12-19-39 City Council MinutesDecember 19, 1939 Meeting called to order by the chairman Paul A. Seeman. Members present: Seeman, Frandsen, Tolg, Wilson. Members absent: Reiss Minutes of the previous meeting read. There being no corrections or objections minutes were accepted as read. Motion by Tolg, seconded by Frandsen, to accept the recommendation of the planning commission that a special building permit be granted to G. K. Halvorson for Lot 1, Block 1, Delphian Heights, 2nd unit, and to Louis Klugman for Lot 9, Block 1, McNair's first addition. Seeman, Frandsen, Tolg, Wilson (Yes) Motion by Tolg, seconded by Frandsen, that a special meeting be called for Tuesday evening, December 26, 1939, at 8 o'clock to take up the acceptance of the plat of the Glen Urban addition and such other business as may coms before the meeting. Seeman, Frandsen, Tolg, Wilson (Yes) Lotion by Tolg, seconded by Frandsen, to adopt the following resolution: WHEREAS the owners of land in Delphian Heights, Delphian Heights Second. Unit and Delphian Heights Third Unit, being platted areas in the Village of Golden Valley,' Minnesota, have defaulted in the payment of taxes and special assessment$, assessed and levied against the property located in said additions; and WHEREAS in 1931 a water main improvement was installed in said Addition and special assessments were levied against the lots in said platted areas; and WHEREAS certificates of indebtedness were issued by the Village of Golden Valley, Minnesota, to defray the cost of said improvement; and WHEREAS said certificates of indebtedness became due and were in default by reason of the fact that the owners of the lots in said platted Additions failed and refused to pay the taxes and special assessments against said property; and WHEREAS the Village of Golden Valley was obliged to refund said certificate of indebtedness by issuing to the State of Minnesota its refunding bonds in the principal amount of $25,000; and WHEREAS a large number of lots in said Delphian Heights. Delphian Heights Second Unit and'Delphian Heights Third Unit have been sold for non-payment of taxes and special assessments and the same have been bid in by the State of Minnesota, and the time to redeem from said tax sales will expire during the months of December, 1939, January 1940 and February 1940, and by reason thereof title to said lots will be forfeited to the State; and WHEREAS the Village of Golden Valley has become obligated to the extent of over $25,000 by reason of the issuing of said refunding bonds, and can be reimbursed only by the proceeds of collections of said special assessments; and WHEREAS the State of Minnesota will, after the expiration of time to redeem from said tax sales, conduct sales of said lands in said Additions; and WHEREAS it is necessary to protect the preferential rights of the Village of Golden Valley, Minnesota, in and to said special assessments now in default, or hereafter to become due, as well as the rights of the Village of Golden Valley in and to general taxes; 1 -2- NOGG THEREFORE, BE IT RF'SOLVED by the Village Council of the Village of Golden Valley that formal demand be made of the County Commissioners of Hennepin County, Minnesota, that upon any sale of said lands in said Delphian F, ights, Delphian Heights Second Unit and Delphian Heights Third Unit after expiration of time to redeem and after forfeiture of title to the State of Minnesota, no lot in any of said additions be sold far less than the total of special assessments (including those now in default and those hereafter to accrue), levied and assessed against such lot, and that no sale of any such lot be made except upon a re -appraisal thereof, and that no lot be sold for less than the full and true value thereof, and FURTHER BE IT RESOLVED that the Village Council petition said Board of County Commissioners to notify said Village Council before any sale of said forfeited lands is made so as to afford to said Council opportunity to protect its rights in the matter, and that no sale thereof be made in any event except in accordance with the terms and conditions set forth in the preceding paragraph. BE IT FUPTHER RESOLVED that a copy of this resolution be forwarded to the Board of County Commissioners of Hennepin County, Minnesota, to the County Auditor of Hennepin County, Minnesota, and to the Minnesota Tax Commission.
