07-05-05 CC MinutesRegular Meeting of the City Council July 5, 2005 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley�Road in said City on July 5, 2005 at 6:30 p.m. The following members were present: Freiberg, Grayson, Loomis, Pentel and Shaffer. Also present were: Thomas Burt, City Manager; Jeannine Clancy, Director of Public Works; Allen Barnard, City Attorney; and Judy Nally, Administrative Assistant. Northwest Hennepin Human Services Council Presentation - Smoke Free Ordinance Survey LeeAnn Mortenson, Northwest Hennepin Human Services Council; and Barbara Schillo, Minnesota Partnership for Action Against Tobacco; reviewed the smoke free ordinance survey and answered questions from the Council. Approval of Agenda MOVED by Pentel, seconded by Freiberg and motion carried unanimously to approve the agenda of July 5, 2005 as submitted. Citizen Input Mayor Loomis introduced the agenda item. Hearing and seeing no one, the Mayor continued the meeting. Approval of Consent Agenda MOVED by Grayson, seconded by Freiberg and motion carried unanimously to approve the agenda of July 5, 2005 as amended: Removal of Approval of Minutes - City Council Meeting - June 21, 2005; Minutes of Boards and Commissions - Board of Zoning Appeals - May 24, 2005 and Environmental Commission - May 23, 2005. Mayor Loomis read the items listed on the consent agenda. Approval of Minutes: City Council Meeting - June 21, 2005 Mayor Loomis made corrections to the Public Hearing - Preliminary Design Plan Approval - PUD #101 — Maywood. MOVED by Loomis, seconded by Pentel and motion carried unanimously to approve the City Council meeting minutes of June 21, 2005 as amended: Public Hearing - Preliminary Design Plan Approval - PUD #101 - Maywood - name correction to Jelan Heidelberg and amend motion to reflect that Mayor Loomis voted no. Regular Meeting of the City Council July 5, 2005 Page 2 *Bills and Claims MOVED by Grayson, seconded by Freiberg and motion carried unanimously to authorize the payment of the City and Housing and Redevelopment Authority bills as submitted. *General Business Licenses MOVED by Grayson, seconded by Freiberg and motion carried unanimously to authorize the issuance of licenses as recommended by staff. *Peddler's License - T. J. Beagan for Century 21 Luger MOVED by Grayson, seconded by Freiberg and motion carried unanimously to approve the peddler's license for T. J. Beagan for Century 21 Luger. *Minutes of Boards and Commissions MOVED by Grayson, seconded by Freiberg and motion carried unanimously to receive and file the minutes as follows: Open Space and Recreation Commission - May 23, 2005 Envision Connection Project Executive Board - May 26, 2005 Human Services Foundation - May 9, 2005 Minutes of Boards and Commissions - Board of Zoning Appeals - May 24, 2005 Council Member Freiberg wanted to know if the property owner at 117 Paisley Lane filed an appeal to the Council regarding the Board decision. Thomas Burt and Allen Barnard answered questions from the Council. MOVED by Freiberg, seconded by Grayson and motion carried unanimously to receive and file the May 24, 2005 Board of Zoning Appeals minutes. Minutes of Boards and Commissions - Environmental Commission - May 23, 2005 Council Member Pentel asked about the status of reviewing a comprehensive lighting plan. Thomas Burt answered questions from the Council. MOVED by Pentel, seconded by Shaffer and motion carried unanimously to receive and file the May 23, 2005 Environmental Commission minutes. Regular Meeting of the City Council July 5, 2005 Page 3 Public Hearing - Recorded Utility and Platted Drainage and Utility Easement Vacations - PUD #91 - RLT Addition Jeannine Clancy introduced the agenda item. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one, the Mayor closed the public hearing. Member Grayson introduced the following resolution and moved its adoption: RESOLUTION 05-46 RESOLUTION VACATING CERTAIN RECORDED UTILITY AND PLATTED DRAINAGE AND UTILITY EASEMENTS IN THE PLAT OF RLT ADDITION P.U.D. NO. 91 The motion for the adoption of the foregoing resolution was seconded by Member Freiberg and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Grayson, Loomis, Pentel and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Continued Public Hearing - Preliminary Design Plan Approval - PUD #101 - Maywood Thomas Burt introduced the agenda item and answered questions from the Council. Allen Barnard answered questions from the Council. The Mayor opened the meeting for public input and persons present to do so were afforded the opportunity to express their views thereon. Hearing and seeing no one the Mayor closed the public hearing. MOVED by Pentel, seconded by Grayson and motion carried to continue the public hearing for consideration of the Preliminary Design Plan for PUD No. 101, Maywood, until the July 19, 2005 City Council meeting. Approval of Plat - PUD #91 - RLT Second Addition Jeannine Clancy introduced the agenda item. Member Freiberg introduced the following resolution and moved its adoption: RESOLUTION 05-47 RESOLUTION FOR APPROVAL OF PLAT - RLT SECOND ADDITION P.U.D. NO. 91 Regular Meeting of the City Council July 5, 2005 Page 4 Approval of Plat - PUD #91 - RLT Second Addition - Continued The motion for the adoption of the foregoing resolution was seconded by Member Pentel and upon a vote being taken thereon, the following voted in favor thereof: Freiberg, Grayson, Loomis, Pentel and Shaffer; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Authorization to Sign PUD Permit - PUD #91 - Amendment #1 - Rudy Luther Toyota Jeannine Clancy introduced the agenda item. MOVED by Freiberg, seconded by Grayson and motion carried to authorize the Mayor and City Manager to sign the Amended PUD Permit, Amendment No. 1, P.U.D. No. 91, Rudy Luther Toyota. Announcements of Meetings The next Housing and Redevelopment Authority Meeting will be held on July 12, 2005 beginning at 6:30 p.m. followed immediately by the Council/Manager meeting. The next City Council meeting will be held on July 19, 2005 at 6:30 p.m. The next Bassett Creek Water Management Commission will be held on July 21, 2005 at 11:30 a.m. National Night Out celebrations will be held throughout the evening on Tuesday, August 2, 2005. A City Council meeting will be held on Monday, August 1, 2005 at 6:30 p.m. A Council/Manager meeting will be held on August 9, 2005 at 6:30 p.m. A City Council meeting will be held on August 16, 2005 at 6:30 p.m. Mayor and Council Communications Council Member Grayson announced that he will not seek re-election in November but will run if a vacancy occurs in the 2006 Minnesota Legislature.
