Additionally,AOWLwouldliketorezonefromIndustrialtoInstitutional.Bothchangesare necessaryforAOWLtousethesiteforschooloperationsandforthemtopurchasethesite. MapswereshowntotheCommissionwhatthecurrentzoningisandwhattheguidedlanduse inthe2040CompPlanis. Campbellreviewedthestaffanalysis,remindingtheCommissionthatCityCodedoesnotset specificstandardsforamendmentstoeitherthezoningmaporthefuturelanduseplan.City CouncilandthePlanningCommissionaregiventheflexibilityindeterminationsforachangein either. Amajorityofusesaroundtheproposedpropertyarezonedeitherindustrialorlightindustrial; staffnotesthatamajorityofbusinessesareoffices,services,orretail.LookinglongͲterm,some surroundingpropertiesmaybeexploredforcommercialormixedͲusedesignationsduetotheir proximitytodowntown. CityengineersnotedthatbothBooneAveNand10thAveNhavethecapacityforthesite’s trafficdemandsifrezonedsincebothroadsaredesignedforindustrial/officetraffic.Thereare somelowͲdensityresidentialroadstothenorthandengineeringisabletoworkwithafuture usertoensurethoseareaswouldn’tbeimpacted.Thesite’sparkinglothasmultipleaccess pointsfromtheroadandthereareareastothesouthforturnaroundalternatives.Assembly landusewasnotaplanneduseforthesiteonadoptionoftheCompPlan,butstaffisinterested toseeifotherpoliciessupportthesite’sreͲuseasaninstitutionalproperty. Typically,citiesdonothaveneighborhoodsdesignedaroundtheinstitutionalzoning,andsothe questionof“spotzoning”comesup.TheCitymaychoosetorezoneapropertyinamannerthat doesnotconformtotheComprehensivePlan,evenwhentherezoningisinconsistentwith someofthesurroundinguses,providedthedecisionissupportedwithafactualrecordthat showsthedecisionwasnotarbitraryandcapriciousandwasreasonablyrelatedtothe promotionofpublichealth,safety,morals,andgeneralwelfare.Campbelllistedanumberof findingsbasedonthepreviousanalysistosupporttherecommendation. CommissionerSegelbaumaskedabouttransitionallandͲuseareasandifthere’satypicalarea aninstitutionalzoneisnear.CampbellrespondedthattheMeadowbrook/Brecklocationisa goodexample,thecoͲlocationminimizestrafficimpactsinotherareas;anotheristheCityHall Campus,thereareacollectionofinstitutionaluses.Forthissite,themainimpactswillbeatthe morningandafternoondropoff/pickuptimes.CommissionerBakerstatedthatwhilecurrent neighboringusesarenotincompatiblewithaschool,theneighboringusescouldchangeand becomeincompatibleuses.Campbellrespondedthatit’saconsiderationtomakebutthe groupshouldthinkabouttheactualpossibilityofthoseusesbeingsoldontoanewownerand havingadifferentuse;mostofthebuildingswerebuiltwithasingleuseinmind.Ifan incompatibleuseoperatesnearAOWL,thereisn’tliabilityontheCityforthatincompatibility. Tobacco,firearm,andsexuallyorientedbusinesseswouldn’tbeallowedasdistancerestrictions areinplacetopreventtheirproximitytoaschool. CommissionerJohnsonreferencedtheSpotZoningmemobytheCityAttorneyandthe referencestomorals,heaskedhowtheCommissionissupposedtointerpretthatwithinthe contextoftheirdecision.Campbellreiteratedthatthecodedoesnotdefinestandardstobe metandtherecanbebenefitstocitiesthatofferspacesforpeopletocongregate.Thereis vaguenessaroundthepublichealthsafetywelfareconsideration.Pocklstatedthatwhilethe applicantofferedtotakeontheresponsibilityofthetrafficstudybutaskedwherethe responsibilitylies.JasonZimmerman,PlanningManagersaidthecitytrafficengineerswill reviewandiftheyfeelroadlanesneedtobechanged,they’ddiscusswiththeapplicantto eitherhireaconsultantortakeadeposittousethecityoncalltrafficconsultant. ChairBluminvitedtheapplicanttospeak. WyaynRasmussen,ApplicantgaveabriefpresentationaboutAcademyofWholeLearning, theirgoalsandmission,historyofservices,andpopulationserved.Rasmussenelaboratedon othersitesreviewedforconsiderationandonlyoneother,outof50propertiesreviewed, seemedtomeettheneedsoftheschool.ThislocationinGoldenValleymeetstheneedsofthe schoolaswellasprovidesopportunitiesforcollaborationwithotherdistrictsandbusinesses. Since2003,AOWLhasmoved4timestoleasedspacesandthey’dliketoofferapermanent locationtotheirstudentsandfamilies. Johnsonaskedtheapplicanthowmanyofthepropertiesonthelistofpossibilitiesdidnot requirealandͲusezoningchange.Rasmussenrespondedthatonelocationwaszonedfora schoolhoweveritwasoutofthe494corridorandhadlimitedgreenspace.TheApplicant CityofGoldenValley PlanningCommissionRegularMeeting October26,2020–7pm 4 expandedontherubricforscoringpotentialproperties.10Ͳ12propertiesmetthatrubricwitha scoreof15andonlyonebesidesthislocationscoredhigher.Theotherlocationwassurrounded byalotofwateranditdidn’tfeellikeitwasidealfortheschoolandtheirpopulation. CommissionerPocklaskedwhentheschoolwouldstartoperatingandtheapplicantresponded thattheyarecurrentlyleasingandthatexpiresinJune2022andthegoalistoopeninGolden ValleyinFall2022.JohnsonaskedifAOWLwasexpectinganyfinancialsupportfromthecityin eitherthelotacquisitionortheiroperations.Theapplicantrespondedthattheyhadnosuch plansoragreementswiththeCity.Segelbaumaskediftheschoolhasafterschoolactivity offeringsandtheapplicantrespondedtheyofferclubsMondayͲFridayuntil4:15andoncea weekthatmaygountil7.Theydon’thaveofferingsonweekends.Johnsonaskedhowto engagetheGoldenValleycommunityandcontinuethatrelationship.Applicantillustratedthe schoolsneedandappreciationforvolunteersforeverythingfromhallwaydecoratingto classroomvolunteering.Thegreatestpotentialforbenefitandlongevityinpartnershipis throughjobcoachingvolunteers. TheChairopenedthepublichearingat8:12PM Johnsonaskedwhathappensifthepurchaseofthispropertydoesn’tgothrough.Therezoning can’tbeconditionalandtheCitywillthenhavereͲpurposedlandintheCommercialdistrict. HowcanthisriskbeminimizedfortheCity?CommissionerBrookinsstatedthatthisisagood pointbutthisschoolfillsaholeinthecurrentconditionalͲuselanguage.Brookinsaddedthathe wantstoseethisfacilityandthisneedmetinthecommunitybutit’samatterofmakingsure theprocessisdonecorrectlyandhe’snotsurerezoningisthecorrectroute.Zimmermanstated thereweren’tanyalternativestoanIͲ1zoningintheCityCodetoallowthisschooltooperate. Theconversationcontinuedonspecificswiththezoningcodeandwhyarezoningistheonly option.Segelbaumaddedtothisconversationandaddedwhatabenefitthisschoolwillbeto thestudents,community,andtheCity.CommissionerSadeghiechoedSegelbaum’sstatements andaddedthisisaforwardwayofthinkingregardingbuildingsofthistype.ChairBlumrecalled feedbackatonepointregardingthebenefitsofpreservingIndustrialandLightIndustrialzoned properties.Staffrespondedthisconversationcamefromtheideaofconvertingthesebuildings tomultifamilyunits.Thishasprosandconsbutoneoftheconsisthereductioninjobsandjob growthinthecity.RezoningtoInstitutionalisn’tasbigofachangeasit’sstillajobproducing site.Blumfollowedupbyaskingifthisrezoningsetsaprecedenceforfuturerezonings. Zimmermanstatedthathavingthisrezoningcouldbeanexampleforthisprocessbutitalso dependsonthevisionofCityCouncil. TheChairclosedthepublichearingat8:28PM. CityofGoldenValley PlanningCommissionRegularMeeting October26,2020–7pm 5 Johnsonstatedit’shardtoseethistypeofschoolisn’taddressedinthecode.Insteadof changingthecode,headded,maybethatsamelogiccanbeusedtochangeanordinanceora conditionaluse.Johnsonacknowledgedtheaddedworkloadforstaffbuthefeelstherearetoo manyunknownstoamendexistingcode.Zimmermanaskedifthesuggestionwastoamendthe zoningcodeasaconditionaluseinsteadofrezoning.Itwouldrequireadeterminationthata schoolisappropriateforthispropertybutalsoforanypropertyzonedindustrial.Thereare RLUPAconsiderationsandwhatotherzoningdistrictsmightallowReligiousinstitutionsand Industrialisn’toneofthem.ArecommendationofdenialwouldneedtogototheCityCouncil withanaddendumforthemtodirectPlanningCommissiontogothisrouteinstead.Johnson saidtheremaybeanopportunitybecauseAOWLisaparticulartypeofschool.Planning Commissionhasabilitytodifferentiatethetypeofschoolandstudentsservedinanamended conditionaluse.Johnsonrecommendedthemotionbedeniedbutproceedwithidentifying schoolsakintoAOWLinaLightIndustrialdistrict.Brookinsaddedthatthisisanopportunityto cleanthecodeandamendpermittedorconditionaluse.Thewholelistoftermscouldbe revisitedandapproachedinawaythatdoesn’tleadtospotzoning.Segelbaumaskedwhy thereareconcernsaboutrezoningtoIͲ1andthisuseseemstofitinthisparticularlocation. Johnsonrespondedthatthisisawaytobeconsistentandthismaybeanopportunitytocreate codeclarity.Bakeragreedthatordinancesshouldbeamendedtosupporttheseusesbut doesn’thaveconcernwithaddressingthepresentneedandallowingtheAOWLprojectto moveforward.BakerremindedtheCommissiontherewasamotiononthetable.ChairBlum statedthefindingsofstaffarecredibleandCUPsinthenearbyareahavediversifiedthearea andthisproposedchangecontributestothediversityconsistentwithgrowthinthatarea.The applicantisseekingtoofferincreasedservicesandwillbedoingotherworkaspartoftheir projectthatwillbeanassettoGoldenValley.Blumstatedhehasreservationsonifthisisthe perfectroutetotakebutwillvoteyesonthemotion. IntroductiontoJustDeedsProject–PresentationbyCityAttorneyMariaCisneros MariaCisneros,GoldenValleyCityAttorney,startedherpresentationoftheJustDeedsProject, startedbyCityCouncilandtheHumanRightsCommission.Thisprojectwascreatedtodiscussthe issueofdiscriminatorycovenantsinGoldenValley.In2019,itwasruledthathomeownerscould dischargethediscriminatorycovenantsontheirproperty;theCityCouncilandHumanRights Coalitionwillbeinvolvedtohelpresidentswiththatdischargeprocess. Cisnerosplayedavideoonthisproject. Cisnerosincludedlanguageinherpresentationofthecovenantfoundonherproperty, discussedherfamily,theimpactsthecovenantshavehadandwouldhavehadonherfamilyat thetimethecovenantwassetinplace.Shecitedminutesfromtwoplanningcommission meetingsin1938thatapprovedplatsforWestTyrolHillswithdiscriminatorylanguageinthe approval.CisnerosshowedamapofGoldenValleywithlocationsofthecovenantsdisplayed, thereare1,600discriminatorycovenantsinGoldenValley.Shediscussedpatternsincovenant locationsandspecificallytheareathatbordersMinneapolis,asredliningwasprevalentin Minneapolis.Thepresentationelaboratedonlastingimpactsofthesecovenantsaswellaswhat Commissionerscandomovingforward.Commissionersaskedquestionsandhadadiscussion onprocessandparticularsfromtheLegislativedetermination.
