05-02-06 CC MinutesRegular Meeting of the City Council May 2, 2006 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on May 2, 2006 at 6:30 pm. The following members were present: Freiberg, Loomis, Pentel, Scanlon and Shaffer. Also present were: Thomas Burt, City Manager; Jeannine Clancy, Director of Public Works; Allen Barnard, City Attorney; and Judy Nally, Administrative Assistant. Approval of Agenda MOVED by Pentel, seconded by Freiberg and motion carried unanimously to approve the agenda of May 2, 2006 as submitted. Citizen Input Mayor Loomis introduced the agenda item. Hearing and seeing no one, the Mayor continued the meeting. Approval of Consent Agenda MOVED by Shaffer, seconded by Pentel and motion carried unanimously to approve the agenda of May 2, 2006 as amended: Removal of Approval of Minutes - City Council Meeting - April 17, 2006; Authorization to Sign Agreement with WSB & Associates, Inc. for Pavement Management Program Construction Observation Services and Authorization to Sign Agreement with Short Elliott Hendrickson, Inc. for Miscellaneous City Project Construction Services. Approval of Minutes - City Council Meeting - April 17, 2006 Council Member Shaffer requested the minutes reflect that Mayor Loomis was absent and he served as Mayor Pro Tem. MOVED by Shaffer, seconded by Freiberg and motion carried unanimously to approve the City Council meeting minutes of April 17, 2006 as amended: change Mayor Loomis to Mayor Pro Tem Shaffer. *Bills and Claims MOVED by Shaffer, seconded by Pentel and motion carried unanimously to authorize the payment of the City and Housing and Redevelopment Authority bills as submitted. Regular Meeting of the City Council May 2, 2006 Page 2 *Fireworks Permit - Americana Fireworks Display Company for Golden Valley Days Art and Music Festival MOVED by Shaffer, seconded by Pentel and motion carried unanimously to approve the fireworks display permit for the Americana Fireworks Display Company to discharge aerial fireworks at the Golden Valley Days Art and Music Festival. Peddler's License - Williams Window Solutions & Renovations MOVED by Shaffer, seconded by Pentel and motion carried unanimously to approve the peddler's license for Williams Window Solutions & Renovations. Peddler's License - Trugreen Chemlawn MOVED by Shaffer, seconded by Pentel and motion carried unanimously to approve the peddler's license for Trugreen Chemlawn. *Minutes of Boards and Commissions MOVED by Shaffer, seconded by Pentel and motion carried unanimously to receive and file the minutes as follows: Bassett Creek Water Management Commission - March 16, 2006 Planning Commission - March 27, 2006 Human Services Foundation - February 13, 2006 Board of Zoning Appeals - March 28, 2006 Envision Connection Project Board of Directors - March 23, 2006 Election Task Force - March 27, 2006 Joint Planning Commission and Environmental Commission - March 27, 2006 *Bids - Street Markings and Striping MOVED by Shaffer, seconded by Pentel and motion carried unanimously to award the bids for 2006 street marking and striping to the lowest responsible bidder, AAA Striping Service Co. for $90,385.00. Authorization to Sign Agreement with WSB & Associates, Inc. for Pavement Management Program Construction Observation Services Council Member Frieberg had questions about the costs of hiring a consultant versus hiring a new employee. Jeannine Clancy answered questions from the Council. MOVED by Freiberg, seconded by Shaffer and motion carried to authorize the Mayor and City Manager sign an agreement with WSB & Associates, Inc.for construction observation services for an amount not to exceed $95,424. Council Member Pentel and Scanlon voted no. *Proclamation for Public Works Week MOVED by Shaffer, seconded by Pentel and motion carried unanimously to proclaim May 21-27, 2006 as Public Works Week. *Proclamation for Arbor Day and Month MOVED by Shaffer, seconded by Pentel and motion carried unanimously to proclaim May 25, 2006 as Arbor Day and May as Arbor Month. Regular Meeting of the City Council May 2, 2006 Page 4 Authorization to Sign Agreement with Short Elliott Hendrickson, Inc. for Miscellaneous City Project Construction Services Council Member Freiberg asked about the status of the property owner with the driveway on Plymouth Avenue North. Thomas Burt and Jeannine Clancy answered questions from the Council MOVED by Shaffer, seconded by Pentel and motion carried unanimously to authorize the Mayor and City Manager sign an agreement with Short Elliott Hendrickson to provide construction services for Xenia Avenue/Golden Hills Drive improvements, Plymouth Avenue North sidewalk, and Honeywell Little League Field improvements for $40,300. *Board/Commission Appointments and Reappointments MOVED by Shaffer, seconded by Pentel and motion carried unanimously to make the following appointments: Human Services Foundation: Toots Vodovoz 2 year term term expires - 5/1/08 Shep Harris 2 year term term expires - 5/1/08 MOVED by Shaffer, seconded by Pentel and motion carried unanimously to make the following reappointments: Board of Zoning Appeals: Mike Sell 1 year term Building Board of Review: Angie Knodel 3 year term Human Services Foundation: Steve Schumacher 2 year term Environmental Commission: Rich Baker 3 year term term expires - 5/1/07 term expires - 5/1/09 term expires - 5/1/08 term expires - 5/1/09 Regular Meeting of the City Council May 2, 2006 Page 5 Public Hearing_- Ordinance #344 - Amendments to Chapter 11 Regarding Accessory Uses in the Commercial, Light Industrial, Industrial, Business and Professional Offices and Institutional Zoning Districts The following ordinance was MOVED by Shaffer, seconded by Freiberg: ORDINANCE NO. 344, 2ND SERIES AN ORDINANCE AMENDING THE CITY CODE Amendments to Chapter 11 Regarding Accessory Uses in the Commercial, Light Industrial, Industrial, Business and Professional Offices and Institutional Zoning Districts Thomas Burt introduced the agenda item and answered questions from the Council. Allen Barnard answered questions from the Council The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Pete Nelson, Chester Bird American Legion, stated they have three acres of land and feels that property owners with larger lots may be able to put more than one unit on their property; feels that business should be able to store equipment in storage units on their property and there are cost implications if they are not able to store items for short periods of time. Bob Hill, Chester Bird American Legion; had questions on how businesses could add additions onto their existing building; wanted to know the difference between an addition on the Legion and using an accessory building for patrons to smoke in; stated that St. Louis Park allowed the Legion to add on a building and allows smoking in the new addition and asked if Golden Valley would allow it. Sharon Braaten, Manager, Chester Bird American Legion, asked if they could build a building 25 feet away from their existing building with heating and ventilation for patrons to smoke in and asked about the process for getting a building permit. The Mayor closed the public hearing. MOVED by Shaffer, seconded by Freiberg and motion carried unanimously to continue the public hearing for consideration of Ordinance #344 to the City Council meeting of May 16, 2006. The Council requested staff to prepare an amended version of the Ordinance for discussion at the May 9, 2006 Council/Manager meeting. Regular Meeting of the City Council May 2, 2006 Page 6 Request by United States Luge Association for Use of City Streets to Conduct the USA Luge Slider Search Jeannine Clancy introduced the agenda item and answered questions from the Council. Thomas Burt answered questions from the Council. Heather Leonard, Allianz Life and Tony Benshoof, United States Luge Association, reviewed the request and answered questions from the Council. MOVED by Pentel, seconded by Shaffer and motion carried unanimously to approve the request from Allianz and the US Luge Association to conduct the Luge Slider Search Event on June 10-11, 2006 from 7:30 am to 5:30 pm, and authorize staff to close Manor Drive in the vicinity of Zenith Avenue North and Parkview Boulevard in order to conduct the event. Call for Public Hearing - 2005 NPDES Phase II, Storm Water Pollution Prevention Plan, Annual Report to the Minnesota Pollution Control Agenda - 6/6/06 Jeannine Clancy introduced the agenda item and answered questions from the Council. Member Pentel introduced the following resolution and moved its adoption: RESOLUTION 06-31 RESOLUTION PROVIDING FOR A PUBLIC HEARING ON THE 2005 NPDES PHASE II, STORM WATER POLLUTION PREVENTION PLAN (SWPPP), ANNUAL REPORT TO THE MINNESOTA POLLUTION CONTROL AGENCY The motion for the adoption of the foregoing resolution was seconded by Member Freiberg and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Loomis, Pentel, Scanlon and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Announcements of Meetings Some Council Members may attend the Rotary Fundraiser on May 5, 2006. Some Council Members may attend the Golden Valley Historical Society Douglas Drive Antique Road Show on May 6, 2006 at The Heathers at 1:30 pm. Some Council Members may attend the League of Women Voters meeting on May 6, 2006 at 10 am at the Metropolitan. The next Council/Manager meeting will be held on May 9, 2006 at 6:30 pm. Regular Meeting of the City Council May 2, 2006 Page 7 Announcements of Meetings - Continued Some Council Members may attend the Connection Project Bridge Builder Training on May 12, 2006 from 9 am to 4 pm at the Golden Valley Country Club. The next City Council meeting will be held on May 16, 2006 at 6:30 pm. The next Bassett Creek Water Management Commission will be held on May 18, 2006 at 11:30 am. Golden Valley Days Art and Music Festival will be held on May 19 and 20, 2006. Some Council Members may attend the Optimist Gala on May 23, 2006 at 6 pm at the Golden Valley Country Club. A City Council meeting will be held on June 6, 2006 at 6:30 pm. Mayor and Council Communications No action and/or discussion took place.
