VILLAGE COUNCIL
August 15, 1955'
Pursuant to due call and notice thereof, a special meeting of the Village
Council of the Village of Golden Valley, Hennepin County, Minnesota was held
in the Village Hall in said Village on the fifteenth day of August, 1955, at
7:30 P.M. The following members were present: Bies, Nadasdyj Rahn, and
Stark; and the following member was absent:, Foss. Mr. H. C. Alden, who is
making up the special assessment tax roll for the Lateral Sewer ##1, and Mr.
Harry Mayeron were present.
Re: Assessments, 1955 Street and Storm Sewer Improvements.
The Council was advised that the following improvements are to be assessed
this year, by Village personnel.
Lowry Storm Sewer
26th Ave. Water Main
France Avenue
Xerxes Ave. Oiling
Olympia Ave. Storm Sewer Re -assessment
Yale Garden Homes,
The Council instructed the Village Attorney to begin condemnation proceed-
ings immediately on all street right-of-ways recommended in said area by the
Planning Commission and accepted by this Council on July 15, 1955, all costs
of condemnation to be pro -rata assessed against all benefitted properties.
The Council agreed that rough grading of all streets in Yale Garden Homes
between Noble and including Regent Avenue, and between Lowry Terrace (extended)
and 34th Avenue, should be accomplished in 1955, and further, that Lowry
Terrace from Noble to Regent shall be rough graded by Village day labor at
once due to the urgency of constructing sewer laterals along said street.
Re Rates for Sanitary Sewer Lateral Special Assessments.
The Council agreed that there will be two rates for assessing the cost of
Sanitary Sewer Lateral construction:
1. Outlet Rate or Use Charge
2. Lateral Charge
1, Outlet Rate or Use Charge
"Use Charge". The Use charge is defined as a charged assessed against that
property which may use the present sewer facilities as constructed as an
outlet, but which cannot at this time use said facilities due to the fact
that the sewer is not constructed to immediately service their properties.
The Use charge is to be applied against such properties on either an
acreage basis or a front foot basis. Those properties assessed on a. Use
charge basis will be assessed an additional charge when and if additional
sewer facitilies are provided.

2. -"Full Lateral Charge" is defined as that charge assessed against all proper-
ties using sewer facilities, (or that can use sewer facilities) and consists
of the Use charge plus the Lateral charge.
Railroads;
All railroads will be assessed the Use charge for all right-of-way. All other
Railroad property will be assessed the full Lateral charge.
Sewer Service from other Municipalities:
Buildings receiving sewer service from Minneapolis will be assesed the above
Use charge, provided, however, that the Village does not waive its right to levy
=greater assessment should future conditions warrant.
Trunk Sewer Connections:
Where a building receives sewer service directly from a "trunk sewer" as opposed
to a "lateral sewer" pipe, such building shall be assessed the full lateral charge,
based upon the cost of constructing a lateral sewer to service said building.
"Public Property"
A. All property owned by schools, whether public or private, or churches, hospitals,
or other tax exempt associations whether public or private, or charitable or
religious, shall be assessed for lateral sewer construction costs.
B. Public Property: Property owned by the Village of Golden Valley, the
Minneapolis Park Board, or the State of Minnesota, shall not be assessed for
Sanitary Sewer Lateral construction unless such properties receive sewer
service, in which case (except the Village) such governmental units shall
pay the quarterly service charge in addition to paying the entire cost of
connecting to the sanitary sewer pipe.
Lateral Sewer Assessment Formulas:
All assessment formulas adopted by this Council on February 24, 1955 shall be
used in computing assessments to be levied as a result of the construction of san-
itary sewer laterals, in addition to the following formulas:
1. Nhere a lot exceeds 18,750 square feet and division into additional
lot or lots is possible with or without hardship waiver of said lot, set
back, or rear lot requirements, the assessment shall be based on the
actual charge for street frontage, plus the Use charge computed on an
acreage basis less 18,750 square feet.

2. Curvi-Linear lots; Where lots face the concave side of curvi-linear street.,-
and
treet,and the lot has less actual street frontage than lots in the same block or
area, (although such lots are approximately 100 feet wide at the building
line"), such lots shall be assessed the average of other lots in the same
block. There such a lot, (on the concave side of the street) exceeds 100
feet, assessments shall be based upon the formula applying to pie -shaped lots.
3. Special cases:
a. Lots facing both York and Xerxes will be assessed the full Lateral charge
on their York Avenue frontage, and the Use charge on their Xerxes Avenue
frontage.
b. Lots in Block 4. McNair Manor will be assessed the full Lateral charge
on their York Avenue frontage only.
c. Lots in Westurban 2nd addition (See minutes of April 19, 1955) will be
assessed on the average of their street frontages.
d. George Hanson Propert • Mr. George Hanson's property, consisting of an
acreage fronting on Golden Valley Road, to be assessed the full Lateral
charge on both sides of the sewer pipe which will traverse his property
from north to south following the general route of his present driveway,
and, assuming a`lot depth of 150 feet, all property lying outside of
said 150 feet to be assessed the Use charge.
e. Reeger, Blomberg, and Kennedy Properties: The Reeger, Blomberg, and
Kennedy properties lying south of Golden Valley Road and adjacent to
Sweeney Lake to be assessed on the basis of their front footage on
Golden Valley Road, and, assuming a lot depth of 150 feet, all the
remaining property in each case to be assessed the Use charge.
f. Glenwood Hills Hospital: The Council agreed that said hospital is to
be assessed asfollows:
1. A sewer has been constructed on Golden Valley Road, said sewer run-
ning easterly from Indiana Avenue past the eastern limits of the
hospital property. Approximately 900 feet of this sewer can service
that portion of the hospital's property fronting on Golden Valley
Road.
The hospital is to be assessed the Lateral charge plus the Use charge
for the above sewer pipe, and assuming lots of a depth of 150 feet,
all remaining property to be assessed the Use charge only.
2. A trunk sewer has been constructed through the hospital property,
said sewer traversing the hospital property in an east -west direction.
The hospital is to be assessed the Lateral charge and the Use charge
for that property lying on either side of said trunk line, and
assuming lots of a depth of 150 feet, all remaining property to be
assessed the Use charge only.

Meeting Dates: September 13, 1955: Special meeting for the purpose of calling
for public hearing on the adoption of the assessment for sanitary sewers, and
calling for public hearing on adoption of the assessment roll for the following
improvement, all on October 4, 1955.
1. Olympia Avenue Storm Sewer Re -assessment.
2. 26th Avenue Watermain,
3. Lowry Avenue Storm Sewer.
4. France Avenue Street Improvement.
5. Xerxes Avenue Oiling.
