a planning action such as a PUD Amendment is requested by the owner. Hopkins Schools is currently working with the City to inspect and address the 1/1 issues present in its sanitary sewer system. Stormwater Management The proposed project is subject to the City's Stormwater Management Ordinance. A City Stormwater Management permit is required for the land disturbance. Storm water runoff from the parking lot currently drains into a storm sewer system owned by the school. This system includes an existing environmental manhole north of the driveway access that treats the runoff from the parking lot. The engineer retained by Hopkins Schools must provide calculations which show that runoff from the increased impervious surface can be accommodated by the environmental manhole. Tree Preservation and Landscaping This project is exempt from the City's Tree Preservation Ordinance and does not require a Tree Preservation permit. However, this development is a PUD which includes tree and landscaping standards as part of the PUD permit. Since the proposed plans show the removal of trees and landscaping, the PUD permit will need to be reviewed to determine what replacement, if any, may be required. Summary and Recommendations: Public Works staff recommends approval of the proposed Minor PUD Amendment to modify the existing parking lot subject to the comments contained in this review. These comments are summarized as follows: 1. A Right -of -Way Management permit is required for the construction of the block retaining wall and, as a condition of the permit, the wall will be permanently owned and maintained by Hopkins Schools. 2. Hopkins Schools must continue to work with the City and show progress towards compliance with the City's Inflow and Infiltration Ordinance.
