12-07-70 City Council Minutes208 REGULAR MEETING of the VILLAGE COUNCIL E December 7, 1970 Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Golden Valley, Hennepin County, Minnesota, was held at 7800 Golden Valley Road in said Village on December 7, 1970, at 7:30 o'clock P.M. The following members were present: Bies, Jensen, Paulson, Stockman, and Teresi; and the following were absent: None. Present were Village Manager, Barkley G. Omans; Village Attorney, Robert M. Skare; Village Engineer, Lowell Odland; Village Cler, Helen Penniman; Glen Christiansen, Chairman of the Planning Commission. Minutes of November 16, 1970: MOVED by Bies, seconded by Stockman carried to approve the minutes of Nov- ember 16, 1970, as submitted. Public Hearing - Ordinance Providing for Planned Unit Development: The Village Clerk presented an affidavit showing publication in the official newspaper of the Notice of Public Hearing on certain proposed ordinance. Said affidavit was then examined, approved and ordered filed in the office of the Village Clerk. The Mayor then announced that the meeting was open for public hearing on said proposed ordinance, and all persons present to do so were afforded opportun- ity to express their views thereon. No persons presented objections. Mr. Glen Christiansen, Chairman of Planning Commission reviewed the Planning Commission's recommendation of the proposed ordinance. The Mayor closed the public hearing. MOVED by Stockman seconded by Jensen carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Addition to the Zoning Code of an Ordinance Provid- ing for Planned Unit Developments Within the Village of Golden Valley) MOVED by Paulson seconded by Bies to approve the ordinance herein quoted by title on its first reading. Public Hearing - Phosphate Disclosure Ordinance: The Mayor announced that this was the time and place for all persons pre- sent to do so to express their views thereon. The Village Manager reviewed the proposed ordinance and reported on the results in other communities having such an ordinance in effect. Mr. Ron D. Edstrom, 2303 Xerxes Avenue North, requested the ordinance not be given approval at this time and quoted from several published articles regarding phosphate and NTA. Mr. Edstrom recommended a commission be appointed to study the environment. MOVED by Paulson seconded by Jensen carried to give a first reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Requiring The Posting of Lists Showing Relative Phosphate Content of Detergents By Retailers Thereof) MOVED by Jensen seconded by Paulson to approve the ordinance herein quoted by title on its first reading. Upon roll call vote being taken thereon the members were recorded as voting as follows: Bies NO Jensen YES Teresi YES The Mayor declared the motion carried. Paulson YES Stockman NO Public Hearing - Ordinance Creating a Department of Public Safety: The Mayor announced the rules for the public hearing called for proponents and opponents to the proposed ordinance to each have thirty minutes to speak. PROPONENT REASON Mr. Peter G. Meyer Complimented the Council for their 2225 Orkla Drive approach & stated he was in favor of professional guidance to coordi- nate the three departments of pub- lic safety. The meeting is democ- racy in action. Behind the ordinance. Strongly support the proposed ordin- ance. Much needed ordinance, given a lot of thought, supports ordinance. We do not have adequate monitoring, this will provide the Manager, Council and people with adequate monitoring. Support the ordinance. A hint something is wrong with Police Department, what is need- ed is more indians under the Chief and more squad cars. Mr. Milton Bix Opposed to Public Safety Department. 125 Brunswick Avenue South The Galvin report was negative, the report was only a vehicle to justify creation of Public Safety Department. Will create another level of bureau- cracy. The hearing is cut and dried, Council and Manager want the ordin- ance. Village Manager is chief law enforcement officer now. There are things we don't know, is there a real reason behind this ordinance creating a Public Safety Department? Mr. Frank Conner Keep comments on high level. Will cost $50,000 and up for proposed department. Opposed to ordinance. Mrs. Christine Smith Opposed to ordinance, if Manager can't 1501 Quebec Avenue North handle, get another Manager. Mr. Lyle Larsen On Golden Valley School Board for 830 Rhode Island Avenue South eight years. The University of Minn- esota's advice not the best regarding schools. Mr. John M. Ferguson Public Safety Director not first choice 4827 Culver Road of Galvin report, but removing Police Chief from Civil Service is more dif- ficult. Molly Lyons Questioned if the Police Chief is under 1012 Quebec Avenue North the Village Manager. Mr. Si Weisman Is a new resident, public safety is 4321 Avondale Road near and dear to him. Welfare of voters should be considered and invest the money in more policemen and equipment. Opposed to new department, a drain on tax payers. Mrs. Dan Lynch Opposed to new department on basis of 6320 Glenwood Avenue increase in costs and taxes in village. Mr. Robert 0. Harper When called Minneapolis Police didn't 7514 Knoll Street show, Golden Valley Police came in 4 or 5 minutes on one occasion and 5 or 6 minutes on another, they do an ex- cellent job. Mrs. Gail Gerguson Heard Mr. Galvin speak on the report, 4827 Culver Road everything depends on the man chosen. Present men are responsible for what happens in their departments. Mr. William Varner Should consider a permanent citizens 6930 Olson Memorial Highway committee instead of spending tax payers money. Mr. John Manner Against the proposed ordinance, we 5924 Quail Avenue North don't know what the ordinance is. Mr. Mel Erickson Has watched other departments stand 1812 York Avenue still, hope Golden Valley will some day amount to something. 2*J Regular Meeting of the Village Council, December 7, 1970 The Mayor closed the public hearing. The Village Attorney reviewed Plan B form of government as it pertains to the Civil Service Commission and the Village Manager's authority. The Village Manager recommended a Public Safety Director as the most econom- ical solution, at a salary between $1+,000 and $19,000. The Manager review- ed the responsibilities and qualifications dealing with Public Safety Dir- ector. Member Jensen stated Chief Frandsen has done an excellent job during the past 14 years. But he needs help in upgrading public safety department to meet the needs of the community therefore supports the proposed ordin- ance. Member Bies stated the expenditure of money is justified for supervision in this sized department. Member Stockman stated they are not experts in police field. Galvin's is a good report. Need beter response, need action immediately. Member Paulson stated the decision was most difficult his year. Most sup- portative position towards police operation, not a partisan decision. Member Jensen stated there never really are enough policemen. More import- ant to have a good sound program for new men. Mayor Teresi concurred with all four councilmen, fifteen years ago the Council discussed a Safety Department, there is a need for a Public Safety Department. No persons presented objections. The Mayor closed the public hearing. Request by Jaycees re: Christmas Trees: Mr. James Flaskerud, Jaycee representative, requested the Council to lift the no burning ban to allow the Jaycees to dispose of the Christmas trees in the Village. MOVED by Paulson seconded by Jensen carried to approve a variance to allow disposal of the Christmas trees in the Village by burning, pick-up of trees will be January 10, 1970. Second Reading - Ordinance, Sewer Service Rates: MOVED by Bies seconded by Jensen carried to give a second reading to an ordinance entitled: "AN ORDINANCE AMENDING THE VILLAGE CODE" (Sewer Service Rates) MOVED by Jensen seconded by Paulson carried to approve the ordinance herein quoted by title on its second reading and to order publication thereof. Continuted Public Hearing - Vacation Easement - Glenwood Hills hospital: Member Stockman introduced the following resolution and MOVED its adoption: "RESOLUTION" (Easement Vacation - Glenwood Hills Hospital) The motion for the adoption of the foregoing resolution was seconded by Member Jensen, and upon vote being taken thereon, the following voted in favor there- of: Bies, Jensen, Paulson, Stockman, and Teresi; and the following voted against the same; None, whereupon said resolution was declared duly passed and adopted, signed by the Mayor and his signature attested by the Village Clerk. Building Code Fees - Updating Other Codes by Reference: The Village Manager submitted a request to adopt new Building Code fees and update other Village Codes by reference. M. Rydeen & Robinson Minority Report - Re: Vic's Auto & Marine Body Shop: The Village Manager presented a minority report from Gerald Robinson and James Rydeen, members of the Building Board of Review regarding applica- tion for sign for Vic's Auto & Marine Body Shop. The report objected to the use of a three-dimensional man figure and requested that the applica- tion for sign be referred back to the Building Board of Review. MOVED by Jensen seconded by Bies carried to deny the request for the sign and refer the request back to the Building Board of Review.
