VILLAGE COUNCIL
October 16, 1956
Pursuant to due call and notice thereof a regular meeting of the Village
Council of the Village of Golden Valley, Hennepin County, Minnesota, was
held in the Village Hall in said Village on October 16, 1956, at 7:30
o'clock P.M. The following members were present; Bies, Rahn, Stark and
Teresi; and the following was absent: Nadasdy. Acting Mayor Bies called
the meeting to order at 7135 o'clock P.M. (No minutes were presented for
approval.)
Golden Valley Park Board:
Mr. Charles Doell, Superintendent of the Minneapolis Park Board was present
at the request of the Golden Valley Park Board. Mr. Doell stated that
Golden Valley's most immediate problem is the acquisition of suitable park
property and that his experience led him to believe that Golden Valley
should have two neighborhood parks of ten to twenty acres in size, but that
the actual number of such parks depended upon the division of the Village
by streets and natural barriers or divisions. Mr. Doell further stated
that Minneapolis would cooperate in a survey of all of Golden Valley with
the idea of developing such neighborhood parks and other park facilities as
may be necessary.
Mr. Ray Stockman then referred to a letter from the Administrator dated
September 25, 1956, said letter advising the Park BoaLtd that the Council
would consider ad velorem tax levy upon the Village for park purposes upon'
a proper presentation being made, showing planning and demand.
MOVED by Rahn seconded by Teresi carried to authorize the Golden Valley Park
Board to exceed its 1956 budget in the amount of $1,200.00, said money to be
used for the purpose of hiring a park planning consultant, Mr. Robert Corwin.
Change Order No. 3, South Trunk Sewer (Hopechest):
Mr. Harry Mayeron of the G. M. Orr Engineering Company, presented his company's
estimate of said improvement in the amount of 1,938 lineal feet of sewer at
a cost per front foot of $7.00, or a total cost of $13,566.00. The Attorney
stated that he was giving the Administrator waivers of notice of public hear-
ing, which should be executed by authorized representatives of the Hope Chest
Company.
MOVED by Rahn seconded by Stark carried to authorize the Administrator to
sign Change Order Number 3, subject to the acquisition of the proper waivers,
and to instruct the Administrator to study and make recommendations regarding
the method of specially assessing the improvement.
Minneapolis Park Board:
MWED by Rahn seconded by Teresi carried that the Attorney be instructed to
prepare an ordinance embodying all negotiations heretofore concluded with
the Minneapolis Park Board.

Request for Public Hearing - Standard Oil Company:
MOVED by Rahn second by Stark carried to instruct the Administrator to cause
notice of advertisement of public hearing to be inserted in the official
Village newspaper regarding the zoning of an area described in the petition
of said company from Open Development to Industrial Zoning District, said
hearing to be held on the 8th of November, 1956.
Request for Public Hearing - Meadowbrook High School Propertys
MINED by Stark seconded by Teresi carried to instruct the Village Administrator
to cause notice of advertisement of public hearing to be inserted in the official
Village newspaper regarding the zoning of the Meadowbrook High School property
from Open Development to Institutional District, said hearing to be held on
the 13th of November, 1956.
Commercial Building Permit - Skelgas C2MEZ:
Said company requested permission to enclose a dock located at 5340 Wayzata
Blvd., with fireproof materials. MOVED by Stark seconded by Bies carried to
defer action pending investigation by the Fire Marshall.
Hardsh12 Waiver - Lot 19 Block 2 Noble Grove Addition - Re uest of Grevich:
MOVED by Rahn seconded by Teresi carried to approve said request for hardship
waiver per recommendation of the Planning Commission and to instruct the
Building Inspector to issue a permit for the construction of a home on said
lot and block per plans and specifications on file in the Administrators office.
(Set -back of 25 feet)
Hardship Waiver - Lots 7 & 8, Meadowbrook Acres - Robert H. Carlson:
MOVED by Rahn seconded by Teresi carried to grant request for hardship Waiver
per recommendation of the Planning Commission and grant permission for Mr.
Carlson to plat three lots of not less than 95 feet in width, per petition
on file in the administrative offices.
Request for Building Permit - Valley Community Presbyterian Church:
Mr. Cordling, representing Hills, Gilbertson, and Hayes, Architects, requested
the Council give special consideration to the issuance of a building permit
for the construction of an addition to said church. MOVED by Teresi seconded
by Stark carried to instruct the Building Inspector to issue a permit to
said church subject to review by the Village Administrator as to land use
and car parking facj lities.
Adjourned Public Hearing - First Reading, Comprehensive Zoning Ordinances
MOVED by Rahn seconded by Stark carried to give a first reading to an ordinance
entitled: "AN ORDINANCE AMENDING THE ZONING CODE BY MAKING ADMINISTRATIVE AND
PROCEDURAL CHANGES AND PROHIBITING RESIDENTIAL USES IN OTHER USE DISTRICTS."
MOVED by Rahn seconded by Stark carried to approve the above ordinance quoted

by title on its first reading.
Traffic Signals- Intersection, T. H. #55 and County Road #18:
The Administrator read a letter dated October 3, 1956, from the State Highway
Department, said letter stating that a density and turning movements study at
the intersection of T.H. #55 and County Road #18 showed a justificable need
for traffic control signals. Said letter further stated that the State was
willing to participate in the cost on the following basis: Fifty percent
from State funds, 25% from the Village of Golden Valley, and 25% from the
Village of Plymouth.

Maintenance of Sixth Avenue North:
MOVED by Rahn seconded by Stark carried that the Village of Golden Valley
assume maintenance of Sixth Avenue North effective as of this date.
County Road #102:
The Village Administrator presented and read a letter dated October 1, 1956,
from the Hennepin County Highway Department, said letter being attached to a
resolution stating that the Village of Golden Valley had acquired a 100 foot
right-of-way for Douglas Drive between Golden Valley Road and T.H. #55• The
Administrator advised the Council that he had told Mr. Edward Tomczyk,
Right -of -Way negotiator for Hennepin County, prior to the drafting of said
resolution by Hennepin County, that the Village of Golden Valley owned
right-of-way northerly from T.H. #55 to the right-of-way of the Minnesota
Western Railway tracks, but no more. It appeared that the resolution
accompanying the above referenced letter was not in conformance with the
facts above stated.
MOVED by Teresi seconded by Stark carried that the Village Attorney negotiate
with the Minneapolis Gas Company in order to determine whether or not the
Gas Company will dedicate the necessary right-of-way for Douglas Drive North
from the Minnesota Western Tracks to Golden Valley Road.
Report of Attorney - Condemnation of 4 Yale Garden Homes:
Village Attorney reported the Committee on Condemnation will be ready to
announce the awards on Monday, October 22, 1956.

Member Rahn introduced and read the following resolution and MDVED its adoption:
"RESOLUTION ORDERING PUBLIC HEARING FOR LATERAL SANITARY SEWER IMPROVEMENT"
(Jersey Avenue 2A). The motion for the adoption of the foregoing resolution was
duly seconded by Member Stark and, upon vote being taken thereon, the following
voted in favor thereof: Bies, Rahn, Stark, Teresi; and the following voted
against the same: None, whereupon said resolution was declared duly passed and
adopted, signed by the Mayor and his signature attested by the Clerk, said
hearing to be held November 13, 1956. See Resolutions Book Page i/2L.

RE: Voting Machines:
MOVED by Rahn seconded by Teresi carried that the Administrator advise the County
Attorney that, at the present time, the Village feels that it can continue with
the present methods for an indefinite time.

Brookview Golf Club versus the Village of Golden Valley - Sanitary Sewer Assessments:
The Administrator advised the Council that he had been served notice of said
Golf Club's appeal from the special assessments levied by this Council on
October 2, 1956. The Attorney was instructed to do everything reasonably
necessary to protect the interests of the Village of Golden Valley.
Storm -Sewer Studies - Tyrol Hills,LotA:
The Administrator advised the Council that on September 28, 1956, he had
requested the Attorney and the Engineer to (1) determine whether or not the
Village could condemn and purchase said Lot A in lieu of a storm sewer
improvement and specially assess the cost of said improvement against benefitted
property, and (2) determine the feasibility of the condemnation and purchase
of Lot A and its probable cost as opposed to the cost of a regular storm sewer
improvement. After discussion, the Council instructed that the orders of the
Administrator be complied with by the Attorney and the Engineer and that notice
of public hearing on said matterbbe published, the hearing to be held on
November 13, 1956•
