No leaks were found at that time. Tom Mathisen presented a new proposal from Pure Technologies to inspect the joints and look for indicators of pre -stressing in the pipe. The inspection will include a manned visual inspection, manned electromagnetic inspection, and engineering analysis and report. The total cost for this inspection is $85,000 and will cover the area between Lake Road and Highway 100. Chair Burt asked if the JWC should conduct an operational audit. Crystal staff did not believe the failures were due to transmission operations. Randy Kloepper said operations was taken into consideration when considering the cause of the break. With the manned visual inspection, broken pre- stressing wire wraps will be identified and the impacts of those breaks on the structural integrity of the pipeline evaluated. Test results are expected by October 17. They also asked for an insurance update regarding homeowners who had sewage backups in their homes as a result of the break. Chair Burt reassured Robbinsdale that repairing the line is a priority and the JWC will redirect CIP projects to fund the repair. Sue Virnig added claim information has been forwarded to the League of Minnesota Cities (LMC) and more information should be available next week. There were 11 names and addresses on the list and the LMC has not heard back from all the residents on that list yet. Robbinsdale contacted the LMC about the liability concern and was told the adjusters do not assign liability until their investigation is completed, which is confusing to the homeowners. Robbinsdale asked the JWC to continue to update them as information becomes available from the LMC. MOVED by Norris and seconded by McDonald to approve the cgWt with Pure Technologies in the amount of $85,000 for emergency repairs of the 36 -inch wa Motion carried. Iff Emergency Backup Water Supply Project Update Crystal's two wells are excavated to a 400 -foot dept the contracto urrently finishing the casing installation on the second well. Crystal expects t tractor to be compl by the end of October and the wells will be operational. The Golden Val ell is on schedule for co ction in spring 2015. T FROM: Tom Mathison, Public Works Director & City Engineer TO: Joint Water Commission DATE: October 27, 2014 RE: Inspection of 36 -inch PCCP JWC Pipeline from Mpls On Friday October 17, we received the results from the recent pipeline inspection conducted by Pure Technologies. They entered the pipeline at the location of the September failure on 42nd Avenue in Robbinsdale. This is located just west of Station 70+90 on the asbuilt drawings which is just west of the BN tracks, about two blocks west of West Broadway and three blocks east of Hwy 100. Pure Tech had a six person team. One person remained at the access point in the excavation, three people did the visual inspection, and two pushed the EM cart. In the east direction they were able to get to Lake Road, which is east of Co Rd 81. In the west direction they were able to get all to the Hwy 100 crossing. Results from the electro -magnetic inspection/analysis show 19 locations with anomalies of which 3 they have determined are not related to good or bad pipe condition. The results are shown in the attached email and are summarized as follows: Pipes # 85 and #131 are in an imminent failure condition showing steel liner corrosion. Pipes # 62, 113, 118, and 155 have enough broken wires that they have exceeded their yield limit (based on 80psi operating pressure plus 40 psi surge pressure = 120 psi to failure) The remaining 9 pipes have broken wires just inside the spigot or bell ends. The other 91 % of the pipeline is in good condition (the good news). It is very fortunate we were able to conduct this type of inspection prior to putting the pipeline back in service. Had we done, most likely there would have been yet another catastrophic failure in the near future. We do have safeguards in place that would shut down the pipeline in the event of a failure. This would greatly reduce the overall damage,, but would not prevent failure to the road and damage in the immediate vicinity. Based on the condition of the section of pipe that was inspected, we cannot put the pipeline back in service at full operating pressure. In the short term, we are developing OPERATIONS AND MAINTENANCE AGREEMENT THIS AGREEMENT is made and entered as of this day of , 2014 by and between the City of Minneapolis, acting by and through its Park and Recreation Board (MPRB), a body corporate and politic under the laws of the State of Minnesota, and the Joint Water Commission (JWC), a Joint Powers Commission involving the cities of Crystal, Golden Valley, and New Hope. RECITALS A. In 2014, the MPRB amended and restated its 1965 Easement Agreement with the Village (now City) of Golden Valley (Golden Valley), in which it enlarged the area of property covered by the 1965 Easement agreement in order that Golden Valley, in association with the JWC, could construct an emergency water well on the additional property as required by the Minnesota Department of Health (MDH). The document evidencing this easement was subsequently recorded as Document No. with the Hennepin County Recorder. B. The JWC finds that in constructing the emergency water well it will be displacing sand and potentially disposing of sand when digging the well. C. The MPRB may have a use for the sand at its golf courses but at this time prefers not to commit to taking the sand. D. The JWC is willing to give a portion of this sand to the MPRB for use on its golf courses, if the MPRB so desires. E. The JWC will regularly operate the wells to ensure proper operation and maintenance of the emergency well system on a schedule determined by the JWC. The amount of water produced is not large and shall be discharged into the nearest stormwater basin. F. The MPRB may have a use for and may desire to use this excess water for winter sports activities during the months of November through February of each year. Any MPRB use of the excess water or any additional water that is needed to support MPRB operations shall be discussed and approved by the JWC. G. The JWC desires to direct this excess water for use by the Park Board during the months of November through February each year (upon construction of a conveyance and storage system). H. The Park Board and JWC desire to set out certain details regarding the City's use of the�Easement Property for operations and maintenance purposes. 1 NOW, THEREFORE, in consideration of the foregoing and for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows. Term. This Agreement will be in full force and effect from the date of signing through December 31, unless terminated earlier pursuant to the terms of this Agreement 2. JWC's Obligations. The JWC shall: a. If requested by MPRB, give MPRB access to a portion of the sand, that is displaced by the construction/digging of the emergency water well; b. Install a pump, water line and cut off valve at the emergency water well that direction of the excess water from testing to MPRB's water line during the months of November through February; c. Ensure that the pump is operational at all times that this agreement is in effect; d. Ensure that all excess water from normal operation is directed to the MPRB and its water line during the months of November through February of each year that this agreement is in effect; and e. Remove all sand from the site duringlafter the JWC completes its construction of the emergency well. The sand will be delivered to a site owned by Golden Valley for storage. 3. Park Board's Obligations. The Park Board shall: a. Transport the sand that will be used by the MPRB for its operations from the Golden Valley-owned"site to the MPRB site. b. Pay for all utility and maintenance charges associated with the use of the JWC's well in directing water to the MPRB during the months of November through February of each year that this agreement is in effect but only for the amount of water taken by MPRB exceeds the regular exercising of the well. The payment of such utility and maintenance charges shall also be offset by MPRB use of JWC well water during other months for the benefit of the JWC. 4. Indemnification. Each party is responsible for its own acts and omissions and the results thereof to the extent authorized by law. Minnesota Statutes chapter 466 and other applicable laws govern the parties' liability. Nothing herein shall be construed to waive or limit any immunity from, or limitation on, liability available to either party, whether set forth in Minnesota Statutes chapter 466 or otherwise. 5. Successors and Assigns. Neither the JWC nor the MPRB shall have the right to assign its rights, obligations and interests under this Agreement to any other party without prior written consent of the other party. E 6. Amendment, Modification or Waiver. No amendment, modification or waiver of any condition, provision or term of this Agreement shall be valid or of any effect unless made in writing and signed by the party or parties to be bound, or its duly authorized representative. Any waiver by either party shall be effective only with respect to the subject matter thereof and the particular occurrence described therein, and shall not affect the rights of either party with respect to any similar or dissimilar occurrences in the future. 7. No Agency. Nothing contained herein and no action by either party hereto will be deemed or construed by such parties or by any third person to create the relationship of principal and agent or a partnership or a joint venture or any other association between the parties hereto. 8. Termination. This Agreement may be terminated any time after 2024 by the either the MPRB or the JWC by the terminating party giving the other party 180 days written notice prior to the date of termination. Any such termination shall be in writing and signed by the parties.. Termination shall not require the JWC to remove any, portion of the well from the easement or limit the use of the facility on the MPRB property. 9. Notices. Governing Laws.
