2. Update on The Three•Nine•Four Apartments

Summary
In December of 2012, the City Council approved the Preliminary PUD Plan for The
Three•Nine•Four Apartments which consisted of a multi-family building with 308 units and a
senior building with 118 units. The project was proposed for two parcels in the northwest
quadrant of the Highway 100/I-394 interchange and partially involved a transfer of land from
MnDOT to the HRA and subsequently to the developer.
The Final PUD Plan was approved in December of 2013 for a multi-family building with 303 units
and a senior building with 107 units. A lawsuit brought against the Housing and Redevelopment
Authority (HRA) and the developer by a neighboring property owner resulted in a pause in the
entitlement process prior to approval of the Final Plat, the PUD Permit, and the Development
Agreement.
Resolution of the lawsuit in favor of the HRA and the developer occurred in early July of 2015.
The developer now intends to resume the entitlement process, receive approval of the
outstanding items, and move towards construction as soon as possible.
Due to the delay in the process, the HRA agreement regarding the sale of the property to the
applicant, first approved in April of 2012, must be updated. Staff anticipates bringing this revised
agreement to the HRA at a special meeting on August 18. Consideration of the other outstanding
items is anticipated at the regular City Council meeting scheduled for later that evening.
Staff and the developer will provide additional visuals and information about the project at the
meeting.
