VILLAGE COUNCTL
January 28, 1956
Pursuant to due call and notice thereof a special meeting of the
Village Council of the Village of Golden Valley, Hennepin County,
Minnesota, was held in the Village Hall in said Village on January
28, 1956, at 9:00 o'clock A.M. The following members were present:
Nadasdy, Rahn, Stark and Teresi, and the following were absent: Bies,
The Mayor called the meeting to order at 9:00 otclock A.M.
Ordinance, re: Street Openings:
MOVED by Rahn seconded by Teresi carried to instruct the engineering
and legal departments to prepare an ordinance setting fees for permits
to open streets.
Ordinance, re: Planning Commission Public Hearings:
MOVED by Stark seconded by Teresi carried to give a first reading to an
Ordinance entitled, "AN ORDINANCE AMENDING THE ZONING CODE", said
ordinance amending section 10:10 of the Zoning code by relieving the
Planning Commission of the necessity of holding public hearings.
MOVED b;T Stark seconded by Teresi carried to approve the above
ordinance on its first reading.
MOVED by Rahn seconded by Teresi carried to give the above ordinance
quoted by title a second reading upon the grounds of a public urgency.
MOVED by Teresi seconded by Stark carried to approve the above
ordinance quotedy title on its second reading, and to order publica-
tion thereof.
Ordinance, Re: Twin -residences:
MOVED by Stark seconded by Rahn carried to give a first reading to an
ordinance entitled, "AN ORDINANCE AT?ENDING THE ZONING CODE", said
ordinance amending Section 3:05 of the Zoning Code by increasing the
size of lots upon which twin -dwellings may be constructed.
MOVED by Rahn seconded by Stark carried to approve the above ordinance
quoted by title on its first reading.
MOVED by Rahn seconded by Teresi carried to give a second reading to
the above entitled ordinance on the grounds of a public urgency.
MOVED by Rahn seconded by Stark carried to approve the above ordinance
quoted by title on its second reading, and to order publication thereof.
MOVED by Rahn seconded by Teresi carried that for a period of sixty
days requests for residential building permits in Open Development areas
be referred to the Village Council.
MOVED by Stark seconded by Rahn carried that all requests for permits
to construct twin -dwells gs be referred to the Village Council.
Ordinance, res lots with less than 100 feet of frontage:
14OVED by Rahn seconded by Teresi carried to give a first reading to an
ordinance entitled, "AN 0 RDINANCE AMENDING THE ZONING CODE", said ordi-
nance amending section 3:05 of the Zoning Code by requiring in certain
cases that homes be constructed upon lots of greater frontage than the
frontage originally platted.
MOVED by Rahn seconded by Teresi carried to approve the above ordinance
quoted by title on its first reading.
MOVED by Rahn seconded by Stark carried to give a second reading to the
above entitled ordinance on the grounds of a public urgency.
MOVED by Rahn seconded by Teresi carried to approve the above ordinance
quoed by title on its secon reading, and to order publication thereof.
Ordinance, re: Storm Sewers:
MOVED by Rahn seconded by Teresi carried that the engineering and legal
departments be instructed to prepare an ordinance governing the con-
struction and use of public storm sewers.
Ordinance, Gas Appliances:
Mr. Owens recommended the adoption of the American Standard Code.

ordinance entitled, "AN ORDINANCE REGULATING THE USE OF GAS AND GAS
APPLIANCES".
MOVED b, Teresi seconded by Stark carried to approve the above ordinance

a second reading on the grounds of a public urgency.

MINNEAPOLIS BY REFERENCE", said ordinance permitting periphery heating.
MOVED by Teresi seconded by Stark carried to approve the above ord-
inance quoted by title on its first reading.
MOVED by Teresi seconded by Stark carried to give a second reading to
the above entitled ordinance on the grounds of a public urgency.
MOVED by Stark seconded by Rahn carried to approve the above entitled
ordinance on its second reading, and to order publication thereof.
MOVED by Stark seconded by Teresi carried that the Building Department
be instructed to prepare a memorandum setting forth the various aspects,
good and bad, of all types ofriphery heating.
Hardship Waiver, Parcels A. & B. Lot 4, Sunnyridge Addition:
MOVED by Rahn seconded by Teresi carried to grant Parcels A and B.
Lot 4, Sunnyridge Addition, a waiver to construct homes with a setback
of 23 feet from Poplar Drive, per plans submitted to and inspected b
this Council, and on file in the office of the office of the building
inspector.
Honeywell Re: Setback from Railroad Tracks: (See minutes of January 24,
1956)._
Mr. Emery Swanson requested the Council consider widening the setback
(or buffer zone) the
on south part of the Honeywell property to two
hundred feet. The Mayor appointed Member Rahn a committee of one
to meet with Honeywell officials and interested citizens for the purpose
of determining what steps will be taken to beautify the property.
Sanitary Sewer Special Assessments --Protest of Stejskal:. (See minutes
of January 17., .
Letter of the G. M. Orr Engineering Company dated January 25, 1956,
was read and ordered placed on file.
MOVED by Kahn seconded by Stark carried to deny the request of Mr. J.
V. Stejskal on the basis of the report and recommendation of the engineers.
Dogs:
Representative of Merry Hills Kennels, Hennepin County Animal Rescue
League, and the Citizen's Committee on dogs appointed Setpember 6, 1956,
discussed services need for control of dogs.
MOVED by Rahn seconded by Teresi carried that the Village Attorney be
instructed to prepare a contract with Merry Hills Kennel providing for
Patrolling of the village for not less than two hours a day four days
a week for a trial period not longer than six ,seeks, and to present
said contract to the Council for study not later than February 7, 1956,
said patrol to begin when instructed by the Council.
MOVED by Rahn seconded by Teresi carried to instruct the Village Attorney
to prepare and present on February 7, 19560 all necessary amendments
to existing ordinances to permit Merry Hills Kennel to act as agent
on behalf of the Village with respect to dog control.
Supplemental Bond Issue S. S. Lat. Imp. No. 1:
Member Rahn introduced the following resolution herein quoted by title
and MOVED its adoption: "RESOLUTION, TO AUTHORIZE ;SND SALE". ($375,000.00
Supplemental Issue, Sanitary Sewer Lateral Imp. No. 1.)
The motion for the adoption of the foregoing resolution was duly seconded
by Member Teresi and upon vote being taken thereon, the following
members voted in favor thereof Nadasdy, Rahn, Stark, and Teresi; and
the following voted against the same: None, whereupon said resolution
was declared duly passed and adopted, signed by the Mayor and his
signature attested by the Clerk. See Resolution Book Page.
MOVED by Rahn Seconded by Teresi carried to authorize the issue of
$375,000.00 general obligation bonds, the sale of said bonds to be on
February 21, 1956.
MOVED by Rahn seconded by Teresi carried unanimously that all money
paid the village of Golden Valley by St. Louis Park as its share of the
construction costs of the trunk sewer built within the city limits of
Minneapolis in 1954 be paid into the general fund, earmarked for the
purpose of purchase of sewer meaintenance equipment and sewer department
operation.
Streets in Sanitary Sewer District No. 1:
It was agreed that streets disturbed as a result of lateral sewer
construction in 1955 shall be backfilled and graveled, but that the
village will not, other than replacement of salvaged bituminous
pavement, blacktop streets which were formerly.blacktopped except upon
sufficient petition of persons owning benefited property.
Re: Laurel Avenue:
Attention was directed to Memorandum of conference dated January 27, 1956.
Letter from the Church of the Good Shepherd dated January 27, 1956, ad-
vising of problems concerning the proposed construction of Jersey
Avenue, was read. Said letters were ordered placed on file.
Mr. Paul Enghauser and Mr. Richard Thompson were present, and assured
the Council of their willingness to deed land for Laurel Avenue at
no cost, and their willingness to be specially assessed for the cost
of constructing Laurel Avenue where it is adjacent to their properties.

Mr. Owens stated that Mr. Mayeron wished the Village Engineer, Mr.
Frederickson, to do all necessary engineering work on Laurel Avenue,
and that Mr. Owens had discussed this matter with Mr. Frederickson, who
stated that he thought he'could do the work later in the sumer of 1956.
MOVED by Teresi seconded by Rahn carried that the attorney be autho-
rized to accept gratis deed on necessary right-of-way, and be autho-
rized to condemn on behalf of the village all necessary right-of-way, to
approve the route of Laurel Avenue as set forth in the committee report
acdepted by this Council on August 16, 1955, except that said street
is to extend all the way to Winnetka Avenue South, and further, to grant
preliminary approval to the grades presented by the Village Engineer,
all of said costs including construction work to be specially assessed
against benefitted property,
Sanitary Sewer --Contract with St. Louis Park:
MOVED by Teresi seconded by Stark carried to grant preliminary approval
to the contract submitted by the attorney provided St. Louis Park
agrees that maintenance and repair and reconstruction of all sewers
used jointly by St. Louis Park and Golden Valley shall be on percentage
of flow basis.
RESIGNATION of B. A. Shuttleworth:
MOVED by Stark seconded by Teresi carried to accept the resignation of
Mr. B. A. Shuttleworth as presented by Mr. Teresi, Mr. Shuttleworth
having been elected Fire Chief by the Fire Department, said election
never having been confirmed by this council. The letter of resig-
nation of Mr. Shuttleworth was ordered placed on file.
.F1_ection of Fire Chief:
MOVED by Stark seconded by Teresi carried to affirm the election of
Mr. Eugene Thotland as Fire Chief of the Village of Golden Valley for
the year 1956, per letter of notice from the Fire Department. Said
letter was ordered placed on file.
SPECIAL MEETING:
MOVED b Stark seconded bu Teresi carried to hold a special meeting
beginning at 9:00 o'clock P.M., Saturday, February 4, 1956, at the Village
Hall Council Chambers.
