Meeting - September 2, 1980

The meeting was called to consider a change to the Rules
and Regulations. Proposed:
5ection 3. At the end of the section (following
clause (g) , add as an exception:
"Exception: Candidates for the position of police/
public safety officer who have prior police officer
experience may have the written and/or physical
agility examination requirements waived if they
can demonstrate having previously passed the same
or similar examinations currently used for other
police officer candidates. Upon such waiver, the
candidate must successfully pass all other require-
ments before placement on the eligibility register.
Results of the oral examination , along with prefer-
ence points provided in Section 8, shall determine
placement on the register. "
A discussion of the proposal ensued. The Commission was
informed that Allen Barnard, City Attorney, had reviewed
the proposal, and advised that there was no case law speci-
fically allowing or disallowing such an exception. He
recommended that it be impressed upon the Commission that
consistent application of the policy would be of utmost im-
portance if adopted.
The Commission felt clarification of the testing process was
advisable, and revised the proposed exception as follows :
At the end of the first sentence a phrase would be
added:
"Exception. . .candidates , as certified by a police
department or police civil service commission.
Upon. . .register. "
It was moved, seconded and apnroved that the exception be
adopted as revised.

The Commission was then asked to approve for reinstatement
the application of former Golden Valley Police Officer
James Beardsley. There being no evidence in the file
material available at the meeting that Mr. Beardsley had
passed the same or similar examinatian as currently used,
the Commission agreed to the following:
The Commission will waive the test requirement
upon receipt of evidence of a successful testing
process similar to that currently used either here
or in California, and the Department is authorized
to administer an oral examination. The results of
the process will be presented to the Commission
for a decision regarding his inclusion in the current
police register.
It was moved, seconded and approved that the meeting be
adjourned.
