Minutes of the November 15 meeting were read and on ---
motion by Reiss seconded by Pinch a.nnroved.
The Mayor opened the meeting for a. hearing on the.
special assessments for funds No. 11 and No. 12 in accord-
ance with resolutions duly na.ssed and publication and, nos+.inq
of aporonriate notices. The assessment hearing for the
Zephyr Place -York Avenue project was considered first. The
asse,ssment.rolls indicated that the assessment for this
project was spread on a front footage basis, whereas several
residents requested that the assessment be spread equally
among the lots in accordance with the original petition.
The village attorney then brought out the fact that the
assessments for the Delphian Heights project included. charges
against several lots owned by Yr. rla.rence Scherer but located
behind villagee-park property abutting on Byrd Avenue. Mr.
Scherer stated he wished to consider the possibility of using
the area for home sites before agreeing to accept the assess-
ments against his lots, in case the nark nronerty was vacated.
Terzich was to meet with Mr. Scherer to discuss this possi-
bility. Motion by Pinch seconded by Reiss carried to post-
pone action on Funds No. 11 and No. 12 to the December 20
meeting to give Mr. Kane time to discuss the apnronriate
methods of spreading assessments with bondin,7 attorneys and
for Mr. Scherer to look over the lots in question in the
Delphian Heights area..
Mr. Cleo Kennedy stated that an agreement was made with
the Villa7e Council in the late summer of 1945 wherebv the
village was to construct a turn -around at the end of Douglas
Avenue in South Tyrol Hills in return for the dedication of
Lot A in the subdivision. He also started that some improve-
ment was made on June Avenue south of Tayzata Boulevard as
another part of his agreement. Terzich was instructed to
contact Mr. George Hanson, Mr. Charles Frandsen, Mr. Gail
Wilson and Mr. Arthur Nelson, members of the council at that
time, as to whether or not this agreement had been made.
Mr. William Thomas, 6115 Sixth Avenue N., requested an
electrical inspection of the wiring in his basement home.
Electrical Hermit No. 165 had been issued in 1947. Motion
by Pinch seconded by Putnam carried to authorize the electri-
cal inspector to make the inspection subject to the presenta-
tion of a signed statement by Mr. Thomas that he will have
the shell of his home and a permanent roof constructed within
a twelve-month period after the inspection is made.

Mr. George i�liinder, village engineer, presented. an additional
statement of the amounts due to Mr-Tessem, concrete contractor,
and to Mr. Holm, bituminous contractor, inthe following amounts:

Yr. Minder indicated it was customary to make
payments in accordance with the above statement
when work is halted by winter conditions.
Yotion by Pinch seconded by Putnam carried to withhold 51 of
the amount due to Gust Holm on the bituminous contract and to
pa.y the entire cost of the seal coating of Tyrol gills in the
amount of $804.24, making a., total payment due at this time of
$1,894.97.
The clerk reported the following official tabulations of
votes in the December 6 village election:

the returns and declare the persons receiving the highest
number of ballots elected to the respective offices.
Letter dated December 7, 1949, from "4"r. "T.'A. `Wilkinson,
president rWilkrop Inc., was read requesting waiver of 15'
side line requirements to allow construction of garages within
5' from the side line and 20' from the rear line of houses
located at 2913 Noble Avenue, 3100 Quail Avenue and 3124
Quail Avenue. Request was referred to the planning commission
for processing under the hardship clause.
Mr. Neal Rydmark, village fire marshall, made a. verbal
report on fire inspections recently made of all commercial
establishments and schools in the village. Motion by Finch
seconded by Stark to accent the fire ma.rsha.11's renort and
to thank him for bringing these facts before the Council.
The Council reviewed the site and building plans for
the Northwestern Bell Telephone Company building to be
located on County Highway No. 18 just north of ?Westview
School. Motion by Pinch seconded by Reiss carried to apnrove
the site plans and building -plans and. to authorize the
building department to issue a building permit, with a, copy
of both site and building -plans to be placed on file.
Letter dated November 16, 1949, from Mr. Pofahl,
secretary of the planning commission, was read indicating
the planning commission had recommended against the re -zoning
of the Schuller-Schall property at the intersection of Glen-
wood Avenue and Sixth Avenue N. The letter was placed on file.
Motion by Stark seconded by Reiss carried annointing
Terzich as acting building inspector to serve without
compensation.
Terzich informed the council regarding the action taken
on November 23 rela.tin� to the setback distance of the

Thompson Lumber Company building at the intersection of Tinnetka.
Avenue and Sixth Avenue North. It was pointed_ out that due
to surveying errors the center line of the right-of-way of
Sixth Avenue North was not located where it had. been generally
assumed to be, resultin7 in a distance of less than 70' setback
as required by the ordinance. This matter was discussed with
three councilmen on November 23 and they indicated the general
intent of the re -zoning ordinance was to have the new Thompson
building front line coincide with the front line of the norch
of the village hall. Therefore, permission was given to
Thompson Lumber Company to continue their building subject to
ratification by action of the council. Lotion by Stark
seconded by Pinch carried to confirm the action taken in accord-
ance with the above explanation subject to revision of the re-
zoning ordinance after a survey has been made and. the re -zoning
ordinance corrected in accordance with the original intent for
setback require.lents in this area.
Motion by Reiss seconded by Stark carried to a:onrove the
request of the Northwestern Bell Telephone Company in its
letter dated November 15 for installation of buried cable
crossing 16th Street near the Pelt Line, and letter dated
November 23 to place buried cable in Turners' Cross Road an d
Turnpike Road, in accordance with plans submitted and placed
on file.
Building department reports for the month of November
were placed on file with the following listings:

Discussion was held on the status of the clerk's fund
balances as of October 31, 1949. Motion by Stark secondee by
Reiss carried to a.nprove the following- transfers to correct
entries :Wade incorrectly because of inadequate information on
the tax distribution listings and to comply with the Public
Examiner's report recently received:

Letter was read dated November 20 from Mr. and ?:yrs. C. A.
Harris, owners of Lot 13, Block 4, Spring Green, regarding re-
moval of dirt from their property. Air. Stark was to contact
the Harris' to inform them that the village had no use for
the excess dirt from their lot on Turnpike Road and to advise
them of the deed restrictions regarding removal of dirt in the
Spring Green Addition.

Mr. Paul Enghauser presented a deed dedicating the
westerly 30' of Natchez Avenue from Glenwood Avenue to
Roanoke Road. The matter was referred to"r. Kane for in-
vestigation of description and elimination of statement
regarding payment of taxes for 1949. Mr. Kane is to renort
back at the December 20 meeting.
Terzich reported on a verbal discussion with Mr. Opda.hl,
1725 York Avenue, in which 'Mr. Obdahl indicated that soavy
water had been observed on December 3 coming; out of the
culvert leading from the two drive-in garages across the
street, owned by 'Messrs. Golfuss and Toles. It was also
indicated that Chief McGinnis was called and had observed.
the soapy water. The village attorney was instructed to
write letters to Mr. Golfuss and Mr. Toles warning them that
the culvert in question would be closed should soapy water
be observed again.
Treasurer's report dated November 15, 1949, was pre-,
