October 8, 1948
Pursuant to due call and notice thereof, a special meeting
of the Village Council of the Village of Golden Valley, Minnesota,
was duly held at the Village Hall on October 8, 1948, at 7:30
o'clock P.M.
The following members were present: Fr andeen,Pinch, Putnam,
and Reiss; and the following were absent: Mone.
The meeting was opened to the hearing on the assessment
roll for sealeoating on streets in Teat Tyrol Hills and Glenurban.
The following persons appeared before the Council: Messrs. T. A.
Ericksen, John Mieueki, Chester Campbell, C. T.. Bryan, Harry R.
Olson.
It was explained that the total cost of the eealcoating,
patching and repairing was $8397.73; that the amount of the special
a:=sesements was 45500.00; that corner lots were assessed on the
basis of the largest frontage plus one-half of the shorter front-
age, that lots on Glenwood Avenue were assessed at one-half of
the frontage on streets involved in the improvement, that on the
basis of 18,438 feet of frontage the per foot assessment amounted
to $.2983.
Those who appeared contended that the work should have been
done as a maintenance item out of general village funds and it
was explained that of the total cost all of the patching, repair,
and re -surfacing in the amount of $3153.30 was to come from the
general levy and that only the eealcoating cost of $5244.43 plus
legal, engineering and incidental fees to total $5500. was to
be recovered by special assessment against benefitted property.
Motion for the adaption of the following resolution was
made by Pined, seconded by F andeen, and carried:
ASSESSMENT RESOLUTION
WHEREAS, pursuant to resolution of the Village Council
adopted September 7, 1948, and published in the Robbinsdale
Post September 16, 1948, the Village Council has met at the time
and place specified in said reso-lution and has heard all testimony
offered by interested parties in connection with the proposed assess
went for improvement of:
The entire length of Westwood Drive
The entire length of Janalyn Road
The entire length of Glencrest iioad
The entire length of worth Tyrol Trail
The entire length of Park View Terrace except
gravelled portions
Meadow Lane from its intersection with
Glenwood Avenue south to its inter-
section with Perk View Terrace,
by patching and repairing, seal costing the same with bituminous
material and surfacing the same and covering the curb and gutter

along said streetswith bituminous material according to plans
and specifications prepared by the Village engineer, which work
was done by contract, and Village Council has set the amounts
of benefits conferred by said improvement upon each lot, piece
or parcel of ground so benefitted thereby ratably and in pro-
portion to the special benefit conferred upon it, Now Therefore,
BE IT RESOLVED by the Village Council of the Village of
Golden Valley that the total cost of said improvement is hereby
determined to be Eight -six Hundred Fifty Three and 30/100
($8653.30) Dollars, which is itemized as follows:

BE IT FURTHER RESOLVED that the amount of special benefits
conferred on each lot, part of lot, piece or parcel of ground
for the cost of said improvement without regard to cash vaiu-
-tion, ratably and in proportion to the special benefits conferred
upon it, is hereby determined to be as respectively set forth
in the following list, and there is hereby levied and assessed
against each lot, part of lot, piece or parcel of ground des-
cribed therein an assessment equal to the sums therein respectively
set forth, as authorized by Chapt . 382, Laws of Minnesota, 1903,
which shall be payable concurrent with real estate taxes levied
in 1948 and eollectedin 1949, and interest at 6" per annum from
the due date.
Mrs. Hubert Smith, 1124 Randolph, appeared before the
Council requesting the use of the upstairs of the Hall in behalf
of the Youth Center of Golden Valley on Friday nights. She
stated that a program of youth activities would be carried out
under adult supervision. Motion by Putnam seconded by Frandsen
to grant the use of the hail to the Youth Center of Golden Valley
on Friday evenings starting October 15, from 7:31.) to 10:00 P.M.
was carried.
Councilman Pinch introduced the following resolution and
moved its adoption:
RESOLUTION FOR PUBLIC SALE OF
11,�ATER MAID CERTIFICATES OF INDEBTEDNESS
WHEREAS the Village of Golden Valley, Minnesota, acting
under authority of Layrs of Minnesota, 1947, Chapter 400, and
Minnesota Statutes Sections 432.17 and 432.3+0, has heretofore
duly contracted for the making of certain water main improve-
ments in said Village, and has duly levied assessments upon
properties in the Village speeiail benefited thereby, and the
cost thereof and the amount so specially assessed against
benefited property and remaining unpaid is in excess of $11,500s
and the Village is in need of said amount to pay for such
improvement;
NOW, THEREFORE, EE IT RESOLVED by the Village Council of
the Village of Golden Valley, Minnesota, as follows:
1. The statements contained inthe preamble hereto
axe found and declared true and correct and made a part of this
resolution.
2. It is necessary for the Village to issue its certificates

of indebtedness in the aggregate principal amount of '11,500

to defray the expenses in curred in making said improvement
and such certificates shall forthwith be offered for sale
and sold.
3. This Council shall meet at the time and place specified
in the following form of notice, for the purpose of receiving
and acting upon bids for the purchase of such certificates
of indebtedness. The Village Clerk shall give notice thereof
by causing a COPY Of said notice to be published in Fina nee
and Commerce, a legal newspaperpublished at Minneapolis,
Minnesota, once each week for two successive weeks, the
first publication to be on or before October 12 and the
second one week later, which notice shall be in substantially
the folioaing form:
NOTICE OF SALE OF
TATER MAIN CERTIFICATES OF INDEBTEDNESS
The Village Council of The Village of Golden Valley, Minnesota,
will meet 0 at the Village Hall in said Vi-,lage on October 26,194�
at 7:30 o'clock P.M., to receive and- consider bids for the
purchase of 411,500 principal amount of general obligation
water main certificates of Indebtedness of the Village. Said
certificates will be dated November 10 1948, will be in den-
omination of $1000 each except one in denomination of ;500,
and will mature serially, $!500 on January lo 1950 and $2000
on January 1 in each of the years 1951 to 1955, all without
option of prior payment, except those maturing in the year
1955 which will be subject to prepayment at the option of the
Village on January ls 1951, and semiannually thereafter. The
certificates will bear interest at a rate not exceeding
per annum as specified by the successful bidder, payable
July 1, 1949, and simiannually thereafter on January I and
Julylof each year. Principal and interest will be payable
at any suitable banking institution in the state of Minnesota.
The Village will furnish the printed and executed certificates
for said issue and the approving legal opinion of Dorsey,
Colman, Barker, Ucott and Barber, both without cost to the
purchaser, and delivery will be made within thirty days alter
acceptance of bid. Sealed bids marked "Bid for X11,500
Certificates Of Indebtedness" may be mailed or otherwise

delivered to the undersigned for opening at said meeting.
Oral auction bids will also be received. Each bid must be
unconditional and accompanied by a certified check or bank
cashier's check payable to the Village Tregsurer inthe amount
of $230, to be forfeited as liquidated damages in case the
bid is accepted and the biddershall fail to comply therewith.
No bid of less than par and accrued interest will be
considered. The Village reserves the right to reject
any and all bids.

4. Each and all of the terms and provisions of the
foregoing form of notice are hereby adopted as the terms
and provisions of said certificates of indebtedness and

The motion for the adoption of the foregoing resolution was
duly seconded by Councilman Frandsen, and upon vote being
taken thereon the following voted in favor thereof: Frandsen,
Pinch, Putnam, Reiss; and the following voted against the
same: None; whereupon said resolution was declared duly
passed and adopted, and was signed and attested by the
pro tem president and Village Clerk.
Motion for adjournment by Putnam was seconded by Pinch
and carried.
