08-19-03 CC MinutesRegular Meeting of the City Council August 19, 2003 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Golden Valley, Hennepin County, Minnesota was held at 7800 Golden Valley Road in said City on August 19, 2003 at 6:30 p.m. The following members were present: Grayson, Johnson, LeSuer, Loomis, and Tremere. Also present were: Thomas Burt, City Manager; Jeannine Clancy, Director of Public Works; Allen Barnard, City Attorney; and Judy Nally, Administrative Assistant. Human Services Foundation Tournament Council Member Johnson stated the Human Services Foundation Golf Classic will be held on September 12, 2003 beginning at 9:00 a.m., at the Brookview Golf Course and encouraged golfers and non -golfers to participate. Envision Presentation - Approval of Envision Format Plan and Comprehensive Communications Plan Paul Snyder and Gary Cohen, Co -Chairs of the Format Subcommittee reviewed the format recommendations and answered questions from the Council. MOVED by Tremere, seconded by LeSuer and motion carried unanimously to approve "Envision Golden Valley Town Meeting - Format Recommendation" dated August 19, 2003. Jill Field, Communications Subcommittee, reviewed the communications plan and answered questions from the Council. MOVED by Grayson, seconded by Tremere and motion carried unanimously to approve the Comprehensive Communications Plan dated August 19, 2003. Approval of Agenda MOVED by LeSuer, seconded by Johnson and motion carried unanimously to approve the agenda of August 19, 2003 as amended: Addition of Item - Human Services Foundation Tournament. Citizen Input Mayor Loomis introduced the agenda item. Regular Meeting of the City Council August 19, 2003 Page 2 Citizen Input Continued Kathy Julius, 1008 Quebec Avenue North, stated that this weekend, members from Calvary Church came to her house to listen to the service on Sunday and stated it was the quietest service since she moved in; she stated in the past 2-3 years the music had become increasingly louder and she could even hear the spoken word from her porch; stated when she called to complain she was encouraged to attend the service and join the church; stated she in encouraged that progress has been made with the Church and is planning on attending the Church/neighborhood meeting on August 20, 2003 and wanted to know if the Council needed any information from the neighborhood before the public hearing on the Calvary addition. Thomas Burt stated that consideration of the preliminary design plan for the Church was originally scheduled for September 2 but the item will be continued until the September 16, 2003 City Council meeting. The Mayor continued the meeting. Approval of Consent Agenda MOVED by Johnson, seconded by Grayson and motion carried unanimously to approve the items on the consent agenda, indicated by an asterisk (*), except removal of Minutes of Boards and Commissions - Basset Creek Water Management Commission - July 17, 2003; Planning Commission - July 14, 2003 and Human Rights Commission - June 12, 2003. Mayor Loomis read the items listed on the consent agenda. *Approval of Minutes: City Council Meeting - June 3 and June 16, 2003 and Council/Manager Meeting -August 12, 2003 MOVED by Johnson, seconded by Grayson the City Council Meeting minutes of June 3 meeting of August 12, 2003 as submitted. *Approval of Check Register and motion carried unanimously to approve and June 16, 2003 and the Council/Manager MOVED by Johnson, seconded by Grayson and motion carried unanimously to authorize the payment of the bills as submitted. *General Business Licenses MOVED by Johnson, seconded by Grayson and motion carried unanimously to authorize the issuance of licenses as recommended by staff. Regular Meeting of the City Council August 19, 2003 Page 3 *Commercial Fertilizer Applicator License MOVED by Johnson, seconded by Grayson and motion carried unanimously to approve the commercial fertilizer applicator license as recommended by staff. Minutes of Boards and Commissions - Bassett Creek Water Management Commission -July 17, 2003 Council Member Tremere wanted to know if the Council should contact the Hennepin County Commissioners regarding the proposed tax increase to the BCWMC district. MOVED by Tremere, seconded by LeSuer and motion carried unanimously to direct staff to contact the County about the ad valorum tax that the Bassett Creek Water Management Commission is requesting be placed across the district and inform them that, given the economic climate, we are questioning the timing. MOVED by Tremere, seconded by LeSuer and motion carried unanimously to receive and file the Bassett Creek Water Management Commission minutes of July 17, 2003. Minutes of Boards and Commissions - Planning Commission - July 14, 2003 Council Member LeSuer stated that on page 3, paragraph 5, the minutes should be changed from "is going to" to "may be a proposal to" be a high density, mixed-use development at the Olympic Printing. MOVED by LeSuer, seconded by Grayson and motion carried unanimously to request the Planning Commission to amend the July 14, 2003 minutes as follows: page 3, paragraph 5, change "is going to" to "may be a proposal to" be a high density, mixed-use development at the Olympic Printing. MOVED by LeSuer, seconded by Johnson and motion carried unanimously to receive and fie the Planning Commission minutes of July 14, 2003. The Council directed staff to set up a meeting between the Council and Planning Commission to discuss amendments to the Residential Zoning District in the Zoning Code. Minutes of Boards and Commissions - Human Rights Commission - June 12, 2003 Council Member LeSuer suggested the Human Rights Commission look at housing. MOVED by LeSuer, seconded by Johnson and motion carried unanimously that the Council directs the Human Rights Commission to proactively study the issue of housing within the City from a human rights perspective. Regular Meeting of the City Council August 19, 2003 Page 4 Minutes of Boards and Commissions - Human Rights Commission - June 12, 2003 - Continued MOVED by LeSuer, seconded by Grayson and motion carried unanimously to receive and file the Human Rights Commission of June 12, 2003. *Letter from Kenneth Huber Regarding South Tyrol Hills Trail MOVED by Johnson, seconded by Grayson and motion carried unanimously to receive and file the letter from Kenneth Huber, dated August 14, 2003 regarding the South Tyrol Hills Trail. Call for Feasibility Study - 2005 Pavement Management Program Member Johnson introduced the following resolution and moved its adoption: RESOLUTION 03-33 RESOLUTION ORDERING PREPARATION OF REPORT 2005 PAVEMENT MANAGEMENT PROGRAM The motion for the adoption of the foregoing resolution was seconded by Member Grayson and upon a vote being taken thereon, the following voted in favor thereof: Grayson, Johnson, LeSuer, Loomis and Tremere; and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and her signature attested by the City Clerk. Appointment to 1-394 Express Lanes Community Task Force MOVED by Johnson, seconded by Grayson and motion carried unanimously to appoint Council Member Blair Tremere to represent the City of Golden Valley on the Minnesota Department of Transportation 1-394 Express Lanes Community Task Force. South Tyrol Hills Trail Mayor Loomis introduced the agenda item. Thomas Burt answered questions from the Council. Jim Ladner, 1414 Tyrol Trial, gave a power point presentation; reviewed the background and history of the trail and expressed concerns with the plan and process; feels no major redo is needed; concerned for city financial resources; feels aesthetics can be better; consider the historical context and location of trail, expressed concern for safety and environmental issues, and suggested other ideas for the repair of the trail. Regular Meeting of the City Council August 19, 2003 Page 5 South Tyrol Hills Trail - Continued MOVED by Tremere, seconded by Johnson and motion carried unanimously that the Council direct staff to undertake an evaluation of the trail paving policy and to consider a possible need for alternative design features or options that would address unique situations in the community and suspend during that process the pending trail paving in the South Tyrol area until the Council has formally and publicly reviewed the staff input and has taken action. The City Council will discuss the trail paving policy at the September 9, 2003 Council/Manager meeting. Announcement of Meetings The next Bassett Creek Water Management Commission meeting will be held on August 21, 2003 at noon in the Council Conference Room. The next City Council meeting will be held on September 2, 2003 at 6:30 p.m. A Housing and Redevelopment Authority meeting will be held on September 9, 2003 at 7:00 p.m. The next Council/Manager meeting will be held on September 9, 2003 at 7:30 p.m. The Human Services Foundation Golf Classic will be held on September 12, 2003, beginning at 9:00 a.m., at the Brookview Golf Course There will be a City Council meeting on September 16, 2003 at 6:30 p.m. Mayor and Council Communications Thomas Burt will prepare a memo for the Council on fiscal disparities.
