05-17-66 City Council Minutes1 1 REGULAR MEETING of the VILLAGE COUNCIL May 17, 1966 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on May 17, 1966, at 8:00 P. M. The following members were present: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following were absent: None. Present were Village Manager, Roger K. Ulstad; Village Attorney, Robert M. Skare; Village Engineer, Donald Sorensen; Village Clerk, Helen Penniman; Building Inspector, Dan Lynch; Chairman, Board of Appeals, Paul Belz. Invocation: Rev. Norman D. Long, Church of the Brethren. Minutes of May 3, 1966: MOVED by Gar -is seconded by Schaphorst carried to approve the minutes of May 3, 1966, as submitted to the Council. Public Hearing - Public Improvements Sanitar Sewer (66 -LF -2 3 4 5 6 7 8 l0 11): Watermain-WM-1.2. .7. .9.76_ll_1'A The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on certain proposed Public Improvements (Proposed Sanitary Sewer 66 -LF - Proposed Watermain 66-WM) described in the resolution of this Council relating thereto, adopted on April 19, 1966. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objection except the following: OBJECTOR Mr. Al H. Schwankl 170 Kelly Drive Mr. & Mrs. J. 0. Johnson 1004 Sumter Avenue North OBJECTION Mr. Schwankl stated he was not ready at this time for water and sewer. Later changed his mind and approved the construction. Objected to watermain on two lots on Rhode Island by written statement. The Mayor closed the public hearing on sanitary sewer and watermains. dw Regular Meeting of the Village Council, May 17, 1966 Member Teresi introduced the following resolution and MOVED its adoption: 'fRESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Sanitary Sewer - 66 -LF; Proposed Watermain - 66 WM) The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS° (Proposed Sanitary Sewer 66 -LF; Proposed Watermain 66 WM) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following voted.in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. Public Hearing - Public In Bituminous Surfacing (66 -BS -1,2,5,6,8,9,10 The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on certain proposed Public Improvements (Proposed Bituminous Surfacing 66-BS)described in the resolution of this Council relating thereto, adopted on April 19, 1966. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor announced that the meeting was open for public hearing on said proposed public improvements and all persons present to do so were afforded opportunity to express their views thereon. OBJECTION Stated the legal description was not correct. Wants water installed first. Additional assessments would make taxes so high that property could not be rented. Objected to construction at this time. Requested that Pennsylvania Avenue South be posted for load restrictions. Regular Meeting of the Village Council, May 17, 1966 Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Bituminous Surfacing - 66 -BS) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor announced that the meeting was open for public hearing on said proposed public improvements, and all persons present to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION Mr. R. J. Milavetz Objected to curb and gutter construction. 931 Angelo Drive The Mayor closed the public hearing. Member Flannagan introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING CONSTRUCTION OF CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Concrete Curb & Gutter 66 -CG -11 31 41 51 & 7) M Regular Meeting of the Village Council, May 17, 1966 The motion for the adoption of the foregoing resolution was duly seconded by Member Schaphorst, and upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst,and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor, and his signature attested by the Village Clerk. See Resolutions Book page ,2�5% Public Hearin_ - Revision of Ordinance (Car Wash): The Village Manager presented an affidavit of publication in the official newspaper of the Notice of Public Hearing as described in said affidavit. Said affidavit was examined, approved and ordered filed in the Village Clerk's Office. The Mayor announced that this was the time and place for the public hearing above referred to and all persons who desired to do so were afforded opportunity to express their views thereon. No persons presented objections except the following: OBJECTOR OBJECTION None None The Mayor closed the public hearing. Mr. Paul Velz, Chairman of Board of Appeals, presented the recommendation of the Planning Commission to approve the amendment to the ordinance for car washes. (see minutes of 7-15-65). Council discussed adding the word "and" in the last sentence under section c. (1) Screening, following the word "height" before giving the ordinance a second reading. MOVED by Teresi seconded by Flannagan carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Car Wash) MOVED by Flannagan seconded by Teresi carried to approve the ordinance herein quoted by title on its first reading. Regular Meeting of the Village Council, May 17, 1966 Continued Public Hearing - Zoning, Greenhouses & Nurseries: The Village Manager announced that this was a continued public hearing from the meeting of April 19, 1966. MOVED by Teresi seconded by Flannagan carried to defer the matter to the meeting of June 7, 1966. Final Approval - Plat, DeCola's Country Club Terrace: MOVED by Teresi seconded by Garis carried to continue the matter to the meeting of June 7, 1966. Second Reading Ordinance - Zoning, 2400 Rhode Island Ave. N.(Light Industrial): MOVED by Teresi seconded by Flannagan carried to defer the matter to the meeting of June 7, 1966. Second Reading Ordinance - Zoning, 2100 Rhode Island Ave. N.(Institutional I-3): MOVED by Flannagan seconded by Teresi carried to defer the matter to the meeting of June 7, 1966. Second Reading Ordinance - Zoning, 3901-4001 Olson Highway (Multiple Dwelling M-2): MOVED by Teresi seconded by Flannagan carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE ZONING CODE" (M-2 Multiple Dwelling Zoning District) (James A. Anderson) MOVED by Schaphorst seconded by Flannagan carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. Council deferred the matter until requested on the agenda again by the proponent. Reauest for Public Hearing - Plat. DeCols's Country Club Terrace: MOVED by Teresi seconded by Garis carried to call a public hearing to plat DeCola's Country Club Terrace on June 7, 1966. Request for Public Hearing- Street Vacation, Golden Valley Road & Douglas Drive: MOVED by Schaphorst seconded by Garis carried to call a public hearing to vacate the street at Golden Valley Road & Douglas Drive upon request from Alex Lessard, on June 7, 1966. 83 Regular Meeting of the Village Council, May 17, 1966 Resolution Ordering Dust Treatment -(66 -DA -12,13,15,16.,17,18,21,25, & 26): Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION ORDERING DUST TREATMENT FOR CERTAIN STREETS" (66 -DA -12,13,15,16,17,18,21,25, & 26) The motion for the adoption of the foregoing resolution was duly seconded by Member Garis and, upon vote being taken thereon, the following members voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. See Resolutions Book page Re: Sign on Building, 900 Florida Avenue South (Allied Plastics): The Building Inspector presented the matter of a sign on Allied Plastics building at 900 Florida Avenue South being placed on the building without a sign permit. MOVED by Flannagan seconded by Schaphorst carried to send a notice of violation of the village sign ordinance to Allied Plastics at 900 Florida Avenue South. Sewer Interceptor Construction Inspection Service: The Village Manager informed the council that Orr-Schelen-Mayeron had obtained a former Minneapolis employee to inspect the construction of the sewer interceptor between Golden Valley and Minneapolis. MOVED by Teresi seconded by Flannagan to approve the employment of an Inspector by Orr-Schelen-Mayeron for the construction of the sanitary sewer interceptor. Member Garis voted "NO" and suggested that the Village of Golden Valley employ this Inspector or some other inspector to inspect the construction of the interceptor sewer. Members Teresi and Flannagan withdrew their motion and second. MOVED by Garis seconded by Teresi carried that the village employ an inspector to report to the village on the construction of the sanitary sewer interceptor. Discuss Federal Food Stamp Program: The Village Manager read a letter dated May 16, 1966, from Suburban Hennepin County Relief Board regarding the Federal Food Stamp Program. Council took no action. Request for house Movers License - Ernst House Movers: The Building Inspector presented the request for a house movers license for Ernst House Movers. Request for Platting Waiver - 8100 - 10th Avenue North, A. Yngve: Mr. Paul Velz, Chairman, Board of Appeals, presented the Planning Commission recommendation to approve said platting waiver. Request to Advertise for Bids - Two T rucks(4 Wheel Drive) Street Department: The Village Manager presented the request to advertise for bids for two trucks (4 wheel drive) for the Street Department. MOVED by Flannagan seconded by Teresi carried to advertise for bids for two (4 wheel drive) trucks for the Street Department on,July 19, 1966. "Off -Sale" Liquor License - Rosy's Liquors, LeRoy Funk, 8565 Wayzata Blvd.: Mr. LeRoy Funk and his attorney, Mr. Richard Kassow, appeared before Council as the result of a guilty plea on 5-10-66 in Hennepin County Municipal Court to selling Liquor to a minor at Rosy's Liquors at 8565 Wayzata Boulevard. Mr. Kassow requested that the Council exercise discretion. MOVED by Teresi seconded by Garis carried to suspend the license at Rosy's Liquors at 8565 Wayzata Boulevard of LeRoy Funk for 10 days commencing May 18th through May 28th inclusive. Food 20.00 Regular Meeting of the Village Council, May 17, 1966 Resignation of Trustee William K. Schaphorst: The Village Manager read the written resignation of Trustee William K. Schaphorst, dated May 13, 1966, effective May 20, 1966. The Council expressed their regret in accepting the resignation and expressed their pleasure in serving on the council with Member Schaphorst. MOVED by Teresi seconded by Flannagan carried to accept the resignation of William K. Schaphorst. Discussion of of for red Term of William. K. Schaphorst: Council discussed the replacement for the unexpired term of William K. Schaphorst, and agreed the new Trustee should live either in precinct I or II which has no representation by a councilman at this time. Member Teresi suggested Ray Stockman, and Member Garis suggested Lyle Jensen for consideration. Bills: MOVED by Teresi seconded by Flannagan carried to approve the bills as submitted on the prelist. Condition of Bowery Tavern: The Village Manager reported that the Village Sanitarian and Building Inspector have notified the owner of the Bowery Tavern of certain repairs and work that must be done to meet Village health and public safety standards by the 27th day of May, 1966. If the Bowery Tavern has not complied with these requests the matter will appear on the next council agenda. Condition of Wesley Park: All present agreed to add the above matter to the agenda. Mrs. Vhn. Bydlon, 1320 Castle Court and Mrs. Joseph Wagner, 1335 Castle Court, appeared to complain about water, rats and general condition of Wesley Park. Council deferred action on the matter to the meeting of June 7, 1966. Request to Call a Public Hearing - Watermains (66-WM-10,201 22): Member Teresi introduced the following resolution and MOVED its adoption: "RESOLUTION PROVIDING FOR PUBLIC HEARING ON CERTAIN PROPOSED PUBLIC IMPROVEMENTS" (Proposed Watermains 66 WM-10,20,22) The motion for the adoption of the foregoing resolution was duly seconded by Member Flannagan, and upon vote being taken thereon, the following voted in favor thereof: Flannagan, Garis, Nadasdy, Schaphorst, and Teresi; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk.
