Special Meeting June 11,1940
Frsuant to due call and notice thereof, a special meeting
of the"Village Council of the Village of Golden Valley, Minnesota, was
held at the. Village Hall in said Village on the 11th day of June, 1940,
at 8 o'clock, P M.
The following members were present:
Raskop Frandsen, Reiss Wilson
and the following were absent: Tolg'
The Village Attorney, Mr. Bradley, was also present.
The Clerk presented an admission of due service of notice of
the hearing from the absent member, which was examined and found satis-
factory and ordered placed on file. The President of the Village Council
announced that the meeting was called for the purpose of considering de-
velopments in connection with the street improvement in Tyrol Hills and
West Tyrol Hills. The Village Clerk presented to the Council three peti-
tions
eti-tions for the construction of street improvements in Tyrol Hills and Iffest
Tyrol Hills, together with his certificate that he had compared the sig-
natures thereon with the records in the office of the Register of Deeds,
and found and reported that each of said petitions were signed by more
than 51% in frontage of the real property abutting on the parts of the
street or streets named in the petition as the location of the improve-
ment. After due consideration of said petitions and the certificate and
report of the Clerk, Trustee Rei 6a introduced the following
resolution, and moved its adoption:
RESOLUTION DETERMINING SUFFICIENCY OF
PETITIONS FOR STREET IMPROVEMENT.
WHEREAS, three petitions have been filed in the office of the

Village Clerk for the improvement by grading, paving, or macadamizing
the roadbed, setting curb and gutter stones, and laying drainpipes and
constructing necessary culverts or drains in the following streets.
North Tyrol Trail from Wayzata Boulevard
to Ivy Lane
South Tyrol Trail from France Avenue to
North Tyrol Trail
Brenner Pass from North Tyrol Trail to
South Tyrol Trail
All of Alpine Pass
All of the above streets being in Tyrol Hills
Addition;
North Tyrol Trail from the intersection of
Wayzata Boulevard service drive to the
intersection of Meadow Lane
Parkview Terrace from North Tyrol Trail and
running 769 ft. in a northerly direction
Sunset Ravine commencing at North Tyrol Trail
and running 488 ft. in a southerly direc-
tion
Westwood Drive commencing at Sunset Ravine and
running 340 ft. in a northwesterly direc-
tion
All of the above streets being in Vilest Tyrol
Hills AdVition;
Meadow Lane from Parkview Terrace to North
Tyrol Trail, all in West Tyrol Hills
and
WHEREAS, the Village Clerk has compared the signatures thereon
with the records in the office of the Register of Deeds and has presented
the petitions to the Village Council and reported his findings that each
thereof is signed by the owners of more than 51% in frontage of the real
property abutting on the parts of the street or streets named in the peti-
tion as the location of the improvement,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Golden Valley that the Council hereby finds, determines, and
declares that each of said petitions is satisfactory as to form and in
accordance with law and is signed by more than the required percentage
of owners in frontage of the real property abutting on the parts of the
street or streets named in the petitions as the location of the improvement.

The motion for the adoption of the foregoing resolution was
duly seconded by Trustee Frandsen , and upon vote being taken
thereon, the following voted in favor thereof: Raskop, Frandsen, Reiss, Wilson
and the following voted against the same: none
whereupon said resolution was declared duly passed and adopted.
Trustee Frandsen introduced the following resolution
and moved its adoption:
RESOLUTION TO PROCEED WITH THE CONSTRUC-
TION OF STREET IMPROVEMENT.
WHEREAS, three petitions have been filed with the Village Council
for the improvement by grading, paving, or macadamizing the roadbed, setting
curb and gutter stones, laying drainpipes and constructing necessary culverts
or drains in the following streets in the Village of Golden Valley:
North Tyrol Trail from Wayzata Boulevard
to Ivy Lane
South Tyrol Trail from France Avenue to
North Tyrol Trail
Brenner Pass from North Tyrol Trail to
South Tyrol Trail
All of Alpine Pass
All of the above streets being in Tyrol Hills
Addition;
North Tyrol Trail from the intersection of

intersection of Meadow Lane
Parkview Terrace from North Tyrol Trail and
running 769 ft. in a northerly direction
Sunset Ravine commencing at North Tyrol Trail
and running 488 ft. in a southerly direc-
tion
Westwood Drive commencing at Sunset Ravine and
running 340 ft. in a northwesterly direc-
tion
All of the above streets being in 'Nest Tyrol
Hills Addition;
Meadow Lane from Parkview Terrace to North
Tyrol Trail, all in West Tyrol Hills;
and
WHEREAS, said petitions have been determined to be sufficient
as to form and signed by more than the required percent in frontage of
the real property abutting on the part of the street or streets named in
the petitions as the location of the improvements, and
WHEREAS, the petitions have been referred to Albert Graber, a

competent engineer selected by the Council, and his report has been
filed, advising the Council that in his opinion the proposed improve-
ment should be made, and
WHEREAS, the Council has heretofore considered and acted in
reference to said matter and has determined to make said improvements,
and a portion thereof consisting of curb and gutter stones constructed
by the aid of the Works Progress Administration,and the macadamizing in
part of certain streets has been completed but the greater part of said
work remains to be done, and
WHEREAS, the attention of the Council has been called to the
fact that certain defects exist in the proceedings heretofore taken and
that in order to assure the approval of the obligation issued for financ-
ing -the construction of said improvements, it is necessary to re -adopt
said proceedings,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Golden Valley, Minnesota, as follows:
1. The action heretofore taken in appointing Albert Graber
engineer in connection with the construction of street improvements in
Tyrol Hills and West Tyrol Hills is hereby rttified, confirmed, and
adopted and the plans and specifications and estimate of cost heretofore
prepared by said engineer and filed with the Village Clerk are accepted,
approved, and adopted.
2. The Village Council shall meet at the Village Hall on Fri-
day, the 28th day of June, 1940, at 8 o'clock, P. M., for the purpose of
considering each of said petitions and taking action in reference to the
matter, and the Village Clerk is hereby directed to give notice of said
meeting by publication in the Robbinsdale Post, the official Village news-
paper, there being no legal newspaper published in said Village, which
notice shall be published two successive weeks, the last publication at
least seven days prior to the date set for hearing.
3. In event said petitions are approved, the said petitions
and the streets described therein shall be united in one improvement,
which shall be hereafter known and designated as Street Improvement No. 1
of the Village of Golden Valley.
4. The Village Council shall meet at the Village Hall on the
day of June, 1940, at 8 o'cloth, P. m., for the purpose of opening
and considering bids for the construction of said Street Improvement No. 1
in accordance with the plans and specifications prepared by the engineer,
and the Village Clerk is hereby authorized and directed to cause advertise-
ment for bids for such improvement in the official newspaper and in the
Improvement Bulletin by one publication not less than one week prior to
the time above set forth.
5. In order to finance the cost of said improvement, the Village
of Golden Valley shall issue Improvement Warrants under the provisions of
Section 1918-29, Mason's Yinnesota Statutes, which warrants shall be in the
amount of approximately $10,000, or so much thereof as may be needed to pay
I the cost of said improvement,shall mature serially in one to five years
from date thereof in an approximately equal amount, shall be in the denom-
ination of $1,000 each, and shall be in such form and with such other details
as the Village Council shall hereafter determine, and the Village Clerk is
hereby authorized and directed to cause notice of the sale of said warrants
to be given by publication for two weeks in the official newspaper, specify-
ing that bids will be received for approximately the amount of warrants
specik-)t elivery to be made not more than sixty days from the date of sale
and thereafter at the bidder's option.

6. All resolutions or parts of resolutions heretofore adopted
are hereby amended to conform to this resolution, and as so amended are
hereby ratified, confirmed, and adopted as the action of the Village
Council, and all contracts and expenditures heretofore made in connec-
tion with said improvement are hereby ratified and confirmed.
The motion for the adoption of the foregoing resolution was
duly seconded by Trustee Reiss , and upon vote being taken thereon,
the following voted in favor thereof:
Raskop,Frandsen, Reiss, Milson
and the following voted against the same; h one

Motion by Reiss seconded by Frandsen to adopt the following resolution:
Be it resolved by the Village Council of the Village of @olden
Valley that the village employ the firm of Fletcher,Dorsey,Ba.rker,Colman
and Barber for extra legal services in connection with street improvement
No.1, the fee to not exceed 4300.00 to be paid as an ernense of the
