Minutes of the regular council meeting held Febr.16,1943 were read. Motion by Reiss seconded by Busch that the minutes stand approved as read. Mr. Geo Johnson, Mgr, Suburban Division, Mpls Gas Lght Co explained the new rate reduction to the Council Motion by Frandsen seconded by Busch to adjourn was so ordered. Raskop, Frandsen Reiss Busch Wilson (YES) AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT AND GOVERN- MENT OF A VOLUNTEER FIRE DE- PPARTMENT FOR THE VILLAGE OF GOLDEN VALLEY, HENNEPIN COUN- TY, MINNESOTA. Be it enacted and ordained by the Council of the Village of Golden Valley, that to better protect the lives and prop- erty of its citizens, a Department to be hereafter known as the Golden Valley Fire Department is hereby created. Its object shall be the prevention offire and the preservation and protection of life and property from and during such fires as may occur. SECTION I Article 1. The Fire Department shall consist of a Chief Engineer and two Assistant Engineers and as many fire- men of the age of twenty-one (21) years and not more than fifty-five (55) years old at the time of their election to mem- bership, and who are citizens and resi- dents of the Village of Golden Valley, as are or may be elected and be approved by the Board of Fire Officers, the mini- mum number of firemen to be twenty (20). Article 2. The names of all persons who are candidates for membership and are proposed as members of the Depart- ment shall be presented to the Board of Fire Officers in writing, signed by the President and Secretary -Treasurer of the Golden Valley Fire Department Relief Association, to be elected and approved by the said Board of Fire Officers. All resignations from the Department shall take the same course as elections and propositions to membership as above provided for. Article 3, The Chief and Assistant En- gineers and the President and Secretary - Treasurer shall constitute a Board of Fire Officers who shall meet monthly or more frequently for the transaction of all business of the Department, which Board shall have entire and absolute control over the management of the Department and its government, when such Depart- ment isnot upon active duty. Article 4. Any member of the Depart- ment who has arrived at the age of sixty- five (65) years may be retired from service by the Board of Fire Officers. and in like manner any member who shall be come physically unfit for active service. Article 5, The Board of Fire Officers is hereby authorized, empowered an(f re- quired to adopt, and from time to time to amend, a code of by-laws and rules for the control, management and govern- ment of the Department and for the regulating of the proceedings and busi- nessof said Board. Article 6. The Board of F56 Officers is hereby authorized, empowered and re- quired to inspect from time to time, but at least annually, all buildings and premises where accumulations of com- bustible materials or other hazardous conditions are liable to exist, and to or- der such changes or removals as are in their opinion necessary to safety from fire. For such purpose of inspection, they are empowered hereby to enter any and all buildings and premises at any reasonable hour. Article 7. The Board of Fire Officers is required to devise forms or methods :of keeping records and shall see that records are kept of all alarms of fire, fire losses, methods of extinguishment, drills, hose, apparatus, minor equipment and condition of hydrants and designated water sources. SECTION II Article 1. The Chief Engineer shall be elected by the members of the De- partment at the annual meeting, which election shall be subject to confirmation by the Council. He shall hold office for one year and until his successor has been duly elected and epnfirmed. He may be elected and re-elected as many times as the Department may see fit. Article 2. The Chief Engineer shall appoint two Assistant Engineers, one of whom shall serve also as Fire Marshall. They shall serve for one year or for such part of a year as the Chief En- gineer remains in office. n_ W Artie 3. -The-. (President; Vice -Presi- dent and Secretary -Treasurer shall hold their respective offices in the Depart- ment by virtue of their election to these same offices in the Golden Valley Fire Department Relief Association. Article 4. The Chief Engineer may be removed by the Council for good and sufficient cause after public hearing. Article -5. &n Assistant Engineer may be removed by the Chief Engineer for good and sufficient cause after public hearing before the Board of Fire Officers. SECTION III Article 1. The Chief Engineer shall have the general supervision of the De- partment, which supervision shall be subject to and not conflict with such rules and by-laws for the government and management of the Department as may from time to time be adopted by the Board of Fire Officers as herein provided. Article 2. 'In all cases of fire the Chief Engineer, or, in his absence, an Assist- ant, shall have full power and absolute control and command, and cause the several pieces of apparatus to be worked in the mostadvantageous manner. Article 3. Should the Chief Engineer and .the Assistant Chief Engineers be absent from a fire, the person having charge of the apparatus - first arriving at the fire shall assume the duties of the Chief Engineer until the arrival of his superior officer. Article 4. It shall be the duty of the Chief Engineer to report quarterly to the Council of the Village of Golder. Valley the condition of thevariouspieces of apparatus and appurtenances; the number of hydrants and designated water sources and condition of same: the number of fires during the quarter, their location and cause, and date of same and loss occasioned thereby: and the number of active members in the De- partment, and resignations andexpul- sions passed upon by the Board of Fire Officers. Article 5. The Chief Engineer and his assistants or officers in command at any fids are hereby vested with full and com- plete police authority, and are hereby authorized and directed to require and secure the removal sof any and all ob- structions from in front of and around fire hydrants and designated water sources, and for the purpose are hereby authorized to call upon the head of, or any member or members of any municipal departments for aid and assistance in securing such removal of obstructions. Article 6. It shall be the duty of the Chief Engineer to see that the members of the Department have all hose thoroughly washed and dried after use at fires and drills and that no wet or dirty hose is placed on apparatus. Article 7. It shall be the duty of the Chief Engineer to see that the members of the Department have all hose on ap- paratus changed every thirty days, if not otherwise used and have water run through it every sixty days,. Article 8. It shall be the duty of the Chief Engineer to see that the fire houses are heated during the winter season. Article 9. It shall be the duty of the Chief Engineer to see that all new hose is subjected to a test of 200 pounds hydrostatic pressure and that all hose is tested annually at a hydrostatic pres- sure of 150 pounds. Article 10. It shall be the duty of the officer in charge at a fire or drill to re- port to the Chief Engineer all fire hy- drants and designated water sources that fl are folind frozen, out of order, leaky, or that are set in such a manner as to make it impossible to connect thereto or secure water therefrom. Article 11. It shall be the duty of the Chief -.Engineer to make a permanent record' of all reports of defective, in- operati�gp or improperly set fire hydrants and nated water sources, and he shall submit a report to the Council giv- ing the locations, names of makers, and specifications of the troubles. Article 12. It shall 'be the duty of the Secretary -Treasurer of the Department to keep a permanent record of the fire and drill service of each member. A copy of this record shall be submitted to the Board of Fire Officers at the close of each year. Article 13. It shall be the duty of the Board of Fire Officers to appoint five drivers for the automobile apparatus, who shall be thoroughly instructed in the operation of the apparatus to which they are assigned. Article 14. It shall be the duty of the Chief Engineer to appoint two me- chanics who shall be charged with the duty of maintaining all apparatus of the Department in good condition and ready j for immediate service. -____---SECTION IV- - Article 1. It shall be the duty of the Secretary -Treasurer to make a report once each month to the Board of Fire Officers in accordance with such rules and regulations as may be established by said Board. Article 2. If the Secretary -Treasurer neglects or refuses to make such report, the Board of Fire Officers shall immedi- ately prefer charges against such delin- quent Secretary -Treasurer in accordance with the rules and regula1%ns--cf said Board. Article 3. All requests for repairs and supplies for the Department shall be pre- sented to the Board of Fire Officers for the approval or recommendation of said Board by the Secretary -Treasurer at the time of the monthly report mentioned in Article 1 of this section. but in case any apparatus shall become so disabled that immediate repairs are necessary, the fireman operating such apparatus shall immediately report the condition of same to the Chief Engineer who is hereby em- powered to have seine repaired at once. SECTION V Article 1. Any officer or member of the Department who shall refuse or vol- untarily neglect to, obey or execute any orders from the officer in charge of anv fire, or who shall violate or wilfully neglect or refuse to be controlled, gov- erned or managed by any of the rules and bv-laws of the Board of Fire Offi- cers that may be adopted from time to time as herein provided. shall be subject to suspension or expulsion from the Department by the Board of Fire Offi- cers in such manner and upon such hear- ing or trial as may be prescribed or provided by the by-laws and rules of the Board of Fire Officers. SECTION VI Article 1. No person shall enter anv fire house cr handle any apparatus or implements belonging to the Department unless accompanied by an active member of the Department. Article 2. No person shall take or move any fire apparatus out of its house during any fire or the report of any fire or at any other time unless at 'least one active member of the Department shall be present and assent thereto. Article 3. No apparatus shall be let out for hire, or let in anv case except upon consent of the Chief Engineer or his Assistants and 'then only in the case of fire in an adjacent or neighboring township or municipality. SECTION VII Article 1. The members of the Depart- ment upon .order. -.4 the E'kief--i*7ngixtgEr--i-._ or his Assistants are hereby author'zel to answer fire calls outside of the Vil- lage limits, and when so doing shall be deemed to be serving as Firemen of the Village of Golden Valley. SECTION VIII Article 1. If the Department shall cote for the expulsion or suspension of any of its members, the result of such vote shall be reported to the Board of Fire Officers at their next meeting. Article 2. The expelled or suspended member shall have the right to appear before the said Board of Fire Officers and state cause (if any) why such pen- alty should not be confirmed, and in case of non-appearance, or in case his appeal is not sustained, the Chief. En- gineer shall report his name to the Council as expelled or suspended, as the case may be. SECTION IX Article 1. The Chief Engineer and As- sistant Engineers shall wear -when upon duty white hat and a white frontpiece with the name of their respective offices thereupon in white letters upon a black background. Article 2. Each other member of the Department shall wear when upon duty a black hat with a black frontispiece with the name of the Department there- upon in white letters. SECTION R"' Article 1. It shall be the duty of the Chief Enginer to call out the Department for practice drill and the Chief Engineer may whenever he deems it necessary, call out the Department for such drills when and where he may think advisable. but the Department shall be drilled and trained not less than once each month, except during the winter season. Any officer or member being reported to the Board of Fire Officers for refusal or failure to respond to any such order. without good and sufficient cause, shall be liable to suspension or expulsion as provided for by the -rules and regulations of the Board of Fire Officers. Article 2. It shall be the duty of the Chief Engineer to arrange the drills and training so that they will include the proper and efficient use of all appliances and apparatus, the quick handling, lay- ing and raising of hose, handling of streams, use of shut-off nozzles. The t Chief ll a f Should per ca exceed two hours, he shall be compen- sated at the rate of $1.00 per hour for each additional hour. Article 2. The Assistant Engineers shall be compensated at the rate of $2.00 per fire call they attend. Should the call exceed two hours they shall be compensated at the rate of $1.00 per � hour for each additional hour. Article 3. The Firemen shall be com- pensated at the rate$1.50 per fire call they attend. Should the call exceed two hours, they shall be compensated at the rate of $0.75 (75 cents) per hour for each additional hour. SECTION XII Article 1. All charges for offenses or neglect of duty or insubordination while on duty at a fire that may be preferred against any officer or member of the Department shall be tried and determined by the Board of Fire Officers, subject. however, to an appeal from such deci- sion to the Council who shall either con- firm the action of the Board of Fire Officers or refer the same back to them for retrial. Article 2. In the event of a retrial being ordered by the Council, the deci- sion arrived at by the Board of Fire Officers at such retrial shall be fihal, conclusive and not subject to appeal. SECTION XIII Article 1. The members of the Golden Valley Fire Department shall organize and incorporate a "Firemen's Relief As- sociation" in accordance with the laws of the State of Minnesota. It shall be known as the Golden Valley Fire De- partment Relief Association. SECTpON XIV Article 1. It shall be unlawful for any person to give or make, or cause to be given or made, an alarm of fire without probable cause, or to neglect or refuse to obey any reasonable order of the Chief Engineer, or officer in charge at a fire, or to interfere with the Depart- ment in the discharge of its duties. Article 2. No unauthorized person '+ sha,11 ride upon, race with, trail or fol, ' low within 600 feet. any apparatus be- longing to the Department when actively responding to a fire alarm. Article 3. No person shall park any vehicle of' any description or place any material or obstruction within twenty feet of the entrance to any fire house.` or within fifteen feet of any fire hy- d`rAnr 6T --r 1rnat0T-'W'ater source,' nor park any vehicle within three hundred feet of a fire. Article 4. No person shall drive any vehicle over 'a, fire hose except upon specific orders "from the, Chief Engineer or officer in charge, and then only with - due caution. Article 5. No member of the Depart- mentor any other person, shall he per- mitted to tamper with;_ or fix; or repair any of the apparatus unless so directed by the Chief Engineer or, in his absence. an Assistant Engineer. Article 6. No member of the Depart- ment, or any other person, shall drive the automobile apparatus except the regularly appointed drivers unless di- retced to do so by the Chief Engineer, or officer in charge, and then only in case of emergency. SECTION XV Article 1. Personal cars of officers and members of the Department shall have the right-of-way over all other traffic when responding to a fire alarm. Article 2. Said cars may be designated as such in accordance with the statutes of the State of Minnesota. SECTION XVI Article 1. It is hereby made the duty, and the special duty, of the Chief of Police, Policemen, and such other peace officers as are on duty at the time, to respond to all fire alarms and assist the Department in the protection of life and property of the citizens, and the prop- erty of the Department, and in control- ling and regulating traffic and maintains ing order. SECTION XVII Article 1. Any person violating any provision of this ordinance shall, upon conviction thereof, be punished by a fine of not more than $100.000 or imprison- ment of not more than 90 days. SECTION XVIII Article 1. All officers and members of the Department at the time of the adoption of this ordinate shall be con- sidered regular members and the duty elected and appointed officers for the balance of the current year. SECTION XIX Article 1. All ordinances and sections of ordinances in conflict with the fore- going are hereby repealed.
