December 20, 1949
Pursuant to due call and notice thereof, a regular
meeting of the Village Council of -Golden Valley, Minnesota,
was duly held at the Village Hall on December 20, 1949, at
7:3C o'clock p.m.
The following members were present: Mayor Stasel,
Clerk Putnam, Trustees Pinch and Stark, and the following were
absent: Trustee Reiss.
Minutes of the December 7 meeting were read and on motion
by Pinch seconded by Stark 9pbro77ed.
The Village Attorney read a letter dated December 9 from
Arthur Nelson, attorney in behalf of Mr. Crosby, Archibald
Avenue and Poplar Drive, relating to the drainage of water
across Mr. Crosby's pronerty from an underground. the system.
The matter was referred to the Village Attorney for investi-
gation. Mr. Harry Hamman explained the action taker. within
the last three months to eliminate the overflow of three cess-
nools into the underground drain system, and indicated that
only clean water was now flowing through the drain the and.
across Mr. Crosby's property. Mr. Ha.mmam also suggested a,
revision of the plumbing ordinance to require a double fee
on plumbing permits where the plumbing has been started or,
in some cases, completed before a plumbing permit has been
obtained. The Council indicated it will look into the matter.
Mr. Earl Maxwell, attorney, presented an monlication for
granting of an on -sale liquor license for Mr. Clifford A. Adams,
9425 Sixth Avenue North, such license to be issued as soon as
it can be legally determined that the Village ca.n issue another
liquor license and requesting that the application will receive
priority consideration by reason of the filing thereof on
December 20, 1949. The netition was read and placed on file.
The meeting_ was then oven to the continuation hearing on
the assessments for Funds 11 and 12. The Village Attorney
stated that he had contacted the bonding attorneys, who in-
dicated that the Village was not bound by the rider inserted,.
in the petition for the York Avenue -'ark Place improvement.
Further, the bonding attorneys indicated various legal diffi-
culties that might be encountered if the assessments were
spread equally on lots rather than on a, front footage basis.
General discussion was held on the necessity for re -advertising
and passing of resolutions for assessment hearings for Funds
11 and 12.
Trustee Pinch introduced the followingresolution and
moved its adoption:
RESOLUTION FIXING THE TINE AND PLACE OF
HEARING ON PROPOSED ASSESSMENT FOR. STREET IMPRCVEM7NTS
BE IT RESOLVED by the Village Council of Golden Valley,
Minnesota, as follows:
1. It is hereby found and declared that, tiursuant to
due and nroner petitions, resolutions, notices, hearings,
advertisements, and other annropriate actions, the Villa,g;e
has heretofore duly determined to improve the following
described streets or portions thereof in said Village,
to -wit:
A. The 'fie?t 60 feet ?f the East 275 feet of the S1 of
the SE4 of the Nry of the NE4 of Section 30, Town -
shin 29, Range 24, Hennepin County, Minnesota., here-
tofore deeded to the Village for street nurnoses.
B. TOLEDO AVENUE NORTH in the Village of Golden Valley,
starting at the center line of Golden Valley Road
and. thence south a distance of 654.4 feet to the
south line of Lot 24, Auditor's Subdivision No. 330,
Hennepin County, Vinnesota.
C. WINSDA LE AVENUE from its intersection with Toledo
Avenue, thence east 720 feet to the east line of the
east 90 feet of the west 10.0 feet of Lot 14, Auditor's
Subdivision, No. 330, Hennepin County, Minnesota..
D. ANGE LO DRIVE from its intersection with 17insdale
Avenue, thence south 301.4 feet to the south lire of
Lot 20, Auditor's Subdivision No. 330, Hennepin County,
Minnesota.
E. HIGHVIEW TERRACE from its intersection with 19th Avenue
North, nort'nward to its termination.
F. ZENITH AVENUE NORTH from 26th Avenue North, in south
direction to Glenwood -Camden Parkway.
G. CRESTTTI77J AVENUE from Byrd Avenue North, in south
direction to intersection with North Valley View Drive.
H. BYRD AV'E'NUE NORTH from 26th Avenue North, in southeast
direction to intersection with Parkview Boulevard.
I. VcNAIR DRIVE from 26th Avenue North, in southeast
direction to intersection with Byrd Avenue North.
J. PARKVIEW BOULEVARD from 26th Avenue North, in south-
east direction to intersection with North Valley
View Drive.
K. M7RIDIAN DRIVE from 26th Avenue North, in southeast
direction to intersection with Terrace Lane.
L. TERRACE LANE from intersection of Zenith Avenue North,
in southwest direction to intersection with 7a.rlview

M. NORTH VALLEY VIF'T DRIVE from intersection with Zenith
Avenue North, in southwest direction to intersection
with Crestview Avenue.
each of said improvements constituting installation of hard
surface pavement of bituminous or other suitable material,
with such changes in surface drainage and grade as found neces-
sary; that the cost thereof heretofore and hereafter to be in-
curred will be the sum of Twenty-six Thousand Five Hundred
and no/1CO Dollars ($26)500.00), which is hereby declared to
be the assessable cost of said improvements, and the entire
amount thereof should be and is hereby ordered to be assessed.

improvements, ratably in nronorticn to the special benefits
so conferred upon each thereof.
2. The nronosed assessment heretofore nrenared by the
Village Clerk shall be forthwith filed in his office and,
opened for public inspection, and. this Council shall meet at
the Village Hall in Golden Valley on the 3rd day of January,
1950) at 7:30 o'clock w m., to hear and pass upon all objec-
tions thereto, if any; and notice of the time, place, and nur-
pose of such meeting shall be given by the Clerk by hosting
of a suitable notice thereof in at least three public and con-
snicuous places in the Village and by nublica,tion thereof in
at least one issue of The Robbinsdale Post, such hosting and
publication to be made at least one week nrior to said date
of hearing.
3. *That certain nronosed assessment roll nrena,red by the
Village Clerk, filed in his office, and described in a resolu-
tion entitled "Resolution Fixing the Time and Place of uearinF
on Proposed Assessment for Street Improvements," rela.tin7 to
the above-described improvements, adopted by the Village Council
on November 1, 1949, is hereby rejected.

taken thereon the following trustees voted in favor thereof:

1. It is hereby found and declared that, pursuant to due

vertisements, and other apDropria.te actions, the Village
has heretofore duly determined to improve the following
streets or portions thereof in said Village, to -wit:
N. ZEPHYR PLACE, formerly known as Park Place, from its
intersection with 19th Avenue North, in a southwesterly
direction a distance of 550 feet;
0. YORK AVENUE NORTH from its intersection with Zephyr
Place, in a generally south and east direction a
distance of 550 feet;
P. NOBLE AV7NUE SERVICE ROAD, more exactly described as
follows: The easterly 15 feet of Blocks 1 and ? of
Woodlawn Park, Hennepin County, Minnesota, being more
specifically described as the easterly 15 feet of

each of said improvements being the improvement of the des-
cribed streets or portions thereof by the installation of hard
surface pavement of bituminous or other suitable surface
material and curb and gutter, with such chances in surface
drainage and grade as found necessary, and the Village has
duly contracted for such improvements; that the cost thereof
heretofore and hereafter to be incurred will be the sum of
Fourteen Thousand and no/100 Dollars($14,00.00), which amount
is hereby declared to be the assessable cost of said improve-
ments, and the entire amount thereof should be and is hereby
ordered to be assessed against each lot, niece, or parcel of
land benefited thereby, ratably and in nronortion to the
special benefits so conferred upon each thereof.
2. The proposed assessment heretofore prena.red by the
Village Clerk shall be forthwith filed in his office and
opened to public inspection, and this Council shall meet at
the Village Hall in Golden Valley on the 3rd My of January,
1950, at 7:30 o'clock p.m., to hear and pass upon all ob-
jections thereto, if any; and notice of the time, place, and
purpose of such meeting shall be given by the Clerk by hosting,
of a suitable notice thereof in at least three public and con-
snicuous places in the Village and by publication thereof in
at least one issue of The Robbinsdale Post, such posting and
publication to be made at least one week prior to said date of
hearing.
3. That certain proposed assessment roll prenared by the
Village Clerk, filed in his office, and described in a resolu-
tion entitled "Resolution Fixing the Time and Place of Hearing
on Proposed Assessment for Street Improvements," relating to
the above-described improvements, adopted by the Village
Council on November 1, 1040, is hereby rejected.

The mayor opened the meeting to a hearing on the Tyrol.
Hills seal coating assessment. Yo one anneared against the
nronosed assessments. Trustee Stark introduced the follow-
ing resolution and moved its adoption:
ASSESSMENT RESOLUTION
W70TAS, pursuant to the resolution of the Village
Council adopted November 1, 1949 and published in the
Robbinsda.le Post on December 1, 1949, the Village Council'
has met at the time and place specified in said resolution
and has.heard all testimony offered by interested parties
in connection with the proposed assessments for the im-
provement of Tyrol Trail, Brenner Pass, and Alnine Pass,
in or abutting on Tyrol Hills, an addition to and in the
Village, by resurfacing and seal -coating; the same with
bituminous and other suitable material and surfacing the
curbs and gutters of said streets, and the Village Council
has set the amounts of benefits conferred by said improve-
ment upon each lot, part of lot, niece or parcel of land so
benefited thereby ratably and in pronortion to the special
benefit conferred upon it, now, therefore,
BE IT RESOLVED by the Village Council of the Village
of Golden Valley that the total cost of said improvement is
determined to be Nine Hundred Fifty -Nine and 99/100 Dollars
($959.99), which is itemized as follows:

BE IT FURTHER RESOLVED that the amount of svecial benefits
conferred upon each lot, part of lot, niece or parcel of land
for the cost of said improvement, without regard. to cash
valuation, ratably and in nronortion to the special benefits
conferred upon it, is hereby determined to be as resnectively
set forth in the attached list, and there is hereby levied
and assessed against each lot, part of lot, niece or na.rcel of
of land described therein an assessment equal to the sums
therein respectively set forth, as authorized by Chanter 382,
Laws of Minnesota., 1903, payable concurrent. with real estate
taxes levied in 1950 and collected in 1951, with interest as
shown.

The motion for the adoption of the foregoing resolution

Putnam suggested that the nay for the Commissioner of
Registration be set at 125.00 ver year as a, taken of reco�ni-
tion for the position inasmuch as much of the work is now
being done by the administrative offices. Motion by Stark
seconded by Pinch carried to set the nay for Commissioner of
Registration at $25.00 per year.
Notion by Pinch seconded by Stark carried to accent the
quit claim deed presented by Paul Tnghauser from Glendale, Inc.
for thevaesterly 30' of Natchez Avenue North from Glenwood to
Roanoke Road and described as follows:
Easterly 30 feet of the southerly 533 feet of the
east 20 rods of the S. 7. 4 of the S. 'I. 4,
Section 19, Two. 29, Range 24, west of the vrincivle
meridian, all a.ccord.inp; to the U. S. government sur-
vey thereof for street and highway purposes.
Report was presented by Terzich on discussion with the
1945 council members regarding the turn around at the end of
Douglas Avenue in South Tyrol Hills. Yr. Cleo Kennedy showed
a. statement signed by several members of the Planning Commis-
sion at that time indicating that some agreement had been
reached as to the excha.n-9 :e ,of work. The matter was referred
to Pinch and Terzich for inspection.

After discussion of the necessity for codification and
rewriting of certain ordinances, the Council concurred in
requesting the planning commission to codify and rewrite
those ordinances pertaining to building and zoning. A com-
mittee of the council was to be appointed at the next meet-
ing to codify all other general ordinances of the village.
Letter dated November 20 from the civil service com-
mission was read suggesting several actions to he taken
with respect to the size and nay of the police department.
After further discussion, Nor. Putnam suggested that a letter
be written to the commission informing them of an FBI course
in police work to be given shortly, and suggesting that the
relief patrolman be enrolled in the course.
Lotion by Pinch seconded by Stark carried to nut an
insignia on both donrs of the police car to read VILLAGE
OF GOLDEN VALLEY POLICE.
Letter dated December 15 from Mr. Clarence Russell,
1309 Tyrol Trail, was read in which Yr. Russell stated that
the village snow plow had overturned about ten foot of stone
wall at his residence. The matter was referred to Mr. Kane
to look into the possibility of having the insurance company
take care of the damage.
Letter of December 14 from the planning commission was
read recommending that the garage being built on Lot 5,
Block 7, Woodlawn Park, be moved back to line un with
existing structures, denying the hardship plea of 'Wi.lkorn
Incorporated to build garages nearer than 15 feet to side
lot lines in tWoodlawn Dark, recommending that Beverly Avenue
from its intersection with Westwood Drive to its terminous
at Sixth Avenue North be changed to 'Westwood Drive, and
listing eight persons for consideration as appointees to
fill six vacancies on the nlanning commission created by
expiration of terms and one resignation. The council dis-
cussed the location of garages in Woodla.wn Dark and s"q-
gested that a letter be written to Mr. ?William Tilkinson
requesting that he obtain a plat of the area., locate all
garages on all pronerties in the area, and present one re-
quest under the hardship procedure in order that the council
could take one action to clarify the location of all garages
in 'Woodlawn park.

large table and eight chairs from the North Star Toolen
Dills at a reasonable cost. Motion by Putnam seconded by

Discussion centered on the damage done to the blacktop
surfacing in Delphian Heights due to water connections.
Motion by Pinch seconded by Stark carried instructing the

administrative assistant to determine the cost of rena.ir
to the blackto-o surface that will be reauired after a water
connection has been made and to charge this extra amount
in addition to all other fees required by the waster
commission, this charge to be a requirement as a. condition
to granting any hermit. The village will then renair the
road after the connections have been made.
Motion by Stark seconded. by Finch carried to adjourn
to the January 3 meeting.
