10-05-65 City Council MinutesREGULAR MEETING of the VILLAGE COUNCIL October 5, 1965 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on October 5, 1965, at 7:30 o'clock P. M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Acting Village Clerk, Carol Wachter; Building Inspector, Dan Lynch; President of the Planning Commission, Robert Raugland; Village Assessor, Bob Burns. Invocation: Rev. Sylvan A. Lange, Golden Valley Baptist Church. Minutes of September 8 and 21, 1965: MOVED by Teresi seconded by Garis carried to approve the minutes of September 8, 1965, as submitted to the Council, with the following correction: on page 5, at the bottom of the page, Member Teresi seconded the motion, not Member Garis. MOVED by Teresi, seconded by Garis, and carried to approve the minutes of September 21, 1965, with the following correction: On page 2, under Continued Public Hearin - Zoni 200 Winnetka Avenue North (Multi le Dwelling), the motion is to be changed as follows: oto continue the public hearing indefinitely, instead of to October 19, 1965. Public Hearing - Plat, Miller Addition: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded oppor- tunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION OR COMMENTS None None The Mayor closed the public hearing. Since Mr. Raugland had not yet arrived at the meeting, the recommendation of the Planning Commission to approve said plat was read by the Village Manager. (see minutes of 7-15-65). Regular Meeting of the Village Council, October 5, 1965 Member Schaphorst introduced the following resolution and MOVED its adoption: "RESOLUTION (Acceptance of Plat - William R. Miller Addition) The motion for the adoption of the foregoing resolution was seconded by Member Garis and, upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi, and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by,the Village Clerk. See Resolutions Book page Request for Ordinance Waiver, Earl Wilson, 1317 - 1533 Flag Avenue: The Village Manager presented the recommendation of the Planning Commigsion recommending approval of the frontyard setbacks and denial of the sideyard waiver. (see minutes of 8-12-65). Mr. Earl Wilson appeared before Council to answer questions on the part of all the property owners (about fifteen owners involved). Mr. Robert Raugland, President of the Planning Commission, arrived at this point for the Council meeting. He stated that the Planning Commission would like to see a merging of some of these lots, making two lots out of three. MOVED by Flannagan seconded by Schaphorst carried to approve the waiver of frontyard setbacks but not the waiver of sideyard setbacks. Request for Ordinance Waiver, John Hopponen - 2100 Valders Avenue North: Mr. Robert'Raugland, President of the Planning Commission, read the recommendation of the Planning Commission to - deny the request for this waiver. (see minutes of 9-13-65). MOVED by Flannagan seconded by Garis carried to defer this request for waiver to the meeting of October 19, 1965, in order to give the members of the Council an opportunity to view these premises. Public Hearing - Assessments for Various Public Improvements and Certifications: The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in -the Clerk's office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon, and all written objections heretofore filed with the Clerk were presented and considered as follows: 1 190" Regular 90" Regular Meeting of the Village Council, October 5, 1965 Watermain (Balance of 1964 and up to August 1, 1965): OBJECTOR OBJECTION OR COMMENT Ed Goedhart Was this what took place in the last 7120 Glenwood Avenue two weeks? When will this be on the John Haglund 3050 Scott Avenue North Ben Marcor 1305 Castle Court B. A. McClellan 1375 Oak Grove Circle taxes? Watermain just installed a couple -of weeks ago. Have not been notified they can hook up. Sod is not put back yet. Wondered if his property would be taxed on both sides since it abuts on Zealand Avenue. Asked if he could now hook onto water and what would be the charges since the school is on the opposite side, 11hat have they been assessed and what is the procedure. Also a number of other people were with them that lived on Oak Grove Circle. After further discussion the Mayor suggested that the people in attendance concerned with this improvement retire to Mr. Burn's office and have the assessment explained. The group later returned and stated they were satisfied with the assessment. L. Ellstrom Inquired if his watermain assessment 15 Meadow Lane North could be deferred at this time until there is something done on the lot behind him. Willis Fry Has only clay on his road; it is practi- 2013 Hillsboro Avenue North cally a mudhole. For 12 years it has been nearly impossible to get in and out. Big ditch was bulldozed out on Duluth Street. He has, a 3' dropoff where driveway was. Ditch i s unsightly. Ray Farmer Road was supposed to be put in at grade. 1915 Hillsboro Avenue North Has been improved since but grade keeps going lower and lower. In two or three of the driveways in this area the cars hit bottom. Cesspool draining into the large ditch. L. K. Holen Grader came along and knocked out 3'•of 1917 Hillsboro Avenue North driveway. When they brought water into yard, they hauled all the fill away. He has large hole in yard,is afraid some child will get hurt. 191 Regular Meeting of the Village Council, October 5, 1965 The Village Engineer explained at this point that the contractors were respon- sible after installing water. He further explained that there should not be traffic on Earl Street since it is not an improved street. Earl Street should be improved, but the Engineering Department has not received a petition for such improvements. (This should have been Duluth and not Earl; the complain- ant was wrong.) The Mayor inquired about the cesspool that was reported draining into the big ditch. He directed the Village Manager to meet with the people in that area regarding this matter. Surfacim : OBJECTOR OBJECTION OR COMMENT Frank Bolanda Asked when he could pay the assessment. 1121 Unity Avenue North Mentioned that he had asked the Building - Inspector to check on concrete blocks in his home, but that this had not been done as yet. Ron Fishman Has had to have apron on his driveway 23 Western Terrace replaced three times: neighbors also have same trouble. Dirt, sand, and rock is washed from vacant lot over in front of his driveway everytime it rains; has to be swept away every week. 192, Regular Meeting of the Village Council, October 5, 1965 The Village Engineer told Mr. Fishman that he would check on this matter and call him. Mr. Ulstad remarked that this was an outlot and that the owner could not get enough -:land to make it a buildable lot. The Village Attorney remarked that there is no legal liability on the part of the Village. Sanitary Sewer: M. V. Gable 2515 Florida Avenue North BILI. Thomas 251-1 Douglas Drive North OBJECTION OR COMMENT What about the holes that were dug in his lawn? Can they be filled and the sod replaced? Could see why he would be assessed on Florida, but what is assessment on north property line? Is there a deferment procedure as to assessments? The Village Manager read a letter from Mr. A. L. Christensen of LaCrosse, Wisconsin, requesting that his improvements be deferred. The Council discussed the matter and found that no action was necessary as the property was properly benefitted. Member Teresi introduced the following resolutions and MOVED their adoption: "RESOLUTION AMENDING ASSESSMENTS FOR VARIOUS PUBLIC ivROVEmTs - 1965" "RESOLUTION ADOPTING AND CONFIRMING ASSESSMENTS FOR VARIOUS PUBLIC IMPROVEMENTS - 1965" The motion for the adoption of the foregoing resolutions was duly seconded by Member Flannagan, and upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi, and the following voted against the same: None, whereupon said resolutions were declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Susan Becker, Acting Chairman of the Human Rights Commission, appeared before Council to advise them thatthe Commission has now adopted its By-laws and asked if the Council had any suggestions to offer them at this time. She was informed by members of the Councilthat if a problem arises, it would be referred to the Commission for study and review, and then sent to the Council for any necessary action. The same policy is to be followed as for the Planning Commission and Park & Recreation Commission. 1 I 1, y 6 Regular Meeting of the Village Council, October 5, 1965 Construction of Patio by Dr. Bloom: Mr. John W. Laird, 4309 Beverly Avenue, appeared before Council to oppose the construction of a patio by Dr. Bloom. Mr. Raugland.stated that if this patio has a foundation, it is to be considered a structure. Members of the Council agreed that they would like to inspect the construction. MOVE) by Teresi seconded by Garis carried that the Building Inspector put a stop order as of October 6, 1965, on the project and that the Councilmen inspect '.the construction in its present state. Discussion of Proposed Grade at 6801 Knoll Street - Hans Garnes: Mr. Garnes requested that the grade of the road be raised at his driveway. The Village Engineer explained that it was not feasible to raise the grade; that it is at a level now where it does the greatest good for the greatest number of people. No action was taken by the Council. Administrative Lot Division - A. A. Zeiss, 23.0 Brookridge: The Village Manager presented the request for approval of an administrative lot division at 23.0 Brookridge (see Planning Commission minutes of 9-13-65). MOVED by Schaphorst seconded by Garis carried to approve the administrative lot division at 2340 Brookridge, upon recommendation of the Planning Commission. Discussion - Closing Village Hall for Meetings on Legal Holidays: MOVED by Garis seconded by Teresi carried that the Village Hall be closed on legal holidays, other than election days. Hennepin County General Hospital Budget for 1966: The Village Manager presented the 1966 Budget, Revenue and Tax Levy submitted by the Hennepin County General Hospital, together with a Resolution. MOVED by Schaphorst seconded by Garis carried that this Resolution be filed in the office of the Village Clerk. Mr. Flannagan left the Council meeting. Resolution - Re: Adopting the Budget for 1966 & Establishing the Village Property Tax Levy for 1965: Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ADOPTING THE BUDGET FOR 1966 AND ESTABLISHING THE VILLAGE PROPERTY TAX LEVY FOR 1965" The motion for the adoption of the foregoing resolution was duly seconded 'by Member Schaphorst and, upon vote being taken thereon, the following voted in favor thereof: Garis, Nadasdy, Schaphorst, and Teresi, and the following Regular Meeting of the Village Council, October 5, 1965 voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his sigmture attested by the Acting Village Clerk. Certification of Delinquent Utility Bills: The Village Manager presented a copy �f the assessment and levy roll of delinquent utility charges due and payable in 1965. 1 Regular Meeting of the Village Council, October 5, 1965 MOVED by Teresi seconded by Garis carried to approve the Certificate as to Delinquent Utility Service Charges for 1965 and Assessments therefor. Honeywell Regulator Company - Preliminary and/or Footing and Excavation Approval for Permit: Mr. Jack Gentry from Honeywell Regulator Company appeared before 0ouncil and presented pictures and plans of the proposed addition. Interested people from the audience came up to the front to inspect the plans and ask questions. Mr. Emery Swanson requested that no permits be granted until the landscaping matter was taken care of. MOVED by Teresi seconded by Garis carried that permit be granted subject to the issuance of a $20,000 landscaping bond. Request for Building Permit, 5730 Duluth Street - Diversified Developers, Inc. Business & Professional Office: The Building Inspector presented the request for a building permit for Diversified Developers, Inc. at 5730 Duluth Street. MOVED by Teresi seconded by Schaphorst carried to approve the request for a building permit for Diversified Developers, Inc., at 5730 Duluth Street, subject to the posting of a $2,000 landscaping bond. Request for Building Permit 6739 Golden Valley Road - W. C. Bunnel Multiple District The proponent withdrew his request for this building permit. Second Reading Ordinance Amending theZoning Code - Skyline Builders, Inc. MOVED by Schaphorst seconded by Garis carried to give a second reading to an ordinance entitled: AN ORDINANCE AMENDING THE ZONING CODE (Skyline Builders, Inc.) MOVED by Schaphorst seconded by Garis carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. See Ordinance Book page. Call for Sale of Improvement Bonds: The Village Manager presented a request to call for Sale of Improvement Bonds on November 16, 1965, in the amount of $490,000, and to emply T. G. Evensen and Associates as financial advisors. MOVED by Teresi seconded by Schaphorst carried to call for sale of $490"000 Improvement Bonds on November 16, 1965. Regular Meeting of the Village Council, October 5, 1965 Resolution Ordering Dust Treatment (66 -DA -3): Member Garis introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING DUST TREATMENT FOR CERTAIN STREETS" (66 -DA -3) The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and, upon vote being taken thereon, the following members voted in favor thereof: Garis, Nadasdy, Schaphorst and Teresa, and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. See Resolutions Book page 1 . Discussion of Federal Food Stamp Program: The Village Manager and the Village Attorney explained the Federal Food Stamp program to the members of the Council. MOVED by Teresi seconded by Garis carried to give approval to the partici- pation in the Federal Food Stamp program by the Village of Golden Valley. Report of Meeting re: Trunk Highway No. 12 (9-29-65): No action will be taken at this time. The matter will be deferred until such time as additional information is received from the State Highway Department. Discussion re: Traffic Engineering Report: MOVED by Teresi seconded by Garis carried to approve the proposal for Traffic Engineering Study and the procedure to obtain qualified applications for Traffic Engineering Study. Rhe uest for Public Hearing - Brownie Lake Storm Sewer (66 -SS -1): MOVED by Teresi seconded by Schaphorst carried to call a Public Hearing on this matter for the Meeting of November 16, 1965. Bills: MOVE) by Teresi seconded by Schaphorst carried to approve the bills as submitted on the prelist. All present agreed to add the matter of the New Hope sewer check to the Agenda. MOVED by Garis seconded by Schaphorst carried that'the sewer check received from New Hope is to be returned to thea and that their official represent- ative is to appear before the Golden Valley.Village Council at the next regular meeting of October 19, 1965.
