Section 12.10: Preliminary Plat
Subdivision 1.
Before dividing any tract of land into two (2) or more lots or parcels, except as
provided under Section 12.50, Minor Subdivisions and Consolidations, an owner or
subdivider shall, unless a variance is authorized under the terms of this Chapter,
make application to the office of the City Manager or his/her designee preliminary
plat approval. The application shall be heard by the Planning Commission within
thirty (30) days of application. If the application is not heard by the Planning
Commission within thirty (30) days of submittal of a complete application, the
application shall be referred directly to the Council for action. Said application shall
be accompanied by:
A. Fifteen (15) copies of the preliminary plat.
B. A filing fee shall be set by Council resolution. This fee will be used in
connection with approval or disapproval of said preliminary plat, and before
approval of the final plat, the subdivider shall also pay to the City an amount
equal to the charge made to the City by the City Attorney for each abstract
of title or registered property abstract required to be examined in connection
with said final plat approval as specified in Section 12.40, Division 2.

Subdivision 2.
Upon recommended approval or disapproval of the preliminary plat by the Planning
Commission, the plat shall be referred to the Council for action. Referral by the
Planning Commission must be made within sixty (60) days of receiving the
application.
Subdivision 3.
After receiving a recommendation for approval or disapproval of the preliminary
plat by the Planning Commission, the Council shall hold a public hearing on the
preliminary plat within thirty (30) days. The notice of the hearing shall be published
at least once in the official newspaper at least ten (10) days prior to the hearing. A
public notice shall be mailed to all property owners within five hundred (500) feet of
the proposed preliminary plat at least ten (10) days prior to the hearing. At the
close of the public hearing, the Council shall grant approval of the preliminary plat,
approval with conditions, refer the preliminary plat back to the Planning
Commission for additional study or disapprove the preliminary plat stating the
reasons for such action in the official minutes of the Council meeting.
