September 21, 1965
Pursuant to due call and notice thereof, a regular meeting of the Village
Council of the Village of Golden Valley, Hennepin County, Minnesota, was
held at 7800 Golden Valley Road in said Village on September 21, 1965, at
8:00 o'clock P. M.
The following members were present: Flannagan, Garis, Madasdy, Schaphorst,
and Teresi; and the following were absent: Mone.
Present were Village Engineer, Donald Sorensen; Village Attorney, Robert M.
Skare; Village Clerk, Helen Penniman, Building Inspector, Dan Lynch; Member
of the Planning Commission, Joe L. Brown.
Invocation: Rev. Norman L. Long - Church of the Brethren.
Minutes of August 17 and August 24, 1965:
MOVED by Teresi seconded by Flannagan carried to approve the minutes of
August 17th and August 24, as submitted to the Council.
Award of Bid - Concrete Paving With Integral Curb (65 -CP -3):
The Village Clerk presented the affidavit of publication in the official
newspaper. Sealed bids were received and the Village Engineer, and Village
Clerk met in the Council Chamber at 7800 Golden Valley Road at 11:00 A. M.
on September 17, 1965, and have then and there publicly opened and read the
bids received. The Village Engineer tabulated said bids and they were
found to be as follows:

Woodrich Construction Company 36, 181.80
The Village Engineer recommended that Ario Construction being the lowest
responsible bidder be awarded the bid in the amount of $28,21..50.
MOVED by Flannagan seconded by Schaphorst carried to award the bid to
Ario Construction Company in the amount of $28,214.50, upon recommendation
of the Village Engineer.
Award of Bial - Concrete Curb and Gutter (65 -CG -14 & 15):
The Village Clerk presented the affidavit of publication in the official
newspaper. Sealed bids were received and the Village Engineer, and the
Village Clerk met in the Council Chamber at 7800 Golden Valley Road, at
11:00 A. M. on September 17, 1965, and have then and there publicly opened
and read the bids received. The Village Engineer tabulated said bids and
they were found to be as follows:

The Village Engineer recommended that Ario Construction being the lowest
responsible bidder be awarded the bid in the amount of $8,712.75.
MOVED by Teresi seconded by Flannagan carried to award the bid to Ario
Construction Company in the amount of $8,712.75, upon -recommendation of
the Village Engineer.
Continued Public Hearing --Zoning, 2200 Winnetka Ave. N. (Multiple Dwelling):
MOVED by Flannagan seconded by Teresi carried to continue the public hearing
indefinitely.

Public Hearing - Plat, Skyline Plaza Addition:
The Village Clerk presented an affidavit of publication in the official news-
paper of the Notice of Public Hearing as described in said affidavit. Said
affidavit was examined, approved and ordered filed in the Clerk's Office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so were afforded oppor-
tunity to express their views thereon. No persons presented objections except
the following:

The Mayor closed the public hearing.
Mr.Joe L. Brown, Member of the Planning Commission, presented the recom-
mendation of the Planning Commission to approve said plat. (see minutes of
12-10-1964).
MOVED by Teresi seconded by Schaphorst carried to approve said plat, subject
to executing an agreement and posting the required bond.
Member Teresi introduced the following resolution and MOVED its adoption:

The motion for the adoption of the foregoing resolution was seconded by
Member Schaphorst and, upon vote being taken thereon, the following voted
in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresa; and
the following voted against the same: None, whereupon said resolution was
declared duly passed and adopted, signe& by the Mayor and his signature
attested by the Village Clerk. See Resolutions Book page
Public Hearin - Residential Street Lighting (65 -RST -3):
The Village,Clerk presented an affidavit of publication in the official
newspaper of the Notice of Public Hearing as described in said affidavit.
Said affidavit was examined, approved and ordered filed in the Clerk's Office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so'were afforded oppor-
tunity to express their views thereon. No persons presented objections
except the following:

Mr. Richard Mason Mr. Mason stated they were not approached
29.5 Regent Avenue North for the petition.
Mrs. Edna Brautigam Submitted a petition with 56 signatures
3100 Quail Avenue North against street lights. Residents in
Woodlawn Park do not want street lights.
The more street lights the more shadows.
Mr. John Ferguson Asked if it will necessitate another
1827 Culver Road utility pole.
Mrs. Florence Terpeck Will not benefit from lights on the
3138 Quail Avenue North corner.
Mrs. Annette Lindquist Lights will not deter vandals. Do not
3139 Quail Avenue North want lights.
Mr. Gene Kretchner, Engineer from Northern States Power Company, explained
the proposed street lighting and alternatives. Mr. Kretchner answered
questions for Council and residents.
The Mayor closed the public hearing.
Council discussed subdividing the areas, and securing additional signatures.
MOVED by Teresi seconded by Flannagan carried to deny the request for
residential street lighting (65 -RST -3).
Award of Plaques:
The Mayor awarded plaques to the following residents for service to the
community:

Continued Public Hearing - Storm Sewer (65 -SS -6):
The Village Engineer reported on an informal meeting with the residents in
the area, held on September 14, 1965.
MOVED by Flannagan seconded by Schaphorst carried to continue the public
hearing to the meeting of October 19, 1965.
Public Hearing - Storm Sewer (65 -SS -8), Windsor Woods Addition:
The Village Clerk presented an affidavit showing publication in the official
newspaper of the Notice of Public Hearing ona Certain Proposed Public Improve-
ment (Proposed Storm Sewer 65 -SS -8) described in the resolution of this
Council relating thereto, adopted on July 20, 1965. Said affidavit was then
examined, approved and ordered filed in the office of the Village Clerk.
The Mayor then announced that the meeting was open for public hearing on said
proposed public improvement and all persons present to do so were afforded
opportunity to express their views thereon. No persons presented objections
except the following:

Member Teresi introduced the following resolution and MOVED its adoption:
"RESOLUTION ORDERING CONSTRUCTION OF A
CERTAIN PROPOSED PUBLIC IMPROVEMENT"

The motion for the adoption of the foregoing resolution was duly seconded by
Member Flannagan and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the
following voted against the same: None, whereupon said resolution was
declared duly passed and adopted, signed by the Mayor, and his signature

Member Flannagan introduced the following resolution and MOVED its adoption:
"RESOLUTION APPROVING PLANS AND SPECIFICATIONS
AND ORDERING WORK DONE BY DAY LABOR"

The motion for the adoption of the foregoing resolution was duly seconded by
Member Schaphorst and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the

The motion for the adoption of the foregoing resolution was seconded by
Member Garis and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Q_aris, Nadasdy, Schaphorst, and Teresi; and the
following voted against the same: None, whereupon said resolution was de-
clared duly passed and adopted, signed by the Mayor and his signature

The Village Clerk presented an affidavit of publication in the official
newspaper of the Notice of Public Hearing as described in said affidavit.
Said affidavit was examined, approved and ordered filed in the Clerk's
Office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so were afforded oppor-
tunity to express their views thereon. No persons presented objections

Member Schaphorst introduced the following resolution and MOVED its adoption:

The motion for the adoption of the foregoing resolution was seconded by
Member Teresi and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the
following voted against the same: None, whereupon said resolution was
declared duly passed and adopted, signed by the Mayor and his signature

Public Hearing - Zoning, Residential Zoning District (Scheid's Terrace):
The Village Clerk presented an affidavit of publication in the official news-
paper of the Notice of Public Hearing as described in said affidavit. Said
affidavit was examined, approved and ordered filed in -'the Clerk's Office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired'to do so were afforded oppor-
tunity to express their views thereon, and all written objections heretofore
filed with the Clerk were presented and considered as follows:
OBJECTOR OBJECTION
Mr. W. Gendreau Objected to zoning to residential zone,
1913 Regent Avenue_Noi^th preferred site to remain institutional.
Council requested the VillageAttorney to check the acquisition of Scheid's
Park and purchase of additional lots.
Mr. Joe L. Brown, member of the Planning Commission, presented the recom-
mendation of the°°Planning Commission to approve said zoning. (see minutes of
$-12-1965).
MOVED by Teresi seconded by Flannagan carried to continue the public hearing
pending the settlement of a law suit involving said property.
Public Hearing - M-2 Multiple Dwelling District (Skyline Builders, Inc.):
The Village Clerk presented an affidavit of publication in the official news-
paper of the Notice of Public Hearing as described in said affidavit. Said
affidavit was examined, approved and ordered filed in the Clerk's Office.
The Mayor announced that this was the time and place for the public hearing
above referred to and all persons who desired to do so were afforded oppor-
tunity to express their views thereon, and all written objections heretofore
filed with the Clerk were presented and considered as follows:

The Mayor closed the public hearing.
Mr. Joe L. Brown, member of the Planning Commission, presented the recommen-
dation of the Planning Commission to deny said zoning. (see minutes of 8-12-65).
MOVED by Flannagan seconded by Schaphorst carried to give a first reading to
an ordinance entitled:
"AN ORDINANCE AMENDING THE ZONING CODE"
(M-2 Multiple Dwelling Zoning District - Skyline Builders, Inc.)
MOVED by Schaphorst seconded by Flannagan carried to approve the ordinance
herein quoted by title on its first reading.
Waiver of Public Hearing - Watermain (65-WM-40); Sanitary Sewer (65 -LF -13):
The Village Clerk presented a petition and waiver of right to public hearing
by all the owners affected on a certain proposed public improvement, 65-WM-40.
Member Garis introduced the following resolution and MOVED its adoption:
"RESOLUTION WAIVING THE PUBLIC HEARING PURSUANT TO
MINNESOTA STATUTES 1.29.031, SUBD. #3 AMID ORDERING
CONSTRUCTION OF A CERTAIN PROPOSED PUBLIC IMPROVEMENT"

The motion for the adoption of the foregoing resolution was duly seconded by
Member Schaphorst and, upon vote being taken thereon, the following members
voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi;
and the following voted against the same: None, whereupon said resolution
was declared duly passed and adopted, signed by the Mayor, and his signature
attested by the Village Clerk. See Resolutions Book page L
Member Teresi introduced the following resolution and MOVED its adoption:

Member Flannagan and, upon vote being taken thereon, the following voted in
favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the
following voted against the same; None, whereupon said resolution was
declared duly passed and adopted, signed by the Mayor and his signature'

The Village Clerk presented a petition and waiver of right to public

Request for Ordinance Waiver - 716 Rhode Island Ave. S.; G. R. Della Paolera:
Mr. Joe L. Brown, Member of the Planning Commission, presented the recommendation
of the Planning Commission to approve said waiver. (see minutes of 9-16-65).
MOVED by Schaphorst.seconded by Garis carried to approve the ordinance waiver
at 716 Rhode Island Avenue South upon recommendation of the Planning
Commission.
Request for Ordinance Waiver - 2350 Byrd Avenue, Edward L. Johnson:
Mr. Joe L. Brown, Member of the Planning.Commission, presented the recommendation
of the Planning Commission to approve said waiver. (see minutes of 9-16-65).
Mr. Kronbush appeared on behalf of Mr. Johnson.
Mr. John H. Dubuque, 2100 Byrd Avenue submitted a petition against said
ordinance waiver signed by 13 residents.
MOVED by Teresi seconded by Flannagan carried to deny the request for an
ordinance waiver at 2350 Byrd Avenue.
Request for Ordinance Waiver, 5800 Golden Valley Road, Ray E. Michel:
Mr. Joe L. Brown, Member of the Planning Commission, presented the recommendation
of the Planning Commission to approve said waiver. (see minutes of 9-16-65).

MOVED by Teresi seconded by Schaphorst carried to approve the request for
an ordinance waiver at 5800 Golden Valley Road upon recommendation of the
Planning Commission.
Request for Ordinance Waiver - 20111 Winnetka Avenue North, Einar Olsen:
Mr. Joe L. Brown, Member of the Planning Commission, presented the recommenda-
tion of the Planning Commission to approve said waiver. (see minutes of
9-15-1965).
MOVED by Flannagan seconded by Schaphorst carried to approve the request for
an ordinance waiver at 2011 Winnetka Avenue North upon recommendation of the
Planning Commission.
Request for Ordinance Waiver - 3121 Kyle Avenue, Grevco Construction, Inc.:
Mr. Joe L. Brown, Member of the Planning Commission, presented the recommenda-
tion of the Planninc Commission to approve said waiver. (see minutes of
9-16-1965).
MOVED by Schaphorst seconded by Garis carried to approve the request for an
ordinance waiver at 3124 Kyle Avenue upon recommendation of the Planning
Commission.
Request for Building Permit - Standard Oil, 900 Mendelssohn Avenue:
The Building Inspector presented a request for a building.permit for
Standard Oil Company at 900 Mendelssohn Avenue for a steel building.
MOVED by Teresi seconded by Flannagan carried to deny the request for a
building permit for Standard 031 Company at 900 Mendelssohn Avenue North:
Request for Sign Permit - 8950 Olson Highway, Shell Oil Company:
The Building Inspector presented a request for a sign permit for the Shell
Oil Company at 8950 Olson Highway;
MOVED by Teresi seconded by Schaphorst carried to approve the request for a
sign permit for the Shell Oil Company at 8950 Olson Highway,:subject to the
removal of two small portable signs and the approval of the $wilding
Inspector.
Interchange (T.H. #55 & County Road #1.8) Mr. Clarence Sheedy:
Mr. Sheedy presented a traffic count of customers using his service station
over a four day period and presented drawings showing the proposed highway
plan and how it would affect his business. Mr. Mason of Shell Oil Company
was also present.
MOVED by Teresi seconded by Flannagan carried that the Council take no
action on the matter.

Regular Meeting of the village Council, September 21, 1965
.Report of Sanitarian - 4220 Beverly Avenue:
Mr. Schneider, Sanitarian and Mr. Wally Caryl were present and reported on
the health hazard and the rat problem at 4220 Beverly Avenue. Mr. Schneider
presented pictures of the premises and submitted three suggestions for
Council consideration as follows:
1. Vacate premises - Health hazard.
2. Orders to cease violation and village to do work necessary.
3• Convince the residents to vacate the premises.
Dr. David Bloom, 1301 Beverly Avenue and Frederick F. Sheridan, 4400 Ardmore
Drive were present and confirmed the conditions above referred to at
4220 Beverly Avenue.
MOVED by Teresi seconded by Flannagan carried to direct the Health Officer
to certify an order requiring the residents of 4220 Beverly Avenue to
comply with the Vila ge Ordinances.
Request to Fill Property -.Mr. J. P. Weinard:
Mr. Weinard requested permission to haul fill over residential streets to fill
property, at least 10 loads per week. .Estimated cost of street is $12,000.
MOVED by Teresi seconded by Flannagan carried to deny the request to haul
fill in 13 ton truck to fill property in a residential area.
Dr. Bloom, 4301 Beverly Avenue:
All present agreed to add the above matter to the agenda.
The Building Inspector presented the item of whether a particular patio
qualified as a structure or not, and whether a building permit was necessary.
MOVED by Flannagan seconded by Teresi carried that the Council take no action.
Bills:
MOVED by Flannagan seconded by Garis carried to approve the bills as
submitted on the prelist.
MOVED by Flannagan seconded by Teresi carried to adjourn the meeting at
12:30 A. M.
