SPECIAL MEETING
of the
Village Council
February 24s 1954
Pursuant to due call and notice thereof, a special meeting of
the Village Council of the Village of Golden Valley, Hennepin
County, Minnesota, was held at the Village Hall in said Village
on the 24th day of February, 1954, at 7:30 P.M. The following
members were present: Rahn, Bless Foss, Huebsch and Stark; and
the following were absent: None. Present were Mr. Harry May;-
eron and Mr. Robert Houston, representatives of the G. M. Orr
Engineering Company.
Basis of Special Assessments, Sanitary Sewer: The Council unan-
imously agreed that the following formulas shall be used in com-
puting special assessments necessitated by reason of construction
of sanitary sewers:
1. Platted areas, including such areas as "Shangri La" and
"Mollents Addition , and including divided unplatted
property or iegalhomestead area or ess:
A front foot basis shall be used in computing special
assessments to be levied on platted and other properties as
set forth above by reason of the construction of sanitary sewer
facilities.
2. Non -platted areas: generally "acreages", and including
all such areas except numbered formulas contained here-
in:
An acre basis shall be used in computing special asses -
to be levied on real property as described above by reason
of the constr ction of sanitary sewer facilities on the basis

of 8 40' neal feet per acre.
3. Marginal Areas: "Marginal Areas" shall include all
areas where the land is presently swampy, low, covered
with water, and in the judgement of the sanitary sewer
engineer not deemed to be suitable for the construction
of a home or business. Appeal to the Council shall be
permissible in case of dispute.
Where an area is not specially assessed at the time of
the construction of sanitary sewer facilities by reason of the
fact that the area is considered marginal, a connection charge,
based upon the special assessment which would have levied had
not said area been considered marginal at the time of said con-
struction, shall be assessed when and if said area is so improved
as make any construction suitable and/or possible. The Council
reserves the right to charge a reasonable rate of interest on
said connection charge.

4. Other Areas Not Assessed: A Connection charge, as set
forth in 3 above, shall be assessed against all areas
not assessed at the time of construction of sanitary
sewer facilities, said exemption caused by reason of
real estate tax exemption, whenever such areas become
taxable.
5. Irregular shaped lots: Assessments shall be computed
upon the sum of the front lot line plus the rear lot
line divided by two.
b. Corner Lots: Corner lots under (1) above shall be as-
sessed on the basis of the footage of the short side of
the actual frontage of the residence occupying the pre-
mises, but in no case shall a shorter footage be used
which is less than the average of the non -corner lots
in the same block.
7. Street Radii: Radii on corners shall be "squared off"
that is to say, tangents shall be extended to the point
of intersection, and the owner of a corner lot assessed
as though no street radii existed.
8. Pie Shaped Lots, under (1) above: Where a pie shaped
lot fronts on a curved street, and the curved portion
of the street exceeds by 10% the possible frontage if
a straight line were drawn connecting the two front
corners of said lot, the assessment shall be computed
on the basis of the actual frontage of the curved
street plus the possible frontage if the street were
not curved, divided by two. If the street is not cur-
ved, and the computation of the assessment requires the
use of other formulas set forth herein, the actual
frontage divided by two shall be used.
9. Corner Acreages: Shall be treated as all other acreages.
10. Railroad Rights of Way: (Where no sewer benefit can be
assumed3 shall be considered to come under formulas num-
bered (3) and/or (4).
11. Frontage on Two Streets: Where a lot fronts on two
streets, but is not necessarily a corner lot although
it may be a corner lot, and said lot cannot be divided
into two "buildable lots" (under zoning ordinance or
under waiver for variance), assessment shall be com-
puted on the sum of the two street frontages divided by
two.
12. Curved frontages: Where a lot fronts on a curved street,
and the curved portion of the street exceeds by 10% the
possible frontage if a straight line were drawn connect-
ing the two front corners of the lot, assessment shall
be computed on the basis of the actual footage of the
curved street frontage plus the rear lot line footage
divided by two.
13. Business Properties: Business properties, except homes
for rental singes -and double family dwellings) and in-
cluding multiple dwellings as defined in the zoning or-
dinance, shall be assessed on the basis of street front-
age, or acreage as the case may be.
14. Mixing of Formulas: The above formulas shall not be
unreasonably or indiscriminately mixed to grant lower
assessments, provided, however, that two or more of
said formulas may be applied to the same parcel of
land to achieve a just and equitable result, but in no
case shall formulas applying to platted aa-Oas be,,mixed
with formulas applying to non -platted areas.
Member Foss was excused from the meeting.
15. Remainders: Where, in the application of the above
formulas, lots or acreages receive a lesser assessment
than would have been the case had not such formulas
been applied, the sum of the amounts deducted from each
lot or acreage shall be applied to the total assessment
of the district or lateral area.
Note: The above formulas were again studied by the Council on
March 2nd, 1954• Changes made on said date are incorporated in
the above minutes.
Robbinsdale Sewer Connection: The Engineers advised the Council
that the City of Robbinsdale serviced an area lying north of
26th Avenue North by means of a lift station, and that savings
were possible for both Robbinsdale and Golden Valley, should
Robbinsdale wish to.use the proposed Golden Valley gravity -flow
sewer system. The Engineer was instructed to obtain full in-
formation on the possible savings should both municipalities use
the gravity system. The Administrative Assistant was instructed
to advise Robbinsdale authorities that Golden Valley is ready
to proceed with construction of its gravity -flow system, and
this Village is open for negotiations regarding joint use of
its sewer system.
St. Louis Park Connection: The Engineers advised the Council
that St. Louis Park may wish to service a part of said munici-
pality by means of the south trunk sewer line (The "Tyrol Hills"
branch interceptor.) The Engineers were instructed, if they
determine such joint use feasible, to present full data on
such use to the Council, should St. Louis Park wish to proceed
with plans for a joint sewer interceptor. The Administrative
Assistant was instructed to advise St. Louis Park authorities
that Golden Valley is ready to proceed with sanitary sewer
construction, and this -Village is open for negotiations re-
garding joint use of its proposed sanitary sewer system.

Gas Connections: The attorney was instructed to attempt to ne-
gotiate with the Minneapolis Gas Company regarding the cost.of
temporary interruption of house gas service due to construction
of sanitary sewer laterals, and to report the results to the
Council.
Water Connections: The Council decided that the Village would
attempt to locate and map all water mains and house connections
in that area generally known as "Delphian Heights".
Existing Sewer Connections: The Administrative Assistant pre-
sented a tabulation oall persons presently connected with the
Robbinsdale or Minneapolis sewer systems, and the request of
Dr. Sylvester Koontz, 1701 Xerxes Avenue North, that he be per-
mitted to connect his sewer with the Sanitary Sewer System of
the City of Minneapolis.
The Council granted the request of Dr. Koontz, subject to the
provisions that the Council reserves the right to specially
assess Dr. Koontz and all other persons, whether connected to
the sewer system of Robbinsdale or Minneapolis, for their pro-
portionate cost of sewer laterals, or interceptors which may
be constructed by the Village of Golden Valley, regardless of
whether or not they actually connect to said laterals or inter-
ceptor.
Spreading of Special Assessments: The Council instructed the
Attorney to advise Mr. Fortier, et al that they were to proceed
with the spreading of any special assessments necessitated by
reason of the construction of sanitary sewers.
Sanitary Sewer Contract: The Attorny advised the Council that
the G. M. Orr Engineering Company had submitted a contract deal-
ing with the construction of sanitary sewer laterals, and that
said contract would be submitted to the Council at a'later date.
Sanitary Sewer Easements: The Attorney stated that he was mak-
ing satisfactory progress in obtaining legal descriptions cover-
ing the route of the proposed sanitary sewer interceptor. That
a meeting with affected property owners was planned at which
time the matter would be fully explained, and that he did not.
think that formal land condemnation would be necessary in most
cases.
Taking of Bids: The Council tentatively agreed to take bids on
the proposed sanitary sewer improvement during the week of
April 5, 1954•
Auditor's Report on Justices of Peace: The Administrative Assis-
tant forwarded the report of the auditors to the Council, said
report dealing exclusively with Village Justices of Peace.
Assessor: The Administrative Assistant advised the Council that
he had attempted to secure persons to perform certain clerical
functions of the assessor's office, but that he had been unable
to secure any person to do the work.
The meeting adjourned by mutual consent.
