REGULAR MEETING
of the
VILLAGE COUNCIL
February 16, 1954
Pursuant to due call and notice thereof a regular meeting of
the Village Council of the Village of Golden Valley, Hennepin
County, Minnesota, was held in the Village Hall in said Vil-
lage on the 16th day of February, 1954s at 7:30 o'clock P.M.
The following members were present: Foss, Huebsch, Rahn; and
.the following members were absent: Bies, Stark. The Mayor
called the meeting to order at 7:35 otclock P.M. Member Stark
arrived at 8:05 otclock P.M.
MOVED BY Rahn seconded by Stark carried that the reading of
the minutes of the meeting of February 2nd, 1954, be dispensed
with and said minutes stand approved as submitted to each mem-
ber of the Council prior to this meeting unless some member of
the audience wishes them read. (The minutes were not read.)
Public Hearing, Rezoning, Minnesota State Highway Department:
The Village Clerk presented an affidavit of publication of
notice of public hearing to be held at this time and place
regarding the zoning of a parcel of land as described in said
affidavit from Open Development to Industrial. Said affidavit
was examined, approved and ordered placed on file.
The Mayor announced that this was the time and the place for
the public hearing above referred to. All persons present
who desired to do so were afforded opportunity to express their
views thereon.
Name of Objector Nature of Objection
Mr. Elder W. Armstrong Mr. Armstrongstated his objections as
2030 North Lilac Drive follows: (1) The area is now a strictly
residential neighborhood. (2) Highway
100 is 'loaded with traffic" now. The
additional traffic and equipement move-
ment would further restrict public use
of the highway. (3) There would be no
tax revenue to the Village of Golden
Valley. (4) There would be no local
benefit to citizens of Golden Valley
inasmuch as most of the state jobs are
civil service jobs and are presently
held by persons with seniority in the
civil service. (5) At the present time
the State Highway Department is burning
rubbish on the premises, creating a
traffic hazard and a nuisance to the
neighbors, and he and his neighbors
feared increased nuisance value from
such an operation a.s proposed by the

Proponents Mr. McCubrey, District Maintenance Engineer for the
State of Minnesota. Mr. McCubrey stated that the proposed use
of the Minnesota State Highway Department was not an "industrial"
use, but that such zoning is necessitated in order that the State
Highway Department can construct a maintenance shop; that all
heavy repair work is presently done at the Minnesota State Fair
_.Grounds; that the personnel working at the maintenance shop
would consist of a staff of engineers in addition to shop per-
sonnel; that 6 to 12 trucks, including snow plows, would be
garaged at the maintenance shop. Mr. McCubrey further stated
that using the area as a public park would be an illegal use of
Trunk Highway Funds, that servicing the Belt Line is the "num-
ber one job" of his department and a maintenance shop at the
proposed location would facilitate and make more economical the
maintenance of the Belt Line. In response to a previous state-
ment, McCubrey stated that there would be no "riff-raff" on the
premises inasmuch as the State of Minnesota would furnish watch-

Mrs. Elmer Michaelson
Mrs. Michaelson stated her objection '

present location.
Mr. Don Loken
Mr. Loken objected to the burning of
2110 North Lilac Drive
trash and rubbish at the present lo-
cation of the State Highway Department
gravel pit.
Mrs. Ralph R. Hecox
Mrs. Hecox objected to the burning of
2130 North Lilac Drive
trash and rubbish.
Mr. Fred Jones
Mr. Jones stated that it was his under -

standing that the area would be used
as a public park after the removal of
sand and gravel. Mr. Jones further
stated that in his opinion it was a
matter of either letting the Minnesota
State Highway Department in with a
nice shop and yard or continue to look
at a repulsive gravel pit, and that
should the State Highway Department put
in a maintenance shop this Village
would receive better services on its
trunk highways as to snow removal and
maintenance, and that the highway main-
tenance shop is not "the worst thing
that could happen".

ment, McCubrey stated that there would be no "riff-raff" on the
premises inasmuch as the State of Minnesota would furnish watch-

man service 24 hours a day. The plot plans for the mainten-
.ance shop were distributed to the audience. Upon question Mr.
McCubrey stated that the Minnesota State Highway Department
intended to erect a brick maintenance shop on the premises.
The Mayor then stopped discussion from the floor and asked the
Council Members to discuss the matter among themselves. Member
Foss inquired of Mr. McCubrey as to whether or not there was an
urgency, to which question Mr. McCubrey stated that the Highway
Department would like to begin construction within the next
several months. Mr. McCubrey further stated that the County is
building a highway through the Hopkins, Minnesota, maintenance
yards, and that the City of Hopkins and the County of Hennepin
are very anxious that they be permitted to conclude plans for
construction of said highway.
MOVED by Stark that a first reading be given to an ordinance
rezoning the land as described in the affidavit of publication
from•Open Development to Industrial, said Industrial zoning to
remain in force only so long as title and use remain in the
State of Minnesota, and that upon the abandonment of any por-
tion of the property said abondoned property to revert to Open
Development. There was no second to the above motion and the
Mayor declared it lost.
The Village Attorney stated that the State could go ahead and
use this property for a maintenance district even though the
Village does not rezone it to Industrial use. Mr. McCubrey
stated that it was not the policy of the State Highway Depart-
ment to do such things against the wishes of the public.
The Mayor then declared that the petition of the Minnesota State
Highway Department to rezone the area as described in the affi-
davit of publication from Open Development to Industrial is
denied through lack of a motion to rezone said property.
Permit to Operate a Beauty Shop:- Mr. Ellingson, 2912 Lee Avenue
North, petitioned the Council to grant him a special permit to
operate a one chair beauty shop at his home located at 2912 Lee
Avenue North. Mr. Ellingson stated that this was a part-time
operation, that he and his wife would not construct or display
advertising signs of any nature and that he did not anticipate
traffic would exceed one car at any one time. The Council de-
cided to take no action upon the request of Mr. Ellingson.
The Council agreed to the following policy statement: Persons
or groups protesting the use of premises by the owner of said
premises and/or his agents must register their protests with
the Village Administrative Office in writing, said writing must
identify the owner and/or his agent by name and address, must
set forth in detail the offending use and how said use interfers
with the enjoyment of the complaintant's property, and must be
signed by said complaintant.

Re: Traffic Semaphore at T. H. #12 and Turner's Crossroad So.:
Mr. McCubrey presented preliminary plans for the installation
of six traffic semaphores at the intersection of T. H. #12 and
County Road #41 and stated that the estimated cost of said
traffic semaphores would be approximately $6,000.00, and that
the State of Minnesota would pay fifty per cent of said cost.
Mr. McCubrey further stated that it would be the responsibility
of the Villages of Golden Valley and St. Louis Park to maintain
said semaphores.
MOVED by Stark seconded by Rahn carried that the Village of
Golden Valley participate in the cost of erection of traffic
semaphores at the intersection of T. H. #12 and County Road #41
to the extent of 25% of the cost of said installation, provided
that the Village of St. Louis Park pay 25% of the cost of said.
traffic semaphores.
Bond, Brookfair Addition: MOVED by Rahn seconded by Foss car-
ried to accept the bond of the Associated Contractors, Inc.,
platters of the addition known as "Brookfair Addition", in the
sum of $5,000.00, said bond guaranteeing that Associated Con-
tractors will construct oil stabilized streets in said addition,
sod boulevards, plant trees, construct necessary storm sewers,
and install street signs, all in accordance with the specifi-
cations of the Village of Golden Valley and with the bond on
file in the Office of the Village Clerk.

ried to grant preliminary approval to the plat known as"Nal-
Wood Addition", presented by the Otten Construction Company,
and on file in the Office of the Village Clark.
Plat, Green Val]eAddition: MOVED by Foss seconded by Rahn
carried to grant preliminary approval to the plat known as
"Green Valley Addition", presented by Mr. Fred Jones, and on
file in the Office of the Village Clerk.
Franchise, Minneapolis Gas Com an : MOVED by Foss seconded by
Stark carried to give a first reading to an ordinance entitled,
"AN ORDINANCE GRANTING TO THE MINNEAPOLIS GAS COMPANY, ITS SUCH
CESSORS AND ASSIGNS THE RIGHT TO MANUFACTURE, IMPORT, TRANSPORT,
SELL AND DISTRIBUTE GAS FOR HEATING, ILLUMINATING AND OTHER PUR-
POSES IN THE VILLAGE OF GOLDEN VALLEY AND TO USE THE STREETS,
AVENUES AND ALLEYS THEREOF FOR THAT PURPOSE". Member Rahn voted
"NO" on the above motion.
MOVED by Foss seconded by Stark carried to approve the above
ordinance quoted by title on its first reading. Member Rahn
voted "NO" on the above motion.
Committee Report, Re: Assessor and Village Engineer: The Mayor
staid that he had been in touch with Mr. Leonard Bies, chair-
man of the committe studying these :natters., that Mr. Bies. stated

that the committee would meet sometime this coming weekend.
Mr. Fred Greenfield; 5431 Glenwood Avenue, was present at the
meeting and stated that he wanted to apply for the job of Vil-
lage Assessor. Mre Greenfield was instructed to make his ap-
plication in writing.
Sanitary Sewers: MOVED by Rahn seconded by Foss carried to a-
dopt a resolution entitled, "RESOLUTION ACCEPTING PERMIT". See
Resolutions Book Page No. 62.
The 'Council acknowledged receipt of a letter dated February 3rd,
1954, from the Village of Crystal, said letter stating that the
Village of Crystal refused to particiapte in the construction
of a joint sanitary sewer facility on the basis of Crystal pay-
ing 43% of the initital construction cost and Golden Valley 57%
of said cost.
MOVED by Rahn seconded by Foss carried to adopt a resolution
entitled, "RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
SEWER IMPROVEMENT". See Resolutions Book Page No. 63.
The Council agreed to a special meeting to be held February
22nd, 1954, at 8:00 o►clock P.M. in the Village Hall for the pur-
pose of discussing problems created by the proposed sanitary
sewer construction. (Date changed to February 24th.)
MOVED by Rahn seconded by Foss carried that the Village employ
C. E. Coulter, Registered Land Surveyor, for the purpose of aid-
ing the Attorney in land condemnation proceedings, according to
the letter of said surveyor dated February 3rd, 1954•
Re: Dog Control: Two letters dated February 16th, 1954, one
letter from the President of the Meadowbrook School Board and
the other from the President of the Meadowbrook P. T. A., were
read to the Council. Said letters requested that the Village
take action to control dogs in or near said schoolts premises.
Persons in the audience were advised by the Village Attorney
that our present ordinance is not a "leasing or tie up" ordin-
ance.
MOVED by Huebsch seconded by Stark carried that the Administrative
Assistant advise the Police Department to follow.up all complaints
on dogs, make a detailed written memorandum of each such complaint,
and, where possible, to learn the dog owners` names and to warn
said owners of the penalties of not licensing and controlling
their dogs, and to investigate dogs on school grounds immediate-
ly. Member Foss voted "NO' on the above motion.
City of Robbinsdale Excavating on 26th Avenue North: The Admin-
istrative Assistant advised the Council that the City of Rob-
binsdale proposed to construct a storm sewer serving an area
lying north of 26th Avenue (within the City of Robbinsdale) and
that the City of Robbinsdale would find it necessary to excavate
portions of 26th Avenue. MOVED by Rahn seconded by Foss carried
that the Village of Golden Valley grant the City of Robbinsdale
permission to excavate 26th Avenue North for the purpose of
constructing a storm sewer drainage improvement.
The Administrative Assistant further advised the Council that
the City of Robbinsdale would permit the Village of Golden Val-
ley to tie in with the storm sewer project and would furnish
all engineering and cost estimates. MOVED by Rahn seconded by
Foss carried that the Village accept the offer of the Engineer-
ing Department of the City of Robbinsdale to furnish this Vil-
lage
illage with preliminary plans and cost estimates regarding partic-
ipation in the storm sewer project to be constructed by the City
of Robbinsdale.
Bonds of Elected Officials: MOVED by Rahn seconded by Foss car-
ried to approve the bonds of all Village officials elected on
December 8th, 1953•
Village Newspaper: The Council instructed the Administrative
Assista-t..t— o apse the editor and owner of the North Hennepin
Post that the Village Council would appreciate their attendance
at the meeting of March 2nd, 1954.
Bills: MOVED by Stark seconded by Foss carried to approve the
of llowing bills in the total amount of $3,321.4$.
