07-06-54 City Council MinutesREGULAR MEETING of the VILLAGE COUNCIL July 62 1954 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held'in the Village Hall of said Village on the 6th day of July, 1954s at 7:30 o'clock P.M.' The following members were present: Bies, Foss, and Huebsch; the following members arrived -at 7:40 o'clock P.M. Members Rahn and Stark. The Mayor called the meeting to order at 7:47 o' clock P.M. MOVED by Foss seconded by Bies carried that the reading of the minutes of the meetings of June 15th, June 22nd, and July 1st, be dispensed with and that said minutes be approved as submitted to each member of the Council prior to this meeting unless some member of the audience wishes them read. (The minutes were not read.) Public HearUi& 1954 Street and Drainage Improvements: The Village Clerk presented an affidavit showing publication in the official newspaper of the notice of public hearing on certain street and sidewalk improvements described in the resolution of this Council relating thereto, adopted on June 15, 1954,• Said affidavit was examined, approved, and ordered placed on file in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed improvements and all persons present who desired to do so were afforded opportunity to express their views thereon. The Administrative Assistant presented the Engineer's recomm- endations and cost estimates for said improvements, said recommendations having been distributed to members of the Council prior to this meeting. The Council directed that the Engineer's recommendations be placed on file. No objections to the making of said improvements or levy of assessments to pay the cost thereof were made except as follows: Improvement No. 1: The entire length of Hanley Road, Ridgeway Road from is intersection with Winn,etka Avenue to its inter- section with Hanley Road. The Administrative Assistant stated that this improvement came on a sufficient petition, but that the original petition had been amended by two subsequent petitions which the Attorney now ruled rendered the original petition insufficient, i.e., less than 35%. 7 The Engineer for the Village then presented cost estimates as contained in recommendations heretofore presented, stating that the cost of construction Hanley Road with turnaround came to $7.03 per front foot, and without turnaround to $6.44 per front foot, the above figures including a 20f surcharge for contingencies,engineering, and administrative costs. Objector Objection Mr. Allen Bakken 400 Winnetka Avenue South Mr. David Brink 222 Hanley Road Mr. Bakken stated that he did not want concrete curb and gutter. Mr. Brink stated that he did not want concrete curb and gutter. The Engineer upon inquiry stated that the cost of oil was approximately .15 per front foot as compared to a total cost of approximately $7,000.00 which equals $2.50 per front foot for bituminous pavement, but that if the street were oiled, grade corrections as well as drainage corrections, would have to be made which would increase the cost in an amount which he was presently not prepared to state. MOVED by Stark seconded by Foss carried that the improvement be ordered constructed, i.e., that said streets be graded and oiled. The Village Attorney advised those present that if they would •l' pay in cash before October 11, 1954, there would be no necessity for spreading a special assessment upon benefited property Mr. R. C. Jacobson Mr. Jacobson objected to the 319 Hanley Road cost of the improvement. • Mr. W. F. Moody Mr. Moody stated that the gas 38 Hanley Road company proposed to install gas mains within the next year which would destroy a portion of any improved street which might be installed this year. Mr. Moody inquired as to the cost of oiling.said streets. The Administrative Assistant advised the public that an oiled street was merely a dust palliative, and as such was effective for only one year, and that chuckholes in an oiled road are impossible to repair. The Administrative Assistant further stated that the only effective method of repairing an oiled street was to oil it again the following year, and that if such a procedure were followed the oiled street could be expected to last for two or three years following the second application. The Engineer upon inquiry stated that the cost of oil was approximately .15 per front foot as compared to a total cost of approximately $7,000.00 which equals $2.50 per front foot for bituminous pavement, but that if the street were oiled, grade corrections as well as drainage corrections, would have to be made which would increase the cost in an amount which he was presently not prepared to state. MOVED by Stark seconded by Foss carried that the improvement be ordered constructed, i.e., that said streets be graded and oiled. Improvement No. 2: Ensign Avenue North from T. H. 55 to Wally Street, Wally Street from Ensign Avenue North to Decatur Avenue North, and Decatur Avenue North from Wally Street to T. H. 55. The.Administrative Assistant stated that this improvement came on a petition which owners of over 51% of the abutting. front feet had signed, but he had just been handed a petition dated June 29, 1954, which on cursory examination appeared to render the original petition insufficient, i.e., less than 35%. The Engineer advised the Council that the above streets should be regraded, that said streets were not in the center of the t'right of ways' (Tract T, R.L.S. No. 30), that a lot was.being filled through which surface waters formerly flowed, and that it is necessary to change the direction of slope of Wally Street so that surface water can flow west toward the natural drainage slope of the area. The Administrative Assistant advised the Council that the Village did not own Tract T, R.L.S. No. 30. Mr. George Mollen, son of Joseph Mollen, the latter being the owner of Tract T, stated that his father was not willing to deed Tract T to the Village for road purposes. MOVED by Rahn seconded by Foss carried that the improvement of Ensign, Wally, and Decatur Streets be tabled until such time as the Village acquired title to Tract T, R.L.S. No. 30, and until such time as the developer of the area brings the streets up to grade, and further, that the Administrative Assistant be instructed to withdraw all maintenance, snow plowing, and other services until such time as the above is accomplished. Improvement No., 3: Xenia Avenue North from its intersection with St. Croix Avenue southerly to its intersection with Golden Valley Road, and Welcome Avenue North from its intersection with Xenia Avenue North to its intersection with Golden Valley Road. The Administrative Assistant stated that this improvement came on a petition which owners of over 51.6/ of the abutting front feet had signed. The Engineer advised the Council that the estimated cost of improving said streets as contained in his recommendations heretofore presented came to $6.72 per front foot, said cost including a 206' surcharge for contingencies, engineering, and administrative costs. 1 �1' Objector Mr. Virgil Keil 5630 Golden Valley Road Objection Mr. Keil challenged the statement of the Administrative Assistant that the petition was 51% sufficient, (It appeared from discussion that Mr. Keil was under the impression that 51% of the property owners had to be in favor of the impro- vement instead of the owners abutting 51f of the front feet.) Mr. Keil objected to the impro- vement of the grounds of cost. .Mr, Myron Olson Mr. Olson objected to the impro- 1500 Xenia Avenue vement on the grounds of cost and instructed that his name be with- drawn from the petition. An unknown person -residing objected to the improvement at 1520 Xenia and other on the grounds of cost. persons Proponents Mr. Reinin;er Mr. Reininger stated that he 1620 Welcome Avenue appreciated the high cost of the improvement but that he was in favor of the improvement inasmuch as he felt that the impro- vement would benefit his property. He wanted a permanent improvement and not a temporary one. The Administrative Assistant advised the Council that the with- drawal of Mr. Olsonts name from the petition, said petition was rendered insufficient, i.e., less than 51%. Upon question, the Administrative Assistant advised the Council that he was under the impression that the Village had accepted the streets upon the recommendation of the Village Engineer, and that if the Village had accepted the streets, the Village could not now call upon the platter to make grade corrections. The Attorney stated that if the streets were not constructed accord- ing to specifications, the Council could, even if the streets had been accepted, nonetheless force the developer to reconstruct said streets. MOVED by Rahn seconded by Mark carried that the improvement of Welcome and Xenia streets be tabled until such time as the proponents of the improvement circulate and secure sufficient signers to another petition, and that said streets be constructed whenever possible should a sufficient petition be presented to the Village Clerkts office. Improvement No. 4: Regent Avenue North from its intersection with Golden Valley Road northerly with its intersection with Minnaqua Avenue, and the entire length of Sorell Avenue in Westurban Addition, and the entire length of Ordway Avenue in Westurban Addition, and the entire length of Orchard Avenue in Westurban Addition, and the entire length of Markay Ridge in Westurban Addition, and the entire length of Windser Way in Westurban Addition, and the entire length of Westbend Road in Westurban Addition. The Administrative Assistant stated that this improvement came on a petition which owners of over 51% of the abutting front feet had signed. The Administrative Assistant further stated that he had in his possession a letter dated September lb, 1953, from Enaco Inc., said letter being a petition to oil the streets in Westurban Addition in 1954 in the event that they are not blacktopped by 1954• The Engineer advised the Council that the. estimated cost of improving said streets as contained in recommendations heretofore presented, was $6.25 per front foot, said cost including a 20, surcharge for contingencies, engineering, and administrative costs. Objector Objection Mr. Bob Graham Mr. Graham objected to the 2725 Ordway improvement on the grounds that he did not know the cost of the improvement when he Mr. James C. Morken 4925 Sorell Mrs. Marshall Kennedy 2523 Sheridan Avenue North Mr. Bill Frederick 2135 Orchard Proponents Mr, David Blackwell 2200 Windser Way signed the petition and recommend- ed that said streets be oiled instead of blacktopped. Mr. Morken stated that he wished his name withdrawn from the petition on the grounds that sanitary sewers would be install- ed in the area in a few years at which time much of the improvement would be lost. Mrs. Kennedy objected to the improvement of the same grounds as Mr. Morken. Mr. Frederick objected to the improvement of the same grounds as Mr. Morken, Mr. Blackwell stated that he appreciated the cost of the improvement but that he felt 0 1 10 1 that the improvement should pro- gress as outlined by the Engineer. Mr. Gordon Olson Mr. Olson stated that most of 2163 Perry the cesspools are in sand and that there would be no sanitary sewer lateral going through Westurban Addition for five years, and that he was not in favor of putting up with the dust and dirt of a non -improved road for five years, and that the improvement should proceed as outlined by the Engineer. Mrs. Elma House Mrs. House inquired as to whether 2030 Ordway or not the street could be black - topped without curb and gutter except in certain areas. The Engineer stated that curb and gutter would be necessary throughout Westurban Addition due to soil and terrain conditions, but that it might be possible to construct temporary streets, using a mixture of bituminous materials costing slightly more than oil, and that he estimated the cost of said material to be about $.25 per front foot as compared with a cost of $2.50 per front foot for bituminous pavement. The Engineer further stated that extensive grading work would be necessary in order to construct a "better than oiled" street, and that such grading would increase the cost over $.25 per front foot in an amount which he was not presently prepared to state. MOVED by Stark seconded by Rahn carried that the improvement of the streets in Westurban Addition be ordered, that is, that said streets be graded and oiled as outlined by the Engineer. The Village Attorney again advised citizens to prepay the cost of the above improvement by September 1, 1954• Improvement No. ll: Sidewalk on the East side of Noble Avenue from its intersection with 29th Avenue North northerly to its intersection with 34th Avenue North and on the West side 6f Noble.Avenue North from its intersection with 29th Avenue North southerly to its intersection with Ordway and as to street repairs, and regrading; on Noble Avenue North from 34th Avenue North to Ordway. The Administrative Assistant advised the Council that this matter came up upon the request of certain school officials and other persons living in the northeastern portion of the Village, whose children will attend the new Noble Avenue School, The Administrative Assistant further stated that he had in his possession a petition signed by fifty-nine persons, said petition reading as follows: "ode, the undersigned owners of property which will be benefited by the installation of side- walks on Noble Avenue North and by the reconstruction of Noble Avenue North to remove potentially dangerous hills, for our children, hereby petition that sidewalks be constructed where necessary in the discretion of the Village Council, that said hills be removed, and that such changes be made in the drainage of surface waters through the construction of concrete curb and gutter and other construction as may be found necessary." The Administrative Assistant further stated that he had just been presented with a petition signed by approximately 41 persons reading as follows: "We, the undersigned bona fide property owners of Golden Valley who abutt Noble Avenue North, petition the Village Council against authorizing construction of sidewalks or re -grading of Noble Avenue North commencing at the intersection of Merribee Drive to intersection on Ordway Avenue North " The Engineer stated that the cost of constructing sidewalk as set forth in the notice of public hearing would, if assessed against Noble Avenue property owners, was an estimated 08.15 per running foot, said cost including a 20% surcharge for contingencies, engineering, and administrative costs. Ob 'e� ctor Mr. James N. Kane 22.3 Noble Avenue North Ob j ection Mr. Kane presented the writing above referred to petitioning the Council not to authorize the construction of sidewalk or regrading of Noble Avenue North. Mr. Kane inquired as to who would maintain the sidewalk as to snow removal, and stated that other schools were located on arterial streets without sidewalks, and that children attending Noble Avenue School could approach the school on side streets. There were a number of other people who objected to the impro- vement on the same grounds as outlined above. Proponents Mrs. Jean Peterson 2121 Orchard Avenue Mrs. Peterson stated that the Council has no jurisdiction over the school board and therefore cannot control who shall walk to the school or who shall ride buses to the school and that some provision should therefore be made for the "walkers". 1 1 The Village Engineer then presented an alternate plan for sidewalk on the west side of Noble Avenue between Culver Road and Orchard Avenue, for the. -removal of the hill located just in front of said school on Noble Avenue and stated that the alternate plans would cost an estimated $2,30 per front foot. MOVED by Foss seconded by Rahn carried that sidewalks be.construct- ed on the west side of Noble Avenue North between Culver Road and. Ordway and that Noble Avenue North be reconstructed to remove a hill -lying near Noble Avenue School, and that the cost of said improvements be spread over as many properties lying in School District #24, either by ad valorem or by special assessment; in the latter -case the assessment to be spread to the point of diminishing returns. The Village Attorney was instructed to investigate the matter of spreading the cost of the above improvement and to report his findings to the Village Council, Improvement No. 5: 27th Avenue North from its intersection with Noble Avenue North to its intersection with Kyle Avenue North. The Administrative Assistant stated that this improvement came Mr. Roland DeLapp Mr. DeLapp stated that the purpose 2901 Noble Avenue of constructing the school in its present location was to increase the number of "walkerstt, Mr. Harold Eckdahl Mr. Eckdahl stated that in his 2700 Noble Avenue opinion the Council should accept the Engineer's recommendations for the construction of sidewalk. ' Mrs. Holstrom Mrs. Holstrom stated that to her 2200 Orchard Avenue knowledge there would be no bus service in Westurban Addition and that the safety and welfare of the children should be put ahead of resident's pocketbooks, and that something should be done before and not after some child is injured walking to school, Mr, Olson Mr. Olson stated that the entire 2162 Perry Avenue expense should not be born by the resident's of Noble Avenue and expressed his wish to pay his share of the cost of the impro- vement. Mr. Clifford Teresa Mr. Teresi stated that the side - 3140 Orchard Avenue walks should be constructed regard- less of cost. The Village Engineer then presented an alternate plan for sidewalk on the west side of Noble Avenue between Culver Road and Orchard Avenue, for the. -removal of the hill located just in front of said school on Noble Avenue and stated that the alternate plans would cost an estimated $2,30 per front foot. The Administrative Assistant stated that this improvement came on the recommendation of himself for the reasons which follow.: 1) The developer of Merribee Hills Second Addition, Mr. Elmer Crowl, was under bond to construct, pave, and install ✓ concrete curh and gutters on the south side of 27th Avenue between Noble Avenue and Lee Avenue. 2) The Tillage in 1953s constructed half a blacktop street on the north side of 27th Avenue, with concrete curb and gutter, between Lee Avenue North and Kyle Avenue North, 3) Unless 27th Avenue is constructed between Noble Avenue North and Kyle Avenue North, erosin and traffic will destroy existing pavement, and will damage any half streets that may be constructed in the future. 4) Half width paved streets present traffic hazards, particularly when the half -width paved sections are not parallel. The Engineer stated that the estimated cost of improving said street, as contained in his recommendations heretofore presented, came to $5.90 per front foot, said estimated cost including a 20% surcharge for contingencies, engineering, and adminis- trative costs. The Administrative Assistant then presented a letter dated June 26, 1954, signed by Mr. Eimer Crowl, 4444 Merribee Drive, and by Mr. Harold Eckdahl, 2700 Noble Avenue North, requesting that 27th Avenue not be constructed between Noble Avenue and Major Avenue. There were no other objectors. The Engineer stated that if 27th Avenue were not constructed between Noble Avenue North and Major Avenue North, a drain pipe should be constructed on 27th Avenue at an estimated cost of 019300.00 and that a drainage ditch would not be adequate due to the volume of surface water which will flow down the street when Merribee Hills Second Addition is completed. Mr. Eckdahl stated that there -was no present damage from surface water, and was willing to take his chance on future water damages. The Administrative Assistant repeated his recommendation that for the reasons stated above, 27th Avenue be constructed between Noble Avenue and Kyle Avenue North, and stated that fill for Noble Avenue sidewalks is scheduled to be taken from 27th Avenue North. Mr. Crowl offered all the fill necessary for the Noble Avenue project, said fill to be excavated at no cost to him. MOVED by Rahn seconded by Bies carried to table the impro- vement of 27th Avenue North,. provided however, that upon presentation of a proper petition, 27th Avenue North shall be constructed between Noble Avenue North and June Avenue North. n Iovement No, 6: Douglas Drive from its intersection with Golden Valley Road northerly to its intersection with St. Croix Avenue, The Administrative Assistant advised the Council that this improvement came on a petition which over 35% of the persons owning abutting property had signed. The Engineer presented cost estimates as contained in the recordmendations heretofore presented, stating that the estimated cost of furnishing the material for improving Douglas Drive North was $.28 per front foot, said cost including a 20% surcharge for contingencies, engineering, and administrative costs. There were no objections. MOVED by Foss seconded by Rahn carried that the improvement of Douglas Drive North as set forth be ordered. Improvement No. 7: Oiling of certain streets in Belmont.. Addition as set forth in the notice of public hearing. The Administrative Assistant advised the Council that no petition had been submitted calling for the improvement, although one had'been circulated. MOVED by Foss seconded by Rahn carried that the improvement be tabled. Im rovement No. 8: Jersey Avenue North from its intersection with 6th Avenue North to its intersection with T. H. 550 The Administrative Assistant advised the Council that on April 20, 1954, the Council ordered the improvement of Jersey Avenue be included in the procedural requirements of public hearing to be held in conjunction with 1954 -capital improvements. The Engineer presented cost estimates as contained in recommendations 1i t f re resented stating that the estimated cost of ere o o p , grading and graveling Jersey Avenue North was $2.30 per front foot, said.cost including a 20% surcharge for contingencies, engineering, and administrative costs. Objector Objection Mr. Theodore Rutkowski Mr. Rutkowski objected on the 6823 6th Avenue North grounds that the improvement would be of no benefit to his property. Mr. John R. Soltz 6839 6th Avenue North Proponent Mr. James Asch 537 Jersey Avenue North Mr. Soltz objected to the improvement on the same grounds as Mr. Rutkowski. Mr. Asch stated that the present road is impassable for most of the year, that two large trees are growing in the center of the right of way, and that the Council promised a road if he and his neighbors dedicated a 60 foot right of way. MOVED by Bies seconded by Stark carried that Jersey Avenue between T. H. 55 and Sixth Avenue North be graded and graveled said street to run down the middle of the right of way, contingent upon construction costs not to exceed approximately $500.00, the village to perform all work possible. Improvement No. 9: Plymouth Avenue from its intersection with Hampshire Avenue North to its intersection with Florida Avenue North. The Administrative Assistant advised the Council that this improvement came on a petition which owners of over 51% of the abutting front feet had signed. The Engineer presented his recommendations for the impro- vement of said road and stated that the estimated cost of constructing said street was 0.90 per front foot, said cost including a 20% surcharge for contingencies, engineering and administrative costs. Objector Mr. Eugene Anderson 2855 Quebec Avenue Mr. Everett Klucas 1240 Hampshire Avenue Mr. Arthur Oliva 1310 Hampshire Avenue Objection Mr. Anderson objected to the improvement on the grounds of its cost and instructed his name withdrawn from the petition. Mr. Klucas objected to the improvement of the grounds of its cost and instructed that his name be drawn from the petition. Mr. Oliva objected to the improvement on the grounds of its cost and instructed that his name be drawn from the petition. I- I u 1 H 1 A The Administrative Assistant then advised the Council that the above withdrawal of names rendered the petition insufficient that is, less than 35Y - MOVED by Stark seconded by Bies carried that the improvement not be constructed, Improvement No. 10: Ottawa Avenue South from its intersection with Glenwood Avenue to its southerly terminus. The Administrative Assistant advised the Council that this improvement came on a petition which owners of over 51% of the abutting front deet had signed. The Village Engineer presented his recommendations and stated that the total cost of constructing concrete curb and gutter on Ottawa Avenue wherever not presently installed and the reconstruction of said road where necessary would cost an estimated $6.84 per front foot, including a 20% surcharge for contingencies, engineering, and administrative costs. Objector None Proponents: Mr. W. J. Montroy 309 Ottawa Avenue Mr. Arnold Anderson 317 Ottawa Avenue Objection None Mr. Montroy stated that he wished the improvement be constructed. Mr. Anderson stated that he wished the improvement be constructed. The Administrative Assistant advised the Council that he had requested the State Highway Department to install concrete curb and gutter on Ottawa Avenue where said Ottawa Avenue lies on the right of way of T. H. 55, but that he had not as of this date received an answer. MOVED by Stark seconded by Bies carried that Ottawa Avenue be improved by the construction of concrete curb and gutters, that said Ottawa Avenue be reconstructed where necessary, and seal -coated for its entire length. There was discussion as to the possibilities of closing off access to the Belt Line from Circle Downs. The Administrative Assistant was instructed to inquire as to whether the Minnesota State Highway Department would object to closing said access. Several persons appeared and objected to the costs of impro- vements numbered 2, 3, 5, 7,' and 9, in the notice of public -hearing described above. MOVED by Bies seconded by Stark carried that the question of ordering construction of improvements numbered 2, 3, 5, 7s and 9 in the notice of public hearing described above be tabled. Upon vote being taken thereon the following members voted in favor thereof: Bies, Foss, Huebsch, Rahn, and Stark and the following voted against the same: None. MOVED by Stark seconded by Bies carried to adopt a resolution entitled, "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN STREET AND SIDEWALK IMPROVEMENTS". See Resolutions Book page 25 -- Sanitary Sewers: Mr. Harry Mayeron was present as represen- tative of the G. M. Orr Engineering Company. A. Minneapolis Construction- The Council instructed the Attorney to advise the eit of Minneapolis that Golden Valley desired that Minneapolis construct that portion of the sanitary sewer interceptor lying within the limits of said city. The Attorney pointed out that the basis for a bond issue is a bona fide contract, and that if Golden Valley constructs said portion of sewer in accordance with letter dated June 28, 1954, from the Minneapolis City Engineer, no such contract exists. Reference was made to the agreement between Golden Valley and Minneapolis by which. Minneapolis agreed to construct the portion of sanitary sewer above referred to. Mr. Mayeron stated that should Golden Valley sewer lines be fully constructed before the Minneapolis portion is con- sturcted, temporary use may be made of an existing twelve inch sewer main lying near Golden Valley sewer's point of exit, B. Supplemental Contract, Resident Engineer: MOVED by Rahn seconded by Bies carried to approve a contract supplemental to a contract of September 2, 1952, between G. M. Orr Engin- eering Company and the Village of Golden Valley, said supplemental contract providing that the Orr Company shall furnish a supervisory resident engineer for all interceptor construction at a cost of 0800.00 per month, and to authorize the Mayor and the Clerk to affix their signatures thereto. C. Inspectors: Mr. Mayeron referred to the letter of'the Min Assistant dated June 30, 1954, and stated that it now appeared that two inspectors would be needed, said inspectors and the resident engineer to act as a survey party. D. Lateral Contract With G. M. Orr Engineering Company: MOVED by Foss seconded by Rahn carried to approve a contract with the G. M. Orr Engineering Company for engineering services relative to the construction of sanitary sewer laterals, pro- vided that said contract provides for termination of services at the completion of any phase of lateral construction, and to authorize -the Magor and the Clerk to affix their signatures thereto.
