A special meeting of the Council of the 'Village of
Golden Valley was held at the Village Hall on Tuesday,
August 9, 1949, at 8:00 p.m., with the following members
answering to roll call: Trustees Pinch, Reiss and Stark.
Trustee Pinch, acting mayor, presided, and Trustee 'Reiss
acted as Clerl�-
1!inutes of the August 2 meeting were read and on motion
by 'Reiss seconded by Stark approved.
The meeting was open to the hearings on the street im-
proveraent programs pertaining to Highview Terrace, Toledo
Avenue Y., Parkview Terrace, Tyrol Hills, and Delphian Heights:
Highview Terrace blacktop-oing, - Alan *,Raymond, Scott Edwards,
J. H. Kicklar appeared and asked several questions relative to
the cross-section of the road after the blacktopping is
completed.
Toledo Avenue North blacktopping - Mr. Gadbois stated
that his son signed the petition and that he wanted to find
out the approximate cost to him before indicatinLo-, his apioroval.
The Village Engineer gave Yr. Gadbois an estimate of the cost
of the improvement which would be assessed against his
property. Yr. Hedlund stated that rrs. Gadbois signed the
petition in the presence of Yr. Gadbois. Mr. Bakke spoke in
favor of the nro-posed blacktopping project. it was deter -mined
that even without r. Gadbois, signature, owners of over 5111
of the front footage had signed the petition for the imnrove-
ment.
'Parkview Terrace blac'XItn_-0 ing and drainage - 11$essrs.
Pay.�rlcyri, Sahly, Gu en and Hoiseth appeared and inquired
about several aspects of the nronosed improvement. The village
Engineer indicated that concrete curb and gutter were to be

installed instead of continuing the gutter with stone masonry
as exists on either end at the -oresent time. This was decided
on due to the much lower cost of concrete curb and gutter as
corri-oared with stone masonry work. The above four persons
indicated they preferred the concrete installation.
Tyrol Hills sealcoatinZ - Dr. Garr -el and iressrs. Patter-
son, Na7asdy, Bjellaness and others raised questions regarding
the necessity of sealcoating the streets in Tyrol Fills this
year and the cost of such a project. it was indicated by the
village Engineer that the streets were beginning to crack and
that by sealcoating this year a major repair cost could be
saved next year if this coming,,, winter wasa severe one from
a climatic standpoint.Yr. Pinch made the suggestion that
the Villace pay approximately one-third of the cost of the
sealcoating, as it would preserve the surface of the streets
for several years to come and would save the Village the cost
of necessary repairs if the work was delayed another year and

and serious damage to the surface resulted from a severe winter.
1fr. Patterson stated there are two drainage problerms in the area,
one of them being excess blacktop in a gutter and the other the
need for a catch basin and culvert at an intersection. As a re-
sult of the discussions, there was general agreement on the need
for sealcoating this year and on the fact that the Village would
assume anoroximately one-third of the cost of the work.
Delphian Hei hts blacktop -ping- '"essrs. Arras, pofahl and
Clark an-deared and expressed their desire that the blacktopping
be completed this year. Discussion centered on several phases
of the pro-oosed work and the checking of the work to insure
proper drainage of the area.
In accordance with notices theretofore -properly published and
posted, public hearings were had upon the proposed im-orovement
of various streets and -public ways of the villas -;e, and all per-
sons desiring to beheard thereon were heard and the matters given
due consideration by the Council. Said proposed improvements
consisted of:
1. Resurfacing and seal coating with bituminous or other suit-
able material and surfacing the curbs and gutters with bituminous
or other material on Tyrol Trail, Brenner pass, Naltern Lane,
Alpine pass, Geneva Trail, France Avenue S., Douglas Avenue and
June Avenue S. , all in or abutting on Tyrol Tills;
2. Installation: of hard surface navement of bituminous or other
suitable material with such changes in surface drainage and grade
as may be found necessary on Zenith Avenue North from 264Uh Avenue
North in a south direction to Glenwood Camden Parkway; Crestview
Avenue from Byrd Avenue North in a south direction to intersection.
with North Valley View Drive; Byrd Avenue ?North from 26th Avenue
North in a. southeast direction to intersection with Parkview
Boulevard; ycyair Drive from 26th Avenue North in a southeast
direction to intersection with Byrd Avenue North; parkview
Boulevard from 26th Avenue North in a southeast direction to
intersection with North Valley vierr Drive; D-eridian :Drive from
26th Avenue North in a, southeast direction to intersection with
Terrace Lane; Terrace Lane from intersection with Zenith Avenue
North in a southwest direction to intersection with parkview
Boulevard; and North Valley View Drive from intersection with
Zenith Avenue North in southwest direction to intersection with
drestview Avenue.
3. Installing a like improvement on B'ighview Terrace from its
intersection with 19th avenue rTorth northward to its termination;
4. Installation of hard surface pavement of bituminous or other
suitable material on Toledo Avenue North in the Village of
Golden Valley, starting at the center line of Golden Valley ?Poad
and thence south a. distance of 654.4 feet to the south line of
lot 24, Auditor's Subdivision ITo. 330, Hennepin County,
lyinnesota; and 1,,Vinsdale Avenue from its intersection with
Toledo Avenue thence east 720 feet to the east line of the
east 90 feet of the west 190 feet of lot 14, Auditor's Sub-
division No. 330, Hennepin County, 'J'innesota,; and Angelo
Drive from its intersection with Irinsdale Avenue thence
south 301.4 feet to the south line of lot 20, Auditor's
Subdivision No. 330, Hennepin County, Minnesota;
5. Improvement of the stria of land running from the -present
northerly terminus of the southern stretch of parkview Ter-
race to the present southerly terminus of the northern
stretch of Parkview Terrace described further as the west
60 feet of the east 275 feet of the south -L of the southeast

of the northeast of the Northeast of 2 Section 30,

Township 29, Range 24, Hennepin County, Minnesota, by opening,
establishing the grade thereof, grading, surfacing with
bituminous material and the installation of curb and gutter,
as authorized by Chapter 382, Laws of 1925, as amended, and
which strip of land has heretofore been deeded to the Village
f or street purposes.
Upon conclusion of said hearings, Trustee Reiss intro-
duced the following resolution and moved its ado-otion:

BT IT R7SOLVrTD by the Village Council of Golden valley,
Irinnesota, as follows:
1. It is hereby found and declared that the im-orove-
ments described in paragraph 2 hereof have each been -petitioned
for by suitable netitions made and filed pursuant to Laws of
1925, Chapter 382, as amended; that the Village Clerk has
made proper findings an� reports to the Council as to the suf-
ficience of said petitions and the signatures thereto, and
this Council has heretofore determined by resolutions that
each such petition was signed by the owners of at least 514
in frontage of the real -oroT)parts abutting on the arts of
the street or streets named in the respective petitions as
the location of the imnrovements petitioned for; that each
such netition has been referred to a competent engineer who
reported advised and reorted to this Councilthateach of the
ima,orovenients should be made as so petitioned for and as to the
Probable cost thereof; that pursuant to the filing of such
engineeris reports, resolutions were duly adopted fixing
August 9, 1949, at 8:00 p.m. as the time and the Village Hall
as the place for a hearing on each such petition,
and notices
of the hearings have been given as prescribed by law, and such
hearings have been duly held and conducted.

2. pursuant to such petitions and other proceedings, it
is hereby determined and ordered that each of the following im-
provements shall be made:
Installation of hard surface pavement of bituminous
or other suitable material with such changes in surface
drainage and grade as may be found necessary on Zenith
Avenue North from 26th Avenue North in a south direction
to Glenwood Camden parkway; Crestview Avenue from Byrd
Avenue North in a south direction to intersection with
North Valley View Drive; Byrd Avenue North from 26th
Avenue North in southeast direction to intersection with
Parkview Boulevard; jAcNair Drive from 26th Avenue North
in southeast direction to intersection with North Valley
View Drive; meridian Drive from 26th Avenue North in
southeast direction to intersection with Terrace Lane;
Terrace Lane from intersection Zenith Avenue North in
southwest direction to intersection with ?parkview Boule-
vard; and North Valley View Drive from intersection with
Zenith Avenue North in southwest direction to intersection
with Crestview Avenue;
Installing a like improvement on Highview Terrace
from its intersection with 19th Avenue North northward
to its tetmination;
Installation of hard surface pavement of bituminous
or other suitable material on Toledo Avenue North in the
Village of Golden Valley, starting at the center line of
Golden Valley Road and thence south a distance of 654.4
feet to the south line of lot 24, Auditor's Subdivision
No. 330, Hennepin County, Minnesota; and Winsdale Avenue
from its intersection with Toledo Avenue thence east 720
feet to the east line of the east 90 feet of the west 190
feet of lot 14, Auditor's Subdivision No. 330, Hennepin
County, Minnesota; and Angelo Drive from its intersection
with Winsdale Avenue thence south 301.4 feet to the south

Improvement on the strip of land running from the
present northerly terminus of the southern stretch of
parkview Terrace to the present southerly terminus of the
northern stretch of Parkview Terrace described further
as the west 60 feet of the east 275 feet of the south
of the southeast of the northeast 14- of the northeast
of Section 30, Township 29, Range 24, Hennepin County,
Minnesota, by opening, establishing the grade thereof,
grading, surfacing with bituminous material and the in-
stallation of curb and gutter, as authorized by Chapter
382, Laws of 19252 as amended, and which strip of land
has heretofore been deeded to the Village for street
purposes.

3. The plans and specifications for said improvements
heretofore prepared by E. George Yinder and filed with the
Village Clerk are hereby approved and adopted.

moved its adoption:

CHAPTER 382, LAWS OF 1903, AS AMENDED
BE IT RESOLVED by the Village Council of Golden Valley,
Minnesota, as follows:
1. It is hereby found and declared that by resolution
duly adopted on July 19, 1949, this Council determined the
necessity and expediency of making the improvements described
in paragraph 2 hereof and specified August 9, 1949, at 8:00
o'clock p.m. as the time, and the Village Hall as the place,
for a hearing hereon; that said resolution was duly published
in one issue of the official newspaper not less than two weeks
nor more than four weeks prior to August 9, 1949, and copies
of the resolution were posted within said period in three
public places in the Village, and affidavits showing such
publication and posting have been made and filed in the
office of the Village Clerk. A hearing on said improvements
was duly held on August 9, 1949, and due consideration has
been given by the Council to the question of making the pro-
posed improvements, all as required by Laws of 1903, Chapter
382, as smended.
2. Pursuant to such resolution and proceedings, it is
hereby determined and ordered that each of the following; im-
provements shall be made:

Trustee Stark seconded the motion for the adoption of the
foregoing resolution, and on vote being taken thereon, the
following voted in favor thereof: Reiss, pinch, Stark; and
the following voted against the same; none; whereupon said
resolution was declared duly passed and adopted and was signed
and attested by the Acting Mayor and Acting Clerk.
Trustee Reiss introduced the following resolution and
moved its adoption;
RESOLUTION CONSOLIDATING IMPROVEMENTS AND
DIRECTING ADVERTISEITEFT FOR, CONTRACT BIDS
BE IT RESOLVED by the Village Council of Golden Valley,
Minnesota, as follows;
1. All of the street improvements listed and ordered to
be made as described in that certain "Resolution for Street
Imnrovements under Chapter 382, Laws of 1925, as Amended",
and in that certain "Resolution for Street Improvements under,
Laws of 1903) Chapter 382, as Amended1l, both adopted by this
Council on August 9, 1949, are hereby ordered and directed to
be consolidated and made under a single contract to be let and
awarded to the lowest responsible bidder, as awarded, at a
public letting; thereof.
2. Said contract shall be so drawn and performance thereof
so conducted as to specify and show separately the cost or
proportion of the cost applicable to the work to be done on each
street or portion thereof separately described in said resolu-
tions. The Village officers, engineer, and contractor shall
make and preserve adequate detailed records to show such
separate costs or proportion thereof.

3. A separate special fund is hereby ordered to be
established and maintained to be known as "Fund of improve-
ment No. 11++2 for the purpose of financing the said improve-
ments to be made pursuant to Chapter 382, Laws of 1925, as
amended, and into which fund there shall be paid all costs
and expenses including payments to the contractor on account
of all the improvements made pursuant to Chapter 382, Laws of
1925, as amended, and into which fund shall be paid all
special assessments levied on account of those improvements
and interest on such assessments and all taxes levied and
appropriations made from general Village funds for payment of
portions of the cost thereof and also the proceeds of sale of
all improvement warrants issued under said law in anticipation
of the assessments and taxes hereby appropriated thereto.
4. A separate special fund is hereby ordered to be
established and maintained to be known as "Fund of 1949 Street
Improvements, Made pursuant to Laws of 1903, Chapter 382, as
Amended", for the purpose of financing; the said improvements
to be made pursuant to Laws of 1903, Chapter 382, as amended,
and to which fund there shall be charged and from whcih there
shall be paid all costs and expenses, including payments to
the contractor on account of ail the improvements made pursuant
to said law, and into which shall be paid all special assess-
ments levied on account of said improvements, and interest
on such assessments and all taxes levied and appropriations
made from general Village funds for payment of portions of the
cost thereof, and also the proceeds of sale of all improvement
orders to be issued under said law for the purpose of paying
the costs of said improvement.
5. This Council shall meet at the Village Hall in Golden
Malley, Minnesota, on Tuesday, the 23rd day of August, 1949,
at 8 o1clock p.m., for the purpose of receiving, opening and
considering bids for the contract for the making of all of
said ininrovements. The Village Clerk, with the assistance
of the Village Attorney and engineer, is directed to prepare
and give due and proper notice thereof by publication of a
notice calling for such bids. Said notice shall be published
in at least one issue of the official newspaper of the Village,
and in at least one issue of The Conattuction Bulletin,
published at Minneapolis, Minnesota, each such publication to,
be made at least ten days before the aforesaid date for re-
ceiving and opening of bids. Such notice shall specify,
among other things, the work to be done and shall call for
bids on the basis of cash for the work, and shall state the
time when bids will be opened and considered by the Council
and that no bids will be considered unless sealed and filed
with the Clerk and accompanied by a cash deposit or certified
check payable'ia the Clerk for % of the amount of the bid,
this deposit or cheek to be forfeited to the Village in
event the successful bidder shall fail to enter into a
contract awarded to him in accordance with the terms of his

bid, and shall contain such other terms and details as the
Clerk, engineer and Attorney shall deem necessary and
appropriate.

duly seconded by Trustee Stark, and upon vote being taken

upon said resolution was declared duly passed and adopted and
was signed and attested by the Acting Payor and Acting Clerk.

mr• L. Z. Carlson explained that he has employed Morrill
and Nichols to prepare the survey and plans for the Culver
Road and Triton Drive drainage problems. Air. George Nason pre-
sented and explained plans for installation of underground
drains at the intersection of Culver Road and Quail Avenue and
placed an estimate of the cost at $1400. Discussion centered
on the possibility of blacktopping all streets in Woodlawn
park and it was indicated that this would be the best solution
for the whole area. Irr. Carlson inquired if the Village Council
would accept the streets if he installed the culvert drains on
approval by the Village Engineer or if the streets were black -
topped and curb and gutter were installed on Culver Road. The
Council indicated that the streets would be accepted under
either of these two conditions, if the improvements were ap-
proved by the Village Engineer. qtr. Carlson requested that
Triton Drive from Quail Avenue to Regent, and all of Regent, be
omitted from the present improvement program, and stated he
would give an agreement and bond to complete these two streets
after he has completed homes on the lots abutting on thea.
I(r. Carlson made the following statement:
"I agree to set up :1500 for the installation of curb
and gutter on Culver Road from Quail to Regent on both
sides of the street if the residents of Woodlawn nark
petition for blacktopping in Woodlawn park and if the
petition includes blacktopping on Culver Road between
Quail and Regent. Should no petition be put through,
then I agree to put in a culvert on Culver Road between
Quail and Regent as shown on the drawing; filed with the
Village Council and approved by the Village Engineer.
Also, if no petition is presented for blacktopping, I
agree to install additional culvert drains on
Triton and Orchard, as directed by the Village
Engineer. I will fix Triton Drive at Quail in
either case mentioned above with sufficient stones
to prevent erosion and will file with the Village
Council a letter and bond with reference to Triton
Drive west of Quail and all of Regent Avenue in
loodlalrm Park, the bond to be in the amount of 93000,
the bond and letter to be conditioned as were the
earlier bond. and letter. In consideration of
these co=iitnlents, the Village Council is requested
to release ane from the present bond except insofar
as it relates to Triton Drive from Quail to Regent,
and all of Regent, in Toodlarn Park, and to release
me from those streets from the bond insofar as it
relates to those streets when and if a 93000 bond is
filed and subject to final vacation of Lowry Terrace,
with sufficient turn-arounds at the ends of Quail,
Orchard and Regent Avenues."

Jar. L. Z. Carlson's alternate proposals as stated by him in
the minutes as it nerta.ins to the pro-oosed improvements of
the streets in ',7oodlawn Park, with particular reference
to the improvements mentioned on Culver Road between Quail
and Regent and on Triton Drive between Quail and Regent,
and all of Regent Avenue.
Mr. and ?,trs. Vincent Popnler, 1532 Charles Avenue,
Lakeview Heights, requested that they be granted an electrical
permit for their basement home. They stated it was their
intention to continue building the home until it was completed
but that it was necessary to move into the basement home for
the present.1!otion by Stark seconded by Reiss carried that
a signed statement from the Popnler's be submitted in which
they agree to erect the shell of the house, with a permanent
roof, within twelve months from now, and to agree to have
no objection to the revocation of the electrical permit if
the shell and permanent roof are not completed within the
twelve-month period, and that an electrical hermit be issued
subject to the presentation of the statement indicated above.

for Douglas M. Larson.

That on the 6th day of September, 1949, at 8:00 o'clock
p.m., in the village Hall, the petition of John F. Nordstrom
and others, dated July 19th, 1949, for the improvement of the
following described streets:
Zephyr place, formerly known as park Place, from its
zniersec on with Nineteenth Avenue North in a south-
westerly direction a distance of 550 feet;
York Avenue North, from its intersection with Zephyr
place in a generally south and east direction a distance
of 550 feet;
by the` -installation of hard surface paving of bituminous or
other suitable material and by the making of such changes in
and provisions for surface drainage as may be found necessary,
as authorized by chapter 382, Laws of 1925, as amended, wi;l
be considered and acted upon; and the Clerk is directed to give
notice of such meeting by publication in The Robbinsdale post
and posting in three public places for 15 days, the first
publication to take place not later than the llth day of August,
1949, and the second publication to take place one week after
the first.
