SPECIAL MEETING
of the
VILLAGE COUNCIL
May 5th, 1955
Pursuant to due call and notice thereof a. Special Meeting of the Village
Council of the Village of Golden Valley was held at the Village Hall in
said Village on the 5th day of May, 1955, at 7:30 otclock P.M. The
following members were present: Bies, Foss, Mahn, and Stark; and the
following was absent: Huebsch. Member Stark, Acting mayor by mutual agree-
ment, called the meeting to order at 7:47 otclock P.M.
Re: Office of Mayor: Acting Mayor Stark announced that this special meeting
was called or the purpose of deciding the issue of whether the office of
Mayor had been voluntarily vacated by Mr. C. A. Huebsch.
Acting Mayor Stark wished to bring to the attention of the public that proper
notice of the meeting had been given by the office of the Village of Golden
Valley. To substantiate this statement more evidence was presented.
Acting Mayor Stark asked Attorney Kane to read a letter from the Mayor,
which read as follows:
Dear Mr. Kane:
The notice of the meeting for 7:30 otclock P.M., Thursday, May 5th, 1955,
does not comply with Minnesota Law as we know it which provides for a full
t.tiro days n,-tice. I therefore suggest that the meeting on the subject of
the vote of confidence for the Mayor be held on Monday, May 9th, 1955, at
8:00 o'clock P.M., at the Village Hall.
As you realize, I have spent fully a third of my business time in the
interests of the Village of Golden Valley and I request the courtesy of a
weekend delay, the reason being that a call was received to meet with
operators of a large Wisconsin laundry and d ryclear_ing company. They
request immediate consultation with a view of purchasing new and modern
dry cleaning equipment which will amount to a sizeable figure. It is my
hope to be present to observe the results of the vote to be taken Monday
night, otherwise the minutes and voting record can be sent me at 4600
Chatelain Terrace.

Acting Mayor Stark then requested that Attorney Kane read Section 112.191
of the Minnesota Statutes as it applies to special meetings. They read
as follows:
". . . special meeting may be called by the Mayor or by two members of the
council by writing filed with the Clerk who shall then mail a notice to all
members of the time and place of the meeting at least one day before the
meeting. The Mayor, or in his absence, the Acting Mayor, shall preside "
Attorney Kane then showed that the proper notice had been given.
Acting Mayor Stark then stated that the members of the council present did
not wish to consider the status of the office of Mayor without the Mayor's
presence and that a motion for adjournment was in order.
Member Rahn MOVED and Member Bies seconded that this meeting be considered
adjourned until such time as a special meeting can be called or the subject
entered in the agenda of the next regular meeting.
Motion carried.

The/Mayor recommended that Norris L. Ogard be appointed acting Clerk for the
purpose of recording Council action of the instant meeting.
MOVED by Foss seconded by Rahn carried to approve the recommendation of the
Acting Mayor.
Meeting adjourned at 8:10 o'clock P.M.
