Hanson Frandsen Reiss Itoe Wilson (YES) The Village attorney reported that Justice Sweeney's bond was issued for two years)but that he was late in filing it. The president Geo E. Hanson presented the resignation of Wm Sweenqr as justice of the peace to the Council. The resignation was dated Febr. 15;1944. The Clerk ask the President why the resignation was not presented to the Council at the time he received it a year ago. Mr Hanson stated that he was in error in not handing it in. On the request of the Clerk the Village attorney stated that it was his opinion that it is the legal duty of the President to turn over to the Clerk such napers as the resignation of Justice Sweeney as soon as he receives them. Every provision contained in the speci- fled sections of such ordinance is hereby adopted and made apart of this ordinance as if fully set out herein. SECTION 2. DEFINITIONS AND IN- TERPRETATIONS, (a) Whenever the word "City" isused -in the above sections adopted by reference it shall be interpreted to mean and shall mean "Village." (b) Whenever the words "Municipal Court' are used in the above sections adopted by reference they shall be inter- preted to mean and shall mean "a Justice of the Peace of the Village of Golden Valley." Provided, however, that where the words "Municipal Court" are used in Section 108 of said ordinance adopted by reference they shall be interpreted to mean and shall mean "Village Council." (c) Whenever the 'words "City Attor- ney" are used in the above sections adopt- ed by reference they shall be interpreted to mean andshall mean "Village Attor- ney." (d) Whenever the word "Mayor" is used in the above sections adopted by reference it shall be interpreted to mean and shall mean "President of the Village Council,'_ (e) Whenever the words "Board of Commissioners" are used in the above sec- tions adopted by reference they shall be interpreted to mean and shall mean "Vil- lage Council." (f) Whenever the words "Director of Public Safexy" are used in the above sec- tions adopted by reference they shall be interpreted to mean and shall mean "Chief of the Police Department." SECTION 3. The Chief of the Fire De- partment shall on the first secular day of each year detail the Building Inspector as an inspector within the meaning of Sec tion 101 of the above sections adopted by, reference and the Building Inspector is hereby constituted an inspector within the meaning ,of said section. SECTION 4. ELECTRICAL INSTAL- LATIONS. All electrical wiring, apparatus, or appliances for furnishing light, heat, or power shall be in strict conformity with the statutes of the state of Minnesota, the rules and regulations issued by the Rail- road and Warehouse Commission, the State Fire Marshal, and the Industrial Commis- sion of Minnesota, and in conformity with the approved methods of construction for safety to life and property. The regulations in the National Electrical Code and in 'the National Electrical Safety Code as approved by the American Standards Com- mittee shall be prima facie evidence of such approved methods. SECTI( N„ 5. PLUMBING INSTALLA- TIONS. The plumbing or drainage sys- tem of every building or structure shall be installed in conformity with the Min- nesota Plumbing Code as adopted by the Minnesota State Board of Health, July 12, 1937 and amended May 9, 1939, three copies of which are on file in the office of the Village Clerk. SECTION 6. PENALTIES. Any person who'shall violate any provision of this or- dinance or of the ordinance adopted by reference in Section 1 of this ordinance or fail to comply therewith, or who shall violate or fail to comply with any order or regulation made thereunder, or who shall build in violation of any detailed statements of specifications or plans sub- mitted and approved thereunder, or any certificate or permit issued thereunder, shall for each such violation or non- compliance be guilty of a misdemeanor, and upon conviction thereof be flned not to exceed one hundred dollars or im- prisoned in the county jail not to exceed ninety days. The imposition of one pen- alty for any violation of this ordinance shall not excuse the violation, or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects Within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. The owner of a building, structure or i. premises, where anything in violation of this ordinance shall -De placed or shall exist, and an architect, builder, contractor, agent person or corporation employed in connection therewith and who may have assisted in the commission of such viola- tion shall each be guilty of a separate of #ense' and upon conviction thereof shall be punished as herein provided. f The imposition of any penalty for viola- tion of this ordinance shall not be held to prevent the enforced removal or cor- rection of prohibited conditions. SECTION 7. VALIDITY. If any pro- vision of this ordinance is declared in- valid it shall not be held to impair the validity or effect of any other provision of this ordinance. SECTION 8. DATE OF EFFECT. This ordinance shall take effect and be in force from and after its passage and lekal publi- cation. Passed by the council this 6en day of February, 1945. GEORGE E.
