REGULAR MEETING
of the
VILLAGE COUNCIL
October 19, 1954
Pursuant to due call and notice thereof a regular meeting of
the Village Council of the Village of Golden Valley, Hennepin.
County, Minnesota, was held in the Village Hall in said Village
on the 19th day of October, 1954, at 7:30 o.tclock F.M. The
following members were present: Bies, Foss, Huebsch, Rahn and
Stark, and the following were absent: None, The Mayor called
the meeting to order at 7:30 otclock P.M.
MOVED by Rahn seconded by Stark carried that the minutes of the
meeting held on October 5, 19542 be dispensed with and that said
minutes be approved as submitted to each member of this Council
prior to this meeting unless some member of the audience wishes
them read. (The minutes were not read.)
Watermain Improvement Project: Re: Minneapolis Connection: The
Administrative Assistant advised the Council that the Public
Building and Grounds Committee of the Minneapolis City Council
did not meet on October 6th, 1954, but that said committee would
meet on October 20, 1954, and that he, the Village Attorney,
and the Village Engineer, and any other Councilman who so
wished, will attend said committee meeting on said date.
The Administrative Assistant further stated that proper demand
had been made upon the City of Minneapolis for a connection
to their France Avenue watermain and advised the Council of
his letter of October 15, 1954•
Adjourned Public Hearing2 Sanitary ;Sewer Laterals: (See minutes

Improvement No. 1E, As Described in the Affidavit Publication:
(Westurban Addition) Mr. Schulorick, 4944 Sorell Avenue,' stated
that he had been appointed spokesman for persons residing in
Westurban Addition. Mr. Schulorick stated that 72% of the
residents attending a meeting voted in favor of the construction
of Sanitary Sewer Laterals in the addition, their vote being
predicated upon the assumption that all residing in the area
would be assessed a $2.00 per front foot outlet charge even if
they did not receive Sanitary Sewer Laterals.
On question, Mr. Harry Mayeron, representative of the G. M. Orr
Engineering Company stated that the $2.00 outlet charge was
not an exact figure but would probably be less than $2.00 depend-
ing upon the area served. Upon this statement by Mr. Mayeron,
Mr. Schulorick, 4944 Sorell Avenue, requested that the Council
adjourn this public hearing to the next regular Council meeting

in.order that he might advise persons residing in Mesturban Addition
of the above fact.
MOVED by Rahn seconded by Stark carried to adjourn the instant
public hearing to the next regular meeting to be held on
Thursday, November 4, 1954, at the Village Hall, and,that Mr.
Mayeron meet with representatives of Westurban for the purpose
of explaining all details of the proposed Sanitary Sewer Lateral
construction.

Mr. Nelson stated that residents of
Yale Garden Homes had appointed him
as spokesman for said area. Mr.
Nelson stated that persons residing
in Yale Garden Homes were definitely
opposed to the installation of
Sanitary Sewer Laterals because
Yale Garden Homes was presently very
poorly developed.
Mr. Millard and Mr. Mooney stated
their objections to the installation
of Sanitary Sewer Laterals on the
same grounds as those of Mr. Nelson.
Mrs, Helen Linblad Baxter Mrs. Baxter objected to the installa-

the grounds that said, laterals 7 would
not solve the problem of surface
water drainage.
All of the -above persons objected to any outlet charge which might
be assessed against residents of Yale Garden Homes.
Proponents:
Mr. Howard Marquette Mr. Marquette advised the Council that
3307 Quail Avenue North he and two of his neighbors residing
between 33rd and 34th Avenues were
in favor of the installation of
Sanitary Sewer Laterals.
The Administrative Assistant read his report of this date, said
report stating that the Planning Commission recommended that
planning engineers study Yale Garden Homes for the purpose of
designing future street routes. The Council agreed that said
study should be made at the earliest possible time.
The Council discussed the probable outlet charge for Yale
Garden Homes. Mr. Harry Mayeron of the G. M. Orr Engineering
Company stated that outlet charges are not usually assessed
against small areas such as Yale Garden Homes, and that as
outlet charge assessed against the area would probably be
less than $2.00 per front foot..
MOVED by Stark seconded by Foss carried that Yale Garden
Homes be omitted from Sanitary Sewer Lateral District No.
1C, and that any outlet charge assessed against the residents
of Yale Garden Homes by reason of sanitary sewer lateral
construction in other portions of No. 1C be as small as is
equitable.
Improvement No. 1&, As Described in the Affidavit of Publication:
The Administrative Assistant advised the Council that persons
who would be benefited by the installation of sanitary sewer
laterals in Sanitary Sewer Lateral District No. lff, showed no
apparent interest in the matter and had not expressed to him
either opposition or approval of the proposed improvement.
MOVED by Foss seconded by Stark carried that Sanitary Sewer
Lateral District No. 19 be omitted.
Improvement No. 1G, As Described in the Affidavit of Publication;
The Administrative Assistant presented and read a letter from
Miller -Davis Engineers Inc., representing the International
Paper Company, dated October 8, 1954, signed by Mr. H. R.
Harbeson.
MOVED by Stark seconded by Bies carried to accept the offer
in the letter above referred to that the International Paper
Company pay to the Village the actual cost of the lateral to
be constructed in Sanitary Sewer Lateral District No. 1G,
plus a fair charge for trunk connection, it being understood
that under this offer and acceptance connections would be made
for additional users without reimbursement to the International
Paper Company provided the sewer is not overloaded; and that
the trunk connection charge be a very reasonable hook -on charge.
Mr. Harbeson was present and stated that the lateral connection
should not extend beyond the property of the International Paper
Company, and that the International Paper Company would place
the estimated cost of the lateral in escrow for the Village of
Golden Valley.
MOVED by Stark seconded by Bies carried to instruct the sanitary
sewer engineers to provide the estimated cost of constructing
the sanitary sewer lateral designed to service Lateral Area No.
1G, and that the International Paper Company place the estimated
cost of construction in escrow.

MOVED by Stark seconded by Bies carried to proceed with .Sanitary
Sewer Lateral District Improvement No. 1G on the conditions set
forth above.
Re: Use of Robbinsdale Sanitary Sewer System: The Administrative
Assistant presented and read a letter dated October 18, 1954s
from the G. M. Orr Engineering Company detailing the results
of a conference with Robbinsdale City authorities on October
11, 1954, regarding the use of Robbinsdalets 26th Avenue
Sanitary Sewer Lateral. Said letter was ordered placed on file
in the office of the Village Clerk. The Council agreed to the
conditions of said letter, and instructed the attorney to
draft a resolution incorporating said conditions.
MOVED by Rahn seconded by Stark carried that the request of
the Stuart Construction Company to connect the sewer systems
of homes proposed to be built on lots 23, 24, and 25, Delphian
Heights Addition, to the Robbinsdale 26th Avenue sanitary sewer
lateral be approved, subject to the adoption of a reciprocal
resolutions between the City of Robbinsdale and the Village
of Golden Valley,
Planning Map: Mark Hurd Aerial Surveyors Inc: (See minutes of
October 5. 19 Mr. Burns, representative of said company
discussed with the Council the services offered by said company
and the terms of payment.
MOVED by Stark seconded by Foss carried that Mark Hurd Aerial
Surveyors Inc., present a concrete proposal to the Village of
Golden Valley including in said proposal the cost of bringing
any maplAy said company up to date at stipulated intervals.

.Plat: Courtlaw& Addition: Mr. Lester Elstad, presented the
plat of Courtlawn 2nd A ition. The administrative Assistant
advised the Council that said plat had been finally approved
by the Planning Commission on October 14, 1954»
MOVED by Stark seconded by Foss carried that the plat of Courtlawn -_2-4
Addition be accepted and that the Mayor and the Clerk be
authorized to affix their signatures thereto, after certain
corrections as noted by the Administrative Assistant have been
made and after the County Surveyorts approval, provided that
a bond guaranteeing the purchase of street signs, the addition
of necessary culverts and/or drain pipe, storm sewer or
catch basin for correction of drainage, and the maintenance
of said streets for a period of one year following this date,
with addition of gravel where necessary,,,;
Acceptance of 'Streets, Spring Green South: MOVED by Rahn seconded
by Foss carried that all streets in said addition be accepted upon
the recommendation of the Village Engineer and his report that
said streets met or exceeded specifications for street construc-
tion and that no drainage problems existed at this time and
that the bond be released.
Re: Trunk Sewer, Special Assessments: Mr. Albert G. Bell,
representative of the Great Northern Railway, and Mr. Manley
Davenport, representative of the Minneapolis, Northfield and
Southern Railway, and others, addressed the Council"regarding
special assessments assessed against said railways by reason
of the construction of Sanitary Sewer Improvement No. 1. Mr.
Bell and Mr. Davenport stated that there was no apparent benefit
to their companies and petitioned for the reduction of said
assessments. The Council agreed to meet with Mr. Bell and Mr.
Davenport on Friday, October 222 1954s at 5530 Wayzata Boulevard
for the purpose of discussing the matter.
Hardship Waiver, Dot 10 and 11, Block 1, Lakeview Heights Addition:
The Administrative Assistant advised the Council that the
Planning Commission had approved the construction of a garage
ori said premises with a setback of 5 feet from the right of
way of Winsdale Street.
MOVED by Foss seconded by Stark carried that the Building Inspector
be instructed to issue a building permit for the construction
of a garage 5 feet from the right of way line of Winsdale Street
on the grounds of hardship, per plans on file in the office of
the Building Inspector,
Hardship Waiver, Lot 1, Glenwood Addition: The Administrative
Assistantadvised the Council that the P anning Commission had
approved the construction of a residence on said lot, the rear
of said residence to be 5 feet from the eastern boundary of
said lot.
MOVED by Foss seconded by Rahn carried that said request for
hardship waiver be tabled until the next regularly called Council
meeting.
Application for Commercial Building Permit, Weavewood Inc: The
Administrative Assistant presented the plans of said company for
the construction of an industry to be located at approximately
7526 Wayzata Boulevard.
MOVED by Stark seconded by Foss carried that the Building Inspec-
tor be instructed to issue a building permit to Weavewood Inc.,
for the construction of an industrial building at 7526 Wayzata
Boulevard, per plans inspected by this Council and on file in
the office of the Building Inspector.
Application for Rest Home Site$ Mr. J. P. Hansen: The Admin-
istrative Assistant presented the petition of said person for
a rest home site to be located north and west of the intersection

of Glenwood Avenue and T.H. 100, and presented a free-hand
drawing of the proposed.location.
MOVED by Rahn seconded by Bies carried that the application
be tabled.
Assistant presented and
Police Department: Rules and Regulatio t: The Administrative

and read his report dated October 16, 1954,
and submitted therewith a draft of rules and regulations govern-
ing the duties and responsibilities of the Golden Valley Police
Department.
The Mayor instructed the Administrative Assistant to briefly
outline the contents of the rules and regulations.
The Council agreed that each member of the Council study the
proposed rules and regulations at leisure, after which time the
chair will call a special meeting for the purpose of discussing
the rules and regulations. Member Stark stated that differences
of opinion had existed between the Police Department and the
Village Council for the past six years and that he felt that
the Council should meet with the Police Department and determine
what measures could be taken to rectify the situation.
Deed to Lowr ,Terrace: The Administrative Assistant presented
the deeo Lowry Terrace between Quail Avenue North and Orchard
Avenue North and stated that said street had been vacated in
about 1951 but that the Village now needed the right of way for
the construction of sanitary sewers.
MOVED by Rahn seconded by Stark carried that the Village accept
the deed to Lowry Terrace for the consideration of $1.00 and
that the Attorney be instructed to file the deed.
Deed, Douglas Drive Extended: The Administrative Assistant
presented a deed for a fifty foot right of way between T. H.
55 and the Minnesota Western Railroad tracks.
MOVED by Stark seconded by Bies carried to accept said deed for
the consideration of $1.00 and that the Attorney be instructed
to file the deed.
Application for Transfer of License, 'The Bower'": MOVED by
Stark seconded by B es carried that the application'of Mr..Joe
Inforzato, that all licenses of the Bowery be transferred to
Mr. Frank Gracyasz, be referred to the Chairman of License
Committee for_ report, investigation, and recommendation to
this Council at the next regularly called Council meeting.
Contract.and Bond, improvement No. 18, 1954 Street Improvements:
The Mayor and the Clerk signed the contract for the 1. '154 street
improvements with Bury & Carlson Inc.., as heretofore instructed
by this Council.
