03-19-63 City Council Minutes36 REGULAR MEETING of the VILLAGE COUNCIL March 19, 1963 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin Councy, Minnesota, was held at 7800 Golden Valley Road in said Village on March 19, 1963, at 8:00 o'clock p.m. The following members were present: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following were absent: none. Present were Village Attorney, Stanley D. Kane; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch. The meeting was called to order at 8:05 p.m. Invocation: Rev.`Stanley D. Hanks, Golden Valley Methodist, 7601 Olson Hwy. Minutes of March 5, 1963: MOVED by Teresi seconded by Flannagan carried to approve the minutes of March 5, 1963, as submitted to the Council. Public Hearing - Platting: The Village Engineer discussed the Jones Addition Plat and Witt's rhd Plat. Mr. J. Robert Naab and Mrs. Sleavin appeared regarding the proposed plat of Witt's End. Council took no action. Both plats will have a public hearing on April 2, 1963. Public Hearing - Public Improvements (63-WML, Trunk & Lateral Watermains): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on Certain Proposed Public Improve- ments (Public Improvements No. 63 -WMT; 63 -WL -1, 2, 5, 6, 7, 8, 10, 11, 12, 13, 14, 16, 17, 18, 19, 20, 21, 22, 23, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 40, 41, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 58, 59, 60, 61, 62), described in the resolution of this Council relating thereto, adopted on March 5, 1963. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. Stated they do not want water. MOVED by Teresi seconded by Flannagan carried to omit construction of 63-WM-23 at this time. 63-WM-26; 57.60% Petition: OBJECTOR OBJECTION Mr. Staton Rudser Stated all the people on Douglas 251.8 Douglas Drive Drive are opposed to construction of watermain. MOVED by Teresi seconded by Schaphorst carried to order the construction of 63-WM:26. 63-WM--46; 39.06% Petition: OBJECTOR Mr. Melvin C. Erickson, Representing Meridan Association 1812 York Avenue North OBJECTION Opposed to construction of lateral watermain for last two lots on Glenwood Parkway next to Great Northern R.R. MOVED by Teresi seconded by Flannagan carried to construction 63-WM-46. 63-WM-51; 72.8% Petition: OBJECTOR Mr. Albin L. Winkles 914 Sumter Avenue South Mr. Ritter 1033 Sumter Avenue South OBJECTION Opposed to construction due to proposed construction of overpass for Highway #12. Does not want water at this time. Mr. Albin H. Frandle Stated he wished to withdraw his 915 Sumter Avenue South name from the petition. MOVED by Flannagan seconded by Scherer carried to delete construction on Sumter Avenue, that part lying Southerly of Erie Avenue. 38 Regular Meeting of the Village Council, March 19, 1963 Page 3. 63-Wi4-61; Watermain Trunk: MOVED by Teresi seconded by Flannagan carried to omit on Plymouth Avenue that part lying Westerly of Rhode Island Avenue. 63 -Wm -62: OBJECTOR OBJECTION Mr. Charles R. Coulter Stated that owners of 10 lots 4845 Lowry Terrace on Lowry Terrace were opposed. MOVED by Flannagan seconded by Scherer carried to omit 63-WT�-62 from construction. The Mayor closed the public hearing. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Projects No. 63-WAT; 62-101-1, 2, 5, 6, 7, 8, 10, 11, 12, 13, 14, 16, 17, 18, 19, 20, 21, 22, 23, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 40, 41, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 58, 59, 60, 61, 62.) The motion for the adoption of the foregoing resolution was duly seconded by Member Scherer and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same None, whereupon said resolution was declared dulypassed and adopted, signed by the Mayor, and his signature attested by the Clerk. Member Teresi introduced and read the following written resolution and MOVED its adoption: "RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (63-WML-55, 63, 64, 68) The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Clerk. See Resolutions Book page. Request for Ordinance Waiver - 7740 Winsdale Street: The Village Engineer presented the report from the Planning Commission recommending said Ordinance Waiver be approved. (See minutes of 2-14-63.) MVED by Flannagan seconded by Scherer carried to approve the request for Ordinance Waiver at 7740 Winsdale Street, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 1524 No. Lilac Drive & 5350 Golden Valley Rd.: The Village Engineer presented the recommendation of the Planning Commission regarding an ordinance waiver at 1524 No. Lilac Drive and 5350 Golden Valley Road. The Planning Commission recommended denial of said request. (See minutes of 3-14-63.) MOVED by Teresi seconded by Schaphorst carried to deny the request for ordinance waivers at 1524 No. Lilac Drive and 5350 Golden Valley Road, upon recommendation of the Planning Commission. Request for Ordinance Waiver - 1530 Gettysburg Avenue North: The Village Engineer presented the recommendation of the Planning Commission regarding an ordinance waiver at 1530 Gettysburg Avenue North. The Planning Commission recommended approval of said request. (See minutes of 3-14-63.) Request for Building Permit - 5601 Glenwood Avenue (Mdltiple Dwelling): Mr. Thomas McKee appeared to answer questions regarding the proposed multiple dwelling at 5601 Glenwood Avenue, for 33 one bedroom units with approximate total cost of building $260,000.00. 14DVED by Teresi seconded by Scherer carried to approve the building permit for a multiple dwelling located at 5601 Glenwood Avenue, subject to the approval of the Building Inspector. Request for Building Permit - 5411 Circle Down, Addition to Weldwood: r The Building Inspector presented the plans for a proposed addition to the Weldwood Nursing Home at 5411 Circle Down. Request for Sign Permit - 4900 Olson Highway, White House: The Building Inspector presented the request for a sign permit for the White House parking lot at 4900 Olson Highway. LVED by Flannagan seconded by:'Scherer carried to approve the permit for a parking lot sign for the White House at 4900 Olson Highway, subject to the sign being placed even with the existing building and subject to the approval of the Building Inspector. Request for Sign Permit - 5900 Wayzata Boulevard, Ice Center: The Building Inspector presented the request for a sign permit for the Ice Center at 5900 Wayzata Boulevard. MOVED by Teresi seconded by Schaphorst carried to approve the request for a sign permit for the Ice Center at 5900 Wayzata Boulevard, subject to the approval of the Building Inspector. Re: Publication of Ordinance Amending Zoning Code (Lessard -Wolff): Mr. Gordon Reisinger appeared on behalf of Mr. & Mrs. Lessard, and agreed to transfer additional land area from the proposed apartment to the exist- ing triplex. Council approved publication of "AN ORDINANCE AMENDING THE ZONING CME" (Lessard -Wolff), subject filing of a new survey of the prop- erty. Appointment of Bassett's Creek Citizens Committee: Council discussed the list of proposed members for the Bassett's Creek Citizens Committee.
