Chair Kluchka called the meeting to order at 7 pm. Those present were Planning Commissioners Boudreau-Landis, Cera, Kluchka, McCarty and Segelbaum. Angell stated that tl� applicaii�t,is proposing to construct a Culver's Restaurant at 8851 7tn Avenue North. He explairt�c! tha�the applicant would like to operate a drive-thru window which requires a,Condi#ional U�e Permit. He noted that the proposed restaurant will be 4,300 square feefi:in siz�.with an 807 square foot patio and the ability to seat 126 customers?�J��l�.,�,efer�l to�� photo of the site and said that there will be 64 parking spaces. He add�d tf��t�f�i������tj��is zoned properly and designated properly on the General Land Use Plan map for this use and staff is recommending approval of the requested Canditional Use per.mit. Segelbaum referred to the number of parking spaces and asked if staff believes that 64 spaces will be sufficient. Grimes stated that Culver's is kind of a hybrid restaurant in that approximately half of their business will be a sit-down type of restaurant, and not strictly a fast food type of restaurant so staff is comfortable with 64 parking spaces. Segelbaum asked how the parking for this site would compare to a different type of restaurant. Grimes said a typical fast food restaurant would require more parking spaces. He added that staff's goal is to not have to pave areas any more than necessary for parking and to keep parking at a reasonable amount. McCarty referred to the analysis factor regarding the effect on traffic and stated that it seems like there will be more traffic as a result of this use than the property's current use. Minutes of the Golden Valley Planning Commission June 10, 2013 Page 2 Angell stated that staff feels that this proposed use is not expected to have a negative impact on the traffic in the area. Grimes added that when staff analyzes traffic for this type of use the main concerns are the impact on the streets, if there is adequate capacity and if the proposed accesses function properly. He added that the City's Public Works Department has reviewed the plans and feel the proposal will work. Kluchka suggested the staff report state that the proposal won't impact the capacity or the operation of the streets rather than saying the proposal won't impact traffic. Grimes added that another thing staff considers is how the drive-thru works. In this case, the applicant feels that the site will be more than adequate to meet their needs. ,;E�� Segelbaum asked if any thought has been given to walkability around`tf�� site and..the ability to ride a bike to the restaurant. Angell stated that sidewalks �nd walkabilitye�� the area have been discussed and is being studied as part of the H�ghwa ���5 �t�ne�al and Renovation Area goals. Grimes stated that the City's Sidewal�C Comr���tee coul�J also review this proposal. He added that staff could work with Culve,r's ar� obtai�ing an easement for sidewalks in the future. Boudreau-Landi���sked if`there �r�other sidewalks in the area. Kluchka asked if adding a bike rack has been di��ussed.`A�r�gell said he wasn't aware of discussions regarding bike racks. Kluchka asked if landscape plans will k�� submitted.���'�m�s�stated that a landscape plan will be reviewed as a part of the bui����a�'p�rr�it`process. Segelbaum asked if all drive-thruywindo�i4rs require a Conditional Use Permit or just drive- thru windows in the Commercia� zo�i�g����district. �rimes stated that every drive-thru window requires a Condi�ional Use Permit. Chris McGuire, McCon Building Corp., representing the applicant, stated that they are intending to install sidewalks ar�d a bike rack and they will follow whatever the City Code requires regarding landscap�ng. Kfuchka suggested that they have those items shown on the plans when fih�y ga q�fore the City Council for consideration. Cera asked a�o�t:fi����r,n��Pine for the project. McGuire said they would like to start construc4�n i�°I�te Ju'I��'�r early August with completion in November. Seg��baum su�ge�ted that the applicant stripe a pathway in the parking lot that shows what route pedestrians should take. McGuire stated safe access will be created from the patio to th�sidewalk. Segelbaum asked the applicant if the 64 parking spaces shown on the plans will be too many, too few or adequate. McGuire stated 64 spaces are more than they have at some of their other locations however that will be a nice number for this site. Segelbaum said the City would be open to reducing the number of parking spaces. McGuire said that 64 spaces will work very well. Cera referred to photos submitted with the agenda and asked if they are representative of what will be built on this site. McGuire stated that this restaurant will be similar to the one shown in the photos however it will be slightly taller. Kluchka referred to the site plan and asked the applicant to explain the drive-thru stacking area. McGuire showed on the site plan how the drive-thru traffic would v�c�rk and noted that there is enough room for 15 to 16 cars. a;I�°�`�' Boudreau-Landis asked if the drive aisles and radii for emergenc��vehicfes:will b� 20 feet in width as required. McGuire said they are both greater than 2Q feet in wid�h.. Kluchka opened the public hearing. Julie Peterson, Applicant, said she is exited to bring Culver'�;#o Golden'Valley. She stated that there is a bike trail near their proposed store so a bi�C� rack wQuld be a good thing to install. She said she would bring a landscape plan to the'��uncil meeting and she also feels that sidewalks in this area are importa��� i�5� Hearing and seeing no one else wishing to connment, 141uchka closed the public hearing. Kluchka asked Grimes about the timeline of t�is area's overall sidewalk plan. Grimes explained that the Highway 55 Renewal �nd Renovation district could be on hold because the recently approved Tiburc�n aparkment projecf is currently on hold. He noted that the City's sidewalk plan does c�ll for sidewalk in this entire area it is just a matter of having the funds to construct theai�l,,He added tt%at the City cannot stop development because of sidewalks or make �#develo�����hstall sidewalks. Segelbaum stated that the applicant has said they would be v�i����Ig�;to insta!! sidewalks and he would like to encourage them to do so even if the �ity can't requ�r�,them to. Boudreau-Landis asked if there is a plan in place regarding the m��nten�'���of s��ewalks. Grimes stated that the City cu�rrently maintains public sidewalks. McCarty said he understands there are things they might like to have but questioned if t�e Planrring Commission has the authority to require them. Kluchka said the Planning Commission doesn't have the authority to require sidewalks be he thinks it is gQOd to have the discussion. Cera said he feels Culver's is a destination restaurant and is a good use of the property that will bring business to the area. MOVED ��=�era, seconded by Segelbaum and motion carried unanimously to recommend approval to allow for the operation of a drive-thru window in a Commercial Zoning District for the property located at 88517th Avenue North subject the following conditions: 1. The Site Plans submitted with the application shall become part of this approval. 2. All signage must meet the requirements of section 4.20 of City Code. 3. Forss (The Alignment Guy) Applicant Background and Proposed Use Applicant Jeff Forss is proposing to construct a new automotive repair shop at 6124 Olson Memorial Highway. Mr. Forss is requesting a Conditional Use Permit (CUP) to allow for the operation of the automotive repair shop. The location of the proposed automotive repair shop is zoned industrial. Auto repair shops are consistent with that designation as a conditional use. The proposed automotive repair shop will be located within the West Building of Expressway International Park and will be a total of 1,800 square feet. The auto repair shop will fill an existing structure, so no additional buildings will be built. The auto repair shop will consist of two lifts and one alignment rack. The Alignment Guy specializes in wheel alignments, suspension part replacement, wheel bearings, drive axle, tire and wheel, brake, and related chassis repair work. The business was established in 2002 and does not have any additional employees. The applicant would like to relocate to Golden Valley from Bloomington due to his current building having a new owner, who will not be renewing his license. Analysis af Ten Factors The Planning Commission must make findings on ten factors when reviewing a CUP application. They are as fallows with staff comment: 1. Demonstrated Need of the Use: The City requires that an applicant identify a market for the proposed good or service necessitating a CUP. In this case, the applicant believes this is an ideal location for an auto repair shop. 2. Consistency with the Comprehensive Plan: The General Land Use Plan Map guides this site for Industrial uses. Auto repair and storage is considered a conditional use in the Industrial zoning district. Many auto repair businesses operate in Industrial areas throughout the city. 3. Effect on Property Values in the Area:The auto repair business should not have a negative impact on property values in the area. The proposed use is isolated from residential areas and is adjacent to the railroad tracks and other Industrial uses. Auto oriented businesses are best suited for these types of areas. 4. Effect on Traffic in the Area:The additional traffic generated from this type of use is minimal. There is excess street capacity on both Olson Memorial Highway and Douglas Drive. 5, Effect of Increases in Density or Population on the Area:The proposed use will have no effect on population. 6. Increase in Noise Created by Use:There may be some noise level increases from the auto repair business although staff believes it will be minimal. 7. Any Dust, Odor or Vibration caused by Use: Due to the location near Olson Memorial Highway and the railroad tracks, these issues will not be a problem at this location. 8. Any Increase in Animal Pests Caused by the Use:The proposed use will not attract animal pests of any kind. 9. Visual Appearance of the Use:The proposed auto repair shop will not be changing any of the exterior factors of the building, so it should have no impact of the visual appearance on the site. 10. Other Effects of the Use: Staff does not anticipate any negative effects of the proposed use. Recommended Action Staff recommends approval of Conditional Use Permit 134 allowing Jeff Forss (The Alignment Guy) to operate an auto repair facility at 6124 Olson Memorial Highway. The approval of a Conditional Use Permit is subject to the following conditions: 1. The site plan shall become a part of this approval. 2. All signage shall meet the requirements of Section 4.20 of City Code. 3. All future improvements to the building shall meet the City's Building Code requirements. 4. All other applicable local, state and federal requirements shall be met at all times. 5. Failure to comply with any of the terms of this permit shall be grounds for revocation. Fire department access road around the building shall be maintained at 20 feet wide and the turning radius shall be maintained 20 feet inside radius and 40 feet outside radius for the fire apparatus. Staff worked in accordance with Minnesota Solar Challenge in order to understand how other Twin Cities metro regions have adopted solar energy into their City Code. The concern was that Golden Valley currently does not regulate Solar Energy Systems in the City Code besides Pole Mounted Photovoltaic Systems. In order to update Golden Valley's code to best suit the community and remain on-par with the surrounding areas, research and comparisons have been performed. Based upon these comparisons, planning staff has developed an ordinance for Solar Energy. The Planning Commission tabled this item at the May 13, 2013 meeting to allow staff to make some of the recommended changes to the ordinance. Staff has altered the ordinance in accordance with the recommendations from the Planning Commission, as well as the recommendations from Minnesota Solar Challenge. Process Staff focused on how Solar Energy Systems are regulated by Minneapolis and St. Paul. They were chosen due to the fact that they have the most detailed and most recent solar energy ordinances that have been passed and integrated into their respective City Codes. After analyzing these cities, staff created an ordinance to fit Golden Valley. Recommendations Staff recommends that Solar Energy Systems be allowed within all zoning districts, subject to administrative review and approval by the Community Development Director. Informal Public Hearing —Zoning Code Text Amendment— Adding Section 11.75 "Solar Energy Systems" —ZO00-91 Applicant: City af Golden Valley Purpose: To consider the addition of Section 11.75 "Solar Energy Systems" to the Zoning Chapter of the City Code Angell gave a presentation to the Commission regarding the addition of solar energy systems requirements to the zoning chapter of the City Code. He discussed types of solar energy systems including building integrated systems, ground mounted systems and roof mounted systems. He also discussed Minnesota's solar potential and noted that the City's goal is to encourage the use of solar energy in order to reach Minnesota's goal of using 25% renewable energy by the year of 2025. Angell referred to the proposed ordinance and discussed some of the requirements for roof mounted systems including height restrictions, reducing visual impact by means of location, and screening or integrating in with the roof's design. He added that ground mounted systems would be treated as an accessory structure in regard to height, lot area coverage and permitted locations and that building integrated systems would be treated as part of a building. Baker asked about the number of solar energy systems currently located in Golden Valley. Angell said he knows of a few businesses and residential properties that have systems. He added that staff did hear some concerns from residents and that he will review them with the consultant from the "Minnesota Solar Challenge." McCarty asked about the technology to store wind and solar energy. Angell said his understanding is that energy collected can be stored or sold back to energy companies. Minutes of the Golden Valley Planning Commission May 13, 2013 Page 2 Cera added that work is being done to use stored energy for electric vehicles. Waldhauser suggested having discussions with other communities regarding communal energy generation that homeowners could buy into. Kluchka questioned if there should be language added to the proposed ordinance to ensure that it protects trees on neighboring properties from being cut down in order to gain more solar access. Angell explained that in the ordinances he researched language about trees was added when cities wanted to allow trees to be cut down in order to allow for solar access. Grimes noted that trees also have value in keeping energy costs down. Waldhauser asked about the effect of new plantings. Hogeboom stated that solar access easements could be put in place between property owners however the City does not get involved in enforcing private easement agreements. Cera suggested adding language regarding the preservation of existing trees. Segelbaum asked if other cities have provisions regarding the preservation of trees. Angell stated that St. Paul has a model ordinance and it does not mention trees. Waldhauser stated that she thinks there could be education done about existing trees and that the ordinance doesn't necessarily need to address it. Waldhauser asked if there will be a permitting process. Grimes stated that building and electrical permits will be required. Cera asked if the City has considered offering subsidies to homeowners who install solar energy systems. Grimes stated that there are tax credits available and that solar panels are becoming more affordable. Baker added that energy companies also give credits. Segelbaum referred to the definition of Building Integrated Solar System and stated that the words "solar energy system" shauld capitalized. He also noted that Subdivision 3(A)(1) should be changed from "Building Mounted Solar Energy Systems to "Flush Mounted Solar Systems." Segelbaum referred to Subdivision 3(A)(2) and asked what the "exterior perimeter" of the roof ineans. Angell exptained that the language was modeled after St. Paul's ordinance and that he would talk to the consultant he's been working with to better define that paragraph. McCarty suggested that "Ground Mounted Solar System" be added to the list of definitions. He referred to the definition of Solar Energy System and suggested the word "significantly" be removed. Baker referred to Subdivision 3(A)(3) regarding the visual impact of rooftop equipment and questioned the use of the word "shall" in the first sentence. The Commission consensus was to keep the word "shall" in that sentence however they agreed that the word "reduced" should be changed to "minimized." Kluchka suggested that Subdivision 4(A) regarding compatibility be removed because following all of the requirements of the accessory structures language is too restrictive. Minutes of the Golden Valley Planning Commission May 13, 2013 Page 3 The Commission agreed and suggested language regarding height and setbacks would be clearer. Segelbaum referred to the second sentence in Subdivision 3(C) and said the words "building integrated systems" should be changed to "Building Integrated Solar Systems." Waldhauser referred to the language regarding interference and asked if solar energy systems really cause interference. Cera stated that these systems won't generate interference. Baker referred to Subdivision 4(E) regarding maximum capacity and asked how 100 kilowatts was decided. Angell stated that he would have further discussion with the consultant he's been working with about that language. Waldhauser opened the public hearing. Andy Snope, 1320 Unity, said he's worked in the electrical industry for 20 years. He handed out some suggested changes to the language in the ordinance which included requiring that an electrical permit be obtained, requiring a licensed contractor to install solar systems and not limiting the output on commercial properties to 100 Kilowatts. He also handed out several articles regarding solar energy for the Planning Commission to review. Hogeboom stated that Mr. Snope's comments have been forwarded to the consultant for the Minnesota Solar Challenge. Seeing and hearing no one else wishing to comment, Waldhauser closed the public hearing. MOVED by Cera, seconded by McCarty and motion carried unanimously to table this item in order to give staff time to revise the proposed ordinance. --Short Recess-- 3. Purpose The purpose of this section is to allow for and regulate the location, placement, design, and maintenance of active and passive Solar Energy Systems to ensure such equipment are appropriately located and are used in a safe and efFective manner. Subdivision 2. Definitions A. Building Integrated Solar System: A Solar Energy System that is directly integrated into the building by replacing typical building materials. B. Flush Mounted Solar System: A Solar Energy System that is installed on the roof of a building �e�i-a-I� in which the solar panels are parallel with the finished roof materials. C. Ground Mounted Solar Svstem: A Solar Energy System that is installed directly onto the ground by means of brackets or poles. D. Non-Flush Mounted Solar System: A Solar Energy System that is installed on the roof of a building at a different pitch than the finished roof surface. E. Solar Energy System: A device, structure, or part thereof that transfers direct solar energy into thermal, chemical, or electrical energy � , F. Solar Garden: A communitkshared solar array with grid connected subscribers. Subdivision 3. Permitted Use Where Allowed A. Building Mounted Solar Energy Systems shall be allowed in all zoning districts, subject to administrative review and approval by the Community Development Director, so long as they meet the following requirements: 1. Flush �g Mounted Solar Systems shall not exceed the designated height requirement of the principal structure in all zoning districts. 2. Non-Flush Mounted Solar Systems shall extend no more than three (3) feet above the surface of a roof at any point ' . 1 3. The visual impact of rooftop equipment on nearby properties shall be minimized ���Q through such means as location on the roof, flush- mounting to the roof4 screening, or other integration into the roof design. Screening shall be of durable, permanent materials that are compatible with the primary building materials. 4. The structure upon which the Salar Energy System is mounted shall have the structural integrity to carry the weight of the Solar Energy System. 5. A building permit must be obtained before a mounted Solar Energy System shall be placed on a structure. 8:— , , , ��� C. Building Integrated Solar Energy System shall be considered a part of the structure rather than a separate entity. Building Integrated Solar Systems need to follow the regulations set by the building code. D. All Ground Mounted Solar Svstems shall have a maximum height of ten (10) feet. E. Ground Mounted Solar Systems must be set back a minimum of five (5) feet from all property lines. F. Solar Gardens shall be permitted with a Conditional Use Permit. Subdivision 4. Design and Performance Standards Design and performance standards for Solar Energy Systems are hereby established to meet the objectives of the City outlined in the Comprehensive Plan and the purpose and other provisions of this section. A. Compatibility with nearby properties: Solar Enerqy Systems shall be screened from view to the extent possible without reducing their efficiency. Screening shall utilize building materials, colors, and textures that are similar and compatible with the existing principal structure. B. Compliance. All Solar Enerav Systems shall be designed, constructed, and operated in compliance with all applicable federal, state, and local laws, codes, standards, and ordinances, as well as adhere to the requirements of local utilities if connected to utility lines. C. Encroachments and setbacks: 2 1. Solar Energy Systems shall comply with the minimum yard requirements of the zoning district in which they are located. 2. Solar Energy Systems shall comply with applicable regulations as established by chapter 1325 of the Minnesota State Building Code and the National Electrical Code (NFPA 70�. D. Interference. The Solar Energy System shall be designed to not cause electrical, radio frequency, television, and other communication signal interference. E:— F. Installation. Only licensed contractors shall be allowed to install Solar Enerav �stems. G. Maintenance required. The Planning Department has compiled a report of action items that were presented to the Planning Commission in 2012. In additian to this, Chair Kluchka and staff would like to discuss trends in planning and development, as well as possible special topics for the Planning Commission to study in the next year. Staff would like to discuss planning-related topics that are of interest to the Planning Commission at the July 8 Planning Commission meeting so that we may formulate a report for the City Council in August. Staff has identified the following topics for discussion: • Increasing senior housing opportunities in Golden Valley • Participation in the Bottineau Transitway Station Area Planning process • Redevelopment opportunities along Douglas Drive • Revision to mixed-use zoning requirements to expand usage to other areas of the City • Review of current minimum lot dimensional and setback requirements • Identify large current and potential future commercial vacancies in the community and seek ways to foster business growth • Identify trends in variances requested in the past year and determine if amendments to the Zoning Code should be considered • 2018 Comprehensive Plan revision plan Staff would like to work with the Commission to identify items of interest for future study.
