06-28-40 City Council MinutesExtract of Minutes of Meeting, of the Village Council of Village of Golden Valley, Minnesota, held June 28, 1940. Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Golden Valley, Minnesota, was held at the Village Hall in said Village on the 28th day of dune, 1944, at 8 o'clock, P. M. All members were present. The Village Attorney, Mr. Bradley, and Mr. Howard, special attorney, were also present. The President announced that the meeting was convened to take such action as might be necessary in connection with the making of the street improvement in Tyrol Hills and West Tyrol Hills and that the first order of business would be to hear and consider all persons for or against the making of the proposed irprovement. The Village Clerk presented an affidavit showing publication of a notice of hearing for two successive weeks as required by law, which was examined and found satisfactory and ordered placed on file. The President then announced that the Council would hear such persons as oared to be heard in reference thereto. There were no objections offered. Thereupon Trustee Tolg intro- duoed the following resolution and moved its adoption: RESOLUTION DETERMINING TO MAKE STREET IMPROVEMENT. WHEREAS, petitions have been filed with the Village Clerk ask- ing for the improvement by grading, paving, or macadamizing the roadbed, setting curb and gutter stones, laying drainpipes and constructing neo- essary culverts or drains in certain streets in Tyrol Hills and West Tyrol Hills, and WHEREAS, the Village Council has heretofore determined that said improvement should be made and a portion thereof has been constructed by WE'A labor, and WHEREAS, due to certain defects in the proceedings heretofore taken it has become necessary to have a new hearing and consideration of the matter and to take action thereon, and WHEREAS, due notice of hearing has been given by publication 1 1 1 for two weeks in the official village newspaper, and WHEREAS, all persons who care to be heard in reference thereto have appeared before the Council and been heard, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Golden Valley that the Village shall improve by grading, pav- ing or maoadamising the roadbed, setting curb and gutter stones and lay- ing drainpipes and constructing necessary culverts or drains in the fol- lowing streeta: North Tyrol Trail from the intersection of Wayzata Boulevard service drive to the intersection of Meadow bane Parkview Terrace from North Tyrol Trail and running 769 ft. in a northerly direction Meadow Lane from Parkview Terrace to North Tyrol Trail, all in West Tyrol Hills Sunset Ravine commencing at North Tyrol Trail and running 488 ft* in a southerly direc- tion Westwood drive commencing at Sunset Ravine and running 340 ft. in a northwesterly direc- tion North Tyrol Trail from Wayzata Boulevard to Ivy Lane South Tyrol Trail from France Avenue to North Tyrol 'rail Brenner Vass from North Tyrol Trail to South Tyrol Trail All of Alpine Pass BE IT FURTHER RESOLVED that said streets shall be combined into a single street improvement to be hereafter designated as Street Improve- ment No. 1 of the Village of Golden Valley, BE IT FURTHER RESOLVED that the plans and specifioa.tions hereto- fore prepared for said improvement by Albert Graber, Engineer, are hereby approved, adopted and confirmed as the ne©essary plans and specifications for said improvement, and said Engineer is hereby confirmed as the Village Engineer in connection with said improvement. WILSON Village Clerk 190 The motion for the adoption of the foregoing resolution was duly seconded by Trustee Reiss, and upon vote being taken thereon the fol- lowing voted in favor thereof: Raskop, Frandsen, Tolg, Reiss, Milson and the following voted against the same: done whereupon said resolution was declared duly passed and adopted. The Chairman then announced that the Council would consider bids for the making of the street improvement in accordance with the spec- ifications, the notice of sale and the resolution adopted June 11, 1940. The Clerk presented an affidavit showing publication of a notice for bids in one issue of the official newspaper and an affidavit showing publication of a notice for bids in one issue of the Improvement Bulletin, which said affidavits were examined and found satisfactory and ordered placed on file. The Clerk then announced he had received sealed bids from the following bidders: Scully Equipment Company - 70 cents and 57 cents Utley Foster Company - 38 „ " 29 Fielding & Shepley, Inc. - 54 re n 43 e: or 49 °t �} 40 n Jay Vii, Craig Company 48 ++ f9 32 ' Said bids were V -on ::uen3d and examined and considered by the Council. Thereupon Trustee Tolg introduced the following resolution and moved its adoption: RESOLU'T'ION REFERRING BIDS TO ENGINEER AND OTHERS. BE IT RESOLVED by the Village Council that the bids for Street Improvement No. 1 be referred to the Village Engineer, Village Clerk and the Tyrol Hills Comnittee for examination and report at the next regular council meeting on Tuesday, July 2. The motion for the adoption of the foregoing resolution was duly seconded by Trustee Frandsen, and upon vote being taken thereon the following voted in favor thereof; Raskop, Frandsen, Tolg, Reiss, Wilson and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. I The President then announced that the Council would receive bids for the purchase of warrants on account of Street Improvement No. 1. The Village Clerk presented an affidavit showing publication of a notice of sale for two weeks in the official newspaper, which was examined and found satisfactory and ordered placed on file. The Clerk then announced that no sealed bids had been received. The President then asked if any bidders were presents prepared to submit oral auction bids. None were received. I I
