03-06-56 City Council Minutes1 REGULAR MEETING of the VILLAGE COUNCIL March 6, 1956 Pursuant to due call and notice thereof a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota was held at the Village Hall in said Village on March 6, 1956, at 7:30 o'clock P.M. The following members were present: Bies, Nadasdy, Rahn, Teresi, and the following was absent: None. (Member Stark arrived at 8:00 o"clock P.M.) The Mayor called the meeting to order at 7:40 o'clock P M. MOVED by Rahn seconded by Bies carried that the reading of the minutes of the meetings held on February 21st and 23rd, 1956, be dispensed with and that said minutes be approved as submitted to each member of this Council prior to this meeting unless some member of the audience wishes them read. (The minutes were not read.) Application for Commercail Building Permit, Lot 3e, Auditor's Sub -Division 0, Mr. Milton Nelson: Messrs Milton Nelson,.Carl Johnson, and Don Carlson, representing the Nelson and Johnson Cabinet Company, presented plans and specifications for a building to be erected at approximately 730 Winnetka Avenue North. Upon question Mr. Nelson stated that no electric motor larger than 5 horsepower would be used. MOVED by Rahn seconded by Bies carried to approve the plans and specifications as presented and to authorize the issuance of a building permit provided the building has a 50 foot setbakc from Winnetka, a 5 foot sidelot clearance on the south line, and provided the Winnetak Frontage of the building is faced with brick veneer. Fire Department - Physical Examinations: (See minutes of February 21, 1956). Attorney Kane stated that he had checked the 1955 amendment to the Workman's Compensation Act regardirg, compensation to Volunteer Firemen for certain disabilities and stated that he had requested an Attorney General's opinion on the question of the "'time of employment". The matter was tabled witk,out dissent to the meeting of March 19, 1956. Fire Department Board of Fire Officers re expenditures over $25.00: MOVED by Teresi seconded by Rahn carried that all requisitions from the Fire Department indicate approval by a majority of the Board of Fire Officers. Special Assessments - Mr. Charles Husting and Mr. Earl Johnson: (See minutes of August 1 ,,19 Messrs Charles Husting, 2531 Zenith Avenue North and Earl Johnson, 2531 Zenith Avenue Nortl,requested a reduction in their lateral sewer assessments. 91 They stated that they are assessed $5.32 per front foot although actually connected to the Robbinsdale sewer, and, -there is no stub to their pro- perty line. They also stated that they had made a thorough search of all Robbinsdale City records but could find no record of any sewer assessments or charges or payment thereof, to the City of Ribbinsdale for sw,Ter service. MOVED by Stark seconded by Bies carried to instruct that the assessn�ent roll for Sanitary Sewer Lateral Improvement No. 1 be changed to assess Lot 3 and illy one-half of Lot 2, Block 1, Delphian Heights 2nd Unit (Mr. Charles Husting, 2531 Zenith Avenue North) and Lot 19, 20 lock 1 Delphian Heights, (Mr. Earl Johnson, 2534 Zenith Avenue North), on the basis of the outlet charge of $1.83 per front foot, said properties to be assessed an additional $3.19 per front foot if they ever connect up to the "Golden Valley Sewer" lying in Zenith Avenue, said motion being predicated on the grounds that an exhaustive search of the records of the City of Robbinsdale by the Golden Valley Engineer, former engineer for the City of Robbinsdale, show that said properties, although receiving sewer service from Robbins - dale, neither have nor have not paid said city for the service. Building Permit, Westview Good News Chapel: Mr. John Clift, 39 Winnetka Avenue South, presented plans and specifications for a church to be erected at approximately 9300 Sixth Avenue North. MOVED by Bies seconded by Teresi carried to instruct the Building Inspector to issue a building pe m it as per plans and specifications inspected by this Council and on file in the office of the Building Inspector. Opening of Bids, tires, tubes and rims for motor grader. The Village Clerk presented an affidavit of publication of notice of call for bids for the purchase of tires, tubes and rims according to spec- ifications approved by this Council on February 7, 1956. Said affidavit was examined, approved and ordered placed on file in the office of the Village Clerk. The Mayor announced that this was the time and place for opening and consideration of sealed bids for the purchase of said tires, tubes and rims in accordance with the notice of advertisement for bids publiched by the Clerk and heretofore presented to this Council. The Clerk presented to the Council eight sealed bids submitted in the course of said notice. Said bids were then opened, publicly read and considered. Licenses - Recommendations of License Chairman: Member Rahn stated that a recent survey of license fees of neighboring communities showed that the cost of governmental control of licensed activities in said communities has increased, as reflected by their license fees, but that many license fees in Golden Valley do not produce sufficient income to pay for the cost of enforcing the ordinances. MOVED by Teresi seconded by Rahn carried to give a first reading to an ordinence entitled, "AN ORDINANCE AMFTMTNG THE ZONING, CODE," said ordinance increasing the license fee of filling stations to $5.00 per pump. MOVED by Teresi seconded by Rahn carried to approve the above ordinance herein quoted by title on its first reading. MOVED by Teresi seconded by Rahn carried to give a first reading to an ordinance entitled, "AN ORDINACE LICENSING AND REGULATING MUSICAL JUKE BOXES", said ordinance licensing music boxes at $15.00 per box. License -American Legion: MOVED by Rahn seconded by Teresi carried to approve the issue of the following licenses per applications on file. Second Reading Ordinance Changing Certain Street Names: (See minutes of February 21, . The Administrgtor presented and read a letter dated "''arch 6, 1956, from Mr. Wesley Sjostad regarding the names of certain streets in Golden Oaks 4th Addition. Said letter was ordered placed on file. MOVED by Teresi seconded by Stark carried to give a first reading to an amendment amending an ordinance entitled, "AN ORDINANCE ESTABLISHING CERTAIN STREET NAMES," Said ordinance having been given its first reading on February 21, 1956, said amendment changing the names of certain streets pursuant to the above referenced letter. MOVED by Teresi seconded by Stark carried to approve the above amendment on its first reading. MOVED by Teresi seconded by Bies carried to approve the above ordinance on its second reading and order publication. See Ordinance Book Page 266 . MOVED BY Rahn seconded by Stark carried to approve the contract with Merry Hills Kennels for a period of 6 weeks and to authorize the proper officials to affix their signature thereto. Gravel for 1956: Mr. Duane Foss, 5920 St. Croix Avenue stated that he and the Village Attorney had drawn up a license permitting the removal of gravel from Certain premises located east of Douglas Drive North. MOVED by Bies seconded by Teresi carried to approve the license and to authorize the proper officials to affix their signatures thereto. First Reading - Setback on Medicine Lake roads MOVED by Bies seconded by Stark carried to give a first reading to an ordinance entitled, "AN ORDINANCE AMENDING THE ZONING C,ODE," said ordinance establishing a setback of 75 feet from the present centerline of Medicine Lake Road. MOVED by Teresi seconded by Bies carried to approve the above ordinance on its first reading. Resolution cancelling resolution adopted December 20, 1955 said December resolution having designated Orr Engineering Company to design improvement of Laurel Avenue in conjunction with Sewer Improvement Member Rahn introduced the following resolution herein quoted by title and MOVED its adoption, "RESOLUTION CANCELLING RESOLUTION OF GOLDEN VALLEY VILLAGE COUNCIL ADOPTED ON DECEMBER 20, 1955.11 The motion for the adoption of the foregoing resolution was duly seconded by Member Teresi and upon vote being taken thereon, the following voted in favor thereof: Bies, Nadasdy, Rahn, Stark and Teresi, and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Clerk. See Resolution Book Page 3 00 Letter re: Fast half Yale Garden Homes, Byron McCullaugh, Attorney: The Village Attorney stated that he would send a letter to the Council explaining the matter. Tax Forfeited Lands: The Council tabeled the matter and instructed the Golden Valley Park Board to make a recommendation as to whether or not any of the tax delinquent land would be suitable and desirable for park purposes. Area to be assessed, 1955 portion of Lowry Terrace Storm Sewer: The Village Council tabled the matter to the meeting of March 19, 1956. Agreement with Tnternati.onal Paper Company- - The Village Attorney stated that he would have the agreement ready for action at the March 19, 1956, meeting. Repairs, Olson Highway Watermain The Village Attorney stated that an agreement had been reached with the railroad company providing for their payment of $1500.00, or 1/3 of the cost of said repairs (which ever is lesser). MOVED by Rahn seconded by Teresi carried to accept the above offer of the railroad and to instruct the Village Engineer to prepare plans and specifications for the repair of said watermain. Re: Purchase of Seaman Pulvi-Mixer: The Village Engineer stated that a Seaman Pulv-Mixer would be needed by the Village in 1956 for re working bituminous pavement which has been salvaged from certain streets. MOVED by Rahn seconded by Teresi carried that the Village Clerk be instructed to insert notice of call for bids in the official Village newspapers, said bids to be opened April 3, 1956. Lions Club Park: The Administrator read a letter dated Janual-T 30, 1956, from the Golden Valley Lions Club, regarding the stated of disrepair of the warming house at the Lions Club Park. MOVED by Teresi seconded by Rahn carried to refer the matter to the Park Board. Public Hearing, Zoning of certain additions to residential use: MOVED by Rahn seconded by Stark carried to give a first reading to an ordinance entitled, "AN ORDINANCE A1TMING THE ZONIN1 ORDINANCE", said ordinance zoning the following additions to ILesidential use: Golden Oaks IV, Hampshire Oaks II, Hampshire Oaks III, Woodlawn Park II, Dawn Acres I, Mary Hills, Westurban II, Jessen's Addition, Elsen's Valley View, East 1 Yale Garden Homes. The following members were present: Bies, Rahn, and Teresi: and the following were absent: Nadasdy, and Stark. Acting Mayor Bies called the meeting to order at 11:00 o'clock. A.M. The Village Clerk presented an affidavit showing publication in the official Village Newspaper of the call for bids for certain trunk sewer improvements in the Village of Golden Valley. (See minutes of November 14,1955.) Said affidavit was examined, approved, and ordered placed on fik in the office of the Village Clerk. The Mayor announced that this was the time and the place referred to in the above affidavit of publication for the opening and consideration of seal- ed bids for said construction. Results of Trial Minneapolis Honeywell request for Writ of Mandamus: (See Minutes of February 23, 1956.) The Village Attorney, advised the Council that District Court Judge Levi Hall had ruled in favor of the Minneapolis Honeywell -Regulator Company and had ordered the Village Council of the Village of Golden Valley to issues a build- ing permit to said company per application of February 23, 1956. MOVED by Rahn seconded by Teresi carried to instruct the Village Attorney to appeal the ruling of the District Court forthwith, to authorize the Village Attorney to take all proceedural steps necessary toassure the success of the Village in the Supreme Court of the State of Minnesota, and to authorize all necessary expenditures as directed by the Village Attorney. Institutional Zoning District: MOVED by Rahn seconded by Teresi carried to instruct the Village Clerk to insert notice of Public Hearing in the official newspaper on the rezoning of certain properties from their present zoning to a new catagory to be called *Institutional Zoning," said zoning to include such uses as cem- etaries, Sheriff's Radio District, State Highway Department Maintenance Center, Parks, Schools, Institutions of Higher Learning, Hospitals and attendant lands uses, Rest Homes and similar uses, and to insturct the Village Attorney to draw up an ordinance defining and implementing the instant action of this Council, said Public Hearing to be held on April 3, 1956, at 7:30 o'clock P.M. in the Village Hall of the Village of Golden Valley. Request for Special Meeting: The Council agreed on Monday, March 26, 1956, as the entative date for a Special Meeting, the purpose of which will be to discuss 1956 Public Improvements.
