October 15, 1963
Pursuant to due call and notice thereof, a regular meeting of the Village
Council of the Village of Golden Valley, Hennepin County, Minnesota, was
held at 7800 Golden Valley Road in said Village on October 15, 1963, at
7:30 o'clock P.M.
The following members were present: Flannagan, Nadasdy, Schaphorst, Scherer,
and Teresi; and the following were absent: None.
Present were Village Engineer, Donald Sorensen; Village Attorney, Roger A.
Peterson; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch.
The meeting was called to order at 7:35 P.M.
Invocation: Mayor Nadasdy gave invocation.
Minutes of September 17, 1963; October 1, 1963:
MOVED by Teresi seconded by Flannagan carried to approve the minutes of
September 17, 1963 and October 1, 1963, as submitted to the Council.
Award of Bid - House & Garage, 100 Winnetka Avenue North:
The Village Engineer stated that no bids had been received for the house
and garage at 100 Winnetka Avenue North.
NOVED by Teresi seconded by Schaphorst carried to accept bids, if any, or
to burn the house and garage at 100 Winnetka Avenue North if no bids were
received.
Continued Public Hearing - Zoning, 6000 Laurel Avenue (Light Industrial):
Mr. Al Godward, representing the proponent, appeared and stated the Minder
property at 6000 Laurel Avenue was not large enough and the proponents are
negotiating for additional property at 6001 Glenwood Avenue. Mr. Godward
requested another continuation of the Public Hearing to November 19, 1963.
Mr. Lowell Swanson, 245 Brunswick, stated the residents felt that Laurel
Avenue was a natural boundary for industrial zone, and they will wait for
definite plans proposed by the proponent.
MOVED by Teresi seconded by Flannagan to continue the Public Hearing to
the meeting of November 19, 1963, on the following properties: 6000 Laurel
Avenue, 6001 Glenwood Avenue, 6031 Glenwood Avenue, upon request of the
proponent and pending the recommendation of the Planning Commission. Coun-
cil expressed the opinion that everything north of the judicial ditch to
Glenwood Avenue and west of the Hamman property be zoned to residential
zone.

Public Hearing_- Plat, Lilac Heights Addition:
The Village Engineer presented an affidavit of publication in the offic-
ial newspaper of the Notice of Public Hearing as described in said affi-
davit. Said affidavit was examined, approved and ordered filed in the
Village Clerk's Office.
The Mayor announced that this was the time and place for the public hear-
ing above referred to and all persons who desired to do so were afforded
opportunity to express their views thereon, and all written objections
heretofore filed with the Clerk were presented and considered as follows:

The Mayor closed the public hearing.
The Village Engineer presented the recommendation of the Planning Commiss-
ion to approve said plat. (see minutes of 1-11-1962).
Member Flannagan introduced the following resolution and MOVED its adoption:
"RESOLUTION"
(Acceptance of Plat - Lilac Heights Addition)
The motion for the adoption of the foregoing resolution was seconded by
Member Scherer and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and
the following voted against the same: None, whereupon said resolution
was declared duly passed and adopted, signed by the Mayor and his signa-
ture attested by the Clerk. See Resolutions Book page /.

The Mayor closed the public hearing.
The Village Engineer presented the recommendation of the Planning Commiss-
ion to approve said plat. (see minutes of 9-12-1963).
Member Flannagan introduced the following resolution and MOVED its adoption:

The motion for the adoption of the foregoing resolution was seconded by
Member Teresi and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi; and
the following voted against the same: None, whereupon said resolution
was declared duly passed and adopted, signed by the Mayor and his signa-

Public Hearing - Zoning, Richard E. Hipp (Multiple Dwelling):
The Village Engineer presented an affidavit of publication in the official
newspaper of the Notice of Public Hearing as described in said affidavit.
Said affidavit was examined, approved and ordered filed in the Clerk's
Office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so were afforded oppor-
tunity to express their views thereon, and all written objections heretofore
filed with the Clerk were presented and considered as follows:

The Village Engineer presented the recommendation of the Planning Commission

MOVED by Teresi seconded by Scherer carried to give a first reading to an
ordinance entitled:
"AN ORDINANCE AMENDING THE ZONING CODE"

davit. Said affidavit was examined, approved and ordered filed in the
Clerk's Office.

ing above referred to and all persons who desired to do so were afforded

MOVED by Teresi seconded by Flannagan carried to approve the ordinance herein
quoted by title on its first reading.
Request for Ordinance Waiver - 1400 Lilac Dr., Mpls. Star -Tribune:
The Village Engineer presented the Planning Commission recommendation to
approve the ordinance waiver regarding the set -back requirements. (see
minutes of 9-12-63).
MOVED by Teresi seconded by Flannagan carried to approve the ordinance
waiver of set -back requirements and adopt the recommendation of the Plan-
ning Commission.
Request for Noise Control Ordinance - Leonard P. Levine:
Mr. Levine appeared to request a noise control ordinance, based upon a decibel
noise level.
MOVED by Teresi seconded by Flannagan carried to authorize a study and recom-
mendation for a Noise Control Ordinance for Golden Valley.
Special Use Permit - 1200 Turner's Crossroad:
Mr. Bjurquist a realtor; Mr. Haberlach and Mr. Sundberg of Skelly Oil Com-
pany appeared and presented plans for a proposed service station at 1200
Turner's Crossroad.
MOVED by Teresi seconded by Flannagan carried to approve the Special Use
Permit, subject to the following: Either Brick or Porcelain exterior and
the maintenance and upgrading of the Barber Shop in the rear of the prop-
erty.
Request for Public Hearing - Zoning: Lindsay's 2nd Addition; 5700 Duluth
Street:
The Village Engineer presented the request for Public Hearings on zoning
the following: Lot 1,2,3,4, and part of 5, Block 2, Lindsay's 2nd Addition,
and 5700 Duluth Street for the meeting of November 19, 1963•
MOVED by Schaphorst seconded by Scherer carried to call Public Hearings on
November 19, 1963, on the following: Lot 1, 2, 3, 4, and part of 5, Block
2, Lindsay's 2nd Addition and 5700 Duluth Street for zoning.
Re: Sale of Lot belonging to Village on Winnetka Avenue North:
The Village Engineer presented a report by Appraisers on the valuation of a
Village owned lot (Lot 32 Auditor's Subdivision No. 360 on Winnetka Avenue
North.

MOVED by Teresi seconded by Scherer carried to continue the matter to
the meeting of November 5, 1963.
Re: Turn -Around on Boone Avenue South of Mandan:
The Village Engineer presented a request by residents on Boone Avenue
for a turn -around south of Mandan.
Member Teresi introduced the following resolution and MOVED its adoption:
"RESOLUTION PROVIDING FOR ? T,1 IC HEARING ON A
CERTAIN PROPOSED PUBLIC IMPROVEMENT"

The motion for the adoption of the foregoing resolution was seconded by
Member Flannagan and, upon vote being taken thereon, the following voted
in favor thereof: Flannagan, Nadasdy, Schaphorst, Scherer, and Teresi;
and the following voted against the same: None, whereupon said resolu-
tion was declared duly passed and adopted, signed by the Mayor and his

Second Reading - Sign Ordinance, Section 5, 1A:
Council deferred the second reading of the Sign Ordinance, Section 5, 1A.
Request for Sign Permit - Carriage House Motel, 8625 Wayzata Boulevard:
The Building Inspector presented the request for a sign permit for the
Carriage House Motel at 8625 Wayzata Boulevard.
MOVED by Teresi seconded by Schaphorst carried to approve the sign permit
for the Carriage House Motel at 8625 Wayzata Boulevard, said sign to be
the same set -back as established by the Buhler Engineering Company and
subject to the approval of the Building Inspector.
Request for Ordinance Waiver - 3502 Manor Drive, Donald W. Rowe:
The Village Engineer presented the request for an ordinance waiver at
3502 Manor Drive for Doanal W. Rowe.
The Village Engineer presented the recommendation of the Planning Com-
mission to approve said waiver. (see minutes of 10-10-1963):
MOVED by Flannagan seconded by Schaphorst carried to approve the request
for an ordinance waiver at 3502 Manor Drive for Donald W. Rowe upon rec-
ommendation of the Planning Commission.
Request for Ordinance Waiver - 1617 Xerxes Avenue North, Fox -Mandel:
Attorney, Sidney Lorber and Attorney Allen, Oleisky representing the pro-
ponents appeared to request an ordinance waiver for 1617 Xerxes Avenue
North.

MOVED by Flannagan seconded by Scherer carried to approve the request
for an ordinance waiver at 1617 Xerxes Avenue North for Fox -Mandel upon
recommendation of the Planning Commission.
Request for Ordinance Waiver - 1636 Gettysberg Avenue North, I T Maus:
The Village Engineer presented the recommendation of the Planning Commis-
sion to approve said ordinance waiver. (see minutes of 10-10-1963).
MOVED by Teresi seconded by Scherer carried to approve the request for
an ordinance waiver at 1636 Gettysberg Avenue North for I. T. Maus upon
recommendation of the Planning Commission.
Request for Building Permit - Minneapolis Honeywell Company:
Mr. Gentry of Minneapolis Honeywell Company appeared to request a building
permit for a temporary building.
MOVED by Flannagan seconded by Teresi carried to approve the request for
a building permit by Minneapolis Honeywell Company, subject to the approval
of the Building Inspector.
Request for Building Permit - J. F. Bell Research Center, 9000 Plymouth
Avenue:
The Building Inspector presented the request for a building permit for a
storage building for the J. F. Bell Research Center at 9000 Plymouth Avenue.
MOVED by Schaphorst seconded by Scherer carried to approve the request for
a building permit for a storage building for the J. F. Bell Research Center
at 9000 Plymouth Avenue, subject to the approval of the Building Inspector.
Informal Bids, Blacktop Sidewalk:
The Village Engineer informed the Council that no bids were received for
Black -top Sidewalk.
MOVED by Teresi seconded by Flannagan carried to order the work done by
the Village day labor.
Resolution Ordering Dust Treatment (64 -DA -3):
Member Flannagan introduced the following resolution and MOVED its adoption:

Waiver of Public Hearings - Watermains & Sanitary Sewers:
The Village Engineer presented the request for waiver of public hearing for
public improvements for watermains and sanitary sewers in Tremblatt Terrace,
and E. A. Anderson Addition.
Member Teresi introduced the following resolution and MOVED its adoption:

Request for Sign Permit - Lindsay's Temporary Open douse Sign:
The Building Inspector presented a request for a sign permit for Lindsay's
Open House for a temporary sign.
MOVED by Flannagan seconded by Schaphorst carried to approve the request for
a sign permit for a temporary sign for Lindsay's Open House, subject to ap-
proval by the Builsing Inspector.
Re: Minneapolis Clinic of Psychiatry and Neurology:
All present agreed to add the above matter to the agenda.
The Village Attorney gave an oral report on the proposed rezoning of the
property of the Glenwood Hills Hospital.
MOVED by Flannagan seconded by Teresi to call a public hearing, formal or
informal as required, on November 5, 1963, to consider the request for a
building permit for the Minneapolis Clinic of Psychiatry and Neurology
at 4225 Golden Valley Road. (On 10-15-63, the Village Attorney advised
that no legal hearing is required).
Appointment of Village Attorney:
All present agreed to add the above matter to the agenda.

Regular Meeting of the Village Council, October 15, 1963
MOVED by Teresi seconded by Flannagan carried to recommend to the
Village Manager approval of the appointment of Robert Skare as
Village Attorney, effective November 1, 1963, and that the Manager,
with the aid of Trustee Schaphorst, negotiate the attorneys schedule
and arrange for the transfer of responsibilities.
MOVED by Scherer seconded by Flannagan carried to adjourn the meet-
ing at 9:45 P.M.
