08-17-65 City Council MinutesREGULAR MEETING Of the VILLAGE COUNCIL August 17, 1965 Pursuant to due call and notice thereof, a regular meetin&<of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on August 17, 1965, at $:00 o'clock P. M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan'Lynch; President of the Planning Commission, Robert Raugland. Invocation: Mayor Carl Nadasdy. Minutes of June 22, July 20, and August 3, 1965: MOVED by Teresi seconded by Flannagan carried to approve the minutes of June 22, July 20th and August 3, 1965, as submitted to the Council. Public Hearing - Public Tmprovement, Sanitary Sewer (65 -LF -12): The Village Clem presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on a Certain Proposed Public Improve- ment (Proposed Sanitary Sewer 65 -LF -12) described in the resolution of this Council relating thereto, adopted on July 20, 1965. Said affidavit was then examined, approved and ordered filed in the Office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvement, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION None None The Mayor closed the Public Hearing. Member Schaphorst introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT" (Proposed Sanitary Sewer 65 -LF -12) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was 1 1 1 Regular Meeting of the Village Council, August 17, 1965 declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Member Garis introduced the following resolution and MOVED its adoption: "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND AUTHORIZING CONTRACT CHANGES PURSUANT TO MINNESOTA STATUTES 429.041, Subd. 711 (Proposed Sanitary Sewer 65 -LF -12) The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Public Hearing - Public Improvement, Watermain (65 -WN -29, 30, 31, & 35): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on a Certain Proposed Public Improve- ment (Proposed Watermain 65 WM-29, 30., 31 & 35) described in the resolution of this Council relating thereto, adopted on July 20, 1965. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. See Resolutions Book page f Public Hearing - Public Improvement, Concrete Paving (65 -CP -2 & 3): The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on Certain Proposed Public Improve- ments (Proposed Concrete Paving 65 -CP -2 & 3) described in the resolution of this Council relating thereto, adopted on July 20, 1965. Said affidavit was then examined, approved and ordered filed in the office.of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: 6 -CP-2: The Village Engineer presented the proposed improvement and explained the State Aid Program and reported on the traffic count on Noble Avenue. OBJECTOR OBJECTION Mr. Morton D. Silverman Stated the crowd was hereat the meeting 2135 Noble Avenue North due to interest in this improvement. Mr. C. H. Eklin Drew up and circulated the petition by 2720 Noble Avenue North residents against this improvement. Mr. Wm. J. Houlihan Spokesman for approximately 231 residents: 2620 Noble Avenue North 1. Want to be sure of need. 2. The flow of traffic is from Crystal & Robbinsdale, not Golden Valley. 3. State Aid street - 441 width, since residents park in driveway, don't need extra width. Regular Meeting of the Village Council, August 17, 1965 4. Wider street for snow removal not needed. 5. Curb and gutter not needed for drain- age. There is no problem. 6. No need for widening and improvement of Noble Avenue which would result in increased use creating a dangerous situation which will be more hazardous for the children, and cause more accidents. Mr. Bruce B. Gordon Stated the proposed sidewalk should be 220 North Meadow Lane separated from the roadway. The Mayor closed the public hearing. MOVED by Schaphorst seconded by Flannagan carried to approve the ordinance waiver at 5308 St'. Croix Avenue upon recommendation of the Planning Commission. Request for Ordinance Waiver - 428 Sunnyridge Lane, A. Henry_ Edli . Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said waiver. (see minutes of 8-12-65). Regular Meeting of the Village Council, August 17, 1965 Request for Ordinance Waiver - 1317-1533 Flag Avenue, Earl Wilson: Mr. Robert Raugland, President of the Planning Commission, presented the recommendation of the Planning Commission to approve said waiver. (see minutes of 8-12-65). Mr. Wilson appeared to answer questions for Council. MOVED by Flannagan seconded by Teresi carried to defer the matter to the meeting of September 8, 1965. Request for Liquor License - Elks Club, 6224 Wayzata Boulevard: Mr. Earl T. Anderson, Jr., Attorney and Titular head of the Elks Club appeared before Council to explain their plans for a building in Golden Valley at 5224 Wayzata Boulevard and to request an On -Sale Liquor License. The proposed building to be located on 4.9 acres with approximately 12,000 members. Council encouraged the Elks Club to present their preliminary plans for the proposed building but took no action on the request for an fan -ale Liquor License. Re: Lee Avenue North - Spruce Third Addition: All present agreed to add the above matter to the agenda. The matter of the possible condemnation of Lee Avenue North was discussed and the Village Manager reported that unless a compromise could•be.worked out he would soon be requesting condemnation proceedings. MOVED by Flannagan seconded by Teresi carried to extend the time limit for Spruce Third Addition Plat approval. Second Reading - Ordinance Zoning Residential: Mr. Lloyd Bergman, Attorney for the estate of Moser, discussed the possible rezoning of this property to residential zone. MOVED by Teresi seconded by Flannagan carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (Residential Zoning District) Member Schaphorst abstained from voting. MOVED by Flannagan seconded by Garis carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. Member Schaphorst abstained from voting. H. #100. MOVED by Schaphorst seconded by Garis carried to deny the request for a 3.2 Beer License by Shakey's Pizza Parlor at County Road #66 & T. H. #100. Interconnection of Trunk Sewer - City of Minneapolis (Consulting Engineer): The Village Manager presented a proposal to furnish professional engineering services for the building of an interceptor sewer between Golden Valley and the City of Minneapolis dated July 19, 1965, by Orr-Schelen-Mayeron & Associates, Inc., Consulting Engineers. MOVED by Flannagan seconded by Teresi carried to retain the Orr-Schelen- Mayeron & Associates, Inc. as Consulting Engineers for the construction of the proposed interceptor sewer. Member Garis felt in the best interest of the village that the Orr-SchelenMayeron should be employed as a consultant for the above referenced project, however for personal reasons wishes to be recorded as voting NO. Request for Public Hearing - Street Vacation, Hampshire Oaks 5th Addition: The Village Manager presented a request for a Public Hearing for street vacation in Hampshire Oaks 5th Addition. MOVED by Flannagan seconded by Schaphorst carried to call a Public Hearing for street vacation in Hampshire Oaks 5th Addition on September 21, 1965. Resolution Ordering Dust Treatment (66 -DA -1 & 2): Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING DUST TREATMENT FOR CERTAIN STREETS" (66 -DA -1 & 2) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk.
