06-18-63 City Council MinutesLou REGULAR MEETING of the VILLAGE COUNCIL June 18, 1963 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on June 18, 1963, at 8:00 o'clock P.M. The following members were present: Flannagan, Nadasdy, Schaphorst, Scherer, and Terese; and the following members were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Roger A. Peterson; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; President of the Planning Commission, Joe L. Brown. The meeting was called to order at 8:00 P.M. Invocation: Rabbi March Leibhaber, Tifereth B'Nai Jacob Synagogue, 1501 Xerxes Avenue North. Minutes of May 21, 1963 and June 4, 1963: MOVED by Teresi seconded by Flannagan carried to approve the minutes of May 21, 1963 and June 4, 1963 as submitted to the Council. Award of Bids - Concrete Pavement with Integral Curb (63 -CP -3, 6): The Village Manager announced that in accordance with the terms of the Advertisement for Bids published in the official newspaper for Concrete Pavement with Integral Curb, sealed bids have been received, and the Village Engineer and Consulting Engineer have met in the Council_ Chambers at 7800 Golden Valley Road at 11:00 o'clock A.M. on June 14, 1963, and have then and there publicly opened and read the bids received. The Village Engineer tabulated said bids and they were found to be as follows: Bidder Base Bid Victor Carlson & Sons $72,478.50 Mc Cree & Company $73,969.55 The Village Engineer reported that an examination of the unit prices indicates that unit prices for concrete pavement were increased approx- imately 30% over last years bid which would result in assessed costs of $11.00 per foot as opposed to the current $8.00 rate. After checking with other available bidders the Engineer recommended that this improve- ment be readvertised for bids. PAVED by Teresi seconded by Flannagan carried to readvertise for a bid opening on July 12, 1963, with consideration of bids by the Village Council on July 16, 1963, upon recommendation of the Village Engineer. i] 1 1 1 1 Regular Meeting of the Village Council, June 18, 1963 Public Hearing - Plat, E. A. Anderson: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined approved and ordered filed in the Village Clerkts office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR OBJECTION None None Mr. Joe L. Brown, President of the Planning Commission, presented the recom- mendation of the Planning Commission to approve said plat. (see minutes of may 16, 1963.) The Mayor closed the public hearing. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION" (Acceptance of Plat - E. A. Anderson) The motion for the adoption of the foregoing resolution was seconded by Member Schaphorst and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi, and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. OBJECTION Objected to the road change in front of their house. 93 94 Regular Meeting of the Village Council, June 18, 1963 Member Teresi introduced the following resolution and 14OVED its adoption: "RESOLUTION" (Acceptance of Plat - Golden Maxtor) The motion for the adoption of the foregoing resolution was seconded by Member Scherer and, upon vote being taken thereon, the following voted in.favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor ands signature attested by the Village Clerk. Said affidavit was examined, approved and ordered filed in the Clerkts Office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: OBJECTOR Mr. Wm. OBJECTION Stated this zoning would make the lot next to his too small for a residential building. Mr. Reini.nger objected to the rezoning due to pending litigation Mr. Joe L. Brown, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said zoning. (see minutes of 5-16-1963) . MOVED by Teresi seconded by Flannagan carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Lessard - Multiple Dwelling) MOVED by Teresi seconded by Schaphorst carried to approve the ordinance herein quoted by title on its first reading. Resolution Ordering Dust Treatment (63 -DA -10,20122,23): Member Flannagan introduced the following resolution and MOVED its adoption "RESOLUTION ORDERING DUST TREATMENT FOR CERTAIN STREETS" (63 -DA -10, 20, 22, 23) The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Terese; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Lueck: u Regular Meeting of the Village Council, June 18, 1963 The Village Manager presented the request for an ordinance waiver for Dr. W. Lueck at 1905 Kyle Place, of 20 feet of the setback. Mr. Joe L. Brown, President of the Planning Commission, presented the recommendation of the Planning Commission to derrj said request. (see minutes of May 16, 1963). MOVED by Flannagan seconded by Teresi carried to approve the request for an ordinance waiver of 20 feet of setback at 1905 Kyle Place, for Dr. W. Lueck. Request for Ordinance Waiver - 221 Jersey Avenue, Mr. R. V. Bueghly: Mr. Joe L. Brown, President of the Planning Commission, presented the recommendation of the Planning Commission to approve the request for Ordinance Waiver. (see minutes of June 13, 1963). MOVED by Teresi seconded by Flannagan carried to approve the request for an ordinance waiver of Section 14 of the Platting Regulations entitled "Conveyance by Metes & Bounds", upon recommendation of the Planning Commission. Request for Public Hearing - Zoning, 621 Lilac Drive North (B. & P.O.): The Village Manager presented a request for a public hearing to zone 621 Lilac Drive North to Business & Professional Office on July 16, 1963. MOVED by Flannagan seconded by Schaphorst carried to call a public hearing to zone 621 Lilac Drive North to Business & Professional Office on July 16, 1963. Request for Public Hearing_- Street Vacation (Fairbault Street): The Village Manager presented a request for Public Hearing for Street Vacation of Fairbault Street. MOVED by Schaphorst seconded by Flannagan carried to call a public hear- ing to vacate Fairbault Street on July 16, 1963. Re: Street Name Chane - Duluth Street: The Village Manager presented a request for street name change of Duluth Street. MOVED by Flannagan seconded by Schaphorst carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VTLIAGE CODE" (Street Name Change) 97 Regular Meeting of the Village Council, June 18, 1963 MOVED by Scherer seconded by Schaphorst carried to approve the ordinance herein quoted by title on its first reading. Request for Sign Permit - 6500 Wayzata Boulevard: The Building Inspector presented a request for a sign permit for 6500 Wayzata Boulevard, Knutson Realty. MOVED by Flannagan seconded by Scherer carried to approve the request for a sign permit for 6500 Wayzata Boulevard, subject to the approval of the Building Inspector. Discussion re: "Golden Valley Trails": Mrs. John Borchert presented a report from the League of Women Voterts. Said report was discussed and a copy ordered placed on file in the Clerk's office. Council expressed general approval of the preliminary plans for "Trail Ways" in Golden Valley. Public Safety Building Architect: All present agreed to add the above matter to the agenda. Mr. Robert Raugland of Lang Raugland & Brunet, Inc., architects for the Public Safety Building and discussed the Architects percentage in the agreement with the Village. MVED by Flannagan seconded by Scherer carried to approve the agreement with the architects and to approve the various phases of the agreement as the work progresses. Recommendations re: Multiple Dwelling Ordinance: The Village Manager presented recommendations regarding the Multiple Dwelling Ordinance from the Planning Commission dated May 16, 1963. Mr. Joe L. Brown, President of the Planning Commission, discussed the pro- posed amendments to the Multiple Dwelling Ordinance with the Council. Council expressed tentative agreement with the proposed amendments and requested that the Planning Commission continue their study and further recommendations for other changes in the Multiple Dwelling Ordinance. On -Sale Liquor License - Holiday Motor Hotel: Mr. Gillette, Manager of Holiday Motor Hotel, appeared before Council and discussed the reasons why they have not started the improvements and addi- tions to the building as agreed, these were the conditions upon which the "On -Sale" Liquor License was granted.
